Federal Employees Retirement System (FERS) Disability Retirement: The Law’s Mandate

What does it mean to “apply the law”?  Does mere mention of the fact — often, at the end of a lengthy paragraph, almost as an afterthought and merely an appendage to satisfy the criteria of “consideration of the law” — satisfy the requirement?

Does a jury who collectively convicts a defendant because they didn’t like the way he looks, satisfy the obligation of considering “reasonable doubt” if, just before agreeing to render the verdict of “guilty”, everyone in the room nods the consent that there is “no reasonable doubt to consider”?

Or, must a jury deliberate upon the issue and definition of reasonable doubt for a lengthy period of time in order to “appear” that they have considered the law’s mandate in a serious fashion, so that each juror can say, “Yes, we gave the criterion of ‘reasonable doubt’ due seriousness, and concluded that none of us had any reasonable doubt to prevent such a conviction”?

In analogous form, does the U.S. Office of Personnel Management satisfy the law’s mandate if they merely mention the multitude of case-law requirements, or if not even mentioning them, to “refer” to the variegated issues?

There is a sense of finality to the declarative command — in whatever form of the word is applied.  “Just do X and you’ll be fine”; or: “It’s just a few forms to fill out”.

As a simple adverb, it appears rather harmless — until, of course, those forms that “just” need to be completed turn out to be rejected by the U.S. Offie of Personnel Management, and then you are just left alone and abandoned.

“Just because I told you it was easy, doesn’t make it so.”  What?  Just Because….  The “just” insertion is the justification when justice is just not achieved, and just because someone just says so doesn’t make it just so.

FERS Disability Retirement: Thanksgiving 2021

The pandemic of 2020 yet haunts us; and while everyone would like for it to become a vestige of a past nightmare, the reality is that the virus will likely be a part of our daily lives for the next decade or more.

Still, there is much to be thankful for — not the least of which, those who have survived the pandemic can gather together and celebrate Thanksgiving 2021.  Then, of course, there is the ongoing controversy surrounding the holiday event itself — of whether or not Bradford’s depiction of the original meal is historically accurate; of America’s history of genocidal maltreatment of indiginous peoples; of ultimately what the meta-meaning of Thanksgiving will bode for the future, etc.

Through it all, Thanksgiving has become, for most, a special time and a good excuse to prepare an elaborate meal, to get together with family and friends, and to celebrate the year’s events and experiences.  For those who believe that the “traditional” story of Thanksgiving must be “conserved” at all costs, just remember that history is never a static story, but always a vibrant telling of a past which evolves with each storyteller.

This is, in fact, an exciting time where new facts are being discovered about our storied past, and whatever the “official” story of Thanksgiving is, becomes, or is fated to be, it is the telling of stories around a dinnertable exploding with conversation, injected with love and joy, which makes for the meta-Thanksgiving of 2021 — survivors all, where blessings can actually be counted.

OPM Disability Retirement Help: The Fairytale Life

Every now and again, we hear about someone like that — how he or she “lived a fairytale life”.  That is, of course, until the details and private murmurings have been thoroughly vetted.  A good rule to follow is: If you like a certain artist, musician, writer, actor, etc., and you hold some moral qualms about right and wrong, don’t research too much into the details of that favorite person, for the chances are, you will likely be disappointed.

Postal & Federal Employee Disability Retirement: The Day We Realized…

So much can follow the ellipsis; The day we realized we were not the most brilliant; that there are others who are smarter, better looking, more physically adept, more talented; that even given the half-century or so of time that we have been allotted on this earth, we will never become wealthy; that we aren’t any good at X, Y or Z; that our children are not the best-behaved little angels we once thought they were; and so much more.

Some such realizations are significant; others, with a shrug and a wink, we should just let pass.  For, of course there are others more talented; of course, most of us will never become wealthy; of course, most children are brats (but we can love them despite such realizations); and of course, there are others who are smarter and more attractive.

There are perhaps times in which we all face such a state — of a death in the family; financial or other problems; an unexpected accident or incident; a medical condition.

Would it be placed in a science fiction genre, or perhaps a horror story?  Or perhaps shot with a grainy-grey film in a pre-modern totalitarian regime?  Would it even be possible, today?

Perhaps in an isolated country like North Korea, such a mandate would be possible — of a mirrorless world where the “self” cannot be recognized.  Of course, there would still be the possibility of a reflection in a pool of water, or a glass door, a reflective surface, etc., which allows for one to view that “somebody” who is distinctively a different self from “others”.

When does a child — a toddler — begin to identify a distinctive entity unique and separate from others?  Does it occur only after a certain accumulation of experiences involving encounters with the objective world?  Does a person without a memory of past experiences ever identify one’s “self” from others?
