Federal Disability Retirement: The Dependence of Meaning

Wittgenstein believe that it was not possible to have a private language held by an individual alone; for, as language by definition is a means to communicate, any language which is kept in private from everyone else would be a meaningless tool.

Private, insular worlds are dependent upon their functioning upon the receipt by third parties to impart meaning and interaction; otherwise, left within the void and chasm of pure privacy, they remain nothing more than the slow drip of a distant echo of spring water deep within the hollows of an undiscovered cave.  For those of the rest of us who live and interact within a world of words, writings, and regulatory compendium of laws and statutes, the ability to convey meaning in a meaningful way is paramount for the successful progression of our every day lives.

For the Civilian Federal or Postal Worker who suffers from a medical condition, such that the medical condition prevents one from performing one or more of the essential elements of his or her Federal or Postal duties, conveying what one means becomes a critical exercise:  putting together an effective Federal Disability Retirement application to the U.S. Office of Personnel Management, whether under FERS or CSRS, in a manner which persuades and entitles, is the penultimate goal which must be accomplished.

How one gets from point A to point B; what material and evidence to compile and include; what legal arguments to bring up and point out; these are all elements which must be considered. Concurrently, the privacy of one’s medical conditions must be protected to the fullest; but that is where the compromise must be attained, between the private and insular world of necessity, and the public world of reality which must be encountered and engaged.

Federal and Postal Disability Retirement: Responding to Stupidity

Sometimes, one’s initial reaction in a situation — professional setting, social discourse, event gathering, etc. — requires a momentary pause; and it is precisely that couple of seconds of gathering one’s thoughts which saves one from further putting fuel upon a potential fire.

Perhaps you have every right to have responded with a drip of sarcasm; or others would have approved of the lashing back; and still others would say that the response was appropriate and deservedly given.  But the greater question should always be:  how effective was the response; did it evoke the necessary end; and for whose benefit was the aggressive retort given — for the benefit of truth, or for one’s own satisfaction?

In a professional context, of course, it is probably never appropriate to respond in an unprofessional way, if merely by definition alone.  Similarly, in a FERS or CSRS Federal Disability Retirement context, when one receives a denial from the U.S. Office of Personnel Management, there are statements made — whether one pertaining to mis-application or mis-statement of the law; or perhaps a wrong reference to a medical report; or even more egregious, a selective use of a statement from a medical report or record taken out of context — which can deservedly provoke a response involving sarcasm, a deluge of epithets, or worse, a barrage of ad hominem attacks — and in each case, it would be neither appropriately given, nor proper in a professional sense.

Fortunately, paper presentations and paper responses have the advantage of time over social discourse and person-to-person contact.

Holding one’s breath and counting 3 seconds, or 10, or perhaps an eternity, is an effective way of avoiding catastrophe.  Writing a diatribe of what one wants to say, then trashing it, is also acceptable.  On the other hand, beware of that “send” button; and, moreover, never push that “send to all” button.

That would indeed be unprofessional.

Federal Employee Medical Retirement: The Key to a Case

Often, when dignitaries or celebrities visit a particular city, they are recognized, applauded and sometimes “given the keys” to a city — metaphorically meaning that they are provided with certain benefits and access to such benefits.  It would be nice if, in every circumstance involving the necessity of identifying a key to an access, that we could figure out which key fits, in order to open the door to that previously-inaccessible entranceway.

In preparing, formulating and filing for Federal Disability Retirement benefits from the U.S. Office of Personnel Management, whether under FERS or CSRS, it is important to identify, recognize, and implement the “keys” to a successful outcome.  If one metaphorically views a Federal Disability Retirement application, then the application itself would be the key; the doorway which prevents access is the U.S. Office of Personnel Management; and the opening of the door is the successful approval of a Federal Disability Retirement application.

The “key”, then, is that which opens the doorway, and leads to eligibility of one’s Federal Disability Retirement benefits.  The focus of the Federal and Postal employee must be upon choosing the right key; crafting the proper implement; then ensuring that the instrument fits properly the lock which bars the entrance to the gateway of success.

Such formulation and compilation of the proper key in order to obtain access, is — to put it in trite form — the key to one’s success.  As such, it is important to put one’s effort in the timeline just before putting the key into the lock — i.e., in the formulation and preparation, of compiling the right data, arguments and documents, in order to possess and apply an effective application.

Federal and Postal Disability Retirement: Affirmative Steps

Being “aggressive” is often a misunderstood concept.  It is often taken to mean, “pushing people aside” or stepping outside the bounds of decency or acceptable behavior.

In filing for Federal Disability Retirement benefits under FERS or CSRS, the concept should merely entail the assertion of one’s rights under the law — of taking those affirmative steps in ensuring the best possible chances of obtaining an approval.  The old adage to a child is:  “Don’t undertake something unless you are going to do it well.”  The same concept applies.

In preparing a Federal Disability Retirement application under FERS or CSRS, whether a Postal employee or a Federal, non-Postal employee, one needs to take the necessary steps in order to ensure the best possible outcome — both before (preliminary steps, which often involves speaking to the doctors), during (reviewing the entire application packet, for instance, prior to submission, for viability and effectiveness), and after (protecting one’s Federal Disability Retirement benefits) the process.

Within the bounds of decency and acceptable behavior, one needs to always be aggressive in preparing for and filing a Federal Disability Retirement application under FERS or CSRS.

Medical Retirement Benefits for US Government Employees: Stating the Obvious

Sometimes, stating the obvious is necessary.  In filing for Federal Disability Retirement benefits under FERS & CSRS, and in dealing with the Office of Personnel Management, “stating the obvious” becomes not only a necessity, but a truism encapsulated in profundity surrounded by a simple rule:  the greater the obviousness, the more effective the Federal Disability Retirement application.

For the applicant under FERS or CSRS who files for Federal Disability Retirement benefits, who is unrepresented, it is best not to act as a lawyer.  While case-law and statutes abound as free information on the internet (and such information and discussion is certainly available on my website at FederalDisabilityLawyer.com and in various articles I have written on the subject), misinterpretation, misunderstanding, or mis-citation of cases, statutes, rules or regulations can easily be engaged in.  

While generally harmless, and further, since many at the Office of Personnel Management are not even aware of the laws and case-laws governing the very subject which they are supposed to rule upon, what is the point (one might ask)?  The obvious point is for the future — to always predicate a case upon the simple truism that one stage in the process may not be enough, and so building a foundation for the next stage, and the stage after that, by preserving the legal and factual arguments for an eventual appeal, is always a necessary evil one must perform.  State the obvious — and state it multiple times.
