Lawyer Representation Federal Disability Retirement: Biding time

Inmates in correctional facilities do it; criminals in wait; patients in doctor’s offices who have been informed that there will be a short delay because of an emergency procedure that the physician had to attend to; and most of us in general who live life anticipating disasters, tomorrow’s unfortunate events or the next day’s calamity to come.

We all bide our time in living our lives, and it is the time of biding that is wasted away until, near our deathbed, the expected outcome of disaster never came, the calamity never developed and the corrosion of life never materialized.  It is one thing to wait on another person; another altogether to engage in the patient virtue of sitting motionless or passing the time away in anticipation of something beyond; it is quite another, and perhaps unique, that human beings actually actively engage in the activity of “biding time” in order to start a process.

Vengeance often takes biding of time; planning for a future definitely requires biding time; and old men and women in nursing homes have nothing better to do than to bide one’s time.  To live life biding time, even at the horizon of one’s twilight in elder states of despair, is no way to exist.

For Federal employees and U.S. Postal workers who are beginning the process of, have already begun the procedural steps to, or otherwise are in the middle of the administrative process of preparing, formulating or filing a Federal Disability Retirement application with the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, the key to “biding time” during this complex administrative process is to have “a plan”.

It is a long, arduous, difficult and time-consuming process.  Even after it is successfully filed, the time waiting upon a decision just at the First Stage of the administrative process can now take a very, very long time, and how one plans to bide one’s time during this long process is something one needs to consider.

Will you remain on LWOP during this time?  Will you resign, get terminated, and will you work at a private-sector job while waiting for OPM’s decision?  Will temporary loss of health insurance be a consideration?  If it is denied at the Initial Stage of the Federal Disability Retirement process, will that mean that you can endure the lengthy second Stage, the Reconsideration Stage?  And if you have to go and have a Telephonic Hearing before an Administrative Judge at the U.S. Merit Systems Protection Board, which will take a minimum of 120 days beyond, will that still be within the plan of attack in biding time?

Hopefully, one’s Federal Disability Retirement filing with OPM will go smoothly; but in the event that all of the proverbial bumps on the road are encountered in your particular journey, it is important to consider the extent of biding time during the process.

Medical Retirement for Federal Employees: The wrong target

What if you are involved in the highest levels of competitive marksmanship – say, target shooting by a rifle, or crossbow, or bow and arrow, or even by a pistol.  You shot throughout the morning, and hit the bulls eye every time; your opponents try to keep up with you, but at each level of competition, there is a slight deviation here, a centimeter there, and systematically, the competition is “eliminated”, and you are left standing at the podium of the “winner”.

As the trophy is brought out, the Chief Judge who is about to present the awards and ceremonial crown, pauses, reflects for a moment, and declares:  “Sorry, but it turns out that you were shooting at the wrong target each time.”  They then present the accolades to the “runner up”, who was shooting on the same range, aiming at each turn at the target set up in his or her respective lane of sightings, and seemed to follow the protocol as set up by the competition and the committee of judges.

You go and question the judgment of the judges, and especially address the Chief Judge, protesting:  “What do you mean?  I shot at the target that was set up.”  “But you shot at the wrong target.  Your target was the one in the lane next to you.  You shot in Lane A; you were supposed to be in Lane B”.  And you argue:  “But that is irrelevant.  Lane A is the same as Lane B, and there is no difference between the two.”  And the Chief Judge says:  “Look at your designated Card Assignment:  It states without question, ‘Assigned to Lane A’.  Yet, you shot all targets in Lane B”.  You persist in arguing:  “But what difference does it make?  It is the same target whether I am in Lane A or Lane B?”  And the kicker from the Chief Judge:  “In life, you can’t just do what you want; you have to obey the rules.”

Who is right?  Would it matter which lane one is assigned to, and whether obedience to the protocol and adherence to the “letter of the law” is followed, when the substantive point of the whole process – hitting the target – is clearly accomplished beyond the competence of all others?  We often encounter that anomaly in life – of the seeming conflict between the technicality of the issue (the “minutiae” otherwise unnoticed by the rest of the population) and the general adherence based upon common knowledge and boredom of repetitive protocol.  It may well be a trite redundancy, but when a “technicality” is involved, then a technician is the one to call.

For Federal employees and U.S. Postal workers who are considering filing for Federal Disability Retirement benefits, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, the question of the “wrong target” and the “technical violation” of the rules is appropriate to recognize and consider:  For, in Federal Disability Retirement Law, as in many other facets of legal wrangling, making sure that the larger compass of hitting the “right” target, as well as keeping within the proper lane of technical legal issues, are both equally important in preparing, formulating and filing an effective Federal Disability Retirement application, submitted to the U.S. Office of Personnel Management.

The “wrong target” is the agency; the “right target” is the U.S. Office of Personnel Management.  The “technicalities” encompass the statutes, laws, regulations and legal opinions as rendered by the U.S. Merit Systems Protection Board and the Federal Circuit Courts on issues pertaining to Federal Disability Laws litigated as precedents.  And, who is the proper “technician” to call?  An attorney who is experienced in fighting the cause for Federal and Postal employees, to obtain Federal Disability Retirement benefits.

OPM Medical Retirement: Metaphor as the antidote to paraphrasis and reduction

The concept is intended to enhance; it guards against the tendency of deconstructionism and self-analysis, where the initial stages of civilization’s cradle of creativity progresses along a historical regression of questioning and results in cynicism.  Paraphrasis — that need to restate but in different words and altered forms — is a tendency of inherent need to understand and comprehend at a lesser level; for, the original is almost always the greater one in comparative analysis and methodological foray.

Reduction is a corollary of paraphrasis — of attempting to whittle words down to a common denominator of meaning, much like Orwell’s expungement of words in his brilliant novel, 1984, where the totalitarian state would systematically extricate and erase previously known words and concepts.  Do concepts exist without words?  Once forgotten, can they be reintroduced into a world devoid of such constructs?  Do some societies view the universe in ways quite contrary to our own, where parallelism of thought and content fail to intersect because the alien nature of “their” way of thinking is incommensurate with “our” way of viewing the world?

Metaphors are meant to enrich and enhance; it is a uniquely human way of perspective and angle, and constitutes the antidote to linguistic reductionism.  For Federal employees and U.S. Postal workers who are struggling to prepare an effective “Statement of Disability” on SF 3112A, one is well-warned and instructed that the use of a tool in language must be approached with caution, but with a delight to inform, convey and communicate.

In the end, the vast array of tools and substantive pouches filled with magical dusts and sprinkling residues of creative myths — all must come down to the proper usage and effective application of words, phrases, thoughts and conceptual constructs.

For the Federal employee and U.S. Postal worker who must formulate an effective Federal Disability Retirement application, whether under FERS, CSRS or CSRS Offset, the manner one approaches the Statement of Disability, the methodology of logical argumentation, and the legal references needed to cite in submitting a winning Federal Disability Retirement application to the U.S. Office of Personnel Management, may come down to a mere metaphor as an antidote to paraphrasis and reduction.

FERS & CSRS Disability Retirement: Superiority in light of misfortune

Why is it that we delight in the misfortune of others?  Is it a perversity of defective character, like a genetic malformation of deviancy magnified by exponential proportions within the essence of man?  Or, is it that, by comparative analysis and contrasting the parallel states of being, we can elevate our own estimation of worth by pointing to the relative denigration of our neighbor?

Certainly, we proffer the words of appropriate opprobrium; “I feel badly for X”; “I get no joy out of hearing that,” and similarly innocuous statements of hypocritical emptiness.  But we liken the principle of action/reaction, downward trend/upward spectrum, and similar opposites to reflect the superiority of our own circumstances.  “Here by the grace of…”  Is that why the “herd mentality” and the predatory instinct of running with a pack of wild dogs from whence it arises?

For Federal employees and U.S. Postal workers who suffer the indignation and daily harassment at the hands of agency coworkers, Managers, Supervisors, and those who were once considered “workplace associates”, and further fine-tuned and magnified in the hostile milieu of the Postal Service, the daily encounter with pure meanness and focused unpleasantries is experienced pervasively by the Federal and Postal employee who suffers from a medical condition, such that the medical condition begins to prevent the Federal and Postal employee from performing the essential elements of one’s positional duties.

Why, when the medical condition itself should empower one with greater empathy, a higher reception of closeness and affinity, does the very opposite phenomena take place?  The superiority of others in light of one’s misfortune speaks ill of the human essence.

That is why, in the end, filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, is an important step to take for the Federal or Postal employee, precisely because it allows for a “new beginning“, a “step forward”, and all of the cliched foundations in order to escape the greatest delusional cliche of all:  Superiority in light of another’s misfortune, when in fact nothing has changed, either for the one who feels better, nor for the other who suffers, except that the perversity of man is merely reinforced with a deserved reputation for cruelty.

Medical Disability from Federal Employment: Predatory Pathologies

It is unnecessary to study the tendencies of other species and their internal drive to be who they are; for, it is presumed, the innate structure of their genetic makeup becomes the paradigm for self-explanatory justification, and like all conundrums of deviations from synthetic or analytic statements, the self-identity of the process itself makes it abundantly unclear.

Predators are by their very nature self-identifying; it would be a nonsensical proposition to ask the question, “Why”, in connection with the lion or cheetah that hunts and kills; or for the hawk, eagle, and even the household cat, despite their fuzzy beauty of cuteness and domesticated aplomb.  But of man, we question incessantly; of the long history of wars, cruelty, mass murders and genocide, the paradigm is one of puzzlement despite the footprints of self-explanatory consistency.

The need to act civilized in an antiseptic universe of artificial constructs jolts one back into the reality of who we are when deviations from such carefully created models shatter the very essence of our imagined parallelisms of worlds built upon virtual realities, and so we cry for such aliens who never were.  Barbarism tends to do that; and simple meanness in the workplace often shocks.

For Federal employees and U.S. Postal workers who suffer such rude awakenings, perhaps it is because of the disconnect between what we thought we were a part of, and the reality of what is.  That “disjointedness” is often easily attributable to the “medical condition” from which one suffers, and to which everyone else points for justification of bad behavior.

For, the Federal or Postal employee who suffers from a medical condition, where the medical condition impacts and prevents the Federal or Postal employee from performing one or more of the essential elements of one’s positional duties, the focus becomes the Federal or Postal employee, and the predatory pathologies which erupt and shed their thin veneer of civilized behavior become justified because of the loss of “mission accomplishment” of the agency, or some such balderdash of scientific explanation.

The plain fact is that there are bad people in the world, and no amount of studies of predatory pathologies will help to set aside the negative behavior of people within Federal agencies or the U.S. Postal Service.

The solution for the Federal or Postal worker who suffers from a medical condition, such that the medical condition prevents one from performing one or more of the essential elements of one’s positional duties, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, is to file an effective Federal Disability Retirement application through the U.S. Office of Personnel Management.

Let the Federal agency and the U.S. Postal Service worry about the “mission of the agency”; that will continue with or without you, as all bureaucracies do, just as predatory pathologies will persist despite multiple studies to the contrary.

Medical Retirement for Federal Employees: The touch of life

People often refer to “the touch”; of Midas’ ability to engage in alchemy, now transformed into a metaphor for those whose every endeavor results in financial gain; or of that “soft touch” in the arena of basketball, where the swish of the net and the easy bounce which finds the diameter of the hoop always larger than the irascible target of our trying attempts.  But it is the “touch of life” which encompasses all of that, and more.

When most struggle with the morning fog of first dawn, and youth craves for the security of childhood but act with cynicism to protect their own pride; and pride itself, foolish in its heart, but where wisdom never finds refuge but for the mistakes made in trying.  The touch of life comes to the fore when wandering souls finally find restive quietude from the troubles of the world, and for a brief moment when time, history, and the troubles which beset, can be set aside in an orderly, systematic and rational universe of timeless peace and finality of purpose.

Wisdom is hard to come by; and in the midst of daily struggles, finding clarity of purpose is impossible, especially when troubles abound upon the horizon of life’s plenitude.

For Federal employees and U.S. Postal workers who are struggling because the Federal agency or the U.S. Postal Service harasses, intimidates and engages in unfair labor practices, preparing an application for Federal Disability Retirement benefits through the U.S. Office of Personnel Management is often the only viable choice left.

Life often grants only limited options, but when we grumble and complain about the lack of alternatives, we merely delay and obfuscate the richness open to our own lives.  Instead, what the Federal or Postal employee needs to do, is to take that opportunity and prepare, formulate and file an effective Federal Disability Retirement application with OPM.

Grumbling about fate not in the cards merely takes energy away from that which will work; and as America is a land of pragmatism, the home to William James and the only original philosopher from this country, it does well to recognize that the touch of life is not reserved to the magic of alchemy, but to the choices we wisely accept and forge forward upon.
