OPM Disability: Demythologization of the Process

Beyond being an ugly word, Spinoza attempted it, but closer to the heart of a flawed hermeneutical approach, the theologian, Rudolf Bultmann spent his career attempting to separate the conceptually inseparable narratives encapsulating historical content, context and the meaning behind miracles and metaphor.

All processes are mysterious, until detachedly analyzed, devalued or debunked.  Some merely throw up their hands and reject a subject in its entirety; others spend a lifetime in trying to understand it, and thus do cottage industries emerge.  The peril of pursuing a discipline of futility is that, in the end, the process of one’s own actions may be just as inexorably a conundrum as that which one attempts to unravel; read a single, random paragraph from Heidegger, and one immediately understands such a declaration of frustration.

Often, for Federal employees and U.S. Postal workers, the prefatory statements of confusion abound:  ” I’ve heard that…”; “OPM always …”; “Is it even worth it to…”  But there is indeed a practical difference between the bureaucracy itself, and the bureaucratic process; the former is merely a juggernaut of an agency which is impenetrable because of the nature of the Federal system; the latter is an administrative process replete with multiple layers of statutory and regulatory devices which are complex in their compendium of requirements.

Filing for Federal Disability Retirement benefits by the lay person, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, is a complex, puzzling and often overwhelming process.  It can be likened to handing a complex transactional law case involving multiple Fortune 500 companies attempting to merge for purposes of avoiding specific legal entanglements to a first-year associate; mistakes are bound to be made, as one fails to recognize the inherent complexities or the need to draft preventative safeguards.

Further, when a medical condition already weakens the physical stamina of the Federal or Postal employee, and tests the limits of one’s cognitive acuity, the ability and capacity to engage a large and complex bureaucracy can be, at best, a challenge.

Filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management is analogous to the hermeneutical approach of attempt to demythologize a sacrosanct text of unyielding historical import; the difference from theology, however, is in the pragmatic need and practical residual consequences foretelling; and as they say in the fine-print warning of some advertisements, you should probably not try this on your own.

CSRS & FERS Medical Disability Retirement: Insipience

The thread of differentiation and conceptual distinction can be based upon a mere sliver.  In practical life, pausing a moment because a person forgot his or her keys, can result in avoiding a chain of events terminating in causal calamities, merely because the time differentiation as a consequence of the slight delay allows for time to alter the historical ripples of cause and effect.

Words and conceptual distinctions can have similar minutiae of differentiations.  Linguistic gymnastics and elasticity aside, the word “insipience” conveys a meaning of being foolish and lacking of wisdom.  Changing a single consonant, and instead transforming the word into “incipience”, suddenly alters the concept into one encompassing origination and beginning stages.  Upon closer inspection, however, such a singular change of a consonant resulting in a radical alteration of meaning explodes with a recognition that the two are closely related: That which is in its beginning stages is often lacking of wisdom, precisely because little or no thought or reflection has been allowed.

That is precisely why the beginning stage of a process is so important — because it lays the foundation for all that follows. For Federal and Postal employees who suffer from a medical condition, such that the medical condition begins to impact one’s capacity to perform the essential elements of one’s job, the importance of beginning the sequential procedure of formulating an effective Federal Disability Retirement application cannot be overly stressed.

Federal Disability Retirement is a submission which is reviewed by the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS or CSRS.  As such, the reviewing process is accomplished be an agency separate and distinct (in most cases) from the one the Federal or Postal employee is employed by.  The early stages of formulation and preparation in a Federal Disability Retirement application will provide the necessary and important foundation for the successful outcome of a Federal Disability Retirement case.

It is thus the incipience of formulating and preparing a Federal Disability Retirement application, which will determine whether or not the outcome will be insipient, or not.

Federal and USPS Disability Retirement: First Impressions

The older generation often refers to the importance of “first impressions” — of the firmness of one’s handshake; of whether eye contact is made to betray secretiveness; the clothes one wears; tattoos and the number of body piercings; all are evidence of first impressions left for future judgment.

While such initial encounters may not reveal the true “inner” person, they nevertheless leave an indelible and lasting imprimatur upon those who rely upon such an approach.  Whether one likes it or not is besides the point; first impressions are psychological realities which one must deal with in this harsh world.

For those who prepare, formulate and file for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, whether under FERS or CSRS, the Federal or Postal applicant must understanding that one’s formulation of one’s case is merely one of thousands, and the Case Worker who is assigned to the case, upon an initial review and analysis, will be left with such a first impression.

The methodology of evidentiary presentation; the conciseness of the Statement of Disability; the coordination and support of the medical evidence; all will depend upon the manner and content of the presentation.  Too many tattoos, and the grandmother-characteristic in the Case Worker may turn up a nose; not a firm enough handshake, and the old-man sense in another Case Worker may pause with concern.

First impressions; it is how one approaches a case, as much as the presentation of the evidence, in preparing, formulating and filing for Federal Disability Retirement benefits from the U.S. Office of Personnel Management, whether under FERS or CSRS.

Disability Retirement for Federal Workers: Insular Worlds

The private domain of individual, insular worlds always remain unknowable and profoundly unreachable. We can extract common linguistic signposts to have some superficial encounters, with at least a semblance of comprehension; but in the end, can one ever “know” the sensation of pain which another experiences? Or the extreme emotional turmoil that a person who suffers from schizophrenia or Bipolar Disorder; the diffuse pain of a person suffering from Fibromyalgia; or the cognitive dissonance of one beset by Major Depression, uncontrollable anxiety or panic attacks?

Yet, it is a necessary step in preparing, formulating and submitting a Federal Disability Retirement application to the U.S. Office of Personnel Management, whether under FERS or CSRS, to have the ability to convey, delineate and describe the nexus between one’s experiential phenomena of the insular world of a medical condition, and one’s external encounter with the Federal position in the work-world.

The private chaos of one’s medical condition must be linked to the public display of one’s physical or mental capacity and capability in the employment with the Federal Sector or the U.S. Postal Service; how one makes that connection, the manner of the description, and the characterization of the impact of the former upon the latter, will make all the difference in the world whether or not that unique universe of insularity can be protected from the progressive harm of one’s job.

For, in the end, it matters not whether one can adequately relate to another’s medical condition; it is enough to know that the private domain of one’s life is that which makes human consciousness the unique mystery peculiar to the human animal.

Disability Retirement for Federal Workers: Trying to Act “As If”…

One can act as if a mistake was not made; the problem exists, however, and continues to impact, with the assumption that X did happen, despite one’s best attempts at ignoring the occurrence.

Thus, when the question is posed to the undersigned attorney whether it would be “okay” to try and file for Federal Disability Retirement benefits, whether under FERS or CSRS, from the U.S. Office of Personnel Management, on one’s own, and if it is denied, to then seek the assistance of an attorney, the short answer is, “Of course”.  The silent “but” and qualifier is never necessarily posed or queried.

The caveat is a simple one:  While most mistakes are correctable, there is one thing which cannot be done:  one cannot put blinders on OPM for what they have already received and reviewed.  We cannot play “as if” OPM did not review that specific document which implied a situational disability; or the one which characterized a medical condition as one which “waxes and wanes“; or referred to certain elements in terms of possibilities and potentialities; and other such equivocating conceptual paradigms.

The world of OPM, Medical Disability Retirement, Federal employment issues, etc., does not allow for the playing of the “as if” game.  Thus, to the question of going at a Federal Disability Retirement application alone, yes, we can play as if the Federal or Postal employee will do everything properly; but when the consequences come back with a negative result, we cannot then play as if we are back at the starting gates of the race; we have already entered into the fray, and must deal with the facts as they now exist.

OPM Disability Retirement: Tidbits

The term itself is an interesting one; for, unlike its corollary, it refers to the “choice” or “pleasing” morsel of food, as opposed to “leftovers” or “crumbs”, which imply food which has either been rejected or left behind after the table sitter has made the prime decision.  “Tidbits” in its secondary meaning, of course, implies information; the conceptual applicability has transferred from one within the exclusive context of foods, to include information, facts, statements, etc.

Thus, a tidbit:  In preparing, formulating and filing for Federal Disability Retirement benefits under FERS or CSRS, from the U.S. Office of Personnel Management, it is important to understand and recognize that, while most mistakes in the preparation and filing of a Federal Disability Retirement application are “correctable” (what an ugly word — both in appearance and in phonetic structure), what one cannot do is to put “blinders” on the eyes of OPM or before an Administrative Judge, once certain information has been submitted to OPM.

Thus, if an individual wants to attempt the First Stage of the administrative process of filing for Federal Disability Retirement on his or her own, without the assistance of an OPM Disability Attorney, thinking that it is an “easy” case, that is all well and good, but while the tools of representation for an attorney include use of the malleability of language, such that “linguistic gymnastics” will be engaged in as the primary sport of the attorney; nevertheless, elasticity of language does have its limits.

Facts, once exposed, can be explained and amended, but the essence of the fact or statement remains in the hands of OPM.  This constitutes and comprises the tidbit of the day; a choice and pleasing morsel?  Perhaps not in consequential substance, but hopefully in terms of informational relevance.  Ah, but to have been offered instead a morsel of apple pie!

Medical Retirement for Federal Workers: When a Mistake is Made

Mistakes made in preparing, formulating and filing for Federal Disability Retirement benefits under FERS or CSRS, from the U.S. Office of Personnel Management, are usually correctable, and for a number of reasons:  most mistakes merely require additional clarifications; some “mistakes” are only apparently so, but substantively valid otherwise; and ancillary mistakes of an innocuous nature can reflect the inconsistencies of reality, as opposed to a direct contradiction between two or more persons.

While blinders cannot be placed upon the Case Worker at the Office of Personnel Management once a Federal Disability Retirement application has been submitted, nor does it usually require such drastic measures.

The question to be asked, of course, is whether or not the alleged “mistake” should be addressed, to what extent, and how prominently?  For, the old Shakespearean adage that “thou protesteth too much” can apply in a Federal Disability Retirement application, where too much emphasis upon a particular issue can unduly magnify the issue itself, as opposed to dealing with the issue in a passing manner.

Thus, a statement made in the Applicant’s Statement of Disability, or by a treating doctor, which indicates an undermining of meeting the legal criteria of eligibility in a Federal Disability Retirement application, should probably be addressed.

A direct statement made in a Supervisor’s Statement may or may not be relevant.  Often, such statements are merely opinions meant to undermine a Federal Disability Retirement application, but whether it is worth addressing is a discretionary issue.  The real issue concerning discrepancies or mistakes have to do with who is making it into a loud noise; and the one who makes the loudest noise, is often the one who attracts the greatest attention.
