FERS Medical Retirement from OPM: Objectivity

In the West, the traditional approach is to be far removed and dispassionate in attempting to attain that level of acceptable discernment.  If there is even a whiff of personal involvement, a suspicion of a self-serving motive, or some indication of emotional application, the revered status of objectivity comes into question.

For some unknown reason, the label “To be objective” must ignore and minimize all that is preternaturally human.  A Kantian would argue that objective knowledge is a goal inherently impossible to achieve, precisely because we possess only subjective capabilities and impose our worldview upon everything we analyze, evaluate and assess.

To that extent, it becomes a mere tautology, for if we are incapable of reaching beyond  ourselves, then there would be no point in even trying.  But try we do, and in the Western Philosophical tradition, we employ devices such as Logic, the Socratic method of endless self-examination, and a touch of mystical fairy dust sprinkled as “objective analysis”.

For Federal employees and U.S. Postal workers who submit a Federal Disability Retirement Application with the U.S. Office of Personnel Management under the FERS system, the argument for objectivity is often refuted by OPM based upon a “lack thereof”.  OPM will argue that the “pain” one experiences, or the emotional impact from psychiatric conditions, is “purely subjective” and is therefore invalid as a basis for approving a FERS Disability Retirement application.

This, too, is a circular, tautological argument, precisely because ‘pain’ by definition, is always subjective.  Yet, that is not what the applicable law concerning the established legal criteria of proving a FERS Disability Retirement case holds, and despite OPM knowing this, they will systematically ignore the applicable laws governing FERS Disability Retirements.

Federal & Postal Disability Retirement: Standard of incompatibility

How does one “prove” a standard of “incompatibility”?

Physical injuries often allow for a medical opinion to impose certain restrictions:  No lifting more than X-pounds; no standing more than 2 hours within an 8-hour period, etc.  These, then, can directly “prove” that a Federal or Postal employee is no longer able to perform one or more of the essential elements of one’s Federal or Postal job, by comparing such restrictions as against the positional requirements of a given job, and “showing” that the standard required can no longer be met.

The “other” cousin of the standard, as reiterated by cases represented by Henderson v. OPM and related precedents, allow for a “different” type of proof, where one may show that there is a general incompatibility between the entirety of one’s position and the medical conditions one suffers from.

It might be argued that such a standard is more “nebulous” and “harder to prove”, but in fact, the opposite is often true: specificity on a 1-to-1 ratio between a given medical condition or symptom and an element of one’s positional duties no longer becomes necessary.  Rather, a general showing of incompatibility between the “type” of job and the “nature” of a medical condition is enough to qualify for Federal Disability Retirement.

The trick, of course, lies in the manner of “proving” it, but it should be of some comfort to Federal and Postal employees that there is another type of standard beyond the 1-to-1 ratio standard that applies generally for “physical” duties; for, in the end, many psychiatric conditions can only meet the “incompatibility” standard, although some specificity of inability to perform a particular function of the job may be present as well.

Federal Disability Retirement under FERS: OPM Accepted Medical Conditions

The problem with “lists” is that, the moment one realizes that one is not on the list, the tendency is to simply give up and go home.  But lists are rarely exhaustive; rather, most are merely to provide a “paradigm” or “type”, as opposed to exclusionary intent by failing to specify or name.

PTSD

Federal Civilian employees with PTSD may qualify for OPM Disability Retirement depending upon the circumstances.  There is no need to prove that this condition is pre-existing or job-related

Thus, for Federal employees and U.S. Postal workers who are considering preparing, formulating and filing for OPM Disability Retirement benefits, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, the critical issue to recognize is threefold:  First, becoming qualified for Federal Disability Retirement benefits through OPM is not dependent upon having an officially identifiable diagnosis which matches a “list” compiled at OPM; Second, in some ways, the symptoms manifested are just as important as the underlying diagnosis, precisely because what the Federal or Postal employee “suffers from” is what impacts the capacity and ability of the Federal or Postal employee in performing the essential elements of one’s positional duties; and Third, because Federal Disability Retirement is based upon the nexus between one’s medical condition and the positional duties required in one’s job, there is a requirement of showing the “connection” between the Federal or Postal job and the manifestation of the diagnosed medical condition(s).

Sleep Apnea

Obstructive Sleep Apnea (or Apnoea) may also qualify for OPM Disability Retirement if this condition causes fatigue and sleepiness in such a way that it interferes with work productivity

Thus, while a 1-to-1 ratio between a medical condition and an “essential element” of one’s positional duties is not required (the recent Henderson case reiterated that issue), a showing of incompatibility between the medical condition and the positional requirements is enough to establish eligibility for OPM Disability Retirement Benefits.  In the end, providing a “list” is somewhat more of a disservice than not, because no list would ever be complete, and an incomplete list has a tendency to dishearten and dissuade.

Sciatica and Low-back pain

Sciatica is a type of pain affecting the sciatic nerve, often as a result of repetitive strain injury.  U.S. Postal employees are especially vulnerable to low back pain and repetitive strain injuries when pulling “cages” (Mail Handlers); standing, twisting, turning, and bending when working with Flat Sorting Machines (Distribution Clerks); standing for long hours (Windows Clerks); and when sitting in mail trucks and carrying heavy mailbags on their shoulders for several hours (Letter Carriers)

That being said, there are overarching “types” of medical conditions in either categories:  of Psychiatric (Major Depression, Generalized Anxiety, Anxiety, panic attacks, suicidal ideations, Paranoia, Schizophrenia, Bipolar Disorder, Psychosis, ADD, ADHD, OCD), but which also fall under the general aegis of “cognitive dysfunctions” as well; and of Physical (Chronic Pain, Degenerative Disc Disease, Cervical degeneration; disc bulges and herniations; disc impingements; RSD; chemical-sensitivity issues; Asthma; pulmonary issues; anatomically-targeted issues involving hands, wrists, knees, feet, etc.; as well as GERD, Sleep Apnea, Profound Fatigue; IBS; residual effects from treatment regimens; symptoms which impact, directly or indirectly, the ability and capacity to perform the essential elements of one’s Federal or Postal positional duties); and many, many more.

FERS & CSRS Disability Retirement: The Adaptable Criterion

If a criterion is advanced at the outset, one expects that the details of its applicability will result in a fair outcome so long as the requisite subsets are adhered to.  The problem is one of generalizations, however, and the linguistic malleability of hermeneutic interpretation, and in the end, the honesty of the individual.

There may have been a time when the sin nature of man was contained, and Pandora’s box was sealed, or at least somewhat secured; but once relativism creeped into the general populace, the game of restraint was lost forever.  Once, when man was left to individualistic devices, and information concerning the world was considered esoteric and reserved for the ivory towers of science and theological hoods of mystery shorn by Jesuit Orders of secrecy and cavernous enclaves of furtive whispers echoing down dark chambers in secluded corners, the application and usage of criteria demanded knowledge beyond the commonplace. Now, with Google and other search engines, everyone knows everything, or nothing at all.

For Federal employees and U.S. Postal workers who are considering filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, the “trick” is to review the legal criteria, amass the information in a manner which fits the applicability for eligibility, then to “make the case” for an approval.

Is it a science?  Or, more precisely, are the regulatory subsets “open to interpretation”?  And more to the point:  Do the Administrative Specialists at OPM adhere to the “letter of the law”, or is hermeneutics less than an honest methodology these days?  Where human nature is concerned, one need not stray too far from the general knowledge of the masses.

If one has lived long enough, you know that you should always walk through the busy streets of a city with one hand on your back pocket, protecting your wallet.  Pickpockets are everywhere, and in preparing, formulating and filing for Federal Disability Retirement benefits through OPM, the Federal and Postal worker should always be cognizant of the fact that the adaptable criterion is not the fault of the agency or the promulgators of legal standards, but merely reflects the fact that Pandora’s box was left open long ago, and the serpents of horror and dishonesty were left to roam the earth like never before.

Federal Employee Medical Retirement: Back to Fundamentals

In any endeavor, concern or current focus of attention, one can become embroiled in the morass of complexities which comprise the peripheral penumbras of the issue, and disregard the fundamental essence of the matter.  In proverbial terms, it is to overlook the individual trees while viewing the generality of the forest.  So, back to basics.

In a Federal Disability Retirement application, a person who is under FERS (Federal Employees Retirement System — normally those who entered into the Federal Workforce sometime after 1985, and who have a Thrift Savings Plan and contribute to Social Security) or under CSRS (Civil Service Retirement System — pre-1985, with no TSP) may become eligible for Federal Disability Retirement benefits, but must have the following minimum eligibility criteria met: under FERS, you must have at least 18 months of creditable service; under CSRS, you must have at least 5 years of creditable service.

There is a hybrid status applicable for some, called CSRS-Offset, also.  Once that eligibility criteria is met, then the Federal or Postal Worker can take the next step in determining whether one may want to proceed, by asking the following questions: Do I have a medical condition? Does that medical condition prevent me from performing one, if not more, of the essential elements of my position? What are some of the essential elements of my position which I cannot perform? Do I have a treating doctor who will be supportive of my case (remember, this is a medical disability retirement; as such, one must be able to establish through proof of medical documentation, that the medical condition impacts one or more of the essential elements of one’s job)?

These are some of the preliminary, basic questions which should be asked and answered, in order to begin the process of determining whether Federal Disability Retirement is the best pathway for the Federal or Postal employee suffering from a medical condition, in order to manage and maneuver one’s way through the thick forest of a bureaucracy known as the U.S. Office of Personnel Management, which is the agency which ultimately receives and reviews all Federal Disability Retirement applications, whether you are under FERS, CSRS, or CSRS-Offset.

Federal Disability Retirement Lawyer blog: Meeting the Legal Criteria

Lawyers often speak about “the law” as if it has the character of a science — of established principles which are objective, without the arbitrary influences of subjective interpretive devices or nuances. But even science itself fails any pure test of universal unalterability; one need only read Kuhn’s description of shifting paradigms in the history of science (The Structure of Scientific Revolutions) to understand that objectivity is merely another word for pragmatism. For, that which “works” or is “effective” in the eyes of the greatest number of people, is what matters to most people. That is why success is an irreplaceable harbinger of general opinion.

In the Federal government, one would like to expect application of rules, regulations, etc., somewhat in an algorithmic form, where favoritism is lacking, and where everyone has a “clean shot” at everything.

Especially when it comes to a benefit such as Federal Disability Retirement, which impacts those who are most unfortunate — one beset with a medical condition such that one can no longer perform all of the critical elements of one’s job — an expectation that an objective criteria which can be met by pure factual presentation, legal magnification of relevant statutes and laws, and perhaps some modicum of argumentation for persuasion, is what it should really occur in a perfect world.  But as the proverbial perfect world fails to materialize, we must do with what we are given; subjective interpretation, and selective analysis are merely human frailties and imperfections.

That is why legal argumentation and countering of subjectivism must be the proper, employed approach.

Federal and Postal Disability Retirement, whether for CSRS or FERS employees of the Federal government, must be fought for, and “won”; there is no mathematical algorithm of objective application; there is no parallel universe of perfection; there is only the human condition, which requires interpretation, knowledge, analysis, and argumentation which persuades and cajoles.

CSRS & FERS Medical Disability Retirement: Some Basics

Federal Disability Retirement benefits from the U.S. Office of Personnel Management, whether under FERS or CSRS, is an administrative process which one must undergo if a Federal or Postal employee is medically unable to perform one or more of the essential elements of one’s position.

It is a benefit which is accessible only if proven; and proof must meet the legal standard of “preponderance of the evidence“, through a tripartite methodology:  Evidence of the existence of a medical condition; the nexus of that medical condition impacting upon one’s ability/inability to perform the essential elements of one’s job; and that such a medical condition(s) cannot be legally accommodated by the agency such that the Federal or Postal employee can perform all of the essential elements of the Federal or Postal job.

While the Federal or Postal employee has up until one (1) year from the date of separation from Federal Service to file for Federal Disability Retirement benefits, the proof of when the nexus formed between one’s medical condition and the impact upon the position of one’s Federal Service, must have occurred during the Federal Service.

These are just some basics of Federal Disability Retirement law; the complexity, of course, resides in the details, and it is always the details which provide the fodder for an OPM denial.

Federal Worker Disability Retirement: Application of a Neutral Legal Criteria

The application of law upon determination of a Federal Disability Retirement application is based upon a set of criteria which focuses upon the impact of a medical condition on the Federal or Postal employee’s ability or inability to perform all of the essential elements of his or her job.  Thus, it is different from other government programs or compensation benefits, in that it ignores such issues as causality or prima facie accepted medical diagnoses.

Indeed, one can have a serious medical condition and still be denied one’s Federal Disability Retirement application if one fails to show the nexus, or the impacting connection, between the serious medical condition and one’s ability/inability to perform all of the essential elements of one’s Federal or Postal job.  In that sense, the applicable legal criteria is neutral in its very essence:  first, the Office of Personnel Management should (obviously) apply the law in a “neutral” manner, without regard to the person who applies, or be influenced in any way by the agency; but, moreover, and more importantly, the law itself is neutral to the extent that it makes no judgment upon the medical condition itself — only upon the medical condition in conjunction with the impact to one’s ability/inability to perform the essential elements of one’s job.

As such, in preparing, formulating and filing for Federal Disability Retirement benefits from the U.S. Office of Personnel Management, whether under FERS or CSRS, the primary focus in attempting to prove this point — both from a medical perspective as well as from the applicant’s approach — should be to emphasize the connection between the diagnosed medical condition and the essential elements of one’s job, and not merely upon the seriousness of the former.  Only in this way can the neutrality of the legal criteria properly assess the viability and force of one’s Federal Disability Retirement application.

CSRS & FERS Medical Disability Retirement: The Necessity of Explicit Redundancy

In preparing, formulating and filing for Federal Disability Retirement benefits from the Office of Personnel Management, whether under FERS or CSRS, it is important to submit material, at each and every turn possible and available, which repetitively and redundantly satisfies each of the legal criteria necessary to meet the eligibility requirements as espoused by the Office of Personnel Management.

Whether it is because the Case Worker at the U.S. Office of Personnel Management does not have the time (because of being overworked) to “read between the lines”, extrapolate or otherwise comprehend the implicit meaning of a statement; or the mechanical application of the “7-part” legal criteria is merely performed by comparing and contrasting the listed legal criteria to the substantive contents of the Federal Disability Retirement application — the reasons for the failure to understand the implicit (and sometimes explicit) import of the statements made are irrelevant.

Thus, for example, one would assume that if a medical narrative report states that the medical condition upon which a Federal Disability Retirement application is based, is considered to be a “permanent” medical condition, then one would implicitly understand that such a statement meets the criteria concerning the requirement that a medical condition must last for a minimum of 12 months in order to meet the eligibility criteria under the law.

However, “permanent” does not necessarily mean (apparently) “lasting for a minimum of 12 months”, and whether the interpretation is somehow lost because the words themselves do not perfectly conform, or because there is some nuance of meanings which only OPM is privileged to comprehend, is an irrelevancy.  What is relevant is to meet the legal criteria and the guidelines of the law.  As such, make sure and have the medical provider understand that language used must conform to the letter of the law — literally.

Disability Retirement for Federal Workers: Criteria and Proof, II

In preparing, formulating and filing a Federal Disability Retirement application under either FERS or CSRS, it is important to pause in the beginning stages of the process, prior to “going down the road” of the long and difficult administrative process of preparing a Federal Disability Retirement application, to consider the conceptual distinction between a legal criteria and the proof which is needed in order to satisfy the eligibility requirements of the legal criteria.  

In this day and age when the “culture at large” believes that an individual who speaks the loudest, uses words which appear in form articulate, and in cadence of some eloquence, the reverberations to the legal community have been felt both qualitatively and quantitatively.  Lawyers are supposed to be word-crafters; lay individuals who have some inkling of “the law”, may have some competence in the legal arena, but in order to survive the multiple pitfalls which are inherent in any area of law, it is wise to consider “that which” must be proven, as opposed to the proof itself.  

It is thus important, in preparing to formulate a Federal Disability Retirement application under FERS or CSRS, to review the statutes which govern the eligibility criteria for Federal and Postal employees; to read through the regulations; to research the case-laws as interpretive devices which can expand, constrict or regurgitate the statutory authority as written, as handed down by Administrative Judges at the Merit Systems Protection Board; then, upon a thorough and competent understanding of the legal criteria applicable in a Federal Disability Retirement application under FERS or CSRS, to begin to gather the “proof” which is necessary in order to satisfy and meet the legal criteria.  

Only upon an understanding of the distinction between criteria and proof can one then proceed to gather the latter in order to satisfy the former.  Early distinctions made can clarify and avoid later confusions encountered; or, as the age-old dictum goes, being penny wise is preferable to ending up pound foolish (or some variation thereof).
