		<description>i am out on owcp for the last 10 months. i am retired from the army. i was working for cbp when i aggrevated an old injury from military service. I  sent the results to vA I was sent a replie that I can put in for 100% disability in the next thirity days. can i still get disability retirement from CBP. And also i have a EO case pending with the agency for the reason i was hurt on the job. what should i do?</description>

		<description>Work for USPS, been out since 4-13-08.  Injuryed on job, herniationof L4/L5 disc. My doctors say operation is reguired.  OWCP secop says i&#039;m ok with restriction.    Waiting on third opinion doctor appointment.  My doctors say even after operation i will not return to my job. If thats the case i need to my options.  On job 23 yrs, am 59 yrs. old. I have just submitted my application for medical retirement. I have degenerative disc disease, just had back surgery from a on the job injury, plus anxiety and depression. [whew, that looks bad uh?]
Anyway, I am a registered nurse, and work on an acute psych unit for the VA. I read your article of building a bridge, and also had my physician write his narrative along the same lines. I am hoping that since my job is quite dangerous, requires physical strength and mental acuity, that my case will be accepted on the grounds of my inability to perform the duties I had been hired to do. They did have me in a temporary position, but was not accommodated beyond that. I have not read the supervisors statement, or HRs statement as they completed it just recently. 
Now, I was told by the HR employee that DOL  has no say on whether my application for medical retirement is accepted or not. Is that true? My concern is that DOL is sending to another second opinion exam, I&#039;m sure, to try to derail my retirement application.  My question is this:
 Can OPM use DOL findings to deny my application? If I am approved, will DOL have to pay the difference between my retirement and my salary? I heard that they do, up to 66% of my salary, but I&#039;m not sure. I will not be applying for disability through workmans comp. They are jerks to deal with, and I want them out of my life!!!
Any information you can provide will be helpful.

		<description>Question: Initially I was injured on the job....filed my owcp claim and was denied, at the same time I was a FF/EMT and the dr said I could not perform that duty...so awaiting a an apeal on owcp I filed for OPM disability...I won that(I did not receive $$ from OPM) and a week later OWCP called and said my case was excepted..so I opted for Comp....I went back to work(fed) at a lower pay and was compensated for wage loss by OWCP...years went by and my health deterioted...I was told to file again for disability ret., which I did..and left work..after a year waiting and living on just the wage differential I received a answer from OPM...they said to I have to resign from Federal service in order for my retirement(original) to be activated, giving up my OWCPdifferential pay. My concern is that if I resign, will I forfeit OWCP obligation to me..ie: future medical for injury, possible scheduled award, etc?? My CPO said  I could put comment to be added to the SF50 form&quot;stating that I am resigning to Elect my Retirement in lieu of Comp payments, and that I am not reliquishing OWCP obligation by this resignation request&quot;...IS THIS SAFE TO DO??</description>

		<description>When i originally had my first surgery nobody was on my side 1998 it was hard i have had three since and am going through having to have my right hand done again because of my reassignment I gave up all my senoirity as a mail carrier and became a clerk and accepted my new ssa position and now I need surgery again. I have done everthing the usps wanted and I am now injured again. Now I need surgery on my right wrist with a possible left foloowing because of my attempt to go thru the reassessment program and allow them to send me to a clerk job as a ssa at the window....toooo much I have to have surgery now. The USPS decided I was retainable and I gave up my senority to become an ssa and now I am hurt again just tryin to comply so u decide what is more important u or them</description>

I want know why OWCP pa&#039;id for their Doctor to do a report but won&#039;t pay my doctor to do a report it doesn&#039;t make sense. I do agree that I shouldn&#039;t pay $600.00 dollars for the report. Dr reasor knows my case and i know can write a good report. but i will talk to my doctors about seeing if they can write a very detailed brief summary of my health. but my doctor still won&#039;t it to his want OWCP pay his report that problem  them i want attorney going to federal court now then...

for 2 my knee replacement  of both right and left knee
