Medical Disability for Civilian Federal Employees: The Inactivity

Waiting upon a third party or entity is often the hardest thing to do.  Waiting upon a bureaucratic process is an exponential aggravation of that same hardest thing to do, because one cannot fathom a reason or rationale for such dependency of unproductive time.

If there was actual knowledge of some accounting for activity during the process, it would perhaps justify the inactivity; but merely awaiting the sequential attendance of a case file which may or may not be reviewed on any given day, is a non-activity of an unknown and unknowable non-productivity of non-action. The result: frustration.

Now, one may argue that the voluntary submission into the world of bureaucratic waiting means that one has received that which was asked for; but this merely explains the cause, and solves nothing.  Filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, whether under FERS or CSRS, is an administrative process which, unfortunately, requires patience, waiting, and a resolve that there will be an ultimate end to the process, given the right amount of time.

Then, of course, the Federal or Postal employee who is subjected to the long wait, must immediately comply with the time-limitations imposed if a denial of a FERS or CSRS disability retirement application is issued by OPM.  When it is upon them, the Federal and Postal employee must be patient; when it is upon us, there are strict time limitations which must be followed, or else…

The bureaucracy moves, albeit at a pace designed to test the patience of saints; but then, the old adage applies as always, that Federal and Postal Workers are the most virtuous of human beings, given that patience is still considered a virtue.

Medical Retirement Benefits for US Government Employees: The Waiting

We wait in lines and on telephones; we wait for the mail and to be served in restaurants and supermarkets; waiting is a necessity, based upon a closely-held belief that the end-product for which we expend such virtues as patience is worthy of the investment of time. There is always a quick calculation which must be engaged before the waiting can begin; of weighing the importance of the service or product to be received, in conjunction with the time it will take to attain the goal of receipt, and in further consideration of the comparative value of other things “to do”.

For the Federal or Postal Worker who is filing for Federal disability Retirement benefits from the U.S. Office of Personnel Management, whether the Federal or Postal Worker is under FERS or CSRS, the worth of waiting must always be balanced with the proverbial question, “For what?”

Waiting for a Federal agency or the U.S. Postal Service to initiate an action which may or may not impact a Federal Disability Retirement application is normally not “worth” it, for such a wait may never produce anything fruitful. Waiting because to do otherwise — to act — will incur efforts of cognitive or physical exhaustion is something which will only delay an inevitable need, and is therefore unwise to engage, is something that must be often countered by sheer force of will.

On the other hand, once a Federal Disability Retirement application is filed with the U.S. Office of Personnel Management, the real game of waiting begins, and one which no one has very little and limited control over. For, ultimately, the U.S. Office of Personnel Management — the agency which has the authority to approve or deny a Federal Disability Retirement case — has the cards which count, and the requested product of the goal to attain: a decision on a Federal Disability Retirement application filed by the Federal or Postal Worker.

Federal & Postal Employee Medical Retirement: The Intersection of Interests

Throughout one’s life, most Americans have minimal contact with governmental bureaucracies and agencies, except to comply with Selective Service requirements, join the military, file tax returns, claim Social Security benefits in older age, etc.  Such encounters are often considered bothersome, and many grumble and complain about the intrusive nature of such dealings. What is often not perceived, of course, is the vast amount of indirect statutory and administrative requirements placed upon private entities, which then shift burdens upon the private citizen, unbeknownst to the person entering the store, bank, etc.

For the Federal and Postal Worker, however, the daily bureaucratic encounters are part of one’s life. The Federal and Postal employee is part of that administrative process which impacts the private sector of the economy; they are, in essence, the “insiders” who make the mechanisms of the Federal government tick.  As such, the Federal and Postal Worker often has little idea how the “private” individual views such inner workings, until he or she becomes just like the “outsider” and encounters a Federal bureaucracy in the same shoes as the private individual.

When the Federal or Postal employee finds it necessary to prepare, formulate and file for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, whether under FERS or CSRS, such a clash and intersection of interests suddenly takes on a new perspective.  In one fell swoop, the Federal and Postal employee filing for OPM Disability Retirement benefits becomes both an “insider” as well as an “outsider” — the former, because he or she is still part of the Federal agency or Postal Service; the latter, because such dealings must ultimately be with an independent agency identified as the U.S. Office of Personnel Management.

Such intersection of interests often becomes befuddling; for, no longer is the encounter embracing the administrative and bureaucratic work to which one is accustomed; rather, it is to stand in line like other private citizens to file a claim for benefits.

Such a state of being, for the Federal and Postal Worker, can be likened to the deceased individual caught in Purgatory; and, indeed, perhaps some sins unknown and not atoned for, have been placed upon such Federal and Postal employees to have to encounter OPM in such a state. Whatever the reasons, such an encounter can be just as much of an eye-opener to the Federal and Postal employee, as a private citizen who encounters the complex bureaucracy of the Federal government for the first time in his or her life.

OPM FERS/CSRS Disability Retirement: The Time is Now

Waiting for the perfect storm is always the most persuasive grounds for procrastination; that time where coalescence of all necessary factors come together to provide the optimal moment to do something, but which never arrives; and so there is always one issue still to point to, where one can say, “X has not occurred, yet,” in order to delay the inevitable.

The problem with allowing for perfection to prevent action, is that in the meantime it allows for the deterioration of surrounding circumstances and conditions to occur, thereby further exacerbating the allowance for any such perfection to appear.  Grounds always exist to excuse an action; and when the seriousness of contemplating a change of vocation or stoppage of a career is at stake, such grounds are normally reasonable and real.  But at some point, especially when contemplating filing for Federal Disability Retirement from the U.S. Office of Personnel Management, whether under FERS or CSRS, the Federal or Postal employee must simply acknowledge the fact that one’s present circumstance itself is less-than-a-perfect situation, and with that admission, to weigh the factors in deciding whether filing for FERS or CSRS Disability Retirement is the only viable option left.

In a fantasy-filled virtual world, it may well be that one can wait for the coming-together of perfect circumstances; in the “real” world, one must face and decide upon options which may not always present themselves as the best of all possible worlds.

The problem with today is that many of us live in the virtual world of videos; but there is a Kantian world of objectivity out there, and the coldness of that world is often reflected in the very agencies for which Federal and Postal Workers work.

Postal and Federal Disability Retirement: When It All Becomes Worthwhile

Aristotle’s admonishment of determining too early the virtue and reputation of an individual, can be analogously likened to the state of emotional turmoil we find ourselves in, at any given moment of one’s life.  Happiness is indeed a fleeting state of one’s being; and the history of civilization is one fraught with trembling and fear, with interludes of joyous celebration.

For the Federal and Postal employee contemplating preparing, formulating and filing for Federal Disability Retirement benefits from the U.S. Office of Personnel Management, whether under FERS or CSRS, the administrative process of the actual filing itself, and the patient waiting for months-on-seemingly-unending-months, is merely a continuation of the trials which the Federal and Postal Worker has had to endure within the context of a history of such trials.

We tend to view life’s events in a vacuum, as picture-perfect albums of lives lived in tandem with our selective memories.  And for evolutionary purposes, perhaps that is the only way we could survive; for, to constantly be reminded of the trials would be to relive the morbid traumas of our lives.

The Federal and Postal employee who has come to a point in his or her life such that filing for Federal Disability Retirement is the only viable option left, must then endure the further trial of waiting upon the U.S. Office of Personnel Management to render its decision.

In the end, when an approval is received, the sigh of relief reverberates to tell of the happiness felt in that moment of jubilation; but silent is the suffering which preceded that fleeting snowflake of time as joy floats soundlessly for a frozen frame of time.

OPM Disability Retirement: Mechanization, Automation & the Lull of Conformity

Locke and Rousseau both recognized the necessity of the individual human being to enter into civil society in order to escape the theoretical “state of nature” for self-preservation, and once within, conformity to societal norms and orderly constructs became a natural force in the progressive evolution of civilization. But social order need not mandate conformity of a thoughtless drone or loss of creativity.

The term itself — “drone” — is an interesting one. For, in its general usage, it meant a sense of drudgery or monotony; or, in a specific sense, a male, stingless honeybee which produced no honey, and thus a less-than-full entity; and in more recent usage, a non-human, destructive craft, devoid of thought or moral compass.

Social conformity which gave rise to automation and industrial mechanization, has produced a populace given to thoughtless action.  Such conformity, perhaps, is useful; for in a world requiring bureaucratic patience, one is left with no other choice but to wait upon a long and onerous administrative process.

For the Federal or Postal employee who must submit to the long, bureaucratic process of filing for Federal Disability Retirement benefits, whether under FERS or CSRS, the conformity to standard forms, the patience required for the long wait, and the necessity to comply to the rules governing eligibility, legal standards, etc., is part and parcel of the social structure.  We are trained to comply; and with no other choice but to go to the singular Federal Agency, the U.S. Office of Personnel Management, it is best to try and prevail in the most effective and efficient manner possible, inasmuch as there really is no other choice in the matter.

Locke and Rousseau were right; self-preservation requires the escape from the state of nature; what we are left with, is the U.S. Office of Personnel Management — the penultimate reflection of a civilized and advanced society.

Medical Retirement for Federal Workers: The Continuing Life

Snow.  Events such as a major snowstorm tend to have a myopic effect upon individuals, towns, cities, etc.; for, as the focus is narrowly placed upon the event itself, the beauty of nature’s blanketing is lost upon the urgency of what is announced.

Language has such an effect.  One becomes more comfortable reading about an event, rather than experiencing it.  Thus, one may google about a natural occurrence in one’s own neighborhood, when all that should be needed is to open the back door and look outside.

A corollary effect occurs in a Federal Disability Retirement case.  The “event” of preparing, formulating and filing for Federal Disability Retirement benefits becomes the singular focus for the Federal Disability Retirement applicant, and this is understandable, because the necessity of securing one’s future often depends upon obtaining the foundational economic and financial benefit.  But other aspects of one’s continuing life must concurrently progress in a linear fashion. For, the problem with waiting upon another, is that the “other” rarely notices or even cares.

OPM’s shutdown because of the snow will have the reverberating impact of slowing things down for another day, which will echo down the line for hundreds, if now thousands.  The ones who are impacted will be the Federal and Postal employees who have a dire need to have their Federal Disability Retirement cases decided.

From the “other’s” perspective, however, this is a snow-day.  Driveways to be cleared; kids to be attended to.  The continuing life.  If only that were so for everyone, including the Federal or Postal Worker who is awaiting a decision.

Federal Worker Disability Retirement: The Unresponsive Agency

The complaints abound, and continue to exponentially increase; the U.S. Office of Personnel Management is way behind on its evaluation, review and decision-making process for all characters of retirements, disability retirements included.

It is a given that filing for Federal or Postal Disability Retirement, whether under FERS or CSRS, with the U.S. Office of Personnel Management, must necessarily have an expectation of a time-consuming administrative process, precisely because of the encounter with a Federal bureaucracy.  But it seems that each year — nay, each month and week — the delays continue to expand.

At each step of the way, OPM has become more and more unresponsive, and with new cases coming in, the length of time at every stage, and “between” stages, has been extended.  The process itself contains inherent milestones of delay: from filing the entire disability retirement application to a facility in Boyers, Pennsylvania, which merely annotates the receipt of the case and inputs the case into the computer system; to thereafter sending the disability retirement application, with all of its evidentiary submissions and attachments down to Washington, D.C., where it must first await assignment to a caseworker; then, upon assignment, for the caseworker to even get to the applicant’s submission for review and evaluation.  Then, of course, there is the possibility that the entire packet will be selected to be sent out for review by a contract doctor.

The delays are beyond the control of the applicant, his or her OPM Disability attorney, or the agency for whom the applicant worked.  It is, ultimately, an administrative process which can be tedious, time-consuming, and fraught with delays and extended periods of silence.

Patience may well be a virtue, but the unresponsive manner in which the U.S. Office of Personnel Management has handled the delays, fails to engender much confidence in a system which should be most responsive to those in greater need.

Postal and Federal Disability Retirement: Patience & Frustration

Stories now abound concerning the backlog at the U.S. Office of Personnel Management; and as has been often stated by the undersigned lawyer, if the old adage that “patience is a virtue” is truly a truism, then Federal and Postal employees must indeed be the most virtuous of individuals in any given society, because the long wait in order to obtain a decision — favorable or otherwise (and, if the latter, then at least the Federal or Postal worker can assert his or his reconsideration or appeal rights in the matter) — on a Federal/Postal Disability Retirement application certainly tests the outer limits of one’s moral character.

The inverse emotional reaction to the moral character of virtue, is the expression of frustration.  Such an expression is the release of irritation, anger, and an overwhelming sense of angst at a system and administrative procedure which follows no rules, acknowledges no time lines, and concedes no boundaries of what a “reasonable” length of time would be defined as.

Then, of course, one always hears of “stories” about individual X who filed and got a decision within a month of a case being assigned; or that individual Y who had to go into bankruptcy while waiting for OPM to make a decision.  It is best to refrain from comparative analyses; such stories, in whatever form and to what extent of truth is contained, will only increase the level of frustration, and further test the moral fibre of virtue.

While there is no single answer to the long waiting period which OPM has imposed upon the disability retirement process, this much is true:  Approvals are being issued; decisions are being made on a daily basis; it is simply a matter of time.  Thus, in preparing, formulating and applying for Federal Disability Retirement benefits from the U.S. Office of Personnel Management this period of waiting must be “factored in”.  But when such factoring has occurred, the actual period of waiting is indeed a frustrating part of the administrative process.

Federal and Postal Disability Retirement: Unfortunately, like a Toothache

Preparing, formulating and filing for Federal Disability Retirement benefits from the U.S. Office of Personnel Management is analogous to having a toothache — a gnawing sense of foreboding during the entire process, especially during the long period of waiting for a decision from the Office of Personnel Management.  Then, like the extracted tooth which cures all ills, an approval from the Office of Personnel Management solves many of the problems, clears up much uncertainty for the future, and allows for a good night’s sleep for the first time in many months.

The difference between filing for Federal Disability Retirement benefits and having a toothache, however, is that while the latter can have a solution fairly immediately, the former will linger for many months, and it is precisely the longevity of the process which is the most disconcerting.

Further, the fact that one’s own Federal agency, or the U.S. Postal Service, and specifically the Human Resources office of many agencies (there are, of course, exceptions to the general rule, though such exceptions are rare and delightful when found — sort of like coming upon a near-extinct species and recognizing the aberration of the moment) will deliberately and with purposive intent attempt to obfuscate and create unnecessary obstacles (isn’t that precisely why such euphemistic designations like, “The Office of Human Capital” is applied?) is itself disturbing, puzzling, and infuriating.  But like the toothache, all that can be done during the long administrative process is to wait for that moment of extraction — or approval, as the case may be.
