OPM Disability Retirement Attorney: The Quality of Input

We often forget that the quality, validity and accuracy of conclusions produced by computers will depend upon the input of information provided.  Thus, predictability of future weather forecasts are contingent upon present information selected, and the computational analysis resulting in the future paradigm is founded upon current constructs, analyzed through the cumulative data previously provided, with a dash of witch’s brew and a genuflection of hope.  In other words, the trash produced results from the trash collected; a rather self-evident tautology of sorts.

For Federal employees and U.S. Postal workers who are considering filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, the issue of what information to provide, the amount of documentation, the precise wording selected, and the cumulative historical and current data introduced, will determine the statistical ratio of increased chance of success versus the possibility of an initial denial.

Receiving a denial from OPM is a down heartening experience, to put it mildly.  Expectations are that the subjective pain or psychiatric stresses which one experiences, will immediately be recognized and become translated into a societal benefit through a monetary annuity, especially as Federal Disability Retirement is an employment benefit offered for all FERS, CSRS or CSRS Offset employees in the Federal system, and upon proof and sufficient information and documentation provided, one becomes eligible for the benefit.

The difference between preparing, formulating and filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, on the one hand, and computational analysis of information in other sectors of information processing, on the other, is that an intermediate human factor is present.

All Federal Disability Retirement applications are reviewed, scrutinized and evaluated for sufficiency by someone at OPM, and it is this very human element which remains the “X factor” in all Federal OPM Disability Retirement applications.  What can be done about it?  It is simply a reality which must be taken into account, processed and accounted for.  While bureaucratic and ultimately a rather depersonalized process, it is nevertheless an administrative system which must be faced.

It is as old as the ageless adage of yore, attributed to Isaac Newton:  What goes up must come down; or, what information is provided, is the basis of conclusions reached, and it is the quality of information in culling together a Federal Disability Retirement application which is paramount in achieving success.

Postal and Federal Employee Medical Retirement: A Working Paradigm

Most doctors, attorneys, and the general public are familiar with the concept of “disability benefits”, but only in relation to the Social Security Administration.  It is rare that disability benefits are associated with, or are known to exist, separately for Federal employees or the U.S. Postal Service, in relation to a concept which is progressively unique and creatively formulated within a context of a society and a bureaucracy which is not normally know for such characteristics:  a system of disability where the disabled individual is encouraged to seek employment without being penalized for earning income by immediately terminating the disability benefits.

Yes, for Federal and Postal employees, there is the cut-off margin of 80% of what one’s former position currently pays; and, yes, if the private-sector employment is too similar in nature to the positional requirements and essential elements of the former Federal or Postal job, such parallel identity can result in a determination by the U.S. Office of Personnel Management that the former Federal employee or Postal worker is deemed medically recovered; but within those generous parameters, the paradigm upon which Federal Disability Retirement is based, is what can only be described as a “working paradigm”, precisely because, as a system of incentives, it works, and as a practical matter, it encourages Federal and Postal workers to continue to remain productive in the workforce, and to perpetuate a self-paying system, as opposed to the de-incentivized system of Social Security, which has an extremely low threshold of allowable income before terminating benefits.

OPM Disability Retirement is effective precisely because it is a working paradigm — both in a pragmatic sense, and as a metaphorical basis for building a foundation for one’s future, as opposed to being stuck in the rut of an administrative bureaucracy which fails to understand and appreciate the human instinct to remain productive.

Federal Worker Disability Retirement: Interruption or Interlude

Life is full of interruptions which push the pause button upon our grand designs for linear progression; how we view such events, whether as something bothersome, or as a respite and opportunity, a platform for the next stage of life, will determine the extent of character-building foundations needed to forge forward.  Taking care of aging parents is now considered a bother, and not a privilege; mentoring a young person just beginning in a chosen career is seen as a predatory challenge, as opposed to a chance to mold for the future; and revealing a fissure in the otherwise impenetrable public face of constancy is a chance to take advantage of the weakness of the opponent.

How one views a particular event; whether it is seen in the best light possible and anticipated for lessons to be learned; or instead, as a crisis point of quashing all hope for the future, never to be spoken about because of the devastation wrought, reflects both upon the present state of one’s character, as well as the potential for the future. Things are merely bothersome to us, now. Perhaps it is the result of a leisure society, where things once earned are now expected as givens; or, of greater probability, that the antiseptic isolation of our society engenders a certain aura of incomprehensible turmoil.

For Federal and Postal Workers who suffer from a medical condition, such that the medical condition prevents one from performing one or more of the essential elements of one’s job, Federal Disability Retirement should be considered as a viable option. Filed through the U.S. Office of Personnel Management (and available to all eligible Federal and Postal employees who meet the minimum criteria of years of Federal service), it should be considered precisely for two (or more) reasons. First, it allows for a foundational annuity in order for one to move forward with one’s life. Second, it allows for the Federal and Postal employee to embark on a second vocation, and make up to 80% of what one’s former Federal or Postal job currently pays, on top of the base annuity.

As such, there is a built-in mechanism which recognizes that the event of a medical condition is not merely an interruption, but an interlude for the second and subsequent stages of a person’s life.

CSRS & FERS Medical Disability Retirement: The Universe of the Possible (Part II of II)

When avenues are closed off, the human psyche tends to shut down; and when grounds manifest fertile regeneration and bountiful splendor, the endless state of the possible opens like the gaping eyes of a child in excitable wonderment.  That is why internet companies attempt to artificially recreate atmospheres of creativity and prior glory days of unbounded imaginations.  But whether simulating a couch plopped in one’s basement or garage, and making it appear as if the environment is similar to those past dawns of tinkering with one’s imagination in the unheated, primitive conditions of one’s youth, is questionable.

For the Federal and Postal employee who is faced initially with a medical condition, such that the medical condition impacts one’s ability to continue in the vocation and career choice of one’s following, the limitations which the present condition places upon one’s future often seems daunting.

But there are options available.

Federal Disability Retirement allows for those options to open up; for, once the Federal or Postal employee obtains an approval for Federal Disability Retirement benefits from the U.S. Office of Personnel Management, that (now former) Federal or Postal employee may go out into the private sector and earn up to 80% of what one’s former position currently pays, on top of the Federal Disability annuity. Many start their own businesses; others perform consultative work or work part time, thereby controlling the stresses and the extent of activity able to be tolerated within the restrictions of one’s medical conditions.

The avenue of the possible can only reopen once you recognize the reality of the probable; and in order to tap into the fertile imaginations of a brighter future, the roadblocks once observed must be moved in order to travel down the path of viable alternative routes.

Disability Retirement for Federal Workers: Unwanted Change

Stability is what we seek; yet, with stability comes habituation and a staid routine of repetitive boredom.  Adventure, excitement and stimulation; these come at a price, and so we revert and remain in the cocoon of safety, daydreaming of that potential, other-worldly experience, but only if it can be attained under certain circumstances within our control.

That is the anomaly; change is often desired, but only with certain prescribed and proscribed stipulations within our control.  Unfettered change is to enter into the unknown, and therefore unwanted.

That is why medical conditions which impact one’s daily life is unwanted; not only did we not ask for it, and not only is it a burdensome change which forces one to rethink the course of one’s future; it is an experience into the abyss of the unknown.  It is an unwanted change precisely because it suddenly, and often irreversibly, mandates an alteration of course.

For the Federal and Postal Worker who suffers from a medical condition such that the medical condition prevents one from performing one or more of the essential elements of one’s positional duties, serious consideration should be given to file for Federal Disability Retirement benefits through the U.S. Office of Personnel Management.  Whether under FERS or CSRS, Federal Disability Retirement is an employment benefit offered to all Federal and Postal employees.

In the midst of turmoil and change, it allows for a return to the landscape of stability by providing for a base annuity, and a change to engage a second, alternative vocation.  Medical conditions are unwanted changes, and the control which one seeks within the turmoil of life is often found by attaining a further change beyond that unwanted one.

Postal and Federal Disability Retirement: OWCP & the Short Sale

Americans are often looked upon as short-sighted.  Lacking historical longevity, both in terms of an enduring civilization as well as culture, the economic, mercantile (some would say ‘mercenary’), materialistic approach of the American Way lends itself to criticism for the emphasized focus upon short-term gain and profit.

For those questioning whether or not a Federal Disability Retirement annuity, in comparison with compensation received or being received through the Department of Labor, Office of Workers’ Compensation Programs (FECA), would be beneficial, may be suffering from the American-Way syndrome — of viewing the higher pay alone and in a vacuum, without considering the superior benefits of the longer view of life.

Indeed, under an annuity from the U.S. Office of Personnel Management, Federal Disability Retirement benefits, whether under FERS or CSRS, one may continue to receive the Federal Disability Retirement annuity, and yet work and receive income on top of the Federal Disability Retirement annuity, up to 80% of what one’s former Federal or Postal job currently pays.  Under OWCP, of course, one cannot work while receiving temporary total disability payments.

Further, it is important to understand that the time that one is on Federal Disability Retirement counts towards the total number of years of Federal service, so that when it converts to regular retirement at age 62, all those years on Federal Disability Retirement are counted.

Short term sale or long term goals and benefits?

Whether lacking in culture, history or an enduring civilization, it is always beneficial to review the present, in order to plan for the future.  Short sales often sell one short, and that is something which the Federal and Postal employee must take into account in preparing, formulating, and filing for Federal Disability Retirement benefits from OPM, whether under FERS or CSRS.

OPM Disability Retirement: The 80% Rule — Earned Income

As we reach the end of the year, Federal and Postal employees who are receiving OPM Disability Retirement benefits, and who are working in the private sector, should remember the 80% earned income rule.  Be aware that a Federal or Postal employee who is under FERS or CSRS, and who is receiving a Federal Disability Retirement annuity, is allowed to make up to 80% of what one’s former position currently pays.

While it is sometimes difficult to ascertain what the current pay scale is (and the Office of Personnel Management is often completely unhelpful, whether deliberately or inadvertently), it is best to always estimate “down”, so that one is never in danger of exceeding the cap.  Further, if the Federal or Postal employee in any given year exceeds the cap, then reinstatement of the Federal Disability Retirement annuity is allowable if in any succeeding year, he or she goes back under the 80% ceiling.

It is important to keep an eye on one’s earned income if one is to continue to maintain a Federal Disability Retirement annuity.  Planning is the key to the entire process.

Federal Worker Disability Retirement: The 80% Rule

When a Federal or Postal employee files for Federal Disability Retirement benefits, and obtains an approval from the Office of Personnel Management, under FERS he or she will receive 60% of the average of one’s highest three consecutive years of pay, then 40% every year thereafter until age 62, at which point the disability annuity is recalculated based upon the total number of years of Federal Service, including those years that the disability retirement annuitant has been on Federal Disability Retirement.  Thereafter, the now “former” Federal or Postal employee has the capability to work at another, private-sector job, and earn up to 80% of what one’s former Federal or Postal job currently pays, on top of the disability annuity that one is receiving.

While some may wonder whether this is a “fair” benefit, especially in these trying economic times, it might be wiser to consider whether or not it is prudent to consider the economic incentives inherent in such a system.  For, by allowing for the Federal or Postal Disability Retirement annuitant to go out and attempt to earn income in another, different kind of job, it allows for continuing productivity, payment of taxes and FICA back into the “system”, as opposed to limiting the individual to merely receiving a government benefit. As all of “economics” is ultimately based upon incentives to the working population in order to encourage a system of the highest extent of productivity, this system creates an economic incentive to those who are merely disabled from performing a certain kind of job.  They can continue to remain productive — just in a different kind of job from the one in which he or she is disabled.

Medical Retirement Benefits for US Government Employees: A Thoughtful Paradigm

Federal Disability Retirement benefits under FERS or CSRS is a well-thought out paradigm of benefits for two primary reasons:  (1)  First, because it allows for a base annuity for those productive workers who are no longer able to perform one or more of the essential elements of one’s Federal or Postal job, and allows the Federal or Postal Worker who is disabled to have a period of time in which to recuperate and tend to the medical needs in order to regain his or her strength, energy, abilities, etc. — physical, emotional, cognitive or otherwise; and (2) Second, because it allows for the Federal or Postal Worker to become a productive member of society in a different, “other” job.  

While many may be concerned that, in this regressive economy, the prospect of obtaining another job may be severely limited, such an approach is short-sighted.  The economy will rebound; opportunities will arise as various economic sectors adjust to changing circumstances; and during the entire process, the Federal or Postal Worker who is on Federal Disability Retirement benefits from the Office of Personnel Management will be able to receive a base annuity in order to recuperate from the medical condition.  

All said, the alternative prior to the Federal Disability Retirement benefit becoming law was bleak and short-sighted:  to terminate the unproductive Federal or Postal employee, and let him or her go out to deal with loss of job, loss of income, loss of medical insurance — on top of the medical condition which forced the Federal or Postal Worker out in the first place.

Federal Disability Retirement: OPM Disability & OWCP Disability (Continuing…)

A person who is on OWCP Disability payments — 3/4 of one’s gross pay if married or with dependents, or 2/3 of one’s gross pay if single without dependents – may well find the comfort of such payments and the security of such income to be relatively “safe”.  The old adage that one does not read the fine print during times of smooth sailing, and only begins to worry about issues when things go awry, is something to be kept in mind.  If a Federal or Postal employee is receiving OWCP Disability payments, and as such, one’s financial stability is somewhat assured because of it, that is precisely the time to be considering one’s future.  

OWCP Disability payments have a formal designation — it is called “Temporary Total Disability“.  The focus should be upon the first of the three terms — temporary.  It is not meant to be a permanent feature; OWCP is not a retirement system.  If placed on OWCP for over a year, the Federal Agency or the Postal Service will often separate and remove a Federal or Postal employee from the employment rolls of the Agency.  Once removed, the Federal or Postal employee has only up to one (1) year to file for Federal Disability Retirement benefits under FERS or CSRS.  Once that year passes, you cannot file.  Years later, when OWCP & the Department of Labor stop those “Disability payments” for whatever reason, you cannot then start thinking about filing for Federal Disability Retirement benefits under FERS or CSRS. You will be reminded that TTD stands for just that — Temporary Total Disability. It will then be too late.
