Federal Disability Retirement Claims: Mental Health, Stress and First Steps

Disquietude is a negation of a former state of being.  Perhaps it is merely a retrospective re-characterization or romanticization of a time or status that never was; or, maybe even a partial remembrance of a slice of one’s life measured as a fullness in comparison to what is occurring in the present.

Regardless (as opposed to the nonsensical, double-negative modern vernacular of “irregardless”), to have a sense of disquietude implies of a former time, event, or state which had a greater positive light than the present one.

And it is in this context that the Federal or Postal Worker who begins to contemplate filing for Federal Disability Retirement benefits, whether the Federal or Postal worker is living in California, Florida, Hawaii, Kansas, Minnesota or Texas (have we effectively zig-zagged a sufficiency of states in order to make the point, yet, or perhaps we need to include Arizona, Georgia, Maine, Michigan, North Carolina and Wisconsin in order to make the point), that one must understand the greater bureaucratic involvement which one needs to undertake before engaging the complexity of the process of a Federal Disability Retirement application.

First, it is a Federal issue, and therefore, it will be unlikely that one will find, for example, a Florida Federal Disability attorney, or an Oregon, Kentucky or Louisiana Federal Disability lawyer; for, it matters not whether or not the lawyer lives in, or is licensed in a particular state, precisely because this is a Federal issue, and not a state issue.

Second, Mental Health issues — aside from being a valid and viable basis for a Federal Disability Retirement application — can either stand alone, or be in combination with a physical disability (isn’t it interesting how we bifurcate “mental” as opposed to “physical”, whereas both are part of the same physiological state of a person?).  Sometimes, mental health issues stand alone; other times, they can be concurrent medical conditions, or secondary ones.

Third, stress is a basis for a Mental Disability Retirement claim, although it must be properly and carefully approached because of issues concerning situational disabilities.

And Fourth, how one approaches the first steps in preparing a Federal Disability Retirement application, will often determine the success or failure of the disability case.

Overall, it is the plan itself, the cogency of the approach, and the gathering of the proper documentation, which will determine the efficacy of those first steps, and whether the stress, mental and physical health of one’s being, will be relieved as a result of filing for a Federal Disability claim.

USPS & OPM Federal Employee Disability Retirement: One of Those Days

There are “those days”, so characterized because of the micro-calamities which, in their cumulative impact, disproportionately reveal a compendium of aggregated irritants amounting in totality to a forgetful epoch of one’s life.

By contrast, a medical condition of an insidious nature, progressively deteriorating, chronic in persistence and debilitating in severity, magnifies tenfold — nay, a hundred, a thousand, a ten-thousand-fold impact of exponential consequences — the remembrances of pain, psychiatric turmoil, and the bitter acknowledgment that life’s meaningful embrace has lost its luster.

The vibrancy of youth, of formidable tolerance for reckless antics and disregard of forbearance and calm rectitude of reasoned behavior, now replaced with caution and trepidation, lest the excruciating pain explodes unmanageably and coworkers can see that you are one of the ones who are now an “outsider”, like those of old, isolated, quarantined and banished to the leper colony, no longer extolled of the talents and virtues once possessed.

While microcosmic calamities can be shrugged off with an excuse of blaming some external circumstances, the problem with medical conditions is that it is tied singularly, inextricably, and undeniably, to the person “possessing” the medical condition; and like siamese twins who share a vital organ, one cannot extricate from the consequences of a medical condition as one can from a spilled cup of coffee.

For the Federal worker or Postal employee who suffers from a health condition, such that the medical condition constitutes a daily cup of spilled coffee, the choices are quite clear: remain in the same capacity and bear the brunt of the daily calamities; resign and walk away with little to nothing to show for one’s lifetime efforts; or the more viable option, to file for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS or CSRS.

One can sit and sigh, and resign one’s self to accepting fate as characterized as “one of those days”; or fate can be controlled, maneuvered and manipulated, to where those days of calamitous casuistry can be relegated to forgettable events of days bygone, and where the Federal or Postal employee can begin to rebuild a future based upon an OPM Disability Retirement annuity which allows for a base annuity, along with the potential to earn up to 80% of what one’s former position currently pays.

Thus, just as a cup of coffee spilled can be cleaned up; so the hallmark of “one of those days” can be merely an isolated event in an otherwise greater spectrum of life’s potentialities.

Disability Retirement for Federal Workers: Loss of Empathy

Does it establish the existence of empathy if a person asks after someone’s health or wellbeing?  If, in the next moment, the querying individual does something which would constitute “backstabbing“, does it negate the previous sincerity of the asking?  Is there a numbing effect upon a generation of individuals who have engaged in daily role-playing through video games which defy a conceptual designation of “virtual reality“, and for the most part serves to be the “real” reality for most?

Is empathy a lost virtue; is virtue even a meaningful concept in this day and age; and if lost and not, does it make a difference at all?  Or has human nature been consistently mean and low throughout the ages, and any romantic semblance of a Shakespearean view (paraphrasing, here) that man is the paragon of animals and somewhat akin to the angels, is merely a profoundly meaningless statement of reminiscences long past?  And what impact does such foreboding hold for individuals with medical conditions, especially in the context of employment?

For Federal and Postal employees who suffer from a medical condition, whether under FERS or CSRS, there is fortunately the default option of filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management.

Fortunately, such an option does not depend upon the empathetic character of fellow human beings, leaving aside other Federal or Postal employees.  Instead, Federal OPM Disability Retirement benefits are completely dependent upon “the law”.  This is as it should be, as opposed to the fickle character of individuals who sway to and from as the unstable emotions of individuals may change from day to day.  It is ultimately the law which one must cite, rely upon, and use both as a shield and a sword.

As for the lost generation of empathy: Let the laws governing Federal Disability Retirement determine the outcome of that forecast, as laws last somewhat longer than the fickle character of human beings.

CSRS & FERS Medical Disability Retirement: Pain Ownership

Wittgenstein was a master of linguistic analysis, and questioned the traditional correspondence theory between the language which we speak and describe about the world, and the objective reality which we encounter on a daily basis.  He was the penultimate anti-philosopher who saw philosophy as merely a bundle of confused and confusing conundrums unnecessarily propounded by misuse and abuse of language.

Viewed by many as the successor to Bertrand Russell and English Empiricism, he questioned consistently the role of language, its origins, and confounding complexities which we have created by asking questions of a seemingly profound nature, but which he merely dismissed as containing self-induced mysteries wrapped in a cloak of conundrums.

For Wittgenstein, the problem of pain and “pain language” is of interest; of the person who speaks in terms of “having a pain”, as opposed to the doctor who ascribes the situs of such pain in areas vastly different from where the pain is felt; and the complexities of correlating diagnostic studies with the existence of pain.

For the Federal and Postal employee who is under FERS or CSRS and is considering filing for Federal Disability Retirement benefits from the U.S. Office of Personnel Management, the relevance of Wittgenstein’s linguistic analysis should not be overlooked.  Pain is a personal matter, whose ownership is never in dispute by the person who feels such a phenomena; but how to express is; in what manner to effectively convey the validity of such sensation; how best to “put it into words” is always the problem of effective and persuasive writing.

There is a vast chasm of differences between the ownership of pain and the conveyance of the sensation such that the reader (in this case, the U.S. Office of Personnel Management) will be persuaded of one’s medical condition.  The correlative fusion between the world of language and the objective reality of an indifferent universe must be traversed efficiently and effectively; that is the whole point of preparing, formulating and filing for Federal Disability Retirement benefits from the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS or CSRS.

Federal Gov. and USPS Disability Retirement: Pain as a Reminder

Pain is a reminder that the physiological state of one’s body is in need of rest or repair; it is tantamount to an error message on the computer, with the analogy of our brain being the software component.  Chronic pain thus constitutes a system shutdown; continued non-response and delay will either result in systematic error messages or progressive deterioration where the entire system will begin to be impacted with reverberating consequences.

It is well that the largest organ of our body is our skin; for, as a concealing covering, it contains the inner workings — and malfunctions — of our other organs and systems.  But within the constellation of the composite of organs and systems functioning in coordinated fashion to keep us alive, the “software system” allows for error messages to be relayed to important information centers, of warnings meant to be heeded.

Pain is such an error message; chronic pain is the heightened alert system to keep us informed.

For the Federal or Postal worker who experiences such continuous and persistent relays of error messages, the failure to heed merely delays the necessity of responding to the system shutdown.  Federal Disability Retirement is meant to be a compensatory system whereby a restorative period of recuperation is allowed for, with the possibility of engaging in employment in a different capacity without losing one’s base annuity.  It is a long and involved administrative process.  Such preparations must be submitted through the U.S. Office of Personnel Management, whether you are under FERS or CSRS; further, if you are a separated Federal or Postal employee, you have only up until one (1) year to file from the date of separation.

Allowing the error message to be sent repetitively and ignored out of hand may constitute malpractice on the part of the recipient — the Federal or Postal Worker who does nothing but continue to be dedicated to one’s job, while ignoring the basic rule of life:  self preservation.

Federal and Postal Disability Retirement: The Pain Problem

The problem with pain is that, quite simply put, there is only one person who “owns” it — the pain-feeler.  One can describe it, ascribe adjectives which somewhat make it come alive for the listener; and even attempt metaphors and analogies that expand upon the limited universe of words as opposed to the physical sensation which creates havoc and turmoil in a person’s life.

There are numerical designations (“she consistently feels pain on the scale of 7/10 daily”) and words like “chronic”, “intractable”, and “severe” capture a sense of what a person undergoes; but in the end, these are merely word-games in comparison to the agonizing physical trauma which the person experiencing the pain must endure.

In preparing a paper presentation to the U.S. Office of Personnel Management in the form of a Federal Disability Retirement packet, whether under FERS or CSRS, chronic pain and the extent of how such pain prevents one from performing one or more of the essential elements of one’s job, is often problematic for the Federal or Postal employee who is contemplating such a venture.

It presents a challenge for two primary reasons:  First, because of the difficulty in translating a physical sensation into a clear and effective conceptual modality; and Second, because the audience to whom such a descriptive analysis is conveyed is quite likely attuned to, and therefore somewhat indifferent to, thousands of such descriptions, and thus may have a somewhat calloused view of such statements.

Overcoming the roadblocks and gaining the attention of an OPM case worker requires more than the mere meeting of the law; it demands overcoming the problem of pain — both medically, and administratively.

Federal and Postal Disability Retirement: Pain, Anxiety & Exacerbation

Medical conditions tend to “feed upon” one another.  Maintaining a balanced perspective on anything is difficult when one is in pain, and the nagging, incessant presence of pain, diffuse and radiating, extending to areas and points of the body where one can no longer specify a particular area because of the widespread extension, makes it impossible to have the requisite focus and concentration necessary to perform one’s job.  Further, the profound fatigue which results from the daily fight against the pain, where one’s energy and reserve of patience for daily social and professional encounters is expended and exhausted such that one must choose between being civil or countering the pain, is something which many cannot understand.

At some point, consideration must be given to preparing, formulating and filing for Federal Disability Retirement benefits under FERS or CSRS, from the U.S. Office of Personnel Management.  Whether now, or a few weeks from a stated point, becomes an irrelevancy when one suffers from chronic pain, for the Federal or Postal employee who has endured such medical conditions already knows — whether the doctor concedes it or not — that one cannot continue in this manner.

The physical pain, of course, only serves to exacerbate and feed upon the anxiety — anxiety which projects future events, financial security (or insecurity), and whether and for how long one’s agency or the U.S. Postal Service will look the other way as performance deteriorates and the pervasive whispering campaign by coworkers and supervisors begins.  Pain of a chronic nature only invites anxiety; and when the two combine, they serve to exacerbate to an extent where an exponential result is attained, neither explained by the pain alone nor the presence of anxiety, but where the sum of the total exceeds any ability to maintain the balanced perspective needed to continue to perform the essential elements of one’s job.

Federal Disability Retirement: Writing about Medical Conditions

It is easy to give advice about pain when a person is feeling no pain; it is unwise to act upon it when one is in an extreme state of it.  For, the former will often be disbelieving of the extent and severity of it and will therefore view it as involving a lack of fortitude; the latter will be willing to sell his soul in order to rid himself of it.

In preparing, formulating and filing for Federal Disability Retirement benefits from the U.S. Office of Personnel Management, whether under FERS or CSRS, the problem of pain is representative of the greater difficulties of writing about a medical condition — of the dichotomy and bifurcation of subject-object; of sympathy – empathy; of persuasion and what constitutes effective writing which compels a person to tears.

Of course, as to the latter — we need not expect an OPM Case Worker to be reading your narrative in the Applicant’s Statement of Disability to suddenly burst out in tears, get up, and scream as he or she is running down the corridors of OPM holding your case file declaring, “This one is approved!  This one is approved!” (although such a scene would indeed be welcome and rather amusing).

The problem nevertheless exists — of how one can write about one’s own medical conditions, with a level of objectivity, a compelling sense of persuasive effect, a standard of maintaining a perspective which declines to cross into maudlin overstatement, and a judicious use of adjectives in conveying a true picture of pain or symptomatologies of medical conditions, which paints the picture as opposed to merely narrating a list of diagnoses which may portray unfeeling information, as opposed to the entirety of information, feeling, sensation and struggle — the aggregate of the human condition as encompassed by one in pain.  The problem has no answer; rather, it is one which must always seek a solution, which is a process in and of itself.

Medical Retirement for Federal Workers: Chronic Pain

Chronic pain in a Federal Disability Retirement application can result in a “catch-22” (as that famous Joseph Heller novel forever captured that phrase) — on the one hand, the diffuse and radiating, incessant pain results in such a high level of distractability that one is unable to focus and concentrate upon either a sedentary job, or a job which requires physical exertion because of the limitation and restriction of movement which such pain induces; but further, if one ingests pain medications, such medications will often create sedation to the extent that it results in greater lack of focus & concentration, or result in making a Federal or Postal worker into a “workplace hazard” because of the potential for accidents, etc.  

In such a case, “accommodation” in the workplace becomes a moot point in a Federal Disability Retirement case.  Such tripartite connections — between the Federal or Postal Worker and the type of work he or she engages in; the medical condition the Federal or Postal Worker suffers from; and the symptomatologies which manifest themselves which impact one’s ability to perform all of the essential elements of one’s job — are important to explain, delineate, and ultimately narrate effectively in preparing, formulating, and filing a Federal Disability Retirement application under FERS or CSRS.

Federal and Postal Disability Retirement: Easter

Easter is a time of reflection and rejuvenation for Christians.  It is a designated week of Holy reflection — through capture, suffering, death, resurrection and forgiveness.  In a world where the distinction between the sacred and the profane has blurred to indistinguishable heights of platitudes and uncertainties, to reserve a week in one’s life for that which is “Holy” is indeed a phenomena worth preserving.  Christmas has become a season of celebration in a secular sense, full of traditions and shrieks of joy from the mouths of children; Christmas trees, decorations, presents and surprises; and while I am sure there will be disagreement on this matter, the assimilation of Christmas with a secularization of celebration, for whatever reason, is not disturbing.  Yet, somehow, despite the Easter Bunny, egg hunts and the attempt to merely marginalize Easter as a “time of Spring”, the awe of Easter has retained a reserved, contemplative aura with a special meaning. 

As an attorney who represents Federal and Postal employees with various medical conditions and disabilities, the common thread which I hear on a daily basis is the pain and distress which the human condition is able to endure on a daily basis. I do not equate the human condition and the clients I represent with the suffering which Christ endured; yet, those who suffer clearly have an affinity with the One who suffered on the Cross, yet forgave those who condemned and crucified, for the sake of the world.  I am daily amazed and humbled by the positive attitude and ability to endure, by Federal and Postal workers from all across the United States.  May we all have a sense of humanity within us that we can have forgiveness during this Holy Week.  Happy Easter.
