FERS Disability Retirement: Who, What, When, Where, How…

The basics of High School Journalism class provide the content of every good narrative in order to inform the reader of the “news of the day” — who is involved; what occurred; when it occurred; where the event occurred; how it impacts the community, the reader, the bystander, the spectator, etc.

A newspaper article is quite different from other forms of writing, for it is meant to inform the public, and the specific reader who purchases the newspaper, of “current events”.  More and more, local newspapers are being bought up by large corporate entities, and the very “local” nature of the newspaper becomes lost as a result.

There are, of course, different types of writings, such as novels, biographies, autobiographies, as well as subsets of genres — of “crime” novels, “romance” novels, and more recently, of the type which Truman Capote created in his “Nonfiction Novel”, In Cold Blood.

Federal Employee Disability Retirement: The Prospective Case

Deciding to move forward on a Federal Disability Retirement case is not a decision which should be taken lightly.

FERS Disability Retirement for Federal and Postal Workers: Beaten

It is a strange word.  In the past tense, it implies that nothing can be done about it.  When applied to an individual, it describes a haggard portrait of profound hopelessness.  It is the past participle of the verb “beat”, but when the “en” is added, it has a modern connotation of hollowness, of a sense of utter futility and nihilism that cannot be overcome.

Did Sisyphus have that perspective?  As he rolled the boulder up onto the next and endless precipice, did his shoulders sag, his head and eyes remain downcast, and was he forlorn and without hope?  Of course, Camus refashioned the anti-hero into such a figure of futility, which is what existentialism declares life to be: Meaninglessness with the freedom to choose meaning; futility from which manufactured human activity can originate.  Whether that can actually be accomplished, or whether Camus, Sartre and the whole bunch of those French Existentialists who sat around at street cafes and deliberated about the times of dangers and rebellion during the Nazi occupation, now seems like a far-off dream.

Today brings about a new set of problems.  No longer from an occupation force, nor even an identifiable enemy; in modernity, the daily stresses of technology — of simply trying to make a living; of the constant barrage of information; of demands in daily life which stretches the ends of human capacity; and then, when a medical condition intrudes, interrupts and interferes, it all seems to be so overwhelming that we suddenly feel “beaten”.

The beaten individual is the one who has reached his or her limit of human capacity; it is when the intersection of life’s demands exceeds one’s tolerance for sustaining the stresses of everyday life.

For Federal employees and U.S. Postal workers who suffer from a medical condition such that the medical condition prevents the Federal or Postal employee from performing one or more of the essential elements of one’s Federal or Postal position, it may be well past the time that one should have, but still must, file for Federal Disability Retirement.  Do not wait until the term “beaten” applies; instead, try to beat the beaten, and consult with a FERS Disability Attorney who specializes in preparing an effective OPM Disability Retirement application, lest you hear someone whisper to another, “Oh, that person — he/she is beaten.”

Federal Disability Retirement: That promising future

One doesn’t have to have been that “golden boy” to have an inkling of a promising future; there just needed to be some hope, and a taste of success.  Perhaps you came from a background where expectations were low; where higher education was a mere afterthought and nothing beyond an exclamation of gibberish and fantasy.

Was success defined by negation?  That if you didn’t do X, avoided Y and prevented Z, you were considered an anomaly and deemed as one of those who “made it”?

Yet, you exceeded; perhaps night school; whatever the cost, of however the pathway, that promising future that was never guaranteed, rarely spoken of and deliberately left silent but in the fertile imagination of a seeming dream; and the expectation of negation was met and exceeded, precisely because the goal post was never set within sight of grasping, but a mere filament that failed to light any hope of a promising future.

Yet, reality has a tendency to quash the daydreams of even butterflies, and a medical condition can alter forever the course of time and tenacity.

For Federal employees and U.S. Postal workers who once thought that a career under FERS meant a promising future for the duration of one’s life, and who never expected to be saddled with a medical condition that created a circumstance of negation, consider filing for FERS Disability Retirement.  Medical conditions tend to become that negation of hope, when in fact it may merely be an alteration of course.  Perhaps that promising future was too narrow a vision.  Maybe a change of mindset is all that is required.

Federal Disability Retirement is merely a recognition that there is an incompatibility between the medical condition suffered and the type of job one is in.  It does not mean that you cannot work; in fact, you are allowed to make up to 80% of what your former Federal position (“former” because, upon winning an approval of a FERS Disability Retirement claim from OPM, you are then separated from Federal Service) currently pays, and still continue to receive the Federal Disability Retirement annuity.

Just remember that the “promising career” was never defined by naysayers or those who lacked belief; it was always defined by your own drive, and for Federal and Postal employees whose once-promising career became curtailed by a medical condition, the “promising” part of conjunction can still be in the future.

OPM Medical Retirement for Federal Employees: ‘For’ and ‘to’

Do we ever pick up on the subtleties of language’s intentionality, anymore?  Is there a difference with a distinction between the use of the prepositions ‘for’ as opposed to ‘to’?  And, even if intentionally and with deliberative meaning, one inserts one as opposed to the other, would the person for whom it is intended, or to whom it is addressed, catch the difference, or would he or she merely respond as if there was never any difference at all?

Say the person began with one preposition but stopped mid-sentence and corrected it, inserting the ‘other’; would the correction be noticed at all, and even if it was, would that make a difference?  Say, for instance, a person says to another, “I would like to show my appreciation to you,” as opposed to saying, “I would like to show my appreciation for you.”  Is there a difference?  Is there a subtle intentionality hidden – where the “to” is just slightly less personal than the “for”?

What if the person speaking does not believe in any differences between the two propositions – would that make a difference?  Or, conversely, what if the person speaking does know the difference, or believes he does, between the two, but the person being addressed does not; does that make a difference?  Is there, objectively, a difference between the two, and can it be identified, delineated, understood and explained?

When we say, for example, that X is giving a gift to Y – is that different from saying that X is giving a gift for Y?  Or that Sally has shown great empathy to Mary, as opposed to showing great empathy for Mary – can the subtle difference of intentionality be derived?

Language is a difficult tool to master, to begin with, and grammar was once the medium by which correctness of communication could be embraced.  Much of grammar has now been discarded, abandoned and forsaken, and with the detritus of residue left behind, the subtlety of language – both in its usage as well as in its reception – has been lost.

For Federal employees and U.S. Postal workers who are considering filing a Federal Disability Retirement application through the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, almost all of the encounters with the Federal agency responsible for review and determination on a Federal Disability Retirement application – i.e., the U.S. Office of Personnel Management – will be wrought through impersonal “paper” transactions – submission of the Standard Forms (e.g., SF 3112A, Applicant’s Statement of Disability) and medical narrative reports and treatment records, as well as any Legal Memorandum prepared to argue your case – will be through an impersonal communication via language known, language learned and language imparted.

Knowing the subtleties of language, and the correct approach, the context and content driven by legal precedents and argumentation are all an important part of the process of preparing, formulating and filing an effective Federal Disability Retirement application.  It may not have to get into the minutiae of the differentiation of prepositions like ‘for’ and ‘to’, but there is enough complexity in the language of such a strange frontier as Federal Disability Retirement Law so as to justify hiring an attorney who specializes in such administrative legal conundrums, whether to obtain a successful outcome or for attainment of one.

Federal Disability Retirement under FERS & CSRS: Life erasing

In youth and early adulthood, we add; in later years, life erases.  Kids grow up and move elsewhere; vigor depletes; living spaces are downsized; mementoes once meaningful are discarded into a trash heap of forgotten memories; and health deteriorates, with diminution of lives by incremental depreciation both in appearance, worth and human value.

Life erasing is the natural decomposition of matter; the energy that we expended in bringing up our kids has now been complete, and transference of that vigor has become a permanent fixture.

Somehow, what we gave never seems to be enough, and no matter how much we tried, loved, cared for and nurtured, that part of all has separated and journeyed away, never to be sought in unenlightened venues of thoughtless abandonment.  It is as if life reaches its pinnacle, as the arc of never-ending geometric feats of engineering and technological defiance; and then it tapers, becomes warped and disappears into the far horizon.  What ever happened to those youthful dreams once embraced, promised, forever committed to, and now a dash of trailing dust left behind like so many of life’s erasing features?

Medical conditions and deteriorating health tends to symbolize that; for, as one reaches the pinnacle of an incomplete life (is it every complete, even at the point of oblivion, and do we not hang on for a moment more?), the tawdry reality is that we fear the vanishing of all that we have surrounded ourselves with, because we do not walk about this world with a mirror to appease our own insecurities.

Isn’t that why people amass great wealth; invoke power-plays to demand and command loyalty; hoard possessions as if they reflected quantifiable worth; and apply every cosmetic trick into believing that appearance of youth is the same as easing life’s erasing by concealing the decay beneath?  Why is it that such a natural deterioration is fought against, when the peaceful calm of wisdom tells us that life erasing is the easing of burdens amassed in youth and adulthood, and thus to be enjoyed?

Life erasing means that responsibilities garnered previously have now been alleviated, but instead of accepting that natural digression, we buy into the advertising colonnade that age is merely of deceptive appearances and a “mind set” that can be averted merely by acting more foolishly, accepting cosmetic alterations by stretching the wrinkles away, and taking on greater obligations for self-aggrandizement.

For Federal employees and U.S. Postal workers who are beset with medical conditions which prevent the Federal or Postal employee from extending a career chosen, whether the Federal employee or U.S. Postal worker is under FERS, CSRS or CSRS Offset, filing for Federal Disability Retirement is actually an acceptance of the natural course of life erasing – by the proverbial course of “downsizing”, of recognizing the medical conditions impacting one’s life and pursuing Federal Disability Retirement so that life’s erasing can attain a level of focus upon a priority long ignored:  Health.

Federal Employee Disability Retirement: The divided relic

If an ancient relic of sacred origins must always travel with wherever a community, a tribe or an individual must go, can its essence remain intact despite being divided into multiple forms?  Can a divided populace split into two its sacredly-held relic, whether for theological reasons of disputatious incommensurability, or simply resulting from an old-fashioned “I don’t like them anymore” conflict that has erupted into an irreconcilable fissure?  In other words, is the sacredness of the relic contained in the essence of the thing itself, or by the bonding influence of the people who view that item of antiquity with awe and frightful respect?

Whether a sacred scroll or a Bible (which, obviously, would be difficult to divide), or a crystalline object, an ancient arrow holding magical powers or an assortment of divinations empowered by a rich history of spiritual conquests — whether such relics can retain their efficacy for a community divided, might depend upon the strength of the belief itself, and the foundational reliance upon such antiquities of thought-processes.

That is, perhaps, one of the many problems of modernity; we no longer have the capacity to believe in the power of ancient relics, divided or not; and, instead, we put our faith into the predetermination of a Darwinian paradigm, where the gene pools of those who have survived merely contribute to the greater sense of invincibility within a genetically maladjusted populace of pure materialism.  Thus do we abandon all sacred rites of passage and living – of entrance into adulthood, marriage, the sacrament of forgiveness and the commodity of grace.

The divided relic does not lose its powers because of the division into pieces greedily and hastily fractured by human conflict, but because the very act itself merely reflects a broken heart no longer tethered by faith, belief, community or commonality of belonging.  No – it is because we have accepted fractured lives as a justification for dividing sacred relics, that the very sanctity of the relic itself has been diminished and sullied.

Indeed, that is what happens in the Federal sector and the U.S. Postal Service, with people and the workplace itself.  No, there are no sacred relics to be divided in the Federal agency or the U.S. Postal Service, but there can be – should be – a sense of commonality of purpose and an empathy undivided such that the work and missions of the entity itself can be carried forth with a purposeful intent.  The strength of that sense of cohesion, however, is often reflected when a Federal or Postal employee is beset with a medical condition, and must file a Federal Disability Retirement application through the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset.

If the Federal agency or the U.S. Postal facility responds with supportive empathy (rarely seen), then that sense of an undivided and worthy relic remains like a residue of bright hope; but, more often than not, it is the opposite effect that is seen – of a divided relic reflected in the pool of harshness and indifference revealed by human depravity, by harassment, intimidation and scorn within the community of Federal and Postal workers.

Such a state of affairs when responding to a Federal or Postal worker who is in the process of going through the administrative trials of filing a Federal Disability Retirement application through OPM is reflective of this state of modernity, where the divided relic can so heartlessly be accomplished without concern for the essence of one’s soul.

Disability Retirement for Federal Employees: Understanding

The Master asks one of his two dogs, “Where is ___?”  If the second pet wags her tail, looks quizzically at the owner, then proceeds to go to the far end of the next room and locates the wandering misfit and barks to you that she has found him – do we disbelieve?  If the same question were to be asked of one’s child in reference to a sibling, and the identical result occurs where the first child goes into another room or runs up into the attic and locates the lost soul, would there be any doubt?

Same circumstances, identical behaviors, concurrent results; merely different mammals within the genus of species, and yet we disbelieve because of arrogance and pride of self-worth.  Why is it that we refuse to attribute understanding to non-human entities despite clear evidence to the contrary?  Is language defined by grammatical rules of construction retrospectively applied, and does that constitute a basis for refusing to allow admittance into the colony of intelligence “clubs” of exclusivity we have created based upon rules of comprehension we have paradoxically constructed?

The rules constituting grammatical comprehension and technical application came subsequent to language itself; for, no one believes that Man sat down eons ago and decided to set down rules of linguistic conveyance, upon which the growing population then began to follow.  No, conformity to such constricting paradigms were initiated, instituted and concretized when society recognized that there were differences in parochial intonations, and those who had nothing better to do decided with arrogance and ivory-tower nose-lifting that correct idioms of speech needed to be recognized, applied and adhered to.

And what of animals?  So long as the working paradigm consisted of our self-image as just below the angels and above the burdens of beasts, we refused their eligibility to the elite of elasticity in language and comprehension.  Yet, despite all of the convoluted attempts at avoiding acknowledgment and recognition that “to understand” is nothing more than the behavior following an utterance of speech, the pragmatism of daily life refutes our own methodology of exclusionary conduct.  For, in the end, it is merely the impact of speech upon behavior in a given society, whether that indicates a “human” world or a “dog” universe.

For Federal employees and U.S. Postal workers who are considering filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, the question of “understanding” before “acting” often becomes a vicious circularity resulting in non-action:  The complexity of the legal tangles in Federal Disability Retirement law tends to make the Federal or Postal employee pause; failure to act in preparing, formulating and filing a Federal Disability Retirement application serves to exacerbate one’s condition, which leads to greater stress and turmoil; non-action results.

The key is to recognize that “understanding” – not even “complete understanding” – is necessary.  Rather, it is often the subsequent initiation of acting following a verbal commitment that is the only real test of understanding.

OPM Disability Retirement Benefits: The reef beneath the lagoon’s surface

In every worthwhile venture, there is the inherent danger of failure, and more often, of encounters with obstacles while enduring the process.  Some are apparent; others, hidden like the reef beneath the lagoon’s surface, of the jagged formations from sediments deposited and coagulated through time and shifting tectonics of unseen tidal forces.  That is the greatest of dangers – of a peaceful hue by a lagoon in its invitation on the surface of beauty; yet, beneath, lurking unknown and unrevealed, ready to tear the undersides of an unsuspecting boat as it enters into waters mysterious in its captivating picturesqueness.

If only life were always defined by mere appearances; we would never have to stop and reflect, pause and contemplate, or resist the urge to jump head first into shallow waters that seemingly reflected a pool of depth beyond mere sparkling mirrors of a sunlit afternoon.  But that is not how real life, in real time, amidst real people in a real world, works.

And we all know it; except, perhaps, for those shielded children who can actually have a childhood of carefree days and cool breezes in an afternoon where fields of rye still allow for the catcher to stand just at the edge of the cliff, and safely deposit any wayward souls who may wander to the danger’s end.  And like the unseen reef beneath the surface of the seemingly tranquil waters of the lapping waves softly upon the lagoon’s invitation, life embraces, often maims, and forever destroys if unaware and stepping without trepidation of purpose.

For Federal employees and U.S. Postal workers who are considering filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, it is that unseen and unsuspected reef beneath the lagoon’s surface which must be considered before stepping into the still waters of the bureaucratic process.  For, while the waters may be quiet today, who knows what obstacles, dangers and dalliances of pitfalls will lurk about tomorrow?

Federal Employee Disability Retirement: Private thoughts, public offerings

The bifurcation of human contemplation can take many forms, and rarely do they conflict with each other, unless the former is involuntarily injected into the cauldron of the latter.  One can hold private thoughts contrary to one’s public image; and the public self can contradict the private soul without a condemnation of hypocrisy, so long as the two are never manifested as unconcealed revelations of surprised protocols.

We suspect that exacting consistency between the former and latter has never existed in the history of mankind – beginning with the dawn of hunters who trembled with an inner fear so violent that want of flight was paused only by the shame that would prevail at the tribal dance where bravery, conquest and manhood are celebrated; or in more “civilized” settings when socialites raised eyebrows upon behaviors deemed uncouth and agrarian, where divisions of social consciousness resulted from the miscreant amassing of wealth previously unknown.

Can resentment be concealed in a long-enduring marriage, or fear of death be tightly coiled within the heart of a warrior?  The samurai who gave his fearless allegiance to the daimyo, who in turn swore body and soul to the Shogun – did they avert the openness of their trembling by dispensing favors and accolades to the underlings who disseminated the fearsome bloodlettings?  And what of politicians today – the acceptability of having a “private belief” contrary to the “public stance” – do they constitute a hypocrisy, or an acceptable division of setting aside personal feelings for the greater good in public service?

Often, the misguided confusion arising between a conflict of contrasting private thoughts and public offerings, is just that:  We fail to contemplate the ends thought, and mix the means for motives untold, and in the muddle of such a conundrum of confusion, think that it reflects upon the meanness of our own souls, without recognizing that human frailty must always allow for a bit of good humor, if we are to survive the self-flagellation of our inner desires.

Federal employees and U.S. Postal workers have this same problem – of fealty and loyalty to a Federal daimyo or Postal Shogunate without considering the misguided and irrational basis of such compelling inconsistency.  The thought that loyalty to an agency or fealty to the Postal Service must continue despite hostility and abuse perpetrated merely for suffering from a medical condition brought on through no fault of the Postal worker or Federal employee, is tantamount to the bifurcation between private thoughts and public offerings:  publicly, in the company of coworkers, supervisors and managers, the smile of contentment and membership in the agency’s team spirit must be on full display; privately, the suspicions and paranoia mount because of the workplace hostility engaged by others.

Betrayal itself is often a misguided embracing of a blind trust; you cannot betray those who have already undermined your every turn.  Filing for Federal Disability Retirement benefits, whether the Federal employee or U.S. Postal worker is under FERS, CSRS or CSRS Offset, is a very private matter, precisely because it involves the most private of information – one’s medical condition and the records which reveal the intimate and private details of it all.
