OPM Disability Retirement under FERS: Agency Support

In a Federal Disability Retirement application, part of the SF 3112 series of forms will have to be completed by your Federal Agency or the Postal Service — whether you are still working for the agency or not.  Primarily, SF 3112B (Supervisor’s Statement) and SF 3112D (Agency Certification of Reassignment and Accommodation Efforts) will be the two forms which the U.S. Office of Personnel Management will require as part of the Federal Disability Retirement packet.

Can “how” it is completed by your agency impact OPM’s decision on your case?  Of course.

Is it important to have the “support” of your agency or Postal Service?  To some extent.

Can lack of support — or even lying about some of the issues — be overcome?  Yes.

There are, of course, some things which you have no control over — such as individuals making false statement, agencies unwilling to cooperate, the Postal Service not responding, etc.  However, there are things which can be done to circumvent such lies, uncooperative non-responses, etc., and it is certainly advisable to have an OPM Disability Attorney guide you with the wisdom and knowledge of experience and prior encounters in order to give you the greatest possible chance in your quest to obtain Federal Disability Retirement benefits from the U.S. Office of Personnel Management.

Federal Employee Disability Retirement: Loneliness in a Crowd

Do we all share that experience?  Or, do some never sense the isolation felt, the separation determined, the detachment embraced; but instead, always the smiling center where the crowd is but an extension of one’s body and soul?

A crowd, of course, can be an organic mass of an aggregate whole that, because it is a herd of humanity, can never embrace the individual; and as the individual stands within the continuum of others similarly situated, so the uniqueness of each is lost within the greater whole.

Human emotions, however, are possessed by the independent “I” of each person, and the insularity of those emotions within the inner soul of each body conceals itself except when expressed through words, deeds and facial or other characteristics that betray the anonymity of the crowd.  A teardrop here, a smile over there; a forlorn look of regret by a furrowed eyebrow or the curling frown around lips that purse; and words, of course, that are expressed.

Does tone matter?  Can a person express an emotion in an emotionless manner, and still be sincere in the very expression of that emotion?  Similarly, can a person stand within the mass of a crowd and yet declare loneliness, and be believed?  And of how we treat one another as human beings — or as mere objects that respond without regard to the validity of the subjective “I”.

For Federal employees and U.S. Postal workers who suffer from a medical condition such that the medical condition prevents the Federal or Postal employee from performing one or more of the essential elements of one’s Federal or Postal job, the sense of loneliness in a crowd is palpable precisely because, although still with the Federal Agency or the Postal unit, one is treated as an outsider, a person separate and apart and no longer “one of us”; and when that sense of loneliness in a crowd triggers hostility and adversity, it becomes apparent and self-evident that separation must follow — by preparing, formulating and filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management.

Otherwise, the loneliness in a crowd may ultimately lead to detachment from the crowd, involuntarily, by a termination of one’s Federal Service, on their terms and not on your own.

One goes through life struggling just to get through each day.  Life is hard.  Yet, as parents we are scolded into feeling obligated to paint always the positive picture to our children:  That you can work hard and achieve anything; that dreams are there to be realized; that life is a bowl of fairytales waiting to be realized.

Then, of course, children take that viewpoint and filter it through selective and narrow life encounters: The recent Royal Wedding that purports to convey a fairytale-like romance blossomed into reality’s harsh discourse (so long as you don’t read the gossip-columns about the private lives of those involved); the Wall Street trader that makes her first billion; the internet start-up company that offers an initial IPO of a cool 5 billion; and the one who inadvertently wandered into a corner mart store, bought a lottery ticket with his last dollar and won a 50 million dollar jackpot.

We don’t delve into statistical improbabilities of such events actually happening to ourselves, let alone our kids; but there you have it — dreams are here to be realized, grasped, within the reach of a blink’s dream away.

Then, adulthood, reality and the daily grind sets in; the myopic view is the one that strives to earn a living for this day, next week, or even for the month; because, in the end, the “long” view — of planning ahead, thinking about the future or even about the day after the short term — are somehow out of one’s reach, leaving aside being too fuzzy to consider.

For Federal employees and U.S. Postal Workers who must contend with a medical condition that no longer allows for the Federal or Postal employee to perform all of the essential elements of one’s Federal or Postal job, the myopic view of life is the familiar one:  Get through this day; try to limit the pain or mental anguish; try not to make any waves at work; try and remain anonymous, or less noticed than yesterday.

It is the shortsightedness of our lives and the manner in which we live, that becomes the salt upon the wound of our own making.

Preparing, formulating and filing an effective Federal Disability Retirement application, to be filed with the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, is at least thinking about tomorrow, or the day after.  For, the problem with the “short-term” is that it keeps dragging into the “long-term” of our lives, and preparing an effective Federal Disability Retirement application can at least turn the short-term of misery into the long-term of some semblance of future security, in order to attend to the priority of both the myopic view and the far-sightedness of our future: one’s health.

OPM Disability Retirement: Those intersecting connections

We hear all the time about the shrinking world, the smaller universe, the global village – all metaphors to help and understand, to comprehend and be able to withstand within the insanity of a world that continues to intrude, intersect and impose itself upon every corner and aspect of lives lived and daily interrupted.  It is a way for people to cope with the fact that we can no longer avoid the reality of those intersecting connections from worlds, cultures and universes that make up the daily reality of our walking lives.

The newspapers globalize each and every issue; the television and cable news outlets care little for local news unless it, too has some national consequences; and so we live with the anomaly that the only time you might hear about your own hometown is if some horrific event occurs that other people in other towns might care about.  And, even when a story is reported about an event that occurs just around the corner from the news station, headquarters or whatever manner of identifying the central place where all of the equipment, studios and personnel gather to emit their airwaves of newsfeeds, they act as if it is occurring in some distant county or country, with perhaps a bit of weeping as an afterthought with a statement like, “And it makes it all the worse because it happened just in our own neighborhood!”

The world is indeed one comprised of intersecting connections, and we voluntarily allow for those connections to make our own perspectives molded into “theirs” by inviting various cable channels into our living rooms.  Do we really have a choice?  Can we just remain ignorant and ignore the reality of the global economy, the extended village and the universal concerns of the day?  How do we live with the complexities of intersecting connections, when we can barely deal with the local problems that beset us within the cocoon of our own lives?

For Federal employees and U.S. Postal workers who suffer from a medical condition, such that the medical condition begins to impact the daily ability and capacity to perform all of the essential elements of the Federal or Postal job, the microcosm of intersecting connections may well be magnified to a level where it competes with what is occurring on a more global scale.

Suddenly, the Federal Agency is moving to put pressure on you – like those competing foreign companies you hear about in the world economy.  Or, the Supervisor is no longer being cordial – somewhat like the world leader who doesn’t return calls to the President.  Coworkers no longer treat you as an equal – like nations that suddenly go rogue without explanation.  You have to file a complaint – like submitting to a U.N. vote for sanctions.

We have all been groomed and prepared to think in terms of intersecting connections, but for the Federal and Postal employee who suffers from a medical condition such that preparing, formulating and filing an effective Federal Disability Retirement application becomes a necessity, it all comes back to a more local and personal connection: one’s health, and the need to focus upon one’s personal life.

No matter how global the world has become, never forget that it is the personal life of close connections that really only matters in the end.

Medical Retirement from Federal Government Employment: Terms

Language is a malleable vehicle.  There have been times in the history of language, when the staid and stodginess period of loss of vibrancy became the rule, followed by epochs of radical vicissitudes, upheavals and counter-conventional revolutions in the medium of language games.  Whether this encapsulated slice of linguistic alteration, upending traditional forms of communication because of electronic media and the hype of language abbreviated by Twitter, Texting and Tablet Titillations, will last the short life of technological innovation and obsolescence, is yet to be determined.

For example, the time of Shakespeare’s linguistic explosion of experimentation and expansive usage became in retrospect a richness of entering into connotative language meanings from which we benefit to this day.  But steadiness, continuity and conditions of stability are also important in order to take the proverbial breather to accept, embrace and assimilate (a term widely used for contextual purposes in modernity applied to immigration reform, as well) the linguistic revolutions that become incommensurate with meaning, communication and conveyance of terms.

Terms are important, both in common usage and in technical application.  In the arena of Federal Disability Retirement Law, different words are splayed about, sometimes without regard to proper application, especially when the “law” often requires a greater attention to precision of meaning.  Some simple and common crossovers of linguistic confusion involve:  “medical retirement” and “disability retirement” – do they mean the same thing?

If reference to either term involves the submission for an early retirement to the U.S. Office of Personnel Management, then the answer is “yes”, they do mean the same thing.  Federal Disability  Retirement is identical to “Federal medical retirement” if by such words the query is referring to filing for an early retirement based upon the Federal or Postal worker’s inability to perform one or more of the essential elements of one’s Federal or Postal position, and therefore the intention is to access an early annuity because of one’s early retirement based upon the medical condition, and submitted to the U.S. Office of Personnel Management.

Some other terms often confused or conflated:  “On-the-job injury” or “pre-existing condition”; these terms are often used in the language-arena of Worker’s Compensation issues, and rarely have any import – or applicability, at all – in the context of a Federal Disability Retirement application.  For, in a Federal Disability Retirement application, whether the applicant is under FERS, CSRS or CSRS Offset, it matters not whether or not one has been disabled “on the job” or away at a skiing accident; instead, what is important is the impact of the injury or disease upon one’s ability and capacity to perform the essential elements of one’s Federal or Postal position.  As for a “pre-existing” condition – that, too, is more likely appropriately defined in an OWCP context, and rarely in filing a Federal Disability Retirement application.

In any event, “terms” are meant to be used within a context-appropriate content of filings, and in preparing, formulating and filing an effective Federal Disability Retirement application, it is important to clarify and conform to the applicable statutory mandates in defining and using the terms which are most appropriate and effective.

For, in the end, the explosion of language during the era of Shakespeare and the Elizabethan Age reverberates with critical linguistic richness to this day; yet, if we were to have a conversation with a bloke from that era, the terms employed would not only confuse us, but confound us with a profound sense of despairing lack of cogency despite our self-aggrandizing declarations of superiority and advancement in the modern parlance of greater self-esteem.

Federal Disability Retirement: The traveling troubadour and trobairitz

There are vocations and careers which once were, and now forgotten.  Life cycles in endless streams of dying embers and regeneration of growth; and like the mythical Phoenix which arises from the ashes of destruction, so we tend to romanticize that which once was, is now forever lost in the forgotten residues of concealed fingerprints in timeless memories once secluded but dissipated as storytellers no longer found an audience for tales left untold, and children turned to self-amusement with videos, technological blank stares, and smartphones which glow well into the night.

Troubadours of the middle ages (and for those wondering, since this is now a gender-neutral universe and we dare not fail to include the binary aspect of such identification, the female counterpart known as the “trobairitz”), traveling under the patronage of princes in fiefdoms who showed the first signs of supporting “the arts”, and thus would allow for actors, performers and lyric poets to entertain and provide a respite of asides from a world which knew poverty beyond modernity’s capacity to comprehend, plagues which spread quickly and with devastating tenacity, and amongst rogues who cared not for the intellectual conscience recorded by scribes and religious orthodoxy of the Aquinas tradition.

They came onto the scene of history, and disappeared by the end of the High Middle Ages.  Do we even think about them, today — their careers, their imprint upon a fellow human being’s life, and even of the shadow which appeared but for a whispering moment, and with the light of day left not even a hint of prior existence?  Is that what Heidegger meant, when he described human existence as an avoidance out of fear of the ultimate fate of each man?  And so we look upon our own careers, and the choices we have made in life, and that to which we look into the crystal ball for the future.

Federal employees and U.S. Postal workers who are contemplating filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, must by necessity feel trepidation for the unknown.  That is natural.  But as necessity is the mother of invention, so the end of a Federal or Postal career should never bring pause to a hopeful perspective for a future yet undetermined, whether unknown or barely discernible.  And like the traveling troubadour and trobairitz of a past age, the career itself is but a whisper in time, and it is the substance of the life lived, and not the sacraments of a vocation we had chosen, which make for value in a life of plenty.

OPM Disability Retirement from Federal Employment: Far-Flung Universes

Each generation tells a generic story reflective of the times; and thus did the Great Depression era produce movies and epics with undertones of escapism from the harsh realities of life; of the 60s, the fear of nuclear holocaust and the confrontation of the Cold War; of the following decade revealing the hesitation for  technology and its pervasive intrusion into the privacy of our lives; and so on, so the anxiety, fear and loathing goes.

Throughout, people escape in their own private ways, through daydreaming, imaginative time-travels as in the classic short story by James Thurber depicted in, “The Secret Life of Walter Mitty”; and other times in nightmares and dreams controlled only through the breaches in our subconscious.  It often seems as if the far-flung dimensions and dominions of hope save us only through living in those other-world universes, if only for a moment, a period, a time and a day.

Vacations and weekends only delay the inevitable, and then the harshness of who we are, what we have become, and where we are going, all come crashing back, like the rolling waves of thunderous whitecaps which bellow in the echoing chambers of the far recesses of our minds.

For the Federal employee or the U.S. Postal worker who suffers from a medical condition, such that the medical condition begins to threaten one’s livelihood, resulting in the Federal agency or the U.S. Postal Service beginning subtle (or not so) noises of increasing pressures through adverse actions, like unpleasant abdominal groans which should remain private but echo out into the public domain, it may be time to escape the escapism of the alternate universe and become “real” by considering filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset.

Other and far-flung universes offer hope beyond dreams, but when the dream is shattered by the progressively deteriorating forces of a present-day reality, it is time to travel back to the origins of reality, and face a full-frontal confrontation of what the pragmatic steps of day-to-day concerns must by necessity bring, and begin to prepare, formulate and file for OPM Disability Retirement benefits.

Alternate dimensions indeed reflect the times one lives in, and may even represent a pleasant moment in time, a respite away from the harshness of today’s reality; but when the awakening occurs, one must shake away the cobwebs of fantasy, and face the serious concerns of one’s angst-filled day, as the medical condition will not go away, the Federal agency and the U.S. Postal Service will not fade, and the fight to survive will remain as real today as it will be tomorrow.

Federal Disability Retirement: The Hug That Wasn’t

Regrets are priceless; they lack both a marketplace value, as well as a worth beyond applicability of accounting principles.  The conceptual void of negation; the paradox of non-existence and nothingness; the chasm of obsolescence and absence where once perceptual conformity allowed for the revelation of a thing; these are all within the imaginative mind of the human puzzle.

What possible evolutionary utility can be ascribed to things that did not happen, could have, but never did, and where the pit of void in one’s stomach leaves a dissatisfying wanting of that which could have been?  In the quietude of a sleepless night, when images of past concerns invade and prevent that final lull into a dreamworld of peaceful intent, those thoughts of missed opportunities, bumps in the night of moments forgotten by interludes of dusty memories once enlivened but now deadened with time and fading photographs darkened by degeneration of remembrances once clung to; in a twinkle of twilight, a sense of regret can pervade.

It has often been said that, on the eve of one’s deathbed, one never remembers the time of work unfulfilled; rather, we recount the time lost of things we did not do because we were too busy with work.  Regret does not cull the graveyards of memories lost about parallel universes involving work left undone at the office; instead, it reaches into the bottomless chasm of simple recollections, like the hug that never was.

Medical conditions often serve as a reminder of important priorities, and tend to impose the sequence of one’s lives, reordering them into a listing of priceless artifacts, like uncut diamonds lost in the sands of time.  Suddenly, one’s mortality is in question, and more than getting meaningless tasks done, the vitality of relationships come to the fore.

For Federal employees and U.S. Postal workers who suddenly recognize that a medical condition is beginning to prevent one from performing one or more of the essential elements of one’s job, the sense of regret often accompanies the realization, but is also and just as often a misplaced case of loyalty.  Why should fealty be sworn to an agency which is impervious to human suffering?  How can a guilty conscience pervade when the Federal or Postal employee has already given beyond what is required, for years and decades already lost?

Federal Disability Retirement is a benefit open to Federal and Postal employees who suffer from a medical condition, such that the medical condition impedes continuation with an agency or the U.S. Postal Service based upon a legal criteria of proof of preponderance of the evidence.  Guilt and regret should never be a part of the process.  Filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management is an employment right, accorded by statute, and should be done once the Federal or Postal employee recognizes that one cannot perform at least one or more of the essential elements of one’s positional duties.  Whether under FERS, CSRS or CSRS Offset, it is a benefit tapped into only through proof by evidentiary sufficiency.

And like the hug that wasn’t, the failure to file for Federal Disability Retirement is tantamount to the negation of rationality when continuation in circumstances of employment only exacerbates the pain, prolongs the suffering, and extends the nightmare; leaving to wonder the capacity of the human animal, the quietude of regrets and the forlorn despair of the empty space left, when once we tried to embrace a loved one, but instead spent that time serving a master who had long since gone home to his family.

FERS & CSRS Disability Retirement for Employees from the Postal Service and Other Federal Agencies: Things That Go Bump in the Night

The nightmare of filing for FERS Disability Retirement in times of financial, emotional, and medical needs

Whether or not childhood fear and traumas have a long-term impact in determinable ways upon reactive capacities later in life; to what extent regularity of behaviors, consistency of habitual living, and early imprinting mechanisms influence subconscious firings of synapses, remains within the mysterious realm of esoteric knowledge investigated and analyzed by the coalescence of science, philosophy and psychology; but it is the lay person who must, during the process of unfolding discovery and wisdom, live the consequences of actions impacted by others.

Sometimes, however, it is not what others do, but rather, circumstances which manifest of untold trauma and misery, for which no explanation but a shrug of one’s shoulders can presume.  Medical conditions fall into that category.  How one reacts to it; the extent of the impact upon one’s life, livelihood and future; and the preparations one must undertake in order to secure the betterment for one’s life when once you get beyond the condition itself, if ever; these are all concerns and pathways of responsibilities which fall upon a person who suddenly finds him or herself with a medical condition of significant magnitude.

Whether physical in nature — where orthopedic pain, limitation of flexion and movement; chronic pain, profound fatigue, or neurological issues resulting from disc desiccation, internal derangement of joints, etc.; or of psychiatric issues encompassing the many complex diagnoses, including Bipolar Disorder, pain and anxiety issues, Major Depression, depressive disorders; it matters not in the end, for either and both impact those decisions which one must make in determining the pathway of one’s future.

For Federal employees and U.S. Postal workers who find that a medical condition impacts one or more of the essential elements of one’s job, consideration must always be given to filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, whether one is under FERS, CSRS or CSRS Offset.

For Federal Disability Retirement, preconditions and pre-existing conditions matter not; it is not like an OWCP claim where the focus of query may attempt to undermine a claim based upon the origin of the condition; and so the “how” and the “why” are not relevant issues, as in “how did it happen” or “why did it occur”?  The relevant inquiry does not encompass the “time before”; it does not delve into the deep reaches of one’s damaged psyche, or of preexistent traumas in the far recesses of damaged lives.

Whether or not things go bump in the night when once we become adults matters less, than the experiential trauma of having to deal with present issues that impact one immediately.  Taking care of life’s interruptions is a necessary component of living, and for Federal and Postal workers whose future avenue of livelihood is impacted by a medical condition, preparing, formulating and filing for Federal OPM Disability Retirement is of paramount importance.

Bumps always tend to occur in the night; it is what the “thing” is that we must identify and resolve, and what bodes for the uncertain future into which we must venture.
