Postal & Federal Employee Disability Retirement Benefits: When Curiosity Fades

It is that compelling feature for animals and humans alike (if one is to make a distinction between the two); of an innate sense for the extraordinary, and a need to figure out change, reveal the hidden vortex of anomalies, and uncover the mystery behind the curtain.  Shakespeare made reference to the known proverb in Much Ado about Nothing, and it was originally meant as a forewarning for those who meddle in other’s affairs; but it is curiosity, indeed, which maintains an evolutionary compulsion to strive forth, to manifest life and liveliness in the face of dull acceptance and loss of inherent inquisitiveness.

When other concerns begin to intersect and overtake, is when such features meant to enhance survivability and adaption begin to diminish.  Life and its exhaustive characteristics, especially in modernity, can result in the uncharacteristic feature of disinterest and dismay.

Whether the injury or medical condition portends first, or the sense of abandonment in prefatory congealment, the fact is that life and its inherent stresses can be like a weight of seemingly insurmountable burdens crushing in its suffocating pervasiveness.

For Federal employees and U.S. Postal workers, the heightened stress imposed by increasing steps of adverse actions, punitive measures and letters threatening discipline and termination, can be daunting and devastating.  Dealing with a medical condition itself can be a full-time endeavor, and can sap the life, energy and reserve of vitality for even the strongest of individuals.

When the medical condition begins to prevent the Federal or Postal worker from performing one or more of the essential elements of one’s positional duties, it is time to take stock and inventory of one’s choices, which are normally limited to three:

(A)  Stay with the agency or the U.S. Postal Service, and allow for the progressive diminution of that peculiar trait called curiosity for life, (B) Wait for the adverse actions to increase in systematic advancement of punitive impositions, or (C) Begin the process of preparing, formulating and filing for Federal or Postal Medical Retirement.

The shell of a man did not become so in one fell swoop; rather, by incremental destruction, like a child taking apart a completed puzzle piece by piece.

Filing for Federal or Postal Disability Retirement benefits through the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS or CSRS, is often the first step towards regaining a piece of one’s sanity, one’s physical well-being, and one’s “wholeness” of being a human being; and contrary to the common perspective that curiosity killed the cat, it is almost always the exact opposite:  it is the Federal agency or the U.S. Postal Service which kills curiosity, which is the underlying force and beauty of a life worth living.

FERS & CSRS Disability Retirement: Devising Escape Routes

What a person spends his or her time doing away from work, reveals much as to how one’s work will be accomplished.  If one attempts immediately to build protective walls around the core of a project in an effort to stave off potential marauders, as opposed to focusing upon the substantive essence of the idea itself, then perhaps the vulnerability of the project itself will begin to manifest.

Our own fears often overwhelm; but healthy fear can be a positive use of an evolutionary tool meant to apprise and alert.  It is only when it becomes an impediment and obstacle for progress and advancement that our own self-immolative actions begin to impact our capacity to grow.  There is a delicate balance between healthy fear and that which lends itself to self-destruction.  Proper evaluation and analysis of a circumstance or situation is required in order to establish the former; for the latter, a groundless allowance without facts or evaluative input.

For Federal employees and U.S. Postal workers who suffer from a medical condition, the question often becomes, At what point do I begin to consider escape routes?  Do I need to devise them, or are the mechanisms already in place?

Escape routes are devised in response to dangers present; and often it will appear as if the manifestation of a medical condition will bring out the worst in others.  Isn’t that an anomaly in and of itself — that one’s own deterioration of health will impact the behavior of others, in a derogatory manner?  But that is precisely what a “stress test” is for, is it not?  It is never in the best of circumstances that reveals the true nature of a thing; rather, it is under adverse conditions which unravel the artificial appendages with which we camouflage.

Filing for Federal Disability Retirement benefits, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, is somewhat like an “escape route”, in that it allows for the Federal or Postal employee to exit from the adversity of circumstances, and plan for one’s future.  One need not “devise” it, to the extent that it is “already there” — a benefit for all Federal and Postal employees who have a minimum number of years of Federal Service (18 months for those under FERS; 5 years for those under CSRS).

For the Federal or Postal employee considering such a route, the priorities of life should always prevail:  Focus upon one’s health in an effort to remain (for those who are beset with a medical condition which is “work-related”, filing for Federal Workers’ Compensation benefits may be the first option to consider); then, if it becomes clear that one’s medical condition is impacting the ability to perform one or more of the essential elements of one’s job, and that the medical condition will last a minimum of 1 year (and it should be emphasized that one does not need to wait for a year in order to determine this aspect; rather, it is merely a medical prognosis that the medical condition will likely last at least 12 months or more that is required), consideration should be given to preparing, formulating and filing for Federal Disability Retirement.

In the end, it is not a matter of devising escape routes, but rather of recognizing the limits of human endurance, evaluating one’s place within the context of growing adversity, then acting upon those exit points available and allowable — then to make a proper decision for one’s self, and for one’s family and future.

Federal Worker Disability Retirement: Stress, Anxiety, Depression…

Stress is often the noun which triggers.  As the originating causation, it is often considered the evil cousin who brings about other ailments. It is a state of mental or emotional strain which is encountered under extraordinary circumstances, often hostile in nature, and involving a lack of calm or quietude.

Workplace stress is a reality of the modern technological age; hostile work environments have been identified as causative agents of stress; and demands for overburdened, repetitive work habits contribute exponentially.

While the goal for a “stress-free environment” is generally unattainable and a mythological state existing only in one’s imagination, it is thought from a medical perspective that engaging in stress-reducing activities, whether incrementally throughout the day, or during one’s leisure time, remains an important facet of healthy living.

The noun which triggers — stress — is that which, if left unchecked, can result in the debilitating effects of an explosion of psychiatric (and physical) medical conditions, including (but not limited to) anxiety, depression, suicidal ideations, homicidal thoughts, intrusive nightmares, Post Traumatic Stress Disorder, gastric and abdominal dysfunctions, chronic and profound fatigue, general malaise, chronic pain, debilitating migraine headaches, and a host of other medical conditions.

At some point, when the seriousness of a medical condition brought about by stress cannot be relieved or reduced through pragmatic means of altering key components which cause the stress, then complete removal from the stressful environment must be considered.

Generalized anxiety disorders appear in physical and psychological ways. Headaches are a possible physical symptom. So are muscle aches, sweating, and hot flashes.

Federal Disability Retirement, available for all Federal and Postal employees who have the minimum number of years of service, whether one is under FERS or CSRS, and filed through the U.S. Office of Personnel Management, must always be considered when one’s medical condition — whether triggered by stress or some other causative agent — begins to impact and prevent the Federal or Postal employee from performing one or more of the essential elements of one’s Federal or Postal position.

Sometimes, when the visiting cousin who carelessly and thoughtlessly spreads germs and destructive diseases comes for a short visit, subtle hints as to the unwelcome nature of the visit may simply fail to move.  In such cases, it is time to move out, leaving behind the unwanted cousin to drown in the misery of his own making.

Stress is that pernicious aura, neither visible nor definable, with a spectrum of tolerance particularized by individuals, and which pervades silently and invisibly but for the manifestations through physical reactions. It can lead to both physical ailments as well as psychiatric turmoil, requiring medical management ranging from prescription medications to hospitalization.

Who among us knows where the “breaking point” is, for a coworker, Supervisor, etc.? Are there signs of stress where one could have predicted the actions or reactions of another? As a silent killer of incremental gnawing, stress impacts different people in variegated ways, and can often be the primary foundation for multiple medical conditions, but rarely diagnosed as such.

Stress in the workplace, of course, carries over into personal lives, and conversely, people who experience exponential quantification of stress in one’s personal life, will carry it into the professional arena despite monumental efforts to contain it.  Stress can be the exacerbating force in compounding and complicating already-existing medical conditions.

While stress itself, standing alone, becomes a problematic issue in which to base a Federal Disability Retirement application upon, because it points to the potential of being “situational” and therefore contained within a particular work environment; nevertheless, stress can be, and often is, a part of any Federal or Postal Disability Retirement submission.

Federal and Postal employees can become eligible for OPM Disability Retirement benefits, whether under FERS or CSRS, if it can be shown that one’s medical condition prevents you from performing one or more of the essential elements of one’s job.

What role stress plays in such an application; how it is characterized; the manner in which it is presented; where in the compendium of medical conditions it should be stated — all are important in the complex narrative presentation of a Federal Disability Retirement application, for any Federal or Postal employee who is considering filing for the benefit of Federal Disability Retirement.

In the end, however stress is described, one thing is certain: it plays a large role in everyday lives, and pervades as oxygen and toxins alike permeate the atmosphere of the air we live in and of which we breathe.

CSRS & FERS Medical Disability Retirement: Development

Aristotle speaks often in terms of the spectrum between potentialities and actualization, revealing the philosophical concerns surrounding man’s ability to discern reality from appearances, scientific certitude as distinguished from mere opinions; and, in the end, the capacity to bifurcate truth from falsity. As Pre-Socratic philosophy brought out the problems of an ever-changing world, with Heraclitus and Parmenides as two classic examples of the focus of inquiry, so the underlying and common thread remains even with us today: How, in an ever-changing universe, do we attain some semblance of static certainty?

Medical conditions tend to bring to the fore a sudden change which is not merely problematic, but impacting upon all sectors and areas of one’s life. The quietude of the normal and mundane is suddenly turned upside down; that which we relied upon, and for which we worked so hard to achieve, are all suddenly in a state of disarray and disruption.

As certainty is the harbinger of security, so constant flux remains the loosened bolt which potentially unhinges such security. That is why, for Federal and Postal employees who are in the “development” stage of either preparing, formulating or in the process of filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, whether under FERS or CSRS or, in the long and arduous “waiting” stage in anticipation of a decision to be rendered by OPM, a constant sense of anxiety and angst prevails, precisely because the lack of certitude in bringing about stability is presently ever-pervasive in one’s thoughts. Perspectives are important in the quest for truth.

Both Plato and Aristotle recognized the subjective factor of perceptual idiosyncrasies amongst species.  Development of a case for Federal and Postal Workers who are filing for Federal Disability Retirement benefits, will continue to remain in a state of flux, uncertainty, and insecurity. And like the metaphorical river into which Heraclitus walks, revealing the constancy of change and stream of flux, until a decision is rendered by OPM, life remains a metaphor for development into the unknown.

Federal Employee Medical Retirement: The Calendric Term

The marking of a calendric year, and its end, is traditionally recognized by an enthusiastic celebration embracing drinking, noise and a quantity of hugging and kissing.  Whether the year contains anything to celebrate is irrelevant (some would say that all years, like puppies and aged whiskey, are inherently precious); and some years are magnified by shaping events which deserve greater recognition and celebration than other years, but it seems to matter not to the participatory celebrants.

For the Federal and Postal workers who suffer from a medical condition, such that the medical condition impacts one’s ability to perform the essential elements of one’s job, the day before the end of a calendric year differs little from the day after and the beginning of a new calendric year.

The pain and medical condition fails to recognize the distinction between the before and after.  It is perhaps well that we celebrate when health, time and opportunity allows; for, our time within the confines of a given lifespan is short enough, and every day can therefore be viewed as a moment to celebrate.

For the Federal or Postal Worker who must contemplate filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, however, the time is often dictated by events beyond one’s control, and must be seen not in the light of sequential days on a calendar, but rather, in light of today and what tomorrow might bring, regardless of the month or year.

Calendric bifurcations of time, seasons and years are meant for the sequential thought process; for others who suffer, each day is measured by what the next day will bring.

CSRS & FERS Medical Disability Retirement: Negation within an Insular Universe

Real ghosts exist in the minds of those who remember.  It is the negation within a man’s mind; the presence of someone or some entity which is retained in memory, which is negated in the objective, physical world, but whose image continues to haunt us precisely because of the ability to remember, which allows us to perceive ghosts in a universe which otherwise fails to recognize them.

When the last Civil War veteran died, the ghosts of that event disappeared.  When the final WWII veteran departs in peace, the screams at Normandy will have quieted.  For the rest of us in the physical universe, it is only the momentary manifestation through a tear drop making its way down the subtle canals of aging creases on a person’s face, which allows for us to make contact within that insular world of memories.

For the Federal or Postal Worker who suffers from a medical condition, such that the medical condition prevents him or her from performing one or more of the essential elements of one’s job, it is often a hidden pain deliberately concealed; or a psychiatric condition which manifests itself in emotional immobility; but it is merely through performance and other indicia by which we gauge whether something is amiss or not.

Whether one’s coworkers or supervisors believe in the ghosts haunting the Federal or Postal Worker is besides the point; taking care of one’s medical condition is and should be foremost, and filing for FERS Disability Retirement benefits through the U.S. Office of Personnel Management is a step which often must be taken in order to pursue a rehabilitative path for one’s future.

The negation which one experiences — of that which no longer is — because of one’s medical condition, is real enough; concealing it will only further harm and haunt, and preparing, formulating and filing for Federal Disability Retirement benefits is often the first positive step in expunging the ghosts which haunt one’s life.

CSRS & FERS Medical Disability Retirement: Choices

One immediately hears it in the voice — of the frustration and desire to simply give up.  But “giving up” is simply not a choice, if one refuses to acknowledge such an option and fails to place it on the roster of listed alternatives.  Part of the human factor in preparing, formulating and filing for Federal Disability Retirement benefits from the U.S. Office of Personnel Management, is the chasm of the unknown.

No, there is never a guarantee that one’s Federal Disability Retirement application will be approved, just as there is never a certainty that one’s treating doctor will support the patient’s need to apply for Federal Disability Retirement benefits.  It is the unknown — from whether the application for Federal Disability Retirement benefits is sufficient to obtain an approval from the U.S. Office of Personnel Management, to whether the doctor’s report is “strong enough”; from what steps the agency will take to try and undermine a Federal Disability Retirement case, to the long and seemingly endless wait while one’s case simply sits on the desk of some Case worker at the U.S. Office of Personnel Management — the aggregate of all of these constitute and comprise the “unknown”.

There are cases where a thin sliver of medical documents result in a quick and uncomplicated approval; others, where a voluminous binding of reports, diagnostic tests and medical records result in scant attention and a denial. Often, it seems somewhat arbitrary.

It is the “unknown” and “unknowable” factors which heighten the time of anxiety.  But through the entire administrative process, the singular choice should always be clear:  to move forward.  And sometimes, to do so is to merely wait, and disregard the unknown or unknowable.

Disability Retirement for Federal Workers: The Anxiety of Procrastination

In preparing, formulating and filing a Federal Disability Retirement application under FERS or CSRS, there are numerous issues, points, time-frames,etc., during the administrative process, when a Federal or Postal employee’s anxieties may become exacerbated — both because of the inherent complications resulting from the process itself, as well as because of what others do.  Many of the complexities which arise are beyond the control of one’s capabilities.  Thus, if one is accustomed to having some “control” over events and circumstances, it can quickly become a process full of anxieties, exasperation and frustration.  

Time is often beyond one’s control — the time the Agency takes to fill out their portion; the time a doctor responds to a request for a medical narrative; and, finally, the time that the Office of Personnel Management takes in reviewing and rendering a decision on a Federal Disability Retirement application.  

One point of frustration which often builds without ceasing, however, is within the control and capacity of all Federal Disability Retirement applicants — procrastination.  Procrastination merely delays the inevitable, and compounds the complexities because it merely allows for outside difficulties and problems to continue to build, without resolution.  If the need arises to begin filing for Federal Disability Retirement benefits under FERS or CSRS, procrastination should not be part of the game plan.  This is especially true because the Office of Personnel Management is a bureaucracy which takes a long time itself, and procrastinating at the front-end of the process will only delay things further at the back-end.

CSRS & FERS Disability Retirement: The Decision (Again)

Yes, it is a difficult decision to make — to come to terms with filing for Federal Disability Retirement under FERS or CSRS.  It makes it all the more difficult when individuals wait until the last possible minute before calling up the attorney (me) to file for Federal Disability Retirement benefits.  There have been a few times in the past (very few) when I simply could not take on a case with only a week left before the Statute of Limitations runs out.  The only thing I can do at that point is to identify which forms to fill out (however imperfectly), and give the fax number and the address to Boyers, PA for the individual to file. 

Remember the important point:  You can always make factual, medical and legal arguments after you have filed; you cannot make any arguments if you have failed to file on time.  Of course, it comes with the territory — as an attorney who exclusively represents Federal and Postal employees to obtain disability retirement benefits (there are many attorneys who practice Federal Disability Retirement law as one aspect of a larger practice which includes other areas of Federal Employment law), I understand how intertwining the medical condition is, with the anxiety and stress of filing for Federal Disability Retirement benefits, and how procrastination is often part and parcel of the medical condition itself.  At the same time, however, I take pride in doing a good job; I like to service my clients; I like to see the successful outcome.  As such, I am reluctant to take on cases where there is very little time to file.  I have, and will, take on cases where the Statute of Limitations is about to run out, but there must be at least some time left.
