FERS Disability Retirement from OPM: Thinking Ahead

The natural query as an addendum would be: Ahead of what?  What is the intervening cause, issue, obstacle, etc., beyond which the thinking must anticipate in order to overcome, and where the necessity arises in order to avert the troubles prognosticated?

We can, of course, think ahead in a general sense, and that is often a wise activity to engage in.  We all know of those whom such a process never becomes a part of their routine — always running late; often missing commitments because of scheduling conflicts never resolved; of living entirely and exclusively “in the moment” without an aforethought involving consequences of tomorrow’s needs, let alone the day after or the day after that.

Thinking ahead involves and requires planning; anticipating what will likely occur; a realistic assessment of events that can be reasonably predicted; and to act in preparation for the inevitability of near-certain occurrences.

Medical conditions in a Federal Disability Retirement case often involves such a necessity — of anticipating what will happen within a few months’ time, or a year hence.  Yes, and there is the requirement that your medical condition must last a minimum of 12 months; but that can almost always be in the doctor’s prognosis based upon past treatments of similar medical conditions.

It is the step which faces the chasm; the human will is a peculiar and mysterious entity; from thought comes actions, but it is that step which is the deep mystery that often cannot be overcome.

We all know “talkers” — those who, though mired in the plenitude of words spoken, never get beyond that.  Are they sincere?  Perhaps.  Some people do speak with the good intentions of following through with actions, but after a repetition of patterns shown where no follow-through is established, people tend to treat such people with dismissive irrelevance or, worse, with open scorn.

Words are meant to lead to actions; when they fail to, we tend to ascribe underlying motives which can never to fully established: “He lied”; “He just didn’t have the time”; “She meant to, but just forgot”; “Oh, you know how she is”, etc.  How actions follow through; what the thought processes are; how the inner sanctum of fear and loathing come into play; these are all the wheels of mystery that turn upon the human mind.

For Federal employees and U.S. Postal workers who suffer from a medical condition such that the medical condition prevents the Federal or Postal employee from performing one or more of the essential elements of one’s Federal or Postal job, the words, “I have a medical condition”, may then necessitate the actions of, “I must file for Federal Disability Retirement benefits”.

Legal Representation for OPM Disability Retirement: Later editions

Later editions are never as valuable as the First Edition, unless of course something additional has occurred, like the author’s inscription and signature, or a typeset error which is limited in number, or perhaps a reissuance but for a “limited number”, and sometimes as an “anniversary” reprinting, especially and again, if the author or progenitor has signed such a copy.

People follow upon such objects of value; for, as such artifices are mere human conventions, the behavior towards such creations reflect the conduct of man towards his fellow man.  Thus do we treat “later editions” with reduced fanfare; the old are replaced by the new every day, and “first editions” — of a new employee, a rising star and other more recent arrivals — are accorded greater degrees of “oohs” and “ahhhs”.

One might counter that “First Editions” should instead be identified, as a metaphor for human beings, as those who have remained for the longer period of time, and not accorded such status to newcomers; it is those who “come after” who are the second or third impressions, and should be acknowledged as “less valuable”, and not more.

For Federal employees and U.S. Postal workers who suffer from a medical condition, such that the medical condition prevents the Federal employee from performing one or more of the essential elements of one’s Federal or Postal job, it is often the case that your “value” to the Federal Agency or the Postal Facility seems to have diminished as Second editions and Third impressions come upon the scene.

Look at the beauty of First Edition books, for example — often with some wear, and maybe even a tear, but it is the worn state of condition that is often compensated for by the years of experience for which the deteriorated condition can be valued, yet does the “bookseller” treats the later editions as more “valuable” than the stated First Edition?

Federal Disability Retirement: Landmines undetected

Landmines, or other similar devices left undetected, whether improvised to explode and damage, harm or otherwise maim and kill, are constructed and implanted precisely for the purpose of being hidden until it is too late — until, unaware and unconcerned, the unwary enters into the foray of the device and suffers from the resulting potency of mayhem.

Landmines undetected do exactly what they were intended for: to catch the target unaware, and to perpetrate the greatest extent of harm and destruction possible.  Undetected, they lay in wait in camouflaged veils of surreptitious decoys meant to project an aura of innocence and harmlessness, until it is too late.

Then, of course, there are those landmines which could have been detected, or should have been; where the unwary should have been easily apprised of the potential harm, but for whatever reason — apathy, ignorance, lessening of one’s resolve or suspicion, or whatever the excuse or reflective rationale — failed in the process and suffered the consequences.

The term itself — “a landmine” — is often used allegorically and metaphorically, to emphasize a point of danger, potential hazard or other undetected potentiality, whether concealed, veiled or ignored as irrelevant and insignificant.  For Federal employees and U.S. Postal workers who suffer from a medical condition such that the medical condition prevents the Federal or Postal employee from performing one or more of the essential elements of one’s Federal or Postal job, the landmines undetected in Federal Disability Retirement Law may become the very ones which lessen and diminish the chances for a First Stage success.

While most mistakes are correctible, the single greatest landmine that is left undetected, and which often results with the most dire of consequences, is the one that should have been known or otherwise thought of, but was left as a mere inkling ignored and unresolved.

Medical Separation from Federal or Postal Employment: Passion

No, this is not April, and Easter has long passed.  Have we done a disservice by admonishing our youth to pursue it?  That the worth of a thing is inherently determined by our response to it, and not in the thing itself?  If passion is defined by an emotional fervor, barely controllable and unable to be contained, have we set up the wrong criteria by which to live life?  Work, vocation, career — are they as fungible as life’s castaways, rejected based upon a momentary or fleeting sense of acceptance or denial?

In Western Classical tradition, the “ordering” of the soul in Plato’s Republic, or the search for balance in Aristotle’s Nicomachean Ethics, was always the standard to pursue, and was essentially commensurate with the Eastern approaches of Zen’s denial of the body, the warrior’s acceptance of karma and the fate of life as determined by death; and the circle of life as represented by the Rigvedic deity of fire.

Now, how we feel, the passion one embraces, constitutes the totality of acceptance in a world denounced of living spirits and reduced to materialism and Darwinian determinism of the lowest order.  Often, what is lacking is more revealing than the manifestation of a thing; and thus do bifurcated paradigms such as being and nothingness, worth and junk, life and inertness — it is the erasure of one which magnifies the other.

For Federal employees and U.S. Postal workers who have lost the “passion” for their vocation because of the introduction of a medical condition, such that the medical condition prevents the Federal or Postal employee from performing one or more of the essential elements of one’s positional duties as a Federal employee or U.S. Postal worker — the “loss” has a determinate criteria by which to evaluate, and is not merely based upon the lack of an emotional response.

FERS & CSRS Disability Retirement Benefits: That oppressive air

There are circumstances in life when the environment becomes so intolerable, that one just has an inkling to “chuck it all” and walk away.  Fortunately, the human animal possesses a measure of self-discipline and restraint; although, looking at the excesses of the world around us, one would never know it.  If you watch and read the news, one would logically conclude that the world around us is falling apart and disintegrating at the seams.  If you hermetically seal one’s life and shut down all communication devices, happiness may well abound in the bliss of ignorance, but you will be deemed to be either mad or uncouth.  That is, in fact, what the ad agencies wanted us to believe, wasn’t it?

The term of modernity has been “connectivity”; everywhere you go, it is essential to life’s essence to remain in communication through various electronic devices and systems; portable “hot spots” had to be maintained, and even roadside motels got into the swing of things by posting neon signs which first touted a low price for an internet connection; then, later, when the foundational economic principles of supply and demand forced a steep decline in pricing wars, a mere announcement that free WiFi was available replaced the spectacle of flashing signs touting those strange numbers, such as “$19.95” or “$9.99”, as if we were ordering a family meal at Denny’s as opposed to maintaining that vaunted “connectivity” (what an ugly word!) for our various electronic devices.

If I had been paid a dollar for every device and newfangled invention that delivered the advertised promise of allowing me greater “freedom” and “saving more time” in order to do those things which one never has time to do, we would all have retired to gated communities in wealth, luxury and comfort.  Instead, it seems that technology, the constant barrage of information and the heightened level of stress seems to compound the problem; and with a collective sigh, one may ascribe the generic term of that “oppressive air” to describe the state of malaise in which we find ourselves.

Such generalized pressures of life are further exacerbated for the Federal employee or U.S. Postal worker who must contend with the added difficulties of a medical condition, such that the medical condition prevents the Federal or Postal worker from performing one or more of the essential elements of the Federal or Postal positional duties.  Fortunately, for the Federal or Postal employee, whether under FERS, CSRS or CSRS Offset, there is a Federal benefit to be applied for — Federal Disability Retirement benefits.

OPM Disability Retirement: Loss of that subtle distinction — fun versus training

Reading older works of literature is a lesson in historical perspective; times were different, and not just slightly, but by leaps and bounds.  The linear nature of lives results in the incremental adaptation by evolutionary subtlety; that was precisely Darwin’s argument — that the metamorphosis reacting to physiological necessity in order to allow for the propagation of any given species, occurs not by genetic alterations involving sudden and drastic earthquakes, but by slow, almost undetectable nuances of change.

That is why there is no “missing link” to discover in the fossils of unrecorded history; the preservation of ancestry occurs by revealing closeness to modern kin, and the farther in time we discover, the greater the alienation of apparent relationship. Rarely does an anomaly of nature survive, for such mistakes test the forces of survivability; mutants are thus fodder for science fiction and stories about lost civilizations and catastrophic survivors of devastated ambience.  Dystopia is popular, as are zombies and mutants, but hardly reflect a reality generating scientific certainty or a foundation to base genetic discoveries for curing medical mysteries.

The aged who complain distressingly of “them good ol’ days”, have the ability and capacity to recognize the stark contrast between the ills of modernity and of the segmentation of remembrances decades ago; the comparison is not between today, yesterday, or even the day before; rather, it is by erasure of multiple middle years that we can realize the drastic alterations heaped upon us.

Thus, the slow boiling of a frog is the metaphor we can relate to; or, in literature depicting an age of innocence, where children played merely for fun, and not for training to be the next great olympian.  No longer can “playing” be for mere amusement and leisure; any and all activity must be measured as against future utility, and recruiters now roam the hallways and gyms — not of colleges or high schools, as one might expect, but — of middle schools and promising elementary classes.  There is, indeed, something drastically different between modernity and that “time before”, when “fun” is no longer allowed or allowable, and childhood, innocence and carefree disregard of world events must be a means to an end, and never a gemstone retaining value in its own right.

FERS & CSRS Medical Retirement: Fated Lives Intersecting

To state that, because something has happened, it was fated to happen, is to merely confess a tautology of meaningless repetition; and so there must be more to it than what the words themselves seem to logically undermine.  Thus, when Cassius lamented to Brutus that men at times “are master of their fates; the fault, dear Brutus, is not in our stars, but in ourselves, that we are underlings,” he was referring to the clash between human will and the predetermination of events already set, and despite our best efforts, our condemnation by force of will, it is our own pathos that evinces tragedy.

From Classical Greek mythologies to Heraclitus and beyond, the one constant throughout is that, like the river which ever flows and shifts to erode the currency in time, there is little that we can do to forego the fated intersection of lives.

The people we sit beside in school, whether we reach out to make friends or ignore in silent disdain; the lives we impact, whether by choice or by unintended disregard; it is because we cannot live in seclusion and the profound truism of John Donne’s poetry that, indeed, the bell tolls not for everyone else, but specifically for each person, that hamlets and hermitages abound in defiance of fated encounters.

That loneliness and sense of abandonment by all around, is never more powerful than when a person is beset with a medical condition, and suddenly it is as if one is either a martyr or a person shunned for contracting leprosy; either way, the doom of fate and the promising stars have banished any history of meaningful contributions previously attributable.

For the Federal employee and U.S. Postal worker who suffers from a medical condition, such that the medical condition prevents the Federal or Postal employee from performing one or more of the essential elements of the Federal position or Postal craft, the sense that the Federal agency or the U.S. Postal Service will not be supportive of a filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, is not just a mere chimera based upon unfounded psychosis; it is, instead, a very real dilemma.
