We tend to think that perfection is some entity “out there”, and we only have to search for it and find it.  Thus do we believe that the “perfect” marriage partner is out there; that the perfect career or job — and even the perfect life — is somehow in existence to be “gotten”, “had”, “embraced”, “met”.

Yet, people clearly have the wrong idea.  Perfection is forged; it is molded, hammered, worked upon; and like molten metal ready to be configured, it takes hard work.

People tend to think that all that is necessary in life is that “Aha” experience, where the gestalt-phenomenon is what is needed, and Nirvana then envelopes the unassuming.  The truth is, any “aha” moment is just the beginning; the years following — the hard work to forge that level of perfection not yet attained — are what will determine any semblance of perfection.

The delusions engage are represented in modernity by the extravagance of the Wedding Day.  On that day, the opulence and extravaganza seem to confirm the unfortunate falsehood, that if you just spend enough, if the wedding day seems like a day of perfection — then, aha!  Perfection has been achieved, and no further effort needs to be expended.

Unfortunately, such fairy tales do not occur.  Marriage, like anything and everything else worthwhile, must be forged.

Federal Employees Retirement System (FERS) Disability Law: The Novelty Vanished

As it should be, for a child, everything is viewed in terms of, “Wow!”  The novelty of life, of the experiences brought about by a world freshly encountered — like winter’s first snow or the dawn of spring’s warmth, it is the combined meeting of a world newly seen by the eyes of youth yet untarnished and without the destructive force of cynicism which accounts for curiosity, eagerness, innocence, unvanquished optimism and hopeful initiation of plans for a bright future.

That novelty vanished — and vanquished, extinguished and beaten down — comes from repeated encounters with a world which shows no care or concern.  It is when life’s complications keep knocking us down; that is when the novelty vanished.

FERS Employee Disability Retirement: Secondary Causation

Postal & Federal Medical Retirement: The Commodity of More

Of course, by definition, a commodity purchased or otherwise acquired is “more” — but that is not what is meant, here.  The commodity of more implies a greater good beyond the acquisition of the thing itself.  We buy things not for the thing itself; rather, we are sold the goods because of what they represent.  Otherwise, why do companies spend so much on advertising?

If the thing itself is so valuable and needed — or wanted — to such a great extent that it would sell without the “extras” of advertisements, then companies would merely place them on shelves and each morning, like the breadlines in the old Soviet Union, there would be a great clamor to purchase the product.

No — the products we buy are attached to the symbols they represent; of greater status; of more leisure; of increased comfort and superior lifestyle; of a life representing success.  But here is the catch: The commodity of more is like that proverbial straw that broke the camel’s back; at some point, the “more” becomes the greater stress that makes everything less — less worthwhile, less attractive; less enjoyable.  Especially when a medical condition enters the picture-perfect portrait of life.

OPM Disability Law: The Chasm between Reality and The Law

Non-lawyers will often read “The Law” and expect that reality will conform to the language as it is stated.  That is actually a good sign, in that the expectation of the layperson is that respect for the law will necessarily result in compliance with its dictates.  But language is malleable.  It is subject to interpretation, and that is the field of play which allows for elasticity and the chasm which develops between Reality and The Law.

There are, first and foremost, “The Facts” — and whether or not “The Law” applies to a particular set of facts.  Then, from that application of facts-to-law is the further problem of deciding its significance and relevance, and whether or not there are other contravening facts or opposing case-law or statutory citations which may also impact the direct argument of sound legal analysis.  Then, of course, there can be the further difficulty of people, companies, entities and agencies which completely ignore the law and, more recently, of creating one’s own set of “alternative facts”.

For Federal employees and U.S. Postal workers who suffer from a medical condition such that the medical condition has begun to prevent the Federal or Postal employee from performing one or more of the essential elements of one’s Federal job, it is important to apply “The Law” precisely, relevantly and comprehensively.

FERS Disability Retirement: The words we never use

Are they like scraps of papers left in one’s back pocket, or in the vast chasms of oversized purses that seemingly have no bottom and certainly reveal no corners?  Do we keep them in our wallets, reserve them for special occasions, or otherwise allow them to float in the ethereal universe of unclaimed inventions?  Is there a Lost-and-Found Section within an agency entitled, “U.S. Department of Words” (or, should there be) that deals exclusively with ones that are never used?  And in a pragmatic society where utility is the key for relevance, applicability, value and worth, is there any sense to pointing out that which is never used, never recalled, rarely regurgitated and almost certainly never thought of even in the privacy of soliloquies left unstated?

The words we never use can be categorized into: A. Ones we’ve never learned about nor looked up, B. Ones we once knew when once we were serious-minded students who diligently looked up every word we knew not the definition of because we wanted to better ourselves, sound more intelligent and appear with greater utterances of sophistication at cocktail parties we were never invited to — therefore, we once looked them up, memorized them, tried to use them in sentences, and then promptly forgot them, or C. Ones we never came across, have now no interest in using them because we have become old and lazy.

There is a fourth possibility — that we “know” them but “fear” that the mere utterance of them will make a nightmare of a reality we want to avoid.  “Divorce” is one such word for kids who watch their parents fight, and wonder about their own security in the universe of unstable families; “Chronic” or “intractable” are two others — for those with medical conditions who do not want to hear their doctors talk about the consequences of certain disabilities which have developed over the past couple of years.

For Federal employees and U.S. Postal workers who suffer from a medical condition where such medical conditions have now come to the point of being chronic and intractable, and thus prevents the Federal or Postal employee from continuing in his or her career with the Federal government, it is time to consider another set of words which were previously never used: Federal Disability Retirement.

Avoiding the use of words will not undo the reality surrounding the conceptual paradigms encountered; and procrastinating the thought, initiation or formulation of an effective Federal or  Postal Disability Retirement application will not make such words go away; they will remain, even if they are words which we never wanted to use.

Legal Representation on FERS/CSRS Disability Claims: What isn’t known

There is often that final question during a consultation — of “any other advice” that can be given, or whether something else was forgotten, or the generalization of “Anything else I should know?”  That is where the particulars of a case must be known, and the wide chasm that exists between “being a client” and merely receiving an initial overview of a person’s case.  For, what isn’t known is often the element that can harm or injure, and the question asked but left unanswered is the one that no one thought about but should have.

Lawyers like to enter an arena of legal battles well-prepared; all questions asked, normally already are presumptively answered, and no lawyer worthy of his opponent asks a question that he or she already doesn’t know the answer to, or at least has a fairly good idea about.  In a Federal Disability Retirement case, where there are multiple stages of an Administrative Process to tackle and prepare for, the First Key to success is to not submit that which will be harmful to one’s case.

As an attorney who represents Federal and Postal workers in preparing, formulating and filing an effective Federal Disability Retirement application, to be submitted to the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, the primary issue is obviously upon the medical report and records to be submitted; followed by the legal arguments to be presented and established, normally through an extensive Legal memorandum, which provides a kind of “road map” for the assigned OPM Specialist to review and (hopefully) become persuaded as to the validity, incontrovertible legal basis, and the substantive qualification of the Federal or Postal employee in meeting all of the legal criteria in becoming eligible for Federal Disability Retirement benefits.

For the Federal or Postal employee who attempts this complex Administrative Process without legal representation, the obstacles, pitfalls and potential hazards are many, and it is often what isn’t known that defeats a Federal Disability Retirement case.

Sure, there are cases where the presented facts, medical conditions and evidence constitute an undeniable, “slam-dunk” case, but those are few and far between, and we can all recognize such cases and a competent attorney would normally advise such individuals to go ahead and complete the Standard Forms, attach some relevant medical documentation and file for Federal Disability Retirement benefits with OPM.

Then, of course, there are cases on the far side of the spectrum that constitute a “weak” or otherwise invalid case, and those, too, are easily recognizable.  Most cases, however, fall in the middle, within the spectrum where one must affirmatively and by a preponderance of the evidence “prove” one’s eligibility for Federal Disability Retirement benefits.  And for all such cases that fall in that “middle” area of the wide spectrum, what isn’t known is the lynchpin that must be identified and prepared for further assessment and formulation, whether by addressing it in a medical document or reinforcing it by legal argumentation.

OPM Disability Retirement: Imperceptible light shifts

They are almost imperceptible; in any event, we would not otherwise notice them but for the altered hue in morning’s glory of pink shades and yellow gleams of delight.  From one angle and perspective, one might miss the subtlety of a purple shade not otherwise naturally given to observation; from another, a shift, quite impossible to grasp and declare, but there nevertheless, and that is precisely what occurs with the imperceptible light shifts we miss in the daily lives of busy modernity that destroys and in incremental deterioration withdraws from grace.

But that we had the time, or made the way, for viewing and studying the changes of a world’s color; but we act as though we are colorblind, and rush through each day without noticing the alterations of the sensory universe we occupy.

Nature itself is a deceiver of sorts; from the sun’s rise to its apex of brilliance to the fall into twilight behind the arc of earth’s perimeter, we are unable to view the brightness directly, lest we blind ourselves in such a foolish attempt, or otherwise try and comprehend such source of solar energy in a figurative sense like the Cave Analogy in Plato’s Republic, of that chained soul who lives only within the shadows of appearances not reflective of reality.

No, it is the inability to feel the rotation of the ground beneath us that first welcomes the rising sun, then imperceptibly travels the distance to give us the gift of light, only to incrementally and with deliberative direction progress towards the pathway of twilight’s descent that allows for event a glint of the nether world.

Imperceptible light shifts may be seen in the refractive beauty upon a crystal’s gleam, or upon a clearing in a forest after a burst of rain; but it is in life generally that we must keep an eye out for the beauty of change, in order to be in consonance with a universe that is divorced from our instinctive sensibilities as the animals we once were in roaming the earth like the American Indian who followed the migration of the buffalo herd.

For Federal employees and U.S. Postal workers who are impeded in life by a medical condition, such that the medical condition prevents the Federal or Postal employee from performing one or more of the essential elements of the Federal or Postal position occupied, those life-startling but imperceptible light shifts are like the subtle hints of the body’s agony:  They tell us things that we already know, but are too stubborn to see.

FERS & CSRS Disability Retirement: Trading places

Long before the 2008 debacle of economic turmoil; preceding epic movies following, of the lavish ineptitude of miscreants awash in money’s sale of souls in exchange for the temporal pleasures of limitless fantasies; when laughter could be heard yet, because the future still held some hope, there was a movie by the same title.  It was a comedy of innocence – although, the language used may still blush for some, it reveals a period long gone and no longer found in today’s society where revealing all, telling everyone and showing unabashedly have become the normative course of behavior.

Unlike the reality of Wall Street’s mechanism of manipulation, the storyline follows a fairly conventional discourse of moral constancy – of identifiable evil; revenge and retribution for wrongs committed; redemption for those whose failings resulted from unseemly characters.  Contrast that with the fictional depictions of today, some mere several decades hence:  the unjust are left unpunished, or barely so; the miscreants are bailed out from their own folly and greed; and the Mom & Pop store just around the corner is still left wondering why they were never rescued from bankruptcy, when the very ones who created the economic crisis are back at it, again.

The problem with discussing such issues on a macro-scale, of course, is that generalities invite sweeping statements of inane and excusable tendencies, whereas kitchen-table, microcosmic tales of individual narratives leave no room for such averted cover of hidden devices, where rats and other scoundrels may scurry to find convenient places to conceal their shameful misdeeds.

We often wish that we, too, could “trade places”, but only because we fail to listen to the details of troubles faded on lawns across the street where the grass appears greener, but where the internal turmoil of ghosts hidden remain veiled.

Medical conditions have a way of bringing us all back to the basics of living.  For, when one is healthy, all sorts and manner of wishing for fortunes and superficiality of life’s extras are engaged; but when a medical condition hits, all that we desire is for the boredom of good health.  Federal employees and U.S. Postal workers who suffer from a medical condition, such that the medical condition prevents the Federal or Postal employee from performing one or more of the essential elements of the Federal or Postal employee’s position of formal occupation (as reflected on an SF 50 or PS Form 52), understand this concept all too well.

Trading places is all relative, especially when it comes to the basics of human happiness.  For Louis Winthorpe III and Billy Ray Valentine, it happened that fate brought two unlikely characters together to right the wrongs of a macroeconomic system left to manipulative devices on the commodities trading floor; for the Federal and Postal employee who suffers from a medical condition, such that the medical condition prevents the Federal or Postal employee from performing one or more of the essential elements of one’s positional duties, the desire to “trade places” is somewhat more basic – of mere good health in order to maintain a constancy of life’s pleasures taken for granted by others.

Federal Employee Disability Retirement: The problem of inductive reasoning

The difficulties inherent in deriving universal truths from particular observations have been annotated throughout the history of logical analysis, from Hume to Popper, and continue to haunt attempts at scientific certitude.  That probabilities can be imputed, as opposed to arriving at undeniable conclusions, allows for that “wiggle room” which is the hallmark of modern science.

Today, where the intersection and commingling of science, politics and entertainment requires less than rigorous experimental verification, and where drug companies argue for fast-tracking of medications with limited-to-little trials, even of “controlled” ones — inductive reasoning, though unverifiable and certainly wrought with inherent self-compromise, nevertheless compels people to act.

The classic example of having seen only white swans, leading to the general conclusion that there exist only white swans in the entirety of the universe of such species, is merely a convoluted tautology in a world of untrained and unsophisticated populace.

Rigor in argumentation has been decimated; simple Aristotelian logic is no longer taught (leaving aside Bertrand Russell’s 3-volume compendium of advancement in symbolic logic through his work, Principia Mathematica); and instead, we are left with the inane comments and diatribes on Facebook and other chatter which camouflages for intellectual discussions (where are the Buckleys and the Hitchens of the world when we needed them?  Or is it that aristocratic New England accents and British elocutions merely sound of a higher order?), where cyber-bullying has pushed aside the quite reasonings of timid voices.

Of course, deductive reasoning, as well, can be criticized, and has been by insightful corners of cautionary esotericism; for, the question always begins, From whence did the universal statement in such deductive analysis derive?  Were they not, also, from singular arguments based on the particulars of observations?

But more to the point:  For Federal employees and U.S. Postal workers who are preparing one’s Statement of Disability on SF 3112A, it is important to recognized the problem of inductive inference, and not to engage beyond the factual basis of the medical reports relied upon and conclusions derived.

Be careful not to make vast generalizations and presume conclusions not referenced in the medical documentation attached; for, in preparing an effective Federal Disability Retirement application, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, to be submitted to the U.S. Office of Personnel Management, it is always important to stick to the relevant particulars of one’s case, and not get sidetracked into making unverifiable conclusions beyond the confining realms of logical validity.

Otherwise, you might be called upon to defend against Hume’s systematic dismantling of the soundness of inductive reasoning.
