People study history for various reasons: the interest of other times, the peculiarity of other places — and yet the similarity of people no matter what the historical context.  Other places, other times, reveal to us the pattern of behaviors engaged in across time, cultures, historical contexts and prevailing dogmas which dominated a particular society, civilization or epoch of noted influence.  It gives us a perspective and, often for the good, a sense of knowledge that other places, other times are not too dissimilar from the one we are currently experiencing.

OPM Disability Retirement under FERS: Is There Enough of Me?

Whether consciously or not, that is the question we ask of ourselves.  Is there enough of me?  Meaning: Is life worthwhile such that the “me” exists substantially to reach a level of happiness, contentment and joy?

The worker, the parent, the friend, the husband or wife — they are certainly part of every person’s role within society, but there is a separate, private “me” that is defined by the uniqueness of each individual.  Perhaps the “me” part of one’s personhood is in the joy of reading; or of other hobbies and leisure activities, like hunting or fishing, or playing a game of cards, writing a short story, playing basketball, breeding dogs or just sitting in front of a fireplace with one’s dog.

These, and many other activities comprise a list of “me-things” which make for living in a society worthwhile.  Is there enough of me?  What balance within life’s daily grind and busy-ness would satisfy that question?

When the balance between work, obligations, responsibilities, mundane chores and sleep is disrupted such that there is not enough of “me” to be had, there is often the untold consequences of despair and depressive despondency.  In Japan, there is a term for this — Karoshi.  It literally means, “death by overwork”.  It is a state of being where there is clearly not enough of “me” within the daily living and routine of a person.

Somehow, like children and rats, or of mice and men, the peskiness of life continues to trail behind us.  We think that things are going well, and then suddenly we realize that the nagging peskiness of life’s challenges has once again come upon us.  We wonder when that period of nirvana will be reached; that goal that we allegedly strive for each day of our lives; when will it come to fruition?

Life is difficult, and it becomes all the more so because of the technology all around us that persuades, convinces and pulls the proverbial wool over our eyes by making us think that everyone else lives a life of perfection.

Yes, yes, we believe we are all so much more sophisticated than to be “taken in” by the lies of advertisements, instagram pictures and those ads that urgently scream at us to “Call Now!  Don’t miss the opportunity of a lifetime!”  But are we?  If we truly believe in the subconscious — and advertising agencies certainly do — why then would we discount the power of the subliminal message, the persuasive impact of repetition and the daunting images that haunt and pursue?

Movies and television programs tell us daily of the exciting lives of others; instagram photographs reveal that lives of perfection exist in all other households; Facebook postings establish that everyone but you live interesting lives; and the peskiness of life seems to just follow me and you, while the rest of the world merely splashes through the gaiety of life’s endless stream of summer laughs and winter’s avoidance of discontent where youth is never stretched beyond the smile of a springtime dream and old age never comes upon the drifting leaves of fall.

Then, of course, there is the medical condition that suddenly comes upon us — where peskiness of life becomes magnified by the reality of human frailty.

Attorney Representation Federal Disability Retirement: Struggles

It is a law of life, is it not?  To struggle; to always have to thrash about just to survive, whether in the world of employment, the world of self-control, the universe of just maintaining a semblance of sanity within a greater complex of madness we face each day?

And, indeed, that is the basis of most philosophical systems that have been posited – from the Ancients who posited permanence as opposed to constant flux (Parmenides and Heraclitus); of the tension between Forms and the world of appearances; of the universe of perspectives empowered between one’s spatial imposition of human categories as opposed to an objective reality that one can never reach (Kant); or merely reducing all philosophical problems to one of linguistic inconvenience (the British Empiricists); and on and on, the struggle to learn, to maintain, to survive.

Life is a constant struggle, and when once peace is attained, we then die, or at least retire to an old person’s home for the forgotten and the ignored.  Even the fairytales we read to our children begin with the struggle, then end with a world of make-believe; only, those types of endings don’t occur in “real life”, and so we have to explain to our children when they get older that, well…heh, heh, heh…it was all a lie – that, unlike the stories told, mom and I hate to tell you this, but the struggles in life never end.  There is no “happily-ever-after” after all.

Then, life brings about a medical condition – those pesky irritants that hopefully can be controlled or maintained with a pill or a stiff drink, but otherwise an indicator that either we are growing old or something in our bodies are trying to forewarn us of the future.  Then, the medical condition begins to magnify, exacerbate, and turn into that state of being “chronic”, and slowly, it begins to deteriorate and progressively impact how we feel, who we are, and what we can do.

For Federal employees and U.S. Postal workers who suffer from a medical condition such that the medical condition begins to prevent the Federal or Postal employee from performing one or more of the essential elements of the Federal or Postal job, the recognition that life is a constancy of struggles is nothing new; but, what is new is the realization that such a struggle now can become worsened by entering into arenas previously held inviolable – of work and the productivity that was once taken for granted.

Federal Employee Disability Retirement: Lack of time

It takes time in order to be “nice” and “considerate”.  We don’t have such a luxury, anymore.  We have been sold a bill of goods; that technology, Smart phones, computers, laptops, tablets; of the actual engagement in texting, emailing, and all of the multitudes of communicating by delight of button-pushing, will allow for man to pursue the creativity within, and to forego the toil of an otherwise working world. Then, we would reach the pinnacle of human ecstasy, of “time” enough to do that which we  were destined for.

And, yet…  Somehow, the promises made became empty vessels of contractual vacuity, and the social contracts so construed with ponderous delights, never reach a moment of fruition, and instead left us all with an emptiness of soul.

When a society begins to trumpet blares of social “rights”, and to utilize the political process and the courtrooms to assert the ability and capacity to force changes, then it is the step beyond moment of neighborly cohesiveness.  There have always been disputes within organizations, townships, blocks, etc., which have required mediation and third-party intervention; but, for the most part, the working order of a society depends upon common courtesy, decorum, and accepted conduits of conventional behavior governing personal conduct and public displays of geniality resulting in the glue which cements societal functionality.

But, that takes time.

It takes time to say “hello” and “good-day”; it takes time to know that The Stinsons down the way, or the Zachariahs or Abdullahs two houses away and four blocks to the left of the Smiths, respectively, have a child with pneumonia (as opposed to being fearful that such revelation of illness will be interpreted somehow as weakness of character), and the discourse of living should immediately invoke a response of care, concern and a grant of extended help.

But we don’t have time for all of that nonsense.

That mushy-gushy-goo of human relationships, where actual contact has to be engaged, and when picnics were once the commonality of congregation when children dressed in Sunday bests with butterfly nets in hand, flushed cheeks from the midday sun of dancing waves in the delight of a summer’s breeze, and neighbors actually stood face-to-face and reflected upon the concerns of others, and not faceless stoicism and the staid numbness within the cocoon of selfish wants and virtual realities of Pokemon and timeless pursuits of distractions unleashed but for the loss of connection with human contact, and thus of humanity itself.

But, that is because we lack the time.

For Federal employees and U.S. Postal workers who feel the loss of time and the lack of time, and where time seems to be “running out” like a spigot left unintentionally open and connected to a finite source of reserve – it may be “time” to prepare, formulate and file for OPM Disability Retirement benefits.

FERS CSRS Disability Retirement from OPM: Fatal Flaws

Nature is harsher than the artifices created by man; egalitarianism or empathy for the less fortunate, are not found as traces of widespread encapsulation of the essence of the wild; instead, the opposite is true:  of indifference, abandonment in the face of a wounded comrade, and flight as opposed to commonality of surrender.  It is only in the antiseptic universe of human civilization that we discover character, trust and fortitude in the face of threat.

Is this a fatal flaw in the humanity of the species?  Perhaps.  Time will tell, as civilizations rise and fall, as to whether the inherent weakness of totalitarianism will succumb to the overt unsteadiness of democratic institutions, and whether kindness wins out over betrayal, truth over falsity, and cruelty above warmth of favor.  Malignancy is considered nature’s retribution against the unsettling forces of dominance and survival; but as history shows, the linear nature of our thought processes rarely reflects the reality of how man proceeds.  There are fatal flaws in every aspect of life’s misgivings; but most are merely defects correctible by substitution of lack with that of an addendum to afterthought.

In a Federal Disability Retirement application, there will be times when the U.S. Office of Personnel Management requests additional information because of an obvious lack; while a response does not necessarily guarantee an approval of one’s Federal Disability Retirement application, attending to the request will often appease the desire for more evidence.  If a Federal Disability Retirement application submitted to OPM has been denied at the Initial Stage of the process, are any errors or mistakes ever fatal flaws?  Rarely.  It depends.  Likely not.

Qualification: Undoing something is often more difficult than its opposite cousin in the affirmative; blinders cannot be placed upon OPM once they have reviewed something, and we cannot pretend that they haven’t already formed an “impression” of a case.  But corrections, supplemental information and addendum to deficiency; these are all the tools available for the Second Stage of the process — the Reconsideration Stage.

Then, of course, there is the avenue of the Third Stage, if such corrections have been unpersuasive or ineffective; and that would be an appeal to the U.S. Merits Systems Protection Board, where an Administrative Judge would decide the case.  There is even a “Fourth” Stage — a petition before the full board of the U.S. Merit Systems Protection Board.  Beyond that, an appeal to the Federal Circuit Court of Appeals is also available, though the systemic losses in all of the previous forums identified, makes for a near-impossibility to reverse course at that level unless there are onerous legal grounds to argue.

As we pointed out at the begin of this parade of verbosity, natural law is lock-step in tune with the marching harshness (to remain true to the metaphor of parades, marching, bands, etc.) reflected by genetic deficiencies manifested as fatal flaws; but in the bureaucratic universe of administrative processes such as filing for Federal Disability Retirement benefits, the safeguards allowing for a multitude of due process steps rarely follows the trumpets and trombones (there again, that metaphor overplayed) of nature’s unforgiving ways.

Federal Disability Retirement: The Usual Dialogue

Much of our daily dialogue is determined by rote repetition.  Discourse throughout a typical day need not be given much thought; breakfast routine; interaction with colleagues and coworkers; declarative statements which have been repeated hundreds of times, both by one’s own voice as well as by others; salutations which require merely an audible sound; and the sun sets upon another closure of human inertia.

Then, some dialogues awaken the soul.  A sudden discovery of infidelity (though, given the pervasive appearance of popular culture, that, too, is quite commonplace); a perpetrated criminal act; a discussion with one’s doctor concerning a medical condition.  Even the latter, of course, from the doctor’s viewpoint, can be quite commonplace.  But for the Federal employee and the U.S. Postal worker who has been pursuing one’s Federal or Postal career for years, decades, etc., the self-realization that a medical condition may end the financial security represented by one’s job, is a traumatic event in and of itself.

All options for the future must be considered; and the daily dialogue of rote routine must be cast aside.  This is not a time for niceties; it is an event for thoughtful action.  Preparing, formulating and filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, whether one is under FERS, CSRS or CSRS Offset, is an affirmative step which one must pursue aggressively.

The inertia of past repetition of life’s puzzlements; the frightening prospect of an uncertain future; these must all be cast aside, and the reality of facing a time of forced creativity must be fully engaged.  And then, of course, there is the added anxiety that the administrative specialists at OPM will view your own application for Federal Disability Retirement benefits as just another ho-hum event, one which is merely part of their usual dialogue.

OPM Medical Retirement: Graven Images and Craven Homages

One concerns religious restrictions; the other, human tendencies emanating from deeply rooted psychological fears.  Both constitute acts which reflect a trepidation of purpose, and an anthropological study of human frailty.  The Commandment against graven images protects one to respect the sanctity of a singular teleological focus; homage by craven impulse, on the other hand, reveals the continuing connection to an enslaved state of mind, albeit one which may merely be emotionally binding and unfettered by physical force or threat of force.

Both make us pause; and question:  Do we continue to do this out of fear, and fear of what?  How much of human action — or inaction — is engaged in because of fear; fear of the unknown future; timidity of change; cowardly hesitation because change from the status quo may force one to alter the comforting monotony of daily routines.  Explicit adherence and unwavering allegiance to dictates of religious imperatives have conceptual distinctions to be recognized from mere secular responses growing out of a primordial foundation of fear; but still the question becomes, How does one define an image, and what are the borders which constrain that which is offensive?

Medical conditions tend to startle us from the quietude of daily repetition in life.  We tend to become even more religious in our adherence to routine, when the comfort of monotony is preferable to the conundrum of disarray.  But how much homage must one pay to one’s agency, or the U.S. Postal Service, before one’s soul has been desecrated by a blind fealty to the master of one’s employment destiny, where we begin to violate the commandment against graven images?

Medical conditions deplete and debilitate; in such a weakened state, we become even more vulnerable to the power of the agency and the harassing vitriol spewed by the U.S. Postal Service managers and supervisors.

Filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management allows for a separation from the vestiges of foregone fealties.  It is a termination from the consoling state of known quantities; but one which may ultimately have to be done in order to save one’s soul.  So long as one remains in the state of enslaved vulnerability, of being turned and twisted by one’s agency or the U.S. Postal Service, there is always the serious concern of the exacerbation of one’s condition, either because of the stress or hostility of complicating one’s medical conditions.

Federal Disability Retirement may not be the be-all and end-all solution for all Federal or Postal employees, whether you are under FERS, CSRS or CSRS Offset; but it is a step towards cutting the ties which bind, and which force us to pay craven homage or maintain graven images for fealty to a juggernaut which neither cares nor, in the end, consoles our souls.
