Disability Retirement from OPM: All problems suspended

We all seek those moments, don’t we?  A period of respite, that time of suspended ecstasy where all of life’s problems are suspended, if only for a temporary span in order to regain our equilibrium, retake the focus lost and remake the moments wasted.  Isn’t that why people become obsessed with silly arguments on the Internet, in Facebook confrontations and twitter feeds, because it provides for a temporary assertion of power, the sense of winning, of defeating and devastating another, if only for a brief moment in this timeless continuum of problems to be encountered, embraced and finally solved?

In a perfect universe, all problems suspended would be tantamount to a conceived heaven where one need not worry about the daily problems of living a life – the human condition – that confronts everyone all the world over.

All problems suspended – every financial difficulty, relational complexities, consequences intended or otherwise resulting from neglect, negligence or simply thoughtless actions; for all and every one of them to be relegated to a heavenly sequestration like purgatory without judgment.  But that life could be discovered within such a state of joyous reprieve; we would all be dancing and praying to the gods that gave us such a present.

In reality, that is what going to the movies for a couple of hours of distraction, playing a video game, going out with friends, or spending a weekend reading and taking the dogs out for a long walk – these are activities engaged in where all problems become suspended, if only for a brief stint of relief from the daily struggles we all have to confront and “deal” with.

Unfortunately, there is one problem that can almost never be suspended – a medical condition.  The medical condition pervades and remains no matter how hard we try; and though we may be successful in “forgetting” for a brief moment, the problem is never suspended, only delayed in “remembering”.  For people who are in chronic pain, one cannot even forget for a brief moment.  Instead, whether actively in thought or lulled through a sleepless night, the medical condition is always there, never suspended.

For Federal employees and U.S. Postal workers who suffer from a medical condition, such that the medical condition presents an even greater set of problems – of not being able to be accommodated and beginning to prevent the performance of one or more of the essential elements of one’s Federal or Postal job duties – it is time to consider filing for Federal Disability Retirement benefits, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset.

Delaying does not suspend the problem, but may only add to it; neglecting will not solve the problem, and may only magnify it; and while temporarily “forgetting” by engaging in another activity may distract from it, the brief nature of such thoughtlessness will only roar back with a greater sense of urgency, especially when dealing with the bureaucratic morass of the U.S. Office of Personnel Management, which is the agency that makes a determination on all Federal Disability Retirement applications.

FERS & CSRS Disability Retirement: Little battles fought

It is the minor skirmishes of life that maintain the vitality of everyday existence; they are fought in preparation for the greater battles and campaigns.  That is why a ‘strategy’ is important; otherwise, taking the same hill countless times in a day leads one to wonder what the greater plan is.  For, futility and the sense of meaninglessness are what defeat any motivation to continue.  Incentives for advancement; a sense of growth and an optimism for the future; these and other values are what one fights for, engages in skirmishes, and those little battles that are fought with a worthwhile sense of gaining something.

Medical conditions, especially of a chronic kind, tend to diminish the will to fight.  They not only weaken and debilitate; they begin to eat away at any sense of accomplishment and striving for those valued goals.  It is, in the end, a sense of hope for which we all fight the little battles fought; otherwise, the major wars would fail to be worthwhile.

Medical conditions are the “unfair” factor in any war, sort of like roadside bombs planted in this new war of hit-and-run attacks.  They often come upon one slowly; and whether in a sudden, traumatic event or evidencing a slow progression of debilitation and subtle changes over a period of days and months, the insidiousness of not knowing how to battle it, of doctors telling of being patient, of medications themselves sometimes having worsening side effects that complicate, exacerbate and exponentially magnify in frequency, severity and other realms of wounds endured – these all cumulatively combine to create a sense of frustration like fighting an enemy you cannot see and will never be able to actually “fight” in the traditional sense.

That is why preparing, formulating and filing an effective Federal Disability Retirement application, to be submitted to the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, is an important step in those “little battles fought” – for, unless the little ones are taken care of, the large ones that loom ahead may not be properly engaged in.

Reorganizing priorities; focusing upon one’s health; determining the future course of relevancy; these are all part of the metaphorical battles to be fought, but for the individual who experiences the medical condition and specifically for the Federal or Postal employee who must consider filing a Federal Disability Retirement application, they are no less real than the sudden devastation of a roadside bomb exploding beneath one’s Humvee.

Early Medical Retirement under FERS & CSRS: Of spare things left in the world

We don’t seem to have a capacity to share of those things which we have no need, anymore.  Does scarcity of resources result in “doubling down” in ways formerly described as miserly in deed?  Does the free market principle of supply and demand explain the loss of social grace in responding to need?  What ever happened to the spare tire, the jingle of spare change, and the ephemeral absence of spare time?  Has society come to a criss-cross of contending forces, where the explosion of population growth, the rise of the middle class in developing nations around the globe, coupled with the exponential depletion of finite resources, have cumulatively coalesced to an incandescent compromise of character crisis?  Does the lack of everything mean that we can spare no more for others, or provide assistance in the event of need?

As for the spare tire issue, the fact is that modern technology has extended the wear of tires, and many people have lost the knowledge or skill to use a jack or a lug wrench.  This, combined with fear of scams and roadside robberies, in conjunction with the durability of today’s tires, has resulted in the widespread consequence of calls for help defined as a cellphone dial for professional roadside assistance.  Further, society has deemed that any caricature of a ‘damsel in distress’ is tainted with a misogynist attitude; and we certainly would never want to be charged with an ‘ism’ at the cost of helping another.  And of spare change?

Homelessness has been relegated to either a non-existent phenomenon until a different political tide rolls in, or has otherwise been linguistically redefined as an alternative lifestyle.  What remains, then, is our spare time — which we have no more of, despite the constant drumbeat to the contrary that the aggregate of modern technology is always supposed to ‘save us time’.  Isn’t that what we are told each time a new gadget is foisted upon us?  That it will save time so that we have more time for greater and more important things — like politicians who suddenly leave office or fail to seek another term in order to spend “more time” with family.  Right.

The fact is that we are left with very little of anything, anymore, other than to stare vacuously into the fluorescent chambers of computer screens and smartphone apps.  Yet, spare time, spare tires and spare change — while apparently mere arbitrary anachronisms of antiquity, alas, fading into the dim light of change itself — reflects a community of sharing now lost as art was once a defined form.

For Federal employees and U.S. Postal workers who suffer from a medical condition, where the medical condition prevents the Federal or Postal worker from performing all of the essential elements of one’s Federal or Postal positional duties, the idea of sparing a person a break, has gone the way of other spare things.  Neither the Federal agency nor the U.S. Postal Service has any spare time to spare anything, anymore, and certainly no more than the rest of society can spare.

Filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, can be likened to the spare tire in the back of the trunk, which is always there but forgotten but for the time of crisis or need.  When the Federal or Postal worker can no longer perform one or more of the essential elements of one’s positional duties with the Federal agency or the U.S. Postal Service, then preparing an effective Federal Disability Retirement application to OPM is like getting out that spare tire.

The problem is, as most people have lost the skill to use the ‘other’ implements hidden beside the spare tire — like the jack and the lug wrench — so the proverbial roadside assistance may be required.  As for spare change and spare time?  Pockets are a requirement for the former, and future fashion will determine the necessity of an antiquated design, as will inflation and online banking for the need of coins or paper money at all; and as for the latter, we are told that we have more of that than ever before; just not enough to spare for others.

Federal Disability Retirement: The Court of Sycophants

The word itself is a linear sequence of consonants and vowels which delight the linguistic palate of parallelism between sound and meaning; rolling off of the tongue, it begins with the soft purr of the ‘s’, then slides midway into the harsh and guttural clash of a germanic cough, as if something untoward has been stuck in the center of one’s throat which needs to be cleared, like phlegm gathered in the mucous membranes of the respiratory passages; then flows to the end and drifts off into a quietude of irrelevance, disregard and dismissal, as the pointed meaning of application coincides with the diminishing utterance of fading signification.

In feudal times, when kings and princes of minor fiefdoms pockmarked the divided provinces of Europe and Asia, the gathering of sycophants pervaded each hour with daily tributes of flowery adjectives added effortlessly in conjunction with backstabbing motivations; the smiles of agreement and infusion of words to puff up the royal kingdom were offset by the murderous rage hidden in the dark corridors of dungeons where the abyss of human cruelty and malevolence resided with unfettered and ravenous appetite.

Does the modern presence of such and the like represent a fading vestige of that former calumny of bacterial servitude, or merely a reflection of the true nature of man’s essence?  The court of sycophants does not exist merely in dusty books of historical irrelevance; it survives in small pockets of sibling rivalries where inheritances are favored by means of embellished compliments combined with fading cognitive capacity for recognition of the distinction between words and sincerity; and in workplaces where no hostages are taken when one’s livelihood is at stake.

For Federal employees and U.S. Postal workers who are intimately familiar with the darkened hearts of sycophants, there are more colorful words used to describe them — as in the kissing of another’s behind; but whether one uses the original one or a replacement of a more informal vernacular, the meaning all amounts to the same.  Especially, when a medical condition begins to impacts the Federal or Postal employee’s ability and capacity to perform at the same level as before, the wide range of sycophants begin to make their appearance.

Somehow, denigration of others is believed to elevate one’s own status and stature, and indeed, the feudal court of sycophants was based upon that system of favoritism and derisive discourse.

For the Federal or Postal employee who suffers from a medical condition, however, such that filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management becomes necessary, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, the escape from the constant backbiting and backstabbing becomes necessary not only to maintain and further one’s health and well-being, but is also a recognition that one has lost the favor of the court itself, and it becomes incumbent upon the Federal and Postal employee to recognize that the Court of Sycophants has been powdering the nose not of the king’s face, but of the emperor whose clothes has disappeared and where the cheeks which quiver with frolicking laughter are at the wrong end of the anatomical map.

Medical Disability from Federal Employment: Predatory Pathologies

It is unnecessary to study the tendencies of other species and their internal drive to be who they are; for, it is presumed, the innate structure of their genetic makeup becomes the paradigm for self-explanatory justification, and like all conundrums of deviations from synthetic or analytic statements, the self-identity of the process itself makes it abundantly unclear.

Predators are by their very nature self-identifying; it would be a nonsensical proposition to ask the question, “Why”, in connection with the lion or cheetah that hunts and kills; or for the hawk, eagle, and even the household cat, despite their fuzzy beauty of cuteness and domesticated aplomb.  But of man, we question incessantly; of the long history of wars, cruelty, mass murders and genocide, the paradigm is one of puzzlement despite the footprints of self-explanatory consistency.

The need to act civilized in an antiseptic universe of artificial constructs jolts one back into the reality of who we are when deviations from such carefully created models shatter the very essence of our imagined parallelisms of worlds built upon virtual realities, and so we cry for such aliens who never were.  Barbarism tends to do that; and simple meanness in the workplace often shocks.

For Federal employees and U.S. Postal workers who suffer such rude awakenings, perhaps it is because of the disconnect between what we thought we were a part of, and the reality of what is.  That “disjointedness” is often easily attributable to the “medical condition” from which one suffers, and to which everyone else points for justification of bad behavior.

For, the Federal or Postal employee who suffers from a medical condition, where the medical condition impacts and prevents the Federal or Postal employee from performing one or more of the essential elements of one’s positional duties, the focus becomes the Federal or Postal employee, and the predatory pathologies which erupt and shed their thin veneer of civilized behavior become justified because of the loss of “mission accomplishment” of the agency, or some such balderdash of scientific explanation.

The plain fact is that there are bad people in the world, and no amount of studies of predatory pathologies will help to set aside the negative behavior of people within Federal agencies or the U.S. Postal Service.

The solution for the Federal or Postal worker who suffers from a medical condition, such that the medical condition prevents one from performing one or more of the essential elements of one’s positional duties, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, is to file an effective Federal Disability Retirement application through the U.S. Office of Personnel Management.

Let the Federal agency and the U.S. Postal Service worry about the “mission of the agency”; that will continue with or without you, as all bureaucracies do, just as predatory pathologies will persist despite multiple studies to the contrary.

OPM Disability Retirement Application: Eligibility & Entitlement

The two concepts are often confused; for the Federal employee and the U.S. Postal Service worker filing for Federal Disability Retirement benefits, the frustration is often voiced precisely because of the misapplication of the legal import between them.

Eligibility is determined by the contingencies which must be met, the thresholds of prerequisites which must be satisfied:  The Federal or Postal employee must be either under FERS, CSRS or CSRS Offset; the minimum number of years of Federal Service must have been accrued; the Statute of Limitations must not have already passed; further, then, some age limitations need to be considered as a practical matter, to allow for pragmatic justification to even apply.

Entitlement is based upon proof.  As the law is set by statutory authority, filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management requires that the Federal or Postal applicant meet certain preset standards of acceptable proof, based upon that which constitutes sufficiency of satisfaction.

The legal standard is based upon a “preponderance of the evidence“; the evidentiary requirement provides that a tripartite nexus be established between (A) the medical condition, (B) the Federal or Postal position which the Federal or Postal employee occupies, and (C) evidence showing that as a result of A, one or more of the essential elements of B cannot be satisfied.  Further, there is the “D” component, and that involves the issue of “reasonable accommodations” and whether the Federal agency or the U.S. Postal Service can reassign the Federal or Postal employee to a similar position at the same pay or grade.

It is only upon the initial satisfaction of eligibility requirements that the Federal or Postal employee can then further investigate whether entitlement is feasible or not.  Thus, “entitlement” in this sense is not based upon meeting eligibility requirements; rather, satisfaction of eligibility prerequisites allows for entrance into the gateway of establishing entitlement.

Federal Disability Retirement under FERS & CSRS: Reduction and Emergence

The fear in most instances is that the latter will not follow upon the former; that the state of diminution will become permanent, and the potentiality promised by a subsequent stage of linear progression will instead reflect a downward spiral or, worse, remain in a state of stagnant immobility.   And, indeed, neither in physics nor in human living, is there a stated and inevitable law of nature which mandates that following a period of reductionism, emergence of a greater state of affairs will occur.

Perhaps personal experience even dictates thoughts and reflections otherwise perceived; for, why is it that inventions and innovations seem to occur in youth?  Or that the older populace wants to merely hoard and fend off losses, like the football team that tries desperately to hold on to a lead, and loses in the process because they have failed to play with aggression and abandonment of fear?

Federal Disability Retirement should always be looked upon as an opportunity for the future.  It is likely the most thoughtful paradigm formulated by the Federal government, precisely because it encourages the system of disability payments to be “self-paying”, by allowing for disability annuitants to enter into a different vocation even while receiving a Federal Disability annuity, thereby continuing to pay back into the “system”.

Federal OWCP/Worker’s Comp does not allow a person to work at another job at all, while concurrently receiving permanent partial disability benefits; and Social Security Disability has such a low threshold of allowable earned income that it discourages further alternatives in employment.

But for Federal employees and U.S. Postal workers who receive Federal Disability Retirement benefits, the Federal and Postal worker can make up to 80% of what one’s former position currently pays, and all the while continue to receive the Federal disability retirement annuity, and meanwhile, accrue further years of Federal Service while on Federal Disability Retirement, such that at age 62, when one’s Federal Disability Retirement benefit is recalculated as “regular retirement”, the time that one was on Federal disability retirement counts towards the total number of years of service.

Thus, when a Federal or Postal employee first considers filing for Federal Disability Retirement benefits, there is always the fear involving the immediate reduction of one’s income; but such a limited perspective should always include the further possibility of the corollary potentiality — that of emergence in the near, intermediate or long-term future.

Regrouping sometimes takes some time; but whatever the specific circumstances which necessitate consideration in preparing, formulating and filing for Federal Disability Retirement benefits from the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, one should always be careful that a skewed perspective of future opportunity is not altered or quashed because of the medical condition from which one suffers.

As emergence is the natural consequence resulting from a period of diminution, and is the pink dawn of hope for the promise of a bright future, so reductionism is merely a temporary interlude in this brief visit upon the historical expansion of man’s infinite and limitless plenitude of potentialities.

Federal Disability Retirement: The Hug That Wasn’t

Regrets are priceless; they lack both a marketplace value, as well as a worth beyond applicability of accounting principles.  The conceptual void of negation; the paradox of non-existence and nothingness; the chasm of obsolescence and absence where once perceptual conformity allowed for the revelation of a thing; these are all within the imaginative mind of the human puzzle.

What possible evolutionary utility can be ascribed to things that did not happen, could have, but never did, and where the pit of void in one’s stomach leaves a dissatisfying wanting of that which could have been?  In the quietude of a sleepless night, when images of past concerns invade and prevent that final lull into a dreamworld of peaceful intent, those thoughts of missed opportunities, bumps in the night of moments forgotten by interludes of dusty memories once enlivened but now deadened with time and fading photographs darkened by degeneration of remembrances once clung to; in a twinkle of twilight, a sense of regret can pervade.

It has often been said that, on the eve of one’s deathbed, one never remembers the time of work unfulfilled; rather, we recount the time lost of things we did not do because we were too busy with work.  Regret does not cull the graveyards of memories lost about parallel universes involving work left undone at the office; instead, it reaches into the bottomless chasm of simple recollections, like the hug that never was.

Medical conditions often serve as a reminder of important priorities, and tend to impose the sequence of one’s lives, reordering them into a listing of priceless artifacts, like uncut diamonds lost in the sands of time.  Suddenly, one’s mortality is in question, and more than getting meaningless tasks done, the vitality of relationships come to the fore.

For Federal employees and U.S. Postal workers who suddenly recognize that a medical condition is beginning to prevent one from performing one or more of the essential elements of one’s job, the sense of regret often accompanies the realization, but is also and just as often a misplaced case of loyalty.  Why should fealty be sworn to an agency which is impervious to human suffering?  How can a guilty conscience pervade when the Federal or Postal employee has already given beyond what is required, for years and decades already lost?

Federal Disability Retirement is a benefit open to Federal and Postal employees who suffer from a medical condition, such that the medical condition impedes continuation with an agency or the U.S. Postal Service based upon a legal criteria of proof of preponderance of the evidence.  Guilt and regret should never be a part of the process.  Filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management is an employment right, accorded by statute, and should be done once the Federal or Postal employee recognizes that one cannot perform at least one or more of the essential elements of one’s positional duties.  Whether under FERS, CSRS or CSRS Offset, it is a benefit tapped into only through proof by evidentiary sufficiency.

And like the hug that wasn’t, the failure to file for Federal Disability Retirement is tantamount to the negation of rationality when continuation in circumstances of employment only exacerbates the pain, prolongs the suffering, and extends the nightmare; leaving to wonder the capacity of the human animal, the quietude of regrets and the forlorn despair of the empty space left, when once we tried to embrace a loved one, but instead spent that time serving a master who had long since gone home to his family.
