Medical Retirement for Federal Employees: Future Plans Deterred

The common criticism launched against Bishop Berkeley, whether deservedly or not, is that his philosophical positions fly against the common sense of everyday experience.  Of course, it all depends upon how you interpret his position.

His generally-accepted dictum of “Esse est percipi” (no, we will not try and be like the great William F. Buckley, engaging in the well-known habit of interspersing Latin phrases which no one understood but everyone acted like they did; and instead will provide in the next dependent clause the English translation so as not to appear too intellectually prudish) — “To be (i.e., to exist) is to be perceived” — engendered ridicule, confusion, complex rebuttals for justification of untenable positions, and a firestorm of fascinating linguistic gymnastics to explain contortions of philosophical positions.  For, we all believe that there exists, beyond our own perceptions, an objective world separate and apart from the experiential sensations of our own bodies.

One might counter: If “existence” is defined merely by our own sensations, then we should be able to defy the objective existence of the world by numbing our perceptual apparatus.  Thus, if a bus is oncoming, simply blot out our perceptual capacities and when the bus “hits” us — poof! — no bus.  Similarly, when we leave a room, the existence of the room from which we just exited is assumed to still exist despite our distance from it where we no longer perceive it.  In other words, we “believe” that the viability of the objective world does not depend upon our perceiving it.

Thus, the criticism of the statement itself — “To be” (i.e., exist) “is to be perceived” (i.e., that such existence depends upon our perception of it) — is thought to be nonsensical.  It is akin, likewise, to our future plans.  We expect future occurrences to follow upon the path of present conditions.  Thus do we wake up each morning and expect the coffee to taste somewhat like the way it tasted the day before, and the day before that; that when we awaken, the ceiling above is the same color as it was the morning previous; and that the office or worksite we will approach will be there as it was before.  The future depends upon the present; the present is inescapably embraced by the past; and so we walk about in this universe expecting that future plans will be undeterred by unexpected phenomena.  Except, when they are.

Medical conditions do that, don’t they?  They deter future plans because they disrupt what we were before; they alter the scope of who we were just yesterday, or the day before.  The proverbial “room of existence” that Berkeley posited has in fact changed; it is no longer the “I” who was yesterday.

FERS Disability Retirement: The Inevitability of Change

It is a tautology; for, “inevitable” encapsulated and embraces the term “change”, and one presumes that, in applying and comprehending the word “change”, there is a sense of inevitability contained within it.

Thus do we assume certain truths which naturally follow: If you don’t like the weather, just wait a moment (for, the natural course of the universe dictates that the weather will change over time); if you are dissatisfied with your life today, ride it out (for as circumstances appear static for the moment, time will resolve many of the uncertainties faced today); and similar dictums of sagely advice.

What we are not told, however, is that which we have already accepted by experience:  That “change” is too often a negative component, and that is why we believe that things almost always change for the worse.  That is the byline for the pessimist, of course: That good things never last; everything changes for the worse.  The optimist, on the other hand, always tries to squeeze the good out of anything that worsens, and tries to see the glass as half full, instead of half empty.  Whether you are an optimist or a cynic, both accept that change is inevitable; the difference is merely in how one perceives the change.

Then, of course, there is the human element — of affirmative actions taken by an individual or a multitude of individuals in performing acts that contain or otherwise alter the course of change.

For Federal employees and U.S. Postal workers who suffer from a medical condition such that the medical condition prevents the Federal or Postal employee from performing one or more of the essential elements of one’s Federal or Postal job, change is inevitable.  Whether by being placed on a “Performance Improvement Plan”, or the increasing harassment perpetrated by the Federal Agency or the Postal Service — or in the inevitability of a termination — the medical condition itself will normally and often dictate the need for change.

The “human element” is the action taken by the Federal or Postal employee in preparing, formulating and filing an effective Federal Disability Retirement application, where the affirmative intervention of actions taken may change the ultimate outcome of life’s trials.  Yes, the inevitability of change is a given; but how that change will come about and what outcome is to be determined will depend upon the Federal or Postal employee who recognizes both the inevitability and the need for change, but moreover, of how to go about initiating the process.

Is it by actions followed by words, or by mere words spoken that it develops, solidifies and concretizes? Can we really go by appearances alone, or must there be a history of words followed by actions, followed further by assurances, then again by more actions, until a sense of comfort and solidarity of feeling comes together to form an aggregate whole where we declare within our inner consciences, “Yes, I trust him (her)”?

Trust is a peculiar human emotion –for, it is an emotion, in the end, is it not?

Not quite like smiling or crying; not nearly a cousin to a shriek or a wail; but more akin to a calm, a peace of mind or a self-satisfying sigh.  Once earned, it can last a lifetime and beyond into off-springs and surviving relatives; once betrayed, it may be that it can never be restored, no matter how many apologies, the innumerable “make-up” actions and the irrelevancy of gifts galore.  For, how can you restore that which was meant to be inviolable?

If a spouse cheats once, will the suspicion of another time ever disappear?  If a person abandons his or her post and absconds in the middle of the night, does that not hint to a character flaw that he or she can and likely will do the same thing again?  Would an embezzler be invited to be employed as the head treasurer once accused, convicted and imprisoned?  Can trust shaken once ever be regained?

Attorney Representation Federal Disability Retirement: The running of days

How does it happen?  Where did it all go?

One day, you are a young man or woman, full of promises and hopes, dreams that defy any limitation or restriction of potentiality yet to be unleashed; and the next, an old man or woman, rocking back and forth, awaiting the grim reaper with its scythe and faceless chasm of darkness and despair.  In between, of course, there is a memory – of a blur, a constant rush from this activity to that, of emergencies, turmoil and tumults, of the proverbial peaks and valleys; in short, it is called “living life”.

It is the running of days, one upon the other, one mixed into the two, then weeks, months and years, and finally decades that turn into a half-century.  Was it all worth it?  Did we stop and perform that salient act that became so popular during the 60s – of stopping to “smell the roses”?  And if we did not, what wisdom was gleaned from the lack thereof, the absence of pause, the semicolon of interludes?

Or, did we follow upon the admonishment stated in that 1974 folk song by Harry Chapin, “Cat’s in the Cradle”, where all we did was to teach our kids to be “just like me” and roam the universe in search of meaningless trope and allowing for the running of days to overtake us?

Or is it simply that our memories fail to serve us, and there were many days and some months where enjoyment, relationships and meaningful engagements were in fact embraced, but that the living of life often erases, smears and obscures such that our recollection is so cluttered with valuable connections and so consumed with overflowing “moments” that we just cannot even contain them anymore?

The running of days is ultimately just a metaphor, like running water and leaks that just keep on; but it is one that sometimes needs fixing, and it is the repair work that often cannot be performed within a lifetime of such disrepair.  Regrets hit us all, but the greatest one that never seems to close the wounds of time is that one where time was wasted upon frivolous acts of unrepentant entanglements.

For Federal employees and U.S. Postal workers who suffer from a medical condition, such that the medical condition prevents the Federal or Postal worker from performing one or more of the essential elements of one’s Federal or Postal job, the other proverbial saying is that one which refers to “spinning one’s wheels”, and yet knowing that no good will come out of staying put.

Federal & Postal Disability Retirement Help: Caught in the world in-between

It is a purgatory of sorts; of the netherworld where twilight is a constancy of confusion, and when neither dawn nor dusk, between summer and winter, or of cognitive clarity and conundrums of confusion reach the pinnacle of an infinite maze.  Do we prefer clarity to confusion, or the light of dawn to a period “just before”, when consciousness of thought is suppressed or prevented by a darkness befalling thoughtful perspectives impeded by streams of dancing oracles upon a seamless stupor?

It is often uncertainty which tires the soul.  For, while wealth is preferable to destitution, and employment to its opposite, it is being caught “in-between” which engenders uncertainty and angst of future plans, and that is likened to a form of hell.

When a Federal employee or a U.S. Postal worker first learns of a medical condition — whether from an accident or injury on the job, or during a foray into uncharted recreational activities, it matters not for purposes of meeting the criteria for eligibility in a Federal Disability Retirement application submitted through the U.S. Office of Personnel Management — the weariness of time and the toll of uncertainty is often worse than the failure of resolution encountered through therapy, medication regimens, surgical intervention and the long delays in recuperation and rehabilitation.

OPM Disability Retirement Attorney: The Quality of Input

We often forget that the quality, validity and accuracy of conclusions produced by computers will depend upon the input of information provided.  Thus, predictability of future weather forecasts are contingent upon present information selected, and the computational analysis resulting in the future paradigm is founded upon current constructs, analyzed through the cumulative data previously provided, with a dash of witch’s brew and a genuflection of hope.  In other words, the trash produced results from the trash collected; a rather self-evident tautology of sorts.

Federal & Postal Medical Retirement: Life’s Scarring

It builds through repetition of wounding, or because it is deep, jagged, or otherwise unable to repair through normal processes of cellular regeneration.  It remains a mark of a person; over time, fading through exposure to sunlight, disappearance of discoloration, and the slow erasure of the damage done through the healing process of the linear course of a lifetime, may allow for one to forget.

Traumas, medical conditions and chronic maladies takes time to heal, and time is the commodity which society relishes, values, and measures by the worth of productivity.  It is that segment of immeasurable continuity which determines the markings of a lifetime’s work; like prehistoric epochs which we name in order to neatly fit in the existence of dinosaurs and their disappearance through volcanic and meteoric catastrophes, we bifurcate the unconquerable continuum with significations of memorable moments in time.

Medical conditions and their disruptions to lives require time for healing; and whether it is the impact of psychiatric conditions upon one’s psyche and soul, or the physical manifestation of a chronic illness or injury, that commodity of value in the world of economics remains unsympathetically beyond the reach of most.

For Federal employees and U.S. Postal workers who suffer from a medical condition, such that the medical condition prevents the Federal or Postal worker from performing one or more of the essential elements of the Federal or Postal job, the acquisition of time becomes ever more important and critical as one awaits the winding morass of a Federal Disability Retirement application through the bureaucratic maze of the U.S. Office of Personnel Management.

Bureaucracies grind forward as if time is nonexistent; but all the while, life must continue to flow, as rivers unfettered by dams and natural obstacles, the course of life cannot be interrupted by mere tragedies of fate.  The problem is, of course, that the rest of the Federal bureaucracy — agencies, coworkers, supervisors, managers, etc. — does not have the patience to wait upon Federal and Postal employees during a daunting administrative process in which it is already known that, if successful, the Federal or Postal employee will be leaving the agency or the U.S. Postal Service.

So, what is the reaction during this administrative process?  Sometimes, it results in an administrative separation; more often than not, to simply allow the Federal or Postal employee to remain on LWOP and remain forgotten, lost in the maze of time immemorial.

In the end, it is life’s scarring which remains; how one has been treated; whether the burns of fate scorched upon flesh or memory were deliberate or through an uncaring indifference. No matter; as life’s scarring is like an organic monument of one’s test of endurance, so the manner in which one approaches the wound will determine the character of an individual.
