Federal Disability Retirement: The historical data

How much historical data is too much?  Is there a correlation between “too much” and “loss of interest”? In other words, when a history book is written, does the interest shown by the reader begin to wane when a certain point of quantitative overload begins to overwhelm?  Further, does the audience for whom the historical data is written depend upon the extent given?

Certainly, “popular” historical narratives provide “juicier” content than more “serious” biographies, where the salacious aspects of a person’s life or of an event are put to the fore, as opposed to relegating them to footnotes or in those “fine print” pages at the back of the book.

If, for example, data is compiled for an internal study for the “Historical Society of X”, then certain detailed information without limitations might be included — i.e. how many times this or that civilization went to war, went to the bathroom daily, ate one kind of fruit as opposed to another, etc. But if that “study” were to be made into a biography of an indigenous tribe, to be sold to the general public, it might leave out certain of the more uninteresting data, or placed in footnotes or “background notes” at the back of the book.

At what point does a historical narrative become “tedious”?  Again, is there a correlation between “interest shown/sparked/waning/losing” and the extent of data provided?  Is there a “qualitative” difference as opposed to sheer quantitative overload?

These issues are important to keep in mind when a Federal or Postal employee begins to write one’s narrative in response to questions posed on SF 3112A, Applicant’s Statement of Disability.  For, there is always a tendency on the part of the Federal or Postal applicant to have this unquenchable desire to “tell one’s story”, as opposed to answering the question on SF 3112A in as precise, concise and incisive manner.

At times, some amount of historical background may be relevant and somewhat necessary, but unlike “internal studies” that have no cognizable consequences in providing “too much” information, an overabundance of irrelevant data provided may have a duality of negative results: First, it may take away from, and diminish, the “main point” of the narrative, and Second, you may be providing information that is inadvertently harmful to one’s OPM Disability Retirement case without intending to.

Remember always in a Federal Disability Retirement case, that the eyes that once see cannot be blinded after the fact, and it is better to provide information as a supplemental means in a Federal Disability Retirement case, than to have to explain, correct and amend after a denial is received from the U.S. Office of Personnel Management.

FERS & CSRS Medical Retirement: Best/Worst Case Scenario

It is a procedural approach, and those who engage in it often have the greater talents akin to science, engineering, mathematics and symbolic logic.  It is the person who views every contingency in terms of best and worse case scenarios before deciding upon a determined course of action.

But how accurate is the “best” and the “worst”?  How can one determine if the informational input that is “fed” into the substance of that which will result in the output of what is described as the “best” and the “worst” is accurate enough to make it even worthwhile?  Does a gambler enter into a casino and make such assessments? Of thinking to him/herself in terms of: If I place X amount on the table and lost it all, what is the best case scenario, and what is the worst?  When a person begins a career, does he or she begin life with the same approach?  How about marriage?  Or having children?  Or, is it more likely that such an application really has a very limited impact, and should be used sparingly in the daily events of life’s encounters?  Is that a false set of alternatives precisely because there are many incremental and relevant “in-betweens” that may determine one’s course of action?

Perhaps the picture painted of the “best” scenario of outcome determinatives need not be the basis for one’s decision, and even the “worst” case scenario need not be the minimum standard or quality of life that we would accept, but somewhere in between or just shy of that extreme cliff that we have described?  Perhaps they are false alternatives when we present it in that light, with only those two extremes of alternative realities to consider?

For the Federal or Postal employee who suffers from a medical condition, such that the medical condition prevents the Federal or Postal employee from performing one or more of the essential elements of the Federal or Postal employee’s job with the Federal Agency or the Postal Service, preparing an effective Federal Disability Retirement application does not need to be based upon false alternatives presented, but should instead be based upon a pragmatic step towards recognizing the reality of one’s medical condition, its impact upon one’s capacity and ability to continue in a job or career that may be detrimental to one’s health, and proceed based upon the totality of factors considered – but primarily with a view towards safeguarding one’s health.

Health is that “other factor” that tips the balance of what is the best or worst case scenario; for, in the end, there is no scenario at all without one’s health.

FERS & CSRS Medical Retirement: Bastion and Refuge

The former is a fortress of protective repose; the latter, a shelter from pursuit or danger; in either case, both provide for an escape from harm.  And there are harms beyond physical danger, which count as “real” threats.  One need not be a refugee standing in line at the borders of Hungary or Croatia, hoping to be given asylum enroute to Germany, France or the U.K. in order to be considered a person of persecutory targeting.

Whether physical harm or by psychological demeaning, the need for safe harbor should never be determined by comparative analogies of differing circumstances, but via the perception of our needs and levels of tolerance.

In logic, there is the fallacy of mereology, where the relationship of part-to-whole can lead to conclusions wrong in substantive form, and dangerous in terms of truth and validity.  One’s own circumstances may be “merely X” in comparison to the greater encompassment of tragedies taken as a whole; but that does not necessarily invalidate the reality of the desultory situation one must face, and the loss of compass, meaning and circumference of relational considerations in determining the future course of one’s life.

Medical conditions have a tendency to skew one’s perspective.  To continue on without change or repose, because the rest of the world in comparison to one’s own microcosmic universe is merely that much worse off, is to deny the reality of one’s own hurt.  For Federal employees and Post Office workers who feel that giving up one’s career and applying for Federal Disability Retirement benefits through the U.S. Office of Personnel Management is a step towards escaping to a bastion and refuge but one which fails to adequately compare to others in more dire circumstances, the need for a “reality check” is often required.

One needs to always start from the vantage point of the present.  What others do, where others are, and how comparatively one’s own situation is “merely X” in contrast to stranger-Y, are irrelevancies perpetrated upon one’s imagination through an overabundance of informational overload.  Once, there was a time when a local newspaper was the only contact with the greater world.  Now, with Smartphones and constant Internet access, we tap into the greater bastions and refuges of those in far-off lands.

But for the Federal employee and the U.S. Postal worker who must confront the reality of the situation of contending with a medical condition, such that the medical condition prevents the Federal or Postal employee from performing one or more of the essential elements of the Federal or Postal positional duties, the “here and now” is what must be faced, and whether one’s medical condition and the situation facing the Federal or Postal worker of today “merely” pales in comparison to others in unknown wastelands, is to concern one beyond the focus and centrality of concerns and problems encountered now, in real time, in the reality of one’s universe, today and this minute.

Other parallel universes will have to deal with their own internal problems; it is the bastion sought and the refuge take by the Federal or Postal employee of today, which matters in the most personal of manners, and what should concern the hurting Federal and Postal employee in the here and now.

OPM Disability Retirement Attorney: Avoiding the Pedantic Prophet

Doomsayers are everywhere, and in every generation and region of thoughtful pronouncements, prophets foretelling of anticipated events await to ring the ears of those who desire future confirmation of that which was already expected.

Beyond the general prophesy of future events, however, is the one who focuses upon minutiae and details irrelevant to the greater paradigm of events.  It is like the man who was informed that major surgery would be necessary, and oh, by the way, the scalpel to be used is made by a German manufacturer whose great uncle was related to Lord Byron.  Interesting tidbits may be relevant in limited circumstances; one should avoid the pedantic repetition of facts, events and details which detract from the main theme of a narrative.

In preparing a Federal Disability Retirement application, filed through the U.S. Office of Personnel Management, whether you are under FERS, CSRS or CSRS Offset, part of the process must involve the preparation of a Statement of Disability as required by completion of Standard Form 3112A.  Certainly, details can be important; but a meandering rambling of peripheral issues detracting from the centrality and essence of one’s case, can not only become a self-undermining proposition, but annoying as well.

Begin the narrative with the focus upon the condition, then build upon that with reverberating ripples of riveting prose of significance and tactile tenses entailing direct links to positional requirements.  For, in the end, a Federal Disability Retirement application is a person’s story, told in narrative form, as a paper presentation to OPM which must be singularly focused, coherent and comprehensively conveyed.

When the world is foretold of coming to an end, one does not want to know the color and make of the undergarment to be worn by your neighbor; at best, it distracts; at worst, it may well reveal a privacy concern you did not want to stomach.

Federal Disability Retirement under FERS & CSRS: Reduction and Emergence

The fear in most instances is that the latter will not follow upon the former; that the state of diminution will become permanent, and the potentiality promised by a subsequent stage of linear progression will instead reflect a downward spiral or, worse, remain in a state of stagnant immobility.   And, indeed, neither in physics nor in human living, is there a stated and inevitable law of nature which mandates that following a period of reductionism, emergence of a greater state of affairs will occur.

Perhaps personal experience even dictates thoughts and reflections otherwise perceived; for, why is it that inventions and innovations seem to occur in youth?  Or that the older populace wants to merely hoard and fend off losses, like the football team that tries desperately to hold on to a lead, and loses in the process because they have failed to play with aggression and abandonment of fear?

Federal Disability Retirement should always be looked upon as an opportunity for the future.  It is likely the most thoughtful paradigm formulated by the Federal government, precisely because it encourages the system of disability payments to be “self-paying”, by allowing for disability annuitants to enter into a different vocation even while receiving a Federal Disability annuity, thereby continuing to pay back into the “system”.

Federal OWCP/Worker’s Comp does not allow a person to work at another job at all, while concurrently receiving permanent partial disability benefits; and Social Security Disability has such a low threshold of allowable earned income that it discourages further alternatives in employment.

But for Federal employees and U.S. Postal workers who receive Federal Disability Retirement benefits, the Federal and Postal worker can make up to 80% of what one’s former position currently pays, and all the while continue to receive the Federal disability retirement annuity, and meanwhile, accrue further years of Federal Service while on Federal Disability Retirement, such that at age 62, when one’s Federal Disability Retirement benefit is recalculated as “regular retirement”, the time that one was on Federal disability retirement counts towards the total number of years of service.

Thus, when a Federal or Postal employee first considers filing for Federal Disability Retirement benefits, there is always the fear involving the immediate reduction of one’s income; but such a limited perspective should always include the further possibility of the corollary potentiality — that of emergence in the near, intermediate or long-term future.

Regrouping sometimes takes some time; but whatever the specific circumstances which necessitate consideration in preparing, formulating and filing for Federal Disability Retirement benefits from the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, one should always be careful that a skewed perspective of future opportunity is not altered or quashed because of the medical condition from which one suffers.

As emergence is the natural consequence resulting from a period of diminution, and is the pink dawn of hope for the promise of a bright future, so reductionism is merely a temporary interlude in this brief visit upon the historical expansion of man’s infinite and limitless plenitude of potentialities.

OPM Disability under FERS, CSRS or CSRS Offset: To Fly a Kite

It is the epitome of a pleasurable moment, of engaging a mindless activity which spurs thought; and so to fly a kite is to soar with winds beyond our reach.  Does a life lived vicariously live life lifelessly?  As the flapping breeze at heights unreachable carries it airborne with but a thread to preclude its sudden spiraling away and into an abyss of telephone wires, treetops and treacherous heights of threatening snags, it is that hand which holds steady the coil of connection which controls length, movement, and steadiness of stability.

How tenuous is the reed of life?  When once youth masked the viscosity of existence, where mortality seemed but a yarn of empty rocking chairs and tall tells in the shadows of the flickering embers of a warm fireplace; and how the tenacity we maintained with vigor and vitality concealed those fears we harbored as we set about to conquer the challenges of an uncertain world; but when the fanfare subsided, and the promises of unspoken ceremonies fell silent before the finish line, the realization that life is but a short span of eternity where worth and value can be embraced only by measuring the momentary warmth of a hug or holding a gaze with a loved one for a millisecond beyond the practical, then does one finally achieve a balance of peace in a universe of turmoil.

The holidays tend to bring such realizations to the fore; so do medical conditions and their impact upon body, mind and soul.  If by “soul” we attribute, just for a moment, not that controversial component of man where existence beyond the ephemeral world of matter must by belief encompass eternity, but instead, the aggregate of man’s complexities:  of mind, physical body, consciousness, the heart and vegetative divisions, etc. — then it is indeed the totality of man who is impacted by a medical condition.

For Federal and Postal employees who find themselves with a medical condition, such that the medical condition prevents one from performing one or more of the essential elements of one’s job, the tenuous reed of life becomes exponentially magnified because of the stoppage of career, intervention of life’s goals, and interruption of all of the “things” that need to be done.  An interrupted life is like the proverbial ship without sails; the moorings have been damaged, and one senses a drifting without control.

Filing for Federal Disability Retirement benefits is a pragmatic step for the Federal employee or the U.S. Postal Worker who cannot perform each of the essential elements of one’s Federal or Postal position.  When a medical condition impacts a Federal or Postal employee, it is the pragmatic steps — the ones which can actually realize a practical outcome — which counts for something.

If you are a Federal or Postal employee under FERS, and you have at least 18 months of Federal Service, then you have already met the minimum eligibility requirement to file for Federal Disability Retirement benefits.  If you are a dinosaur under CSRS or CSRS Offset, then you have likely already met that requirement, anyway.  All that is necessary is to put together a case of proving that one’s medical condition prevents the Federal or Postal employee from performing one or more of the essential elements of one’s Federal or Postal job, by a preponderance of the evidence.

For, in the end, it is that thin thread which guides the pleasure of flying a kite which stands between chaos and connectivity; letting go should not be the only option; it may just be a little tug which is all that one needs, in order to steady the flight of life and retain that childhood sense of invincibility.

Federal Disability Retirement: Peripheral Vision

Something catches one’s notice; perhaps an odd movement, a dotted color scheme of minute origins and insignificant except in contrast to the toneless surroundings; or, because of a survival instinct still active from a forgotten history of evolutionary need, a signal of caution that danger may be lurking.  The eyes shift; the attempt to focus upon that which was noticed through one’s peripheral vision, is suddenly lost forever.

No matter how hard you try and focus upon that which seemed perceptually evident, but somewhat indistinct, where one’s peripheral vision caught a moment of certainty, but now the direct visual assault is unable to locate that which existed outside of the parameters of the obvious.  As much in life is an anomaly which can only be adequately cloaked in metaphors and analogies in order to reach a semblance of understanding and comprehension, so the loss of that which existed on the edge of perception can never be understood, where directness fails to hit the target, but indirectness does.

Much of life is like that; we think we have it all solved, or under control, when suddenly chaos and the abyss of timeless disruption overtakes us.  Medical conditions have a tendency to do that.  It is, to a great extent, a reminder that our souls are not the property of our own selves, but only on borrowed time, to be preserved and valued through a course of time within a boxed eternity of complex circumstances.

For Federal employees and U.S. Postal Service workers, when a medical condition hits upon the very soul of one’s being, and begins to prevent one from performing one or more of the essential elements of one’s ability to perform the positional duties of the Federal or Postal job, consideration should be given to filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, whether one is under FERS, CSRS or CSRS Offset.

The beauty of life can be missed entirely if the focus is always upon the directness of existence; sometimes, we lose sight of the obvious when we fail to prioritize and organize the conceptual constructs given to us in a world of color, light and blazing conundrums of caricatures.  A medical condition is a trauma upon the body, mind and soul; continuing in the same directed assault upon life, without pausing to change course, is the worst path one can take.

Filing for Federal Disability Retirement benefits is an option which allows for reduced stress, potential future security, and time acquired in order to attain a plateau of rehabilitative peace.  It is a benefit offered to all Federal and Postal employees who have met the minimum requirements of Federal Service. That once forgotten art of perceiving beauty in a world of concrete and ugly structures of septic silliness; it is often the peripheral vision which catches a glimpse of life, and not the monotony of mindless work forging ahead in a blind alley of repetition.
