Truth as opposed to Appearance; Civility by contrast with Coarseness; a facade of peace, when in fact the world is ready for war.  Russia’s invasion of Ukraine unraveled the thin shell-game of the West: So long as we let Russia do the “dirty work” and drill for oil, pollute the world, etc., Europe could put on a facade of being the “Green good-guy” — of electric vehicles, windmills and green energy.

Now that the veil of goodness is gone and Russian oil cannot be openly purchased, we have to admit that we in the West, too, have to drill for oil and find other sources to power our countries.  The coarseness of life has been unraveled, yet again.

FERS Disability Retirement: The Law and Modernity

Recent Supreme Court decisions have, at the very least, engendered interest among the non-lawyer population of this country.  The concept of “stare decisis” — of the legal principle of determining points in litigation according to establish precedent — has been turned upside down and cast aside.  Is this a good thing?

Furthermore, there are now grumbles that recently-appointed justices “lied” to senators during their confirmation hearings, but no lawyer believes that such a charge can rise to the level of perjury.  Why?  Because if you ask a lawyer the question, “Do you agree that case-X is established law?” — the answer will always have 2 parts; first, the stated part: “Yes, it is established law and therefore should not be overturned.”

Then, the second, “unstated” and “silent” part — “Unless, of course, I find that when I am on the bench and a new case comes before me, that I find case-X to be unconstitutional, in which case I have no choice but to reverse and overturn the precedent.”

And so the law is as elastic as the best gymnasts qualifying for the Olympics.  Why the great hubbub?  Because society relies upon precedents, because precedents — whether you agree with them or not — provide a foundation of stability and reliability.

It would be as if a Federal Circuit Court Judge were to find all precedents on FERS Disability Retirement to be wrongly decided, and reversing every one of them.  Now, that would be a disaster.

Federal Disability Retirement Application Denied: The Response

How do we learn how to respond?  Are all responses appropriate?

If a person you pass along the street says, “Hi, how are you doing?” — is the appropriate response to actually stop and give an hour-long dissertation about your life history, how your cat recently was run over by a car, and about your kid’s problems in school?  Or, do we just tip our head with a quick nod and respond with: “Good. Have a nice day”?

And of that irritating car in front of you in a one-lane road going 25 mph when the speed limit is 50 — do we honk aggressively, try to pass even though there is a solid yellow line, and finally accelerate illegally on the shoulder, on the right side, and speed past him?  Of course, when the police officer stops you and tickets you, it is hardly a response to say, “But officer! OPM Disability Retirement: The Upper Limit of Havoc

Is there a limit?  Or, is Man’s capacity for havoc, mayhem, untoward devastation limitless and incalculable?

There is havoc on the personal level, and then on the societal level; and perhaps if we just turned off the news, refused to read anything but the local newspapers, then our bifurcated levels would merge into a synthesis of one.  You cannot even go to a 4th of July parade without fear of being shot at; you can barely make a living, nowadays, with inflation eating away at every penny, gas prices skyrocketing, and food prices soaring to unaffordable limits.

In the aggregate, do these all qualify as “havoc”?

Certainly, we do not have the havoc of Ukraine, where entire cities once beautifully landscaped are now devastated to mere images of rubble and mayhem.  Entire populations have disappeared; daily shelling from Russian advances have made survival and habitation impossible.  But wherever people live, in small towns and other cities — where none of what has been described has actually occurred — can one live like the proverbial ostrich with its head buried in the sand?

But then, of course, there is the personal level of havoc — say, of a medical condition.

FERS Medical Disability Retirement Law: Doctor’s Orders

Does strict compliance with doctor’s orders guarantee recovery and good health?

Quite obviously — not.  Medicine is not a science, although it is “science-based”.  The history of medicine — including psychiatry — does not have a pretty history.  It possesses a lineage of trial and error; of successes and failures; of applications which now appear barbaric; but of great and impactful discoveries, as well, including antibiotics and medicines which have saved lives.

Doctor’s orders, in the end, constitute the bare minimum; the rest is often up the individual as to what further to do: Of reducing stress; of eating healthily; of changing or discarding bad habits; of exercising and changing the lifestyle habits which harm.

Federal Disability Retirement Law: The Finish Line

What is there, at that end which you strived so hard to reach?  We often confuse the end-goals and mix up the purposes engaged.  What is the purpose of the finish line?  Is it merely to reach and cross it?  Does a runner engage in the activity merely to cross the finish line, or is there a greater purpose beyond the mere crossing?

Certainly, for an alien from another planet — or even to a child where explanations have not yet been sufficiently comprehensible because of a lack of context and he or she is merely an accidental spectator not yet attuned to the “ways of the world” — watching men and women strain and struggle to reach a white line and collapse upon crossing it, is a specter of strangeness and peculiarity.

Was it for the health benefits of jogging and running?  Was it to win a prize — a ribbon, a trophy, some cash?  Or was it merely for the fun of competition — to train, to discipline, to achieve?  And what of metaphorical finish lines?

The “race of life”, the “marathon to achieve”, etc. — you know, the motivational constructs which allegedly compel us to greater heights of competitive highs.

For Federal employees and U.S. Postal workers who retain an image of a “finish line” — of reaching those magical numbers which declare to everyone, “I have made it!” — it may be that other factors intercede, interrupt and prevent you from achieving that goal of being able to cross that proverbial “finish line”.

What would be the point if, upon reaching the finish line, you collapse and die?  Or, end up in a wheelchair, debilitated and unable to enjoy those “golden years”?

People often mix up and confuse the purpose for the goal with the crossing of the finish line itself: Reaching the finish line is not the same as answering the “why” of getting there.  If your health is deteriorating and you are only destroying yourself in the very effort to reach that finish line, it is time to consider preparing, formulating and filing an effective OPM Disability Retirement application under FERS.

FERS Medical Disability Retirement: The Happy Meter

It works best when no one takes notice.  Think about it:  When are you happiest?  Was it when you stopped what you were doing and asked the question, “Am I happy right now”?  Or, was it when you never noticed, never took note of it, but were simply engaged in the activity which brought you that joy and sense of carefree exuberance?

This modernity’s obsession which emotional quotients, the need to gauge one’s emotional “health” and the need to keep that smile plastered on one’s face at all times, lest others might judge you as being less than the acceptable needle-point resting on the western side of “acceptable” as opposed to the eastern side of “deliriously happy”.

The Happy Meter is a concoction of this modern obsession with happiness being a goal, as opposed to a byproduct of living life properly.  Of course, we don’t ever talk that way, anymore — Of how to live life; of what it takes to maneuver through the difficult phases of life; of disciplining one’s self to govern by rational intentionality the appetitive/emotional natures of our souls, etc.  Heck — we no longer even believe that we possess a soul, leaving aside trying to govern the lesser natures of that soul.

For Federal employees and U.S. Postal Service workers who are suffering from a medical condition where the medical condition doesn’t seem to arouse any empathy from your supervisors, coworkers or anyone at all in your agency, perhaps it is time to make a clean break and exit from your agency before your agency forces the exit upon you by proposing to remove you — by filing an effective Federal Disability Retirement application under FERS.

OPM Disability Retirement: The Age of Folly

The Age of Folly is in contrast to the Age of Reason, the Age of Discontent, the Age of Serious Wonder, the Age of ….  But of modernity: We live in the Age of Folly.

A recent Wall Street Journal article spoke about ways to try and interest a child who is a “gamer” to read books — an endeavor which, in former times, would have been a “given”.  Entice him with books of action!  Try and find books which cater to his interests!  Really?  How about: Books represent the richness of our culture; they open the pathway to a successful life; they expose us to a world beyond, and educate us about the world in which we abide.  Perhaps, restricting “game time” and saying “No” to the child’s every want is the better first step.

Time was, not so long ago, that we had a shared set of values — through the common reading of great works.  Can a city kid have empathy for farmers who struggle?  Yes, because we all read Steinbeck’s, The Grapes of Wrath.  Does a Midwestern Farmer have any knowledge about fishermen?  Yes, because we all read Hemingway’s, The Old Man and the Sea.  Did the Northerner have any idea about the South?  Yes, because we all read Faulkner.  And did the Southerner know anything about their Northern neighbors?  Yes, because we all read F. Scott Fitzgerald.

But we no longer read.  And so we live in the Age of Folly, lost in our Smartphones, forever brandishing opinions on Facebook, Twitter and Social Media.  That is often how Federal and Postal employees who struggle with a medical condition feel about the lack of empathy by their coworkers and supervisors — an Age of Folly where empathy no longer exists, and the attitude is one of:  So what?

FERS Disability Retirement Law: Mistaken Identity

Mistaken Identity can take many forms.  In its simplest version, it is to merely mistake one person for being another.  But there are other, more complex forms.  For example, of going to an extravagant dinner party, enjoying the lavish food, being impressed with the splendor of the decor, the fine mansion, the seemingly expensive furniture, and the elegance of well-dressed people — and mistakenly identifying the wealth of accouterments for the foundation of a fine evening.

You had “fun”.  It was a great evening.  Elegance was the appearance; conversations — well, they had their moments.  The “mistake” is, indeed, in making the identification with the surroundings, and not with the relationships.  That is the difference between modernity and times past; we tend to think that the surroundings — the furniture, the paintings, all of the “possessions” — make up for and constitute the conclusory declaration of a “fine evening”.

But that is where the mistaken identity takes place; for, could not the same result have been achieved in less extravagant settings?  Was it because we were so impressed by the wealth abounding, that we forgot the importance of relationships?

And so we have gone about destroying human interaction, thinking that the accouterments were the basis for a fine evening, disregarding the relational interactions which should always take precedence over the superficial trappings which deceive.  But that is the consequence of materialism — of thinking that, at the end of the day, the winner, the king of the mountain, the one who prevails, is the one who has amassed the greatest volume of possessions.

It is the greatest of mistaken identities — that acquiring “stuff” is what makes us happy.
