FERS Disability Retirement from the Office of Personnel Management: How is it?

How is it that the world became the way it is without our knowing it?  How is it that the rules were already in place, the lands already divided, the waters already polluted, the debt already ballooning, the inventions already made — how did that come about, and who told us the history of the “what”, “when” and “where” of the past?  Can a society long endure while ignoring the past of how it developed and came into being?  And who gets to tell the tale of who we are, how we came to be, and why we are the way we are?

Berkeley’s epistemological approach was to confine knowledge to that which we can perceive, thereby attempting to limit the problems inherent in Being, Truth and Reality.  Like so many of the British Empiricists, philosophy was being reduced to mere “language” difficulties and, indeed, history itself may bear out their “rightness” in this question and problematic approach.  There is, of course, a quiet revolution going on about our past, our history, and the telling of who we are.  That is always a good thing, so long as “Truth” is the end-goal of such an endeavor.

But when Truth itself has become relativized as mere language games malleable in the hands for greater artificial intelligence, and where algorithms rule instead of human input which confines it within stated ethical boundaries (and even that is questionable, given the underlying motives and intent of human beings generally), then perhaps Wittgenstein was right after all; it is all a matter of who sees the “truth”, who gets to “tell” it, and who maintains the Tower of Babel in this universe of increasingly unfettered liberty.

In the end, the “how” of the world will forever be revised as perspectives, opinions and viewpoints change; but it is the “who” that controls the lifestream of information and historical data as to what is important; and in this Orwellian world where the glut of information has relativized all truths, we care less about the “how” than the “who”, anymore.

For Federal employees and U.S. Postal workers who suffer from a medical condition such that the medical condition now impacts the Federal or Postal worker’s ability and capacity to perform one or more of the essential elements of one’s position, the history — or the “how — is important in preparing and formulating one’s Statement of Disability as posited on SF 3112A.  However, remember that all historical contexts must be provided in streamlined form; for, causality is not an issue in a Federal Disability Retirement application (whereas, in OWCP cases, it almost always is), and thus undue focus upon the “how” can detract from an effective Statement of Disability as reflected on SF 3112A.

The world around us may be concerned with the “How” of a question; for an OPM Disability Retirement case, it is the more current “what” that is the necessary focus of articulation.

Federal Employee Disability Retirement: Foreboding Sense

Are such “feelings” valid?  Does it even make any sense to apply the criteria of validity to a “feeling”, or are there circumstances where a foreboding sense of things can be accepted as a confirmed truth?  Does an outcome-based application of the criteria determine the validity of a feeling?

Say, for example, an individual possesses a 100% success rate in confirming the truth of a foreboding sense — does it validate the feeling?  Or is it based upon the foreboding sense that is declared to others who can confirm it?

A foreboding sense of things to come can, indeed, be valid, both as an outcome-based, retrospective confirmation as well as a singular instance of validity based upon a person’s experience.  For, just as statistical analysis cannot refute the probability of something happening the next time (ask a person who was actually attacked by a shark, or hit by lightening, as to whether the statistical improbability of an event makes any sense), so a person’s foreboding sense of things to come can never be mollified until the passing of a non-occurrence.

Such foreboding, however, can sometimes be assuaged and tempered by greater knowledge gained, and for Federal and Postal workers who suffer from a medical condition where the medical condition is beginning to impact one’s ability and capacity to continue remaining employed with the Federal Agency, it may be time to consult with an attorney to discuss the possibility of filing a Federal Disability Retirement application, to be filed with the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset.

A foreboding sense of an impending event may be validated by an outcome-based perspective; or, it may be a subconscious capacity to sense something that our conscious senses are unable to quantify.  But of whatever the source, it is often a good idea to confirm the validity of such a foreboding sense, and for Federal or Postal employees who have a foreboding sense of one’s circumstances because of a medical condition, the assuaging potion of choice is to consult with an attorney who specializes in Federal Disability Retirement Law.

Federal & Postal Disability Retirement: Bugs

Some are systematically exterminated; others, kept by organic farmers for their predatory advantages, including killing others; and still others are quickly brushed off as pesky little creatures not necessarily bothersome in numbers or even in appearance, but because “bugs” are simply not tolerated in an antiseptic universe where good order and neatness cannot include the appearance of a creature that may do nothing but crawl, creep and fly about in the open space of a garden, within a house or along the fence posts.

They have become a generic “catch-all” phrase that includes anything that moves about that is smaller than a rodent and larger than a speck of dust.  We have, additionally, transferred the sense of anathema in a more metaphorical manner, as in “bugs” in computers or in other appliances that fail to work properly, as if the living bugs in the universe are equated with those imaginary deficiencies of human technological innovation.  Then, there is the phrase, of course, of being worried about something, or having something bother one’s thoughts and invading the peace of one’s mind, as in the question, “What’s bugging you?”

We attribute and project from experiences we have had, and by analogy and metaphor transmit reputations that may never be deservedly ascribed.  Bugs are, in the end, creatures that are avoided, entities that have a reputation encompassing something less than desirable, and for the most part, have become a focus for instincts to exterminate, no matter that they are environmentally positive and have contributed to the balance of nature for endless ages.  And yet, we squash them without a second thought, brush them aside and swat at them to rid them from this universe.

They are, in many respects, tantamount to a microcosmic manner in which some people treat other and fellow human beings.

For the Federal employee and U.S. Postal worker who suffers from a medical condition, such that the medical condition prevents the Federal employee from performing one or more of the essential elements of one’s Federal or Postal job, the very concept of the “bug” applies in so many small and almost insignificant ways, but we just don’t realize it.  Has it “bugged” you that the Federal Agency or Postal facility mistreats you because of your medical condition?  Are you considered now as nothing more than a pesky “bug” that irritates, and does the Agency wish to treat you as nothing more than a “bug” to be squashed if given half the opportunity?

Yet, despite having contributed to the mission of the Agency or the work of the Postal Service for all of these many years, just like the bugs that have made the environment better throughout, the Federal or Postal worker with a medical condition is considered expendable.  It may be time to prepare, formulate and file for Federal Disability Retirement benefits through the U.S. Office of Personnel Management.

Resigning from Federal Employment and Filing for OPM Disability Retirement

Resignation is what the adversary wants; it is rarely an innate condition of the human animal.  Whether one believes in the evolutionary process of incremental genetic adaption, progression and determinism, or that the gods of traditional theology puts forth a teleological foundation, the concept of “giving up” possesses an inherent shrinking away, a repugnance and a natural inhibitor to an act which constitutes surrender and, in some corners of thought, betrayal to self.

But the will of human beings is what separates from the genus of that which we derive; and as monks can defy instinct and sit in burning bonfires of self-immolation, and sheer determination of will-power can overcome fear, the rush of adrenaline and the propulsion of compulsive irrationality through reasoned guidance, so there may be times when resignation carries with it a compelling basis which justifies the action.

For Federal employees and U.S. Postal workers who are contemplating filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, the issue of resignation is often at the forefront for multiple and varied reasons:  the agency often suggests it (which, in and of itself, should not be a basis for acting, as the self-interest of the Federal agency or the U.S. Postal service should not be the paramount concern during such a time of turmoil when a medical condition is impacting the Federal or Postal employee’s ability and capacity to perform the essential elements of one’s positional duties at the Federal agency or the U.S. Postal Service); where all Sick Leave, Annual Leave and FMLA rights have been exhausted, and the inability to maintain a regular work schedule has resulted in the initiation of disciplinary actions by the agency (here, the language contained in any such action proposed by the agency or the U.S. Postal Service may be of some use in a Federal Disability Retirement application); or where other pragmatic decisions may be contemplated, such as the ability to access one’s TSP in order to financially survive during the process of waiting for a decision on a pending Federal Disability Retirement application, as well as multiple other unnamed reasons too numerous to discuss within the confines of this limited forum.

Whatever the underlying reasons and rationale, there is often an instinctive reaction, a repugnance and resistance, in engaging an act which is tantamount to surrendering one’s career and “walking away”.  There may, in the end, be compelling reasons to perform such an act, and not all actions involving resignation constitute a reflection of a desperate need.  If reviewed calmly, and decided rationally after due consideration of all of the factors and elements involved, such an act of apparent self-destruction may in fact be the most prudent course of action which perpetuates the genetically-determined embracing of evolutionary survivability, or the voice of gods long whispering in the echoing reverberations of Dante’s concentric circles of ever-impending escape from the fires of hell.

Federal Disability Retirement: Evaluative Adaptability

Life is often like a boat without oars, let alone a motor which functions; and as the waves rock the water transport, one maintains balance, sanity and survival by attempting to prepare for the whitecaps and hoping for a further delay of a storm, and never a tsunami.  But those changes inevitably come, and attack in onslaughts of exponential fury.  One attempts to adapt, to remain like the chameleon who must survive by an unwanted metamorphosis, in order to maintain the delicate balance of nature as described by the brutality of Darwin’s world.

Man presumably has the advantage of possessing the dual modalities of penultimate capacity for survival:  the cognitive and the physical.  Of the latter, the human animal is neither a lion nor a cheetah; and of the former, self-doubt, confusion and intellectual arrogance often muddles the clarity of purpose shown by other carnivores.  But it is the combination of both — of the evaluative adaptability acquired through intake and filtering of information, analysis of factual and predictable processing, and shifting positions based upon real-time data reflected upon through a compendium of intellectual acuity honed and perfected by experience.

That is precisely why bureaucracies are often potholes of frustration; as systematized repetition dulls the soul, so the imposition of irrational decisions heightens the angst of man’s inner being.  For Federal employees and U.S. Postal workers who suddenly find that a medical condition may cut short one’s career with the Federal agency or the U.S. Postal Service, it is with that duality of advantageous survival mode that one must approach both the Federal agency (and the U.S. Postal Service), as well as the U.S. Office of Personnel Management.

Certainly, physical endurance is limited often by the medical condition and the deterioration of stamina and energy; but the evaluative adaptability and the capacity to change course should never be underestimated.

Medical conditions need not deter the direction of the boat; most medical conditions are mere whitecaps which rock like irritants on a summer evening where gnats and mosquitoes ravage the unprotected surface; but unlike hurricanes and tsunamis which overwhelm and destroy, the fact that one’s steering mechanism or the ability to propel oneself forward may be damaged, should never extinguish the Federal or Postal employee from recognizing that one’s evaluative adaptability is the key towards moving positively into the future and affirmatively taking steps to secure a brighter tomorrow, by beginning the process of preparing, formulating and filing for Federal Disability Retirement benefits through OPM.

Disability Retirement from Federal Employment: The Methodological Approach

Many call in a frenzy of confusion, admitting openly of being lost and not knowing where to begin.  That is always the starting point, as even Socrates conceded — of the hope of knowledge beginning upon a recognition of not knowing (though, if one looked carefully and scrutinized the face and eyes of the old sage, one probably gleaned a twinkle of sly naughtiness).

Philosophy began in ignorance, and from there, attempted to ascertain a methodology of approaching problems in a systematic way, in order to overcome the shortcomings of man’s frenetic inclinations.  Identifying and ascertaining a knowledge of a criteria, a system of approaching problems, and an applied methodology of solving, is the preferable way than that of plugging holes where leaks appear.

Thus, for Federal employees and U.S. Postal workers who need to file for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, it is often necessary to formulate a sequential strategy at the outset, before embarking upon the dark abyss of preparing, formulating and filing for OPM Federal Disability Retirement benefits.

In the end, as it turns out, Socrates knew much more than he revealed; but the sly sage was wise enough not to engage in the solipsism of later years, like Descartes and the French Existentialists, and by recognizing that lack of knowledge and the admission of such vacuity is the first step towards wisdom, he was able to initiate the prefatory questions in the quest for knowledge in a world devoid of both.

Federal Employee Disability Retirement: The Game of Calumny

If not one’s reputation, what is the remaining value?  If truth is not a goal, then what fills the void?  Yes, from ashes to ashes, and back to dust, and the elements which make up man are constituted by nothing unique beyond the environment from which he originates, and to which he returns; but the linguistic act of reductionism fails to achieve a full embrace, and just like the defensive football player who hesitates for a moment and sees the blur of the ball carrier speed past, so the aftertaste of materialistic reductionism is somehow unsatisfying.

For, to say that X is “nothing more” than an aggregate of atoms is to characterize a masterpiece as a mere collection of colors, and that is precisely Roger Scruton’s point, isn’t it?  Then, there is the game of calumny, of the capacity to try and strip another through slander and innuendo.  For Federal employees and U.S. Postal workers who suffer from a medical condition, that game by other Federal and Postal employees becomes a daily onslaught.

Somehow, it is not enough that one must suffer from the gods of fate and contend with deteriorating health.  Instead, one must further deal with the sudden isolation into disfavor, like lepers of yore shipped to colonies in deserted islands beyond the reach of virulent populations scared of their own shadows.  Slavery was outlawed decades ago, but the treatment of workers barely has changed.

For Federal employees and U.S. Postal workers who must file for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, the game of calumny by one’s “fellow” workers is merely another indicator that we are not merely a collected mass of elements to be spat upon, and that is a positive side to man’s inhumanity; but, then, finding out the truth about one’s fellow man is always better than to live in ignorance thinking that one’s Federal agency or the U.S. Postal Service was going to be supportive through thick and thin.

The time of “thin” has arrived, and it is in the thick of things that one must now fight for one’s rights.
