Federal Disability Retirement Application: The Facade

In its simplest definition, it is simply the frontal face of a building, expression or impression.  In its more insidious connotation, it is the mask which hides an ugliness within, and thus is meant to deceive.

Or, perhaps not even an ugliness, but of something secretive, of a necessity to cover, to conceal, to brush over in order that people will only notice the skin-deep impression left, the appearance upon first encounter, and not to notice the substance beneath or behind the facade.

Can a mask be kept on for long?  Will the concealment cover for long enough, or wide enough?  And long enough — for what?

Perhaps it is merely a smile to conceal grief; a smirk, to mask pain; or in reverse, of tears in order to contain disgust or anger.

For Federal employees and U.S. Postal workers who suffer from a medical condition such that the medical condition prevents the Federal or Postal worker from performing one or more of the essential elements of one’s Federal or Postal job, having a “facade” is most natural, if not a necessity.  You want to seem “as if” — as if you are still able to do your job; as if nothing is wrong; as if….

At some point, however, the facade may not work, and you may have to prepare, formulate and file an effective Federal Disability Retirement application under FERS, through the U.S. Office of Personnel Management.

At that point, the facade which you wore so well may not be the mask you intended, for some may have come to believe that the facade was the actual you without the facade, in which case the facade may have been one facade too many.

FERS Disability Retirement Law: Disappearing Fences

That pithy old adage; of “good fences make good neighbors”; it is a saying which old people used to say in delineating acceptable social norms; of an ethos which was generally known, frowned upon when violated, and reflects an antiquated time in our society when everyone “knew” their place.

In modernity, the large corporations have convinced us all that fences are unnecessary; that boundaries are meaningless; that bifurcations no longer apply. Instead, to be “connected” is of utmost importance, and loss of connectivity — even for a day, an hour, a minute — means that your entire source of self-identity may have become expunged from the ethereal universe.

It is all well and good for the wealthy to declare that there should not exist a “division” between one’s personal and professional lives; that your job should be enjoyed as much as in your personal sphere; or that taking calls, doing work, etc. while on vacation or on off-days is completely acceptable.  Fences have all but disappeared.  What was their purpose?

For Federal employees and U.S. Postal workers who suffer from a medical condition such that the medical condition prevents the Federal or Postal employee from performing one or more of the essential elements of one’s Federal or Postal job, erecting and maintaining — even building new ones — is important; for, in the end, one’s “quality of life” begins with maintaining one’s health and well-being, but when that health deteriorates and cannot keep up with the demands of work, it might be time then to contact a FERS Attorney who specializes in Federal Disability Retirement Law, if only to establish again that, indeed, good fences make good neighbors.

Federal Government Employee Disability Retirement: “Difficult”

It is not the same as “unable to”, or even one of “incompatibility”; rather, it merely means that here are some impediments, but if one’s performance ratings are still fully successful, then it shows that — despite being “difficult” — the Federal or Postal worker is still able to perform all of the essential elements of one’s Federal or Postal job.

To qualify for Federal Disability Retirement benefits, certain legal criteria have to be met, and the mere fact that it is becoming increasingly “difficult” to satisfy that criteria does not mean that you would qualify.  Having “difficulty” doing your job, but still being able to do it, means that you are still performing all of the essential elements of your job.

If your agency thinks that you are doing a great job by giving you “fully successful” performance reviews, then where is your argument that you are unable to perform all of the essential elements of your job?  Yes, yes, I know — the question often asked is, “Do I have to end up in a wheelchair before I can file for FERS Disability Retirement benefits”?  No, not quite; but the mere fact that you are having “difficulties” doing your job, but are still doing it, may not be enough.

There is a middle ground, a “flash point” that goes slightly beyond “difficult” but somewhat before becoming wheelchair bound, where the criteria of “incompatibility” comes into play.

Federal & Postal Disability Retirement Representation: Forgotten

Is that the basis of our fears?  Does the concept of immortality haunt us precisely because we fear extinguishment, erasure, censure and being forgotten within a moment’s notice beyond the short mention in a local paper’s obituary?  Is that not, instead, the normal course of events — the way in which this non-teleological universe meant it to be — of returning to dust from whence we came, and become regenerated through the soil that embraces our ashes and decomposed flesh so that the genetic materials become recycled by the very foods we digest?

Mortality is that which men fear; becoming immortal is the goal of many; but being forgotten is the fear realized in the lives of most.  What difference, in the end, does it make?

We project an image through the creative imagination of our own psyche, and create images of a time beyond our own demise — of a weeping widow (or widower); children speaking in hushed tones of a person who was but is no longer around; and in our inkling of what it will be like, we posit our own consciousness by being present in a room that acknowledges our own absence.  Is that what sweet revenge is like — of imagining all sorts of regrets by those who shunned us, humiliated and ignored us when we were in their presence in life?

To be forgotten is to regret our own insignificance, and to constantly be haunted by one’s own irrelevance.

For Federal employees and U.S. Postal workers who suffer from a medical condition, where the medical condition begins to prevent one’s ability and capacity to perform all of the essential elements of one’s Federal or Postal job, the issue of being forgotten becomes a reality quite quickly and soon in the process of deteriorating health and use of sick leave or going on FMLA.

For, Federal agencies and the Postal Service are quite adept at forgetting — forgetting the years of loyalty shown by the Federal or Postal employee; forgetting the years of service, unpaid overtime and those “extra” hours put in but left uncompensated but for unrealized hopes of future considerations that never come about; forgetting the contributions of yesterday because today and tomorrow are all that matters to the Federal agency or Postal Service; and it is when the word “forgetting” in the present participle transforms into the past participle of “forgotten” that we finally come to realize that health is of greater importance than loyalty; and that is when the recognition that preparing, formulating and filing for Federal Disability Retirement benefits, to be filed through the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, is the best defense against a bureaucracy that has easily forgotten the essence of human worth and dignity.

FERS Disability Retirement: The period in-between

It is the squeeze that we abhor, the suspension of life during that time.  Like the craven soul that is relegated to purgatory or the mass murderer that must await the culmination of the sentence imposed, it is the period in-between that is wasted because we are frozen in time by the certainty of the past already ensconced and the future that is determined but yet to be fulfilled.  That is the rub, isn’t it?

The uncertainty; whether the future can be altered or modified; or has fate already made an irreversible decision and judgment?

When Scrooge encounters that ghostly apparition representing the future in Dickens’ classic tale, A Christmas Carol, isn’t that the question posed – whether the course of future events as foretold could be altered, modified, reversed or otherwise replaced?  But while we wait, what can be done?  For, in reality, it is too often thought that only the judgment rendered can then be worked upon, worked around or somehow accepted submissively as fated karma that cannot be countered.

Thus is that the reaction of Federal and Postal workers who suffer from a medical condition, such that the medical condition prevents the Federal or Postal worker from performing one or more of the essential elements of the Federal or Postal position – it becomes the period “in-between”.

It is the “in-between” doctor’s appointments to see whether there is any hope of getting better; “in-between” performance reviews to see if anyone at work has noticed; “in-between” temporary teleworking arrangements to see if the Federal Agency can extend the authorization; “in-between” surgery and recovery to see if you can go back to full duty; and on and on, “in-between” the crazy universe of a medical condition and a dying hope for a future withering on the vines of other’s expectations.

It is like being stuck in mud, frozen in time, watching as the impending future comes upon you.

However, there is an affirmative step that can be taken to begin the process of altering, modifying and changing the course of an expected future event – by preparing, formulating and filing an effective Federal Disability Retirement application, to be submitted through the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset.

While filing a Federal Disability Retirement application may not be a solution to the medical condition itself, it is a step towards altering and modifying the course of future events that are controlled by the Federal Agency or the U.S. Postal Service, by accessing an employment disability benefit that recognizes that you can no longer perform the essential elements of your particular Federal or Postal job, but there may be other things in life that you may be able to pursue.

That is how the period in-between can better be embraced, by making sure that the future does not end with a definitive period at all, but merely by a comma that represents a brief pause.

Medical Retirement for Federal & Postal Employees: Staring into nowhere

Except in the slumber of darkness, it is an impossibility of a feat unperformed; yet, the metaphor itself works well, because we all engage in those periods of vacant stares where someone suddenly nudges you back into reality and comments, “It was as if you were lost in thought.”  What does that really mean?

The fact that we can stare, perceive through organically mechanistic means of refractive light upon the cornea of our eyes and yet fail to be “conscious” about the bodily functioning of organs designed to perceive, evaluate, analyze and judge so that other predators may not surprise us for their mealtime delights, is indeed a mystery that evolution cannot fully account for.  Staring into nowhere is the physical capacity to be awake, fully conscious and have perfect vision and eyesight, and yet “see” nothing beyond the point of one’s protruding nose.

In an analogy or even a metaphorical sense, it is the loss of hope because of an inability to see a future bright and with excitable anticipation.  Remember those youthful days when the future yet remained as a potentiality unfulfilled and unable to be fully foreordained because of the unfettered plenitude of energy unbounded to be released forevermore?  We could barely contain the excitement to “get out there” and “show the world” what we are made of, the unleashing of one’s creative energy ready to “wow” the universe that had never seen the likes of such talent and reserve of energetic innocence.

And then something happened.  Life intervened; love paused; a leave of senses occurred.  Or, more likely, we encountered others who had the same hopes and dreams, and recognized that others had already trampled upon the unspoiled grounds of sacrosanct altars, and there was little left for us.  Then, with wisdom and experience somewhat under that proverbial belt, we moved on and adopted some more “realistic” goals, and were perhaps all the more happier for it.

Then again, perhaps a medical condition intervened, and a further and “real” reality set in – one that continued to debilitated and progressively destroy.  Medical conditions can do that to a person, and an agency’s insistence upon antagonizing and creating a hostile work environment somehow adds to the turmoil.

Preparing, formulating and filing an effective Federal Disability Retirement application, to be filed with the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, is often the only way to ultimately escape that vacant staring into nowhere, precisely because it allows for a vantage point of future security to be recognized.

Staring into nowhere, while escaping into the impractical world of daydreams, may allow for relief for a moment, but the more effective perspective is to look at one’s circumstances, assess the Federal agency or Postal Service’s capacity to denigrate and destroy, and begin taking those steps in preparing for one’s future by considering filing an effective Federal Disability Retirement application.

Federal Disability Retirement: Upon the Altar of Work

They are structures where sacrifices or worship occur.  Not being mutually exclusive, the former can represent the act of the latter, and the latter can constitute the fulfillment of the former.  And while we, in modernity, think of ourselves as sophisticated and beyond the vestiges of former practices of superstition and unscientific religiosity, an objective view of our actions betray the ongoing reliance upon past residues of robotic constancies.

Of course we have to make a living; of course we have to support our families.  But at what cost, and to whom do we owe our allegiance?

For Federal Gov. employees and U.S. Postal workers who sacrifice themselves at the altar of work, when medical conditions begin to clearly impact, deteriorate, denigrate and destroy the body, mind and soul of the Federal and Postal worker, then it is time to consider preparing, formulating and filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset.

As most Federal employees and Postal workers are under the FERS system, the minimum eligibility requirement is to have at least 18 months of Federal Service.  Once that threshold is met, then the question is one of having the proper support from one’s treating doctor, psychiatrist, Nurse Practitioner, etc.  The true test for a Federal Disability Retirement application will be in establishing the nexus between one’s medical condition and the positional duties of one’s official job, as reflected on SF 50 (Federal employees) or PS Form 50 (Postal employees).

Ultimately, when the altar of work becomes more than a means of support, and harkens back to the days of yore where sacrifice and worship intersected to pay tribute to the gods of the underworld, it is time to consider the alternatives available, and for Federal and Postal employees, that should always include the possibility of filing for Federal Disability Retirement benefits through OPM.

OPM Disability Retirement Attorney: Pivotal Moments

In basketball, it is a key movement of escaping an opponent’s attempt to block or steal the ball, so long as one foot retains its point of contact with the hardwood floor.  In the game of greater life, it is a moment, in contradistinction from a singular series of movements, comprising the culmination of a spectrum of events, which requires a decision of exponentially quantified significance, such that it may be considered metaphorically to be “earth shaking”.

It can seemingly be as minor an event as when the first confrontation occurred as a child, challenging one to a fist fight; but, in retrospect, win or lose, that moment was pivotal in the sense that it determined the future character of an individual’s make-up:  of courage or cowardice, of fight or flee, and of facing up or turning away.  Or, of greater relevance, at least on a memory and consciousness level, of a career choice, of which school to attend, of whom to marry, and of raising a family despite difficulties, or divorcing with impressionable regrets.

Filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management is just one of those “pivotal moments” — it is a point of reference, the proverbial “fork in the road”, and the Frost-like road less traveled.  For many Federal and Postal employees, whether under FERS, CSRS or CSRS Offset, “sticking it out” and enduring the pain, the constant harassment and pernicious hostile environment, is actually the path of least resistance, precisely because the repetition of habitual comfort is often preferable to the unseen, unknown and unforeseen.

Like the basketball player who must maintain the point of contact with one foot while moving about on the other lest the referee’s whistle blows for a traveling violation, the Federal or Postal employee who suffers from a medical condition such that he or she is no longer able to perform all of the essential elements of one’s positional duties, remains within the “safety net” of the greater arena of life.

But within that macro-context of one’s future, whether one remains or takes an affirmative step by preparing, formulating and filing for Federal Disability Retirement benefits through OPM, will determine that future orientation where retrospective dismay may tether the soft landings of past regrets, when once butterflies fluttered like the dreaming spirits of yesteryear for pivotal moments once grasped at, but lost forever in the floating vestiges of our memories of yore gone and long forgotten.

OPM Disability Retirement: Explicit versus Implicit

The former leaves no room for confusion or doubt; the latter, a bit of “wiggle room” where insinuations, hints and suggestive openings are characteristic invitations of open regards.  They are not mutually exclusive within a paragraph or even a sentence; they are, however, antonyms, and should be used with context-defined relevance.

For Federal employees and U.S. Postal workers who are filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, whether the Federal employee or the U.S. Postal worker is under FERS, CSRS or CSRS Offset, the choice of either can determine the future viability of one’s Federal Disability Retirement application.

Certainly, there are times in life when one chooses the latter methodology, for various reasons — perhaps being forthright and blunt is not the “right” approach; perhaps there is fear of offending, or mere laziness and sludge of confrontation prevents one from being straightforward.  In the legal arena, the former approach is preferable, if only to squeeze out the light of linguistic malleability and flexibility in supercilious argumentation.  But in the context of an OPM Disability Retirement packet, there will often contain multiple usages.

One’s Supervisor, in completing SF 3112B (Supervisor’s Statement), may present contradictory information by checking a box which is relatively unequivocal (is that an oxymoron — to use the terms “relatively” and “unequivocal” in the same breadth of a sentence?) but placing remarks implying the exact opposite in response to “explanatory” and more expansive questions.  Or, for the Federal Disability Retirement applicant, in completing SF 3112A, the “Applicant’s Statement of Disability”, there may be a strategy in mixing both explicit statements and providing for implicit openings for meanings and connections.

Certainly, the “law” of Federal Disability Retirement allows for it; but one must always take care in addressing the nature, extent and susceptibility of statutory interpretation in formulating one’s Federal Disability Retirement application.  Ultimately, as in most things in life, the former is preferable to the latter; though, wiggle room and the dictates social conventions may sometimes require one to be explicitly implicit in order to be inefficiently efficacious.
