OPM Disability Retirement: The Divide between Words and Reality

The problem with the linguistic universe is that they create a parallel universe which can be completely devoid of any connection or correspondence to the reality of the world which we occupy; thus the span of genres of imaginary creations, including fiction, science fiction, fantasy; as well as the virtual world of video games (which encompasses language because of the imaginary conversations which act “as if” the events occurring in the game itself are real).

The danger of language is that it may well communicate far more than what the objective world represents; and, conversely, it can also convey far less than what one may intend.

In preparing, formulating and filing for Federal Disability Retirement benefits from the U.S. Office of Personnel Management, whether under FERS or CSRS, the point of language is to describe and delineate the reality of one’s situation; the severity of one’s medical condition; the logical nexus between one’s medical condition and the positional duties one must engage; and the reasoning, based upon medical evidence, of why the Federal or Postal employee cannot perform one or more of the essential elements of one’s job.

The wide chasm between the world of language and the world of objectivity is the test of success; for, it is the one who can close that gap, and represent the reality of one’s universe by the correspondence of language, who will achieve a successful outcome.

The great divide between language and reality is a challenge which must be approached with care and trepidation; for, in the end, if language fails to correspond to reality, what would be the point of civilization in its endeavor to maintain the historicity of its existence?

Medical Retirement for Federal Workers: Stark Reality

Immanuel Kant was an 18th century German philosopher who recognized the imposition of human categories, structures and conceptual perspectives upon the stark reality of the world around us.  Within such levels of an uniquely human perspective, we shape the barren reality and impose our perceptual constructs.

It is not something we have any choice in; by being uniquely human, we see the world in a human way, thereby bringing to it a comprehension and order which our species can embrace, just as other animals may encounter the world from its own unique perspective.  Thus, the world according to Kant became one of bifurcation — between the “noumenal” world which was unfiltered and unknowable, and the phenomenal world of our own “making”.

For Federal and Postal employees who are contemplating filing for Federal Disability Retirement benefits from the U.S. Office of Personnel Management, whether under FERS or CSRS, one must always keep in mind the two parallel universes — the one which we hope for and often “make”, and the one in which we must survive.

When a medical condition impacts a person’s life to such an extent that he or she must contemplate filing for Federal Disability Retirement benefits, the phenomenal world of our making may include:  Hope that the Federal agency will treat us fairly; hope that the medical condition may improve or go away; hope that one’s work will not suffer as a consequence.  But in the stark reality of the noumenal world, one must recognize the unknowable:  Agencies rarely show a sense of sustained loyalty; medical conditions being what they are, will often remain on a steady course of debilitating progressivity; and one’s medical condition almost always impacts the ability to perform the essential elements of one’s job.

Walking about with a uniquely human perspective is something which we cannot help; gliding through life with self-deceptions is something which, while also uniquely human, one cannot afford to engage in for too long.

OPM Disability Retirement: Decision-Making

It is interesting how individuals make decisions, especially on important matters.  In coming to a decision to file for Federal Disability Retirement benefits under FERS or CSRS, the process itself is often an admixture of rational lists, emotional reactions, and a keen sense of realization.  While we often like to think that the “decision-making process” involves a reasoned, deliberative methodology of thought-processes, the reality of it is that most decisions are made more upon a reliance on instinctive feelings.  There is actually nothing wrong with that.  When an individual is suffering from one or more medical conditions, and those conditions are clearly impacting one’s ability to perform the essential elements of one’s job, it is often the rationalization which impedes the necessary decision to file for Federal Disability Retirement benefits.  Thus, economic and other reasons come into play, which often prolong the gut-instinct of the need to file.  This tension — between what the body is telling one, and what the mind is attempting to prevent — is a natural part of the entire process.

CSRS & FERS Disability Retirement: The Time to Make the Decision (Part 1)

Waiting until the last possible moment to start the process to file for Federal Disability Retirement under FERS or CSRS may be commendable from the Agency’s viewpoint — but is it smart?  If you are a Federal or Postal employee with multiple years of service, and you believe that because you gave your life, your blood, your sweat, tears, and even your firstborn, that therefore you will receive what I often term as “bilateral loyalty” (i.e., an expectation of receipt of loyalty from your agency for having given your undying loyalty to them throughout the years), you might want to reconsider.

If you are exhausting all of your sick leave, using your annual leave, dipping into your TSP in order to “hope” that you will recover from your continuing medical condition, then come to a point where you need to file for Federal Disability Retirement under FERS or CSRS, then come to realize that you must survive for 6 – 8 months, or even longer, and pay an attorney, pay for medical reports, and _______ (here, you may fill in the space yourself), then you may need to re-think the entirety of the process, the time it takes, etc.  Most people know, very early on, whether or not he or she has a medical condition which will last for a minimum of 12 months.  The time to start planning for the future is now.  As a famous football coach once quipped, “The future is now.”

OPM Disability Retirement: The New Year

The New Year is always a time of reflection, resolutions, and an insight as to how quickly time passes by. It seemed like yesterday that we were all amazed that we were entering the “Twenty-First Century”. In a span of a single year, circumstances change; people and perceptions become altered; friends and co-workers seemingly become transformed into strangers; and medical conditions which yesterday appeared irrelevant, contained or able to be endured, suddenly take on a life of its own.

Medical conditions are a reality which cannot be ignored. Then, of course, there is the problem of a medical condition, its impact upon one’s life, one’s employment, and one’s ability or inability to have an acceptable “quality of life” — as distinct from being able to convey a description of a medical condition in order to qualify for FERS & CSRS disability retirement benefits. It is in the describing of a medical condition, and the practical impact upon one’s employment, which is the key to Federal Disability Retirement benefits under FERS & CSRS. There is a distinction between the reality of a medical condition, and the ability to describe it to an impervious and implaccable agency — the Office of Personnel Management. Many think that, because one suffers from a medical condition, that it is enough to become eligible for disability retirement benefits. Nothing could be further from the truth.

CSRS & FERS Disability: The Disabled Federal and Postal Worker

As with most attorneys, I try to maintain an appearance of detached professionalism. It is my job to provide sound legal advice; to guide the client/disability retirement applicant with logical argumentation, rational perspective, and legal foundations as to the strength or weakness of a case, and to guide my client over obstacles, around legal landmines, and through the briars and thickets of “the law”. I try to remain aloof from the inherent emotionalism which arises from the human story of my clients, because not to do so would be to defeat the essence of why a client hires me: to maintain and retain an objective perspective, in order to provide the best legal advice possible. However, to maintain that wall of professionalism is not always possible.

The human story of the Federal and Postal employee is indeed one of encompassing a juggernaut of loyalty, professionalism, dedication, hard work, and the driving force behind and undergirding the economic might of the United States. Yes, of course the United States is built upon the economic principles of the free market system of the private sector; but the services which the government provides are not accomplished by some faceless or nameless entity; each such service — from the letter carrier through “rain, sleet or snow”, to the Special Agents who investigate and put criminals behind bars; from the border patrol agents who guard our security, to the IT Specialist who safeguards our internet viability — is provided by a competent and dedicated worker. That is why I am often humbled by my clients; because, truth be known, the disability retirement applicants who come to me have come to a point with his or her medical condition, where there is no other choice. It is never a question of dedication or hard work; the Federal and Postal Worker has already proven his or her dedication and hard work through the decades of service provided, prior to coming to me.

OPM Disability Retirement: an Art Form II

In constructing the narrative of one’s story of the human condition and how it impacts the essential elements of one’s Federal or Postal job, it is important to weave the story such that it relates as a story.  Every story has a beginning and an end; every story must contain the elements of an effective narrative:  What has occurred; the symptoms; the diagnosis; how the symptoms impact upon one’s ability to perform one’s job; what are some of the essential elements of one’s job; as well as some impact upon one’s personal life.  Now, the Applicant’s Statement of Disability has appropriate sections to “fill in the blank”; but one’s story should not be merely a matter of filling in the blank; instead, it should be a narrative — a coordination of the story, consistent with the medical narrative report obtained from the doctor; and finally, a legal memorandum arguing the law.  The weaving of these elements, in my experience, constitutes what I consider to be a successful disability retirement application.

OPM Disability Retirement: The Employee's Usefulness

Federal Employees and Postal Employees should never consider or entertain the thought that filing for disability retirement benefits is a negative judgment upon his or her lengthy and productive career.  It is merely a statement of reality — that the Federal and Postal employee has had a good career; medical conditions may have shortened the first career, but this merely means that there will be opportunities to have a second career; and, in no way does it mean that there is a blemish upon the Federal career; merely that it is time to move on to something else.  And, indeed, the interruption of the Federal or Postal career as a result of impeding medical conditions merely is a statement that you are no longer a “good fit” for a particular kind of job. Further, if you are removed from the Federal sector because of your medical inability to perform your job, such a removal is a “non-adversarial” and “non-disciplinary” action, and therefore (again) should not, and cannot, be considered a “blemish” upon one’s career. And, finally, it is often the case that it is precisely because of the long and loyal hours you put into your job, that you paid a price for such loyalty — by embracing the stresses of the job, of working despite impending medical conditions.  In other words, very often I see that the stresses inherent in the position took a large and heavy toll upon the individual, such that medical conditions resulted from the long years of such heavy toll.  There is never a need to feel guilty about taking disability retirement; you’ve paid your dues; it is time to move on to another phase of your life.
