OPM Disability Retirement Law: The Retrospective

There is a proportional increase as one experiences a greater linear accumulation; some would call it a heavier luggage to carry; others, of a more cynical nature, would term it as mere “baggage”.

There is a natural inclination — a deliciousness, if you will — in letting the retrospective rule; for, whether of a trauma or of joyful memories, the retrospective as something which has already passed, is passive by definition and can no longer actively harm us.  Furthermore, it is important to have an objective, true view of the past, and not allow our imagination to warp or otherwise overstate the experiences of the past.

For Federal employees and U.S. Postal workers who suffer from a medical condition such that the medical condition prevents the Federal or Postal employee from performing one or more of the essential elements of one’s current job, it is important to provide a concise retrospective of one’s medical condition, but more importantly, to delineate the current impact.

We, all of us, are never “just”, as pigeonholed by nameless and countless others.  “Oh, he’s just…”.  “Oh, her?  She just….”

We fight against such restrictive categories; for, to be “just” is to be minimized, cast into perpetual irrelevancies, and forever “just” that which we just cannot be relegated to.  To just be the doorman, the janitor, the Project Manager, the Civil Engineer, the top-ranked Electrical Engineer — it is the narrowing designation of the “just” which underlines the injustice of it all.

There are, of course, exceptions — as when your son or daughter is overhead to say, “Oh, he’s just Dad” or “Nah, she’s just Mom”.  Then, of course, the “just” can bring a smile and the warmth of love; for, to be “just” a parent to one’s child is the rare time in life when reduction strips away all complications of life and reveals the straightforward, unfettered nature of a special relationship.  But in all other contexts, the “just” of reduction fails to encapsulate the greater complexities of the uniqueness of an individual.

For Federal employees and U.S. Postal workers who suffer from a medical condition such that the medical condition prevents the Federal or Postal employee from performing one or more of the essential elements of one’s Federal or Postal position, the “just” label has likely become somewhat akin to: “He’s (or She’s) just someone who constantly fails to…”.

Office of Personnel Management (OPM) Disability Retirement: The Idiot

Of course, it is the title to one of Dostoevsky’s lesser known works — or one which few have read.  The author, of course, is the great Russian novelist — who wrote long and arduous depictions of psychological compendiums that only a person of great patience can read.

It is assigned in some high schools; perhaps, still in some colleges; then, after exiting the world of academia, it is quickly forgotten.  It is like many books: claimed to have been read by many, but which are actually only glanced by a very few.

There are other books similar to it: Not in plot or character, but in the fact that few read them — Tolstoy’s works; Arno Schmidt’s, Bottom’s Dream; and others.  But of The Idiot — its central character is a man who is simple and good, but it is in his simplicity and goodness by which people question his intellectual intactness.

And there is a point to that, isn’t there?  We have become so tainted with cynicism that we equate moral virtue with cautionary ineptitude.

We grumble and complain about “losing” an hour in Spring’s moving forward for the time change, and are glad to accept the “gain” of it in the Fall.  In either case, we recognize that we have neither lost the hour, nor gained it; it is merely the artificial alteration of clocks uniformly and by international agreement accepted.

The true loss is in the delay of time — of our actions, our thoughts, our lack of initiative in moving forward when necessity dictates a change in our lives.

FERS Disability Retirement: The Inevitability of Change

It is a tautology; for, “inevitable” encapsulated and embraces the term “change”, and one presumes that, in applying and comprehending the word “change”, there is a sense of inevitability contained within it.

Thus do we assume certain truths which naturally follow: If you don’t like the weather, just wait a moment (for, the natural course of the universe dictates that the weather will change over time); if you are dissatisfied with your life today, ride it out (for as circumstances appear static for the moment, time will resolve many of the uncertainties faced today); and similar dictums of sagely advice.

What we are not told, however, is that which we have already accepted by experience:  That “change” is too often a negative component, and that is why we believe that things almost always change for the worse.  That is the byline for the pessimist, of course: That good things never last; everything changes for the worse.  The optimist, on the other hand, always tries to squeeze the good out of anything that worsens, and tries to see the glass as half full, instead of half empty.  Whether you are an optimist or a cynic, both accept that change is inevitable; the difference is merely in how one perceives the change.

Then, of course, there is the human element — of affirmative actions taken by an individual or a multitude of individuals in performing acts that contain or otherwise alter the course of change.

OPM Medical Retirement under FERS: The Promise

Can you make a promise to yourself?  What would that look like?  Would it be valid and binding?  If not, how would we “prove” it?  Perhaps in a similar manner as Karl Popper’s “falsification” approach — of being able to come up with conditions under which a theory or a posited application can be “falsified”?

Take the following hypothetical: A man sits in a cafe and is clearly upset; perhaps he makes unconscious heaving sounds, and tears stream down his face.  A friend of his happens to visit the cafe, enters, sees his friend in distress and sits down at the same table, uninvited.  “What’s the matter?” the friend asks out of concern.  Hesitant but clearly wanting to share his feelings, the individual queried answers, “I broke a promise, and I feel really terrible about it.”  Pausing — for, despite being his friend, this particular person has a reputation for exaggeration and overstatement — he forges onward bravely and asks him to “share” his story, believing that empathy is the better part of valor.  “Well, I made a promise that… [and the reader can fill in the blank following the ellipses].  And I broke it.”  The friend, concerned and puzzled, asks: “And who did you make the promise to?”  The distraught Person A looks up, tears still streaming down his face and states calmly, “To myself, of course.”

Can such emotional turmoil remain commensurate with the fact of a broken promise made to one’s self?  Can a unilateral promise be binding, or can it be broken with as much ease as the creation of it in the first place?

We all make promises to ourselves, and perhaps an argument can be made that the very essence of “character” and “integrity” is revealed in how scrupulously one abides by those promises made and kept by and to one’s self — even if others don’t know about it.

Federal Employee Disability Information: Favoritism

There was an interesting article the other day, where certain public schools were attempting to banish the use of the term “best friend” from the ordinary and daily usage by students.  Now, the immediate reaction by some would be:  Uh-oh, here comes another “politically correct” movement that is based upon the foolish idea that social engineering can be attained merely by manipulating language’s daily discourse by simply expunging the vocabulary we engage.

That is what Orwell’s point was, isn’t it — in that part in his novel, 1984, when there is the discussion of the New-speak dictionary that would be coming out in the fictionalized society of Oceania — of a dystopian world that determines thought by controlling the available words we use?  By expunging and extracting, diminishing and destroying certain words, phrases, concepts, etc., we then limit the ability of an individual to engage in certain thoughts — thereby restricting and ultimately erasing any capacity to discuss and communicate such conceptual constructs.

Some positive idealists would believe that human creativity would somehow remain victorious over such totalitarian methods, and find ways to communicate, then create “new” ideas — newer than the anomaly and counter-insurgency of New-speak — and still come up with alternative words and phrases to replace any such attempt at erasure and extinguishment.  But even Orwell doubted the success of such an endeavor, no matter how hard we try; and thus the dark ending to the novel, 1984.

But back to “outlawing” the references made on the playgrounds all across the country or, likely, across the spectrum of the world — would two or more children still engage in the behavior of “best friends” regardless of the expungement of the language identifying it as such; and if so, what would be the purpose of extinguishing the language if the underlying act itself continues to remain?  Won’t children on playgrounds the world over engage in favoritism and concomitant exclusion because unexplainable attraction is the natural order of the universe?

Of course, social engineering initiated at an early age has a purposive direction which can be seen in later life — as in the Federal employee and U.S. Postal worker, where favoritism prevails no matter how many laws, statutes, regulations etc. are imposed and upheld.  Fiefdoms of every kind will always exist, and totalitarianism will often prevail.

For Federal employees and U.S. Postal workers who suffer from a medical condition where the medical condition begins to prevent the Federal or Postal employee from performing one or more of the essential elements of one’s Federal or Postal job, the concept of “favoritism” — growing out of the tender years of “best friends” but taking on another name and form — begins to take on greater meaning.  For, its opposite — disfavor — begins to be applied for the Federal employee or U.S. Postal worker who is no longer “as productive”, not fully a “member of the team”, and shows signs of slowing down; and then the harassment begins, just like when we were children and the pecking order always favored the bully and disfavored the weakling runts of the world.

At that point, it may be time to consult with an experienced attorney and begin the process of initiating a Federal Disability Retirement application, to be submitted to the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset — sort of like going and “telling” on that bully.  Maybe so — but it is a necessary next step.

OPM Disability Retirement Lawyer: The Balance of Body

Have you ever noticed that, if you attempt to compensate with one extremity over another, whether because of pain or temporary incapacitation in an attempt to alleviate and relieve the lesser limb, that the one in use becomes slowly debilitated as well?  The body is a balanced mechanism; it is designed to work in coordinated fashion, as a unit of entirety.  It may well be that if one component of that working aggregate requires temporary suspension, that another unit may, for a time, serve as the greater replacement by working “overtime”; but in the end, all workers are expected to return to full labor, lest the entire operation itself shuts down.

That is why pain and similar symptoms serve as a warning system for a greater condition.  People often think that compensating for a medical condition can be derived through persevering and ignoring; instead, what happens is that the other parts of the body begin to shut down and deteriorate.

For Federal employees and U.S. Postal workers who suffer from a medical condition, such that the medical condition begins to prevent the Federal or Postal worker from performing one or more of the essential elements of one’s positional duties in the Federal Sector, the attempt to overcompensate often leads to greater exacerbation, both in terms of the medical condition itself, as well as for the agency through bringing greater attention to one’s self.

It may be that a Federal or Postal worker may, for a time, get away with persevering and neglect of the warning systems; but in the end, the intricate and delicate balance of body, like the greater ecosystem of nature, will begin to reveal signs of wear and decay, and the time lost in taking the necessary steps will merely be unrecoverable segments of lapsed periods, where commas and pauses needed to be overcome in the preparation, formulation and filing of a Federal Disability Retirement with the U.S. Office of Personnel Management.

FERS & CSRS Disability Retirement: Life’s Alterations

Spring comes and we clean out old hoardings, discard past articles once thought to be valuable and inseparable from our identity; or perhaps what pop culture has deemed a justifying course of decision-making because there is an inevitable “mid-life crisis“, or some other equally biologically-driven, primordial determinism which compels one to act in one way, as opposed to another.

Life’s alterations are often considered with no greater thought than having the local tailor shorten the seams, or tuck in the waist, like face-lifts and other procedures which attempt to beautify an otherwise insufferable soul.  But in the end, it is always the innocent ones who suffer; it is well that children possesses greater than indexes of fragile psyches; otherwise, the emergency rooms of hospitals across the country would be attending to them around the clock.  But with euphemisms and a can of fresh paint, we may still remain viable cores as stellar pillars in the community; it was a “friendly divorce”; the kids are “better off”; and other such platitudes to justify the devastation wrought.  But some alterations in the cycle of life cannot be attributed to fault; they are, indeed, brought about by fate, nature, will and the indifference of a mechanical universe.
