FERS Medical Retirement: Response to the Shotgun Denial

When the U.S. Office of Personnel Management issues its Initial Denial of a Federal/Postal Disability Retirement application, the usual methodology of argumentation they employ is likened to a shotgun blast — with very little aim or focus.

It is a frustrating narrative to read, and all the more so because they have had an unlimited amount of time to formulate and write the denial, whereas the denied applicant is provided a very short response time.  The Denial Letter can appear extensive in scope, and the initial reaction is to try and rebut each and every line of the denial letter — which is the wrong approach to take.

The “right” and most effective responsive approach to take when responding to an OPM Denial of the Initial application is to categorize the various issues into a manageable number of subcategories, and then to respond to each in a systematic manner, and as to each, to cite a supportive case law that favors your argument.

Remember always that OPM’s purpose in denying your case is two-fold — either in hopes that you will not respond in a timely manner or not at all (thereby obviating the need to do anything further because you will have lost your administrative right to proceed any further in the process); or, that the process will appear so complex that you will fail to respond adequately to the multiple points of the denial letter.

Do not get caught up in the “fairness” issues — for, the entire bureaucratic process is unfairly weighted in favor of OPM at every turn, and to become embroiled in arguing against the unfairness will only lead to endless frustration and get you nowhere.

OPM Medical Retirement Help: Luck and Chance

Is everything determined by it?  Has Darwinian evolution “proven” that when luck and chance happen to coalesce into the “perfect storm” of elements combining at just the opportune moment, that life can suddenly germinate and appear from nothingness?  Or, must there always be an efficient cause in order for even luck and chance to generate the first murmurings of movement’s chords?

Federal Disability Retirement Representation: Living Anguish

Two or more meanings can be gleaned, often depending upon the emphasis one places upon the sequence of words uttered.  One is the experience of the state itself; the other, the active phenomena in the presence of now.  In either form, the clear implication embraces the state of anguish, whether in a living state, or by living it.

Is the state of existence in modernity itself a constant and unavoidable situation involving anguish?  Is the craziness of the lives we live — of the inevitable rush of each day; the interference of work into personal lives, and the incessant drum of technology without a moment’s pause of temporary cessation — the cause of such anguish, or is the anguish felt merely a reflection of who we are?  Is it any different from the days just following the Last Great War when men and women bemoaned the state of absurdity while drinking coffee at sidewalk cafes in Paris?

Living anguish — again, whether in the form of “aliveness” or meaning merely that it is a state of being we find ourselves in — is a simple fact of modernity’s choice of existence.  For, except for those who can afford to live a life of luxury attended to by servants, cooks, butlers and chauffeurs, do the rest of us choose the living anguish, or do circumstances impose the state of being without any say-so in the life chosen?

Federal Employee Disability Retirement: Owning a landline

It is perhaps the single telling factor of a generational divide; if you own a landline, it is likely you are not a millennial.  Or from the generation just before, or even the one before that.  You are probably from the generation sometime within the timeframe of “just after” the Korean War and around the end of the Vietnam War.  It is the remembrance of unreliable “bag” phones and cellular connections that barely became audible; but more than that, it is the evidence of who one is based upon the generational divide that naturally occurs between sets of population growths.

Can there be similarity of morals, ethics and behavioral patterns merely because one is born into a designated generation, as opposed to other such assignations of identifiable features?  Is it really true that one generation has a characteristic trait that is identifiable, recognizable and with imprints that define it with clarity of traits?  Are there “lazy” generations, “psychotic” ones and those that are mere sheep in a fold of followers?  Does owning a landline betray such a characteristic, anymore than being a hard worker, a person who always attends to one’s responsibilities and never turns away from obligations ensconced in the conscience of one’s being?

Yet, at some point, we all become adults, make decisions separate and apart from a “generational identifier”, and go on to become responsible for the pathways taken, the decisions undertaken and the consequences wrought.  Can it be so difficult to abandon a landline, to cancel it, to unplug it?  Or is it the imprint of a generation, so steeped in regularity and reliance that the youthful days of one’s generation cannot ever be completely severed and forgotten?

Owning a landline is like the Federal or Postal employee who comes from a generation where filing for Federal Disability Retirement benefits is almost unthinkable.  It is that characteristic trait that you have to continue working, striving, contributing and making it into work “no matter what”.

Disability Retirement under FERS & CSRS: That child we remember

It is as if we hold, within the inner eye of one’s consciousness, a fading photograph of an innocent, pure child – that child we remember before…

Before what?

Perhaps, the breaking up of a romanticized recollection of an intact home; or a period of natural rebelliousness marking a distancing from the carefree hugs, kisses and unselfconscious holding of hands, when puberty becomes the demarcation point of silly alienation; or maybe just before simply entering into the world of cynicism and loss of innocence.

Afterwards, does it continue to provide a positive impact to carry about the mind’s eye a picture of that child we remember?

After what?

After a lifetime of human encounters reflecting the soil of evil, meanness, indelicate indifference and manipulative motives suspicious of unclean thoughts and insensitive undercurrent of capricious targeting.  In those instances, how does one remain pure and reflect the innocence of that child we remember, without becoming destroyed in the process and becoming a mirror image of that which we attempted to resist throughout our lives?  For, isn’t that the fight we strive throughout – of trying not to be like the uncaring parents who neglected, the failed relationships we tried and the backstabbing friendships that we discovered too late?

We try and harken back to that child we remember, knowing always that we will never quite ever recapture that moment forever lost, and simultaneously recognizing that it is not an achievable goal, and even something not necessarily desirable to attain.  Yet, in the subconscious of our private and compartmentalized souls, we always hold an image of that child we remember, and believe that somewhere in the essence of our very souls, there is that remnant of a spark that has survived the evil detritus of the world around us.

Once, mythological figures and characters looming larger than life itself wandered amidst the common populace of everyday working folks; their very presence bestowed a greater sense of purpose, of a pride in knowing that better days lay ahead, and that even in the upheavals of tempestuous travails and turmoils which interrupted every economy and fiefdom because of the inevitable vicissitudes of economic activity, that somehow we would all survive through the common efforts of community.  But the pureness of the mountain stream became poisoned, diluted and polluted by egomaniacal intrusions of selfish constructs; “we” did not matter much, if at all, and the accolades of accretion demanded greater self-congratulatory spotlights of self-centered egoism.

Perhaps we know too much today, because information is cheap and available; and perhaps giants never roamed the earth in epochs extinguished by time and modernity; for the figures larger than life are nowhere to be found, but in what we make of our lives through sheer effort, planning, and genuine concern for the man sitting right next to us.

FERS & CSRS Disability Retirement Law: The Carousels of Summer

The mounts littered throughout the roundabout can be diverse and captivating; in the swirl of the rotating platform, the child in us wants to sit upon every creature, from unicorns to zebras, the traditional horse and the mythological creatures of one’s limitless imagination.

As we grow older, we come to realize that the spinning sensation itself remains static; the difference between climbing into the bosom of one creature as opposed to another, is indistinct and ultimately irrelevant; when one’s childlike imagination and excitement wrought in ignorance of the cruel world becomes extinguished, the fun of being naive and clueless is no longer an option.  Cynicism comes with maturity; the older we get, the less likely are we to allow ourselves to travel into the realm of the unreal.  Life tends to do that to us.

The road of hard knocks is littered with tales of turmoil and turbulence; storms come and go, and while the devastation left behind can be somewhat repaired, the psyche and soul of damaged people can rarely be glued back together, as fragile porcelain leaving behind fissures wide and gaping as the childlike wonderment we once knew.

Federal and Postal employees know the experiences of life:  the internal battles, the power struggles and the herd-like mentality of agencies and departments.  Then, when a medical condition hits, and the Federal or Postal employee is no longer the golden-boy of past cliques, one is cast aside like the child who is left outside of the teams picked in linear sequence, until the silence of being ignored becomes a reality as shame and embarrassment shouts in muted suffering.  Sometimes, the wisest move is to move on.

OPM Medical Retirement Lawyer: Life’s Series of Decisions

As activity is the fingerprint of life, and inertia denotes death (or at least a somnolence of sluggishness), so the parallelism between thought and life follows the logic of movement versus progressive decomposition.  Thinking, according to Aristotelian tradition, constitutes the essence of human-ness.  Other species may have characteristics which define and distinguish; for the human animal, it is the process of thinking, or thought-engagement, which differentiates and identifies by uniqueness of quality.  Part of that cognitive process involves decision-making.

For all species, this cannot be the essence of being, because such a principle applies to every genus, lest we conclude that determinism is ingrained in one’s DNA.  Predators must decide when and upon what the advantage of a chase will result; frogs must affirmatively choose when to snap that elongated tongue in the split second of time to satisfy its appetite; and men and women must resolve issues short of confrontations engaged in a prior state of nature, to confirm that civilization is indeed a progression of culture and sophistication, and not based upon brute force.

The underlying principles, then, which distinguishes human decision-making from other species, must be some other component; perhaps that of the formulation of a paradigmatic criteria upon which an option is considered.
