Medical Retirement for Federal Workers: The Backbone of Agencies

While the greater geopolitical standoffs continue, it is always the backbone of the agencies which is most profoundly impacted.  The Federal and Postal Workers (yes, fortunately the latter are exempted from the shutdown) who daily toil and keep government services running, are sent home only to return when the whims of compromise decide to restart the indifferent bureaucracy.

For those Federal Workers who suffer from a medical condition which impacts one’s ability to perform the essential elements of the job, the backlog of work will only mount, putting greater pressure upon the need to toil harder.  The backlog will only exponentially increase at the U.S. Office of Personnel Management, also, and at each agency’s Human Resources Department which processes all Federal Disability Retirement applications, whether under FERS or CSRS.  Postal Workers are somewhat more fortunate, in that the H.R. Shared Services remains open to process all Federal Disability Retirement applications; but forwarding them to the U.S. Office of Personnel Management will only await the opening of their doors.

Lines will be forming; but for the Federal Worker who cannot perform all of the essential elements of one’s job, the most important thing to do right now is to get in line, prepare one’s application, and submit it as early as possible.  Backbones aside, there will be much work for OPM once the Federal Government is up and running, again.

For the Federal and Postal Worker preparing, formulating and filing for Federal Disability Retirement benefits from the U.S. Office of Personnel Management, the virtue of patience will again be tested.

FERS & CSRS Disability Retirement for Federal and USPS Workers: Preparatory Steps

Every excellent endeavor requires preparation, whether in purchasing the proper ingredients, of establishing and entering into a proper mental state of mind, or perhaps in performing preliminary stretching exercises to enhance muscular flexibility and loosening for rigorous physical activity.

Lack of preparation is not a necessary prerequisite for success, but it may well be a sufficient basis of failure.  In logic, the conceptual distinction between that which is “necessary”, as opposed to what is “sufficient”, is an important bifurcation of causal implications.  That which is sufficient, may not be necessary; and that which is necessary, may not alone be sufficient in reaching result X; but the combination of sufficiency and necessity will cause X to be achieved.

Thus, adequate preparation alone may be necessary for the best possible outcome, but it may not be sufficient; and, conversely, the utmost of preparation may be sufficient to accomplish a task, but it may not have been necessary all along.

In preparing to formulate and compile a Federal Disability Retirement application, submitted to the U.S. Office of Personnel Management, whether under FERS or CSRS, it is always a good idea to engage in the fullest preparatory tasks before filing for the benefits.  Not every act of preparation may be sufficient, but most are necessary; and while even the necessary tasks may not constitute sufficiency, it is the compendium of aggregated causal linkage which will ultimately ensure the greatest potentiality for success in the endeavor.

Logic aside, one will never be harmed by the extent of preparation.

Preparation for obtaining the best possible medical report; preparation for formulating an effective statement of disability; preparation in establishing the causal connection between the former and the latter; all of these are necessary for a compelling Federal/Postal Disability Retirement application, and in most cases, will establish a sufficiency which meets the legal criteria for eligibility for Federal Disability Retirement benefits, whether under FERS or CSRS, for the Federal and Postal employee.

Medical Retirement Benefits for US Government Employees: Substance versus Process

In every endeavor, there is the substance of activity, as distinguishable from the process which surrounds the activity (which is further differentiated by the issue of appearance versus substance).  The former encapsulates the essence of what the activity involves; the latter is characterized by the entirety of preparation, formulation and engagement in participating in the activity.

Thus, as there is the “actual activity” of the sport which one engages in; there is also the “process” part of it, such as paying a participant’s fee, negotiating a contract, submitting proper forms in a timely manner, etc.

In preparing, formulating and filing for Federal Disability Retirement benefits from the U.S. Office of Personnel Management, whether under FERS or CSRS, there is unfortunately both aspects which the Federal or Postal worker must contend with.

There is the substantive activity of preparing the application itself, with all of its attendant responsibilities of obtaining the proper medical documentation, preparing one’s statement of disability (SF 3112A); completing the Application for Immediate Retirement (SF 3107 & Schedules A, B & C for the FERS employee; SF 2801 & Schedules A, B & C for CSRS employees), as well as a multitude of other such substantive issues to be addressed.

Then, there is the “process” activity, of the long wait while the Federal Disability Retirement application winds its way through the bureaucratic maze, first through the agency, then the finance office, then to Boyers, PA for the intake processing part of it; then, forwarding it to the U.S. Office of Personnel Management in Washington, D.C.

Unfortunately, inasmuch as filing for Federal Disability Retirement benefits is something which is voluntarily engaged, it is seen as a necessary evil to be subjected to both the substantive, as well as the procedural (or “process” aspect) portions of the administrative filing.  In many ways, substance and process cannot be separated or identifiably bifurcated; they come together as inseparable twins, and must be dealt with as such.

Federal and Postal Disability Retirement: The Step-by-step Process

Complexities abound in every field, and the solution to preventing one from become embroiled in such confounding complexities is to divide the complexities into manageable entities.  While any bifurcation may be arbitrary, it does not mean that there is not a reasonable basis for such arbitrary division of issues.  

Thus, in preparing, formulating and filing a Federal Disability Retirement application under FERS or CSRS, it is important to identify the primary medical issues which are impacting one’s ability/inability to perform one or more of the essential elements of one’s life.  It is often queried as to “which one” of the multiple medical conditions should be included in preparing the Applicant’s Statement of Disability (Standard Form 3112A), and further, what are the “primary essential elements” which should be described.  

Both questions pose a complexity beyond an ability to answer such a question in a generic fashion, precisely because each case is unique.  As to the former question, it all depends upon the impact of the latter question; and as to the latter question, it all depends upon the answer to the former question.  

This circularity of interdependence, of which of the major medical conditions one should include, depending upon the type of essential elements of one’s job, is the complexity which must be unraveled, and it is in the process of this unraveling that one then begins to formulate the “bridge” or the “nexus” between the type, extent and severity of one’s medical condition (or its variance of pluralities of conditions) and the multi-tasking nature of the essential elements of one’s positional duties.  

It is a complex process, but one in which the various components begin to provide for a foundation of that bridge, which must be constructed carefully, with scrutiny, and with deliberate reasoning.

Federal & Postal Service Disability Retirement: Right Questions (Part 2)

Beyond asking questions of one’s self (financial; employment; future; whether one will last until regular retirement, etc.), it is also important to take a two-step process in preparing for a disability retirement application:  First, to do your own, independent research (in this day and age, internet research is the obvious first step), and Second, to contact an attorney.  By the time you contact an attorney concerning disability retirement issues, you should already have an idea as to what your intentions are. 

Hopefully, the attorney you contact will be experienced and knowledgeable concerning all aspects of Federal Disability Retirement laws under FERS & CSRS.  There are many attorneys “out there”; some attorneys do work in Social Security, Federal Worker’s Comp, etc.  Other attorneys perform work in various Federal labor matters; and still others perform work in State and private disability insurance issues.  Remember, Federal Disability Retirement is a specific, specialized field of law; it is best to retain an attorney who specializes and focuses upon your specific area of concern.  Finally, in speaking with an attorney, you should come to a point of becoming “comfortable” with that attorney:  and “comfort” comes only as a result of competent and confident advice — advice that is consistent with the facts you have gather from your prior research on the matter.
