Office of Personnel Management (OPM) Disability Retirement: Doubt

Is it an emotion.  Or, is it an “instinctive sense”?  Perhaps a cognitive level of reasoned thought?  If the latter, do animals doubt?  Why do we often qualify it by adding the term, “a sense of”?

The dictionary definitions often avoid the doubt of doubt by including both: “A feeling of uncertainty or lack of conviction”.  Note the inclusion of both: Emotion (“feeling”) and Reason (“conviction”).  Whether of a feeling or of a rational basis, it allows one to pause, to ponder, to consider the various signs and symbols of life’s intractable problems, and to consider whether or not to move forward.

As you enter your house or apartment, does the door slightly ajar make you doubt?  Do certain indicators at work — of furtive glances, of avoidance by your supervisor, of closed-door meetings excluding you: Do they in the aggregate create a doubt?

Or, for Federal employees and U.S. Postal workers who are not quite sure as to the qualifying criteria in filing for Federal Disability Retirement benefits under FERS from the U.S. Office of Personnel Management — is there a doubt?

Legal Representation on Federal Disability Retirement Claims: That voice within

Whose voice is debating within the insular corridors of the otherwise silent individual?  Which one is the dominant voice, and how does one determine if that particular voice should be the one which attains such a prominent status and stature within the cauldron of one’s own thoughts?

We assume, of course, that when we are pondering within the insularity of our own thoughts, that the voice which speaks within is our own voice; but is it necessarily so?  Yes, yes — the traditional concept of “madness” will begin to encroach, of strange voices which begin to invade and intrude, and where schizophrenia is considered the likely explanation whenever “other” voices are considered.

But that is not what is necessarily the case.  It may be that the voice within is simply a regurgitation from a memory stored long ago — perhaps of one’s parents; a friend; an old school chum; a brother, sister or a cousin; and it is retrieved as an amalgamation of many others, besides.  More importantly, who determines the validity of what is being said, the subject of debate and the substance of the winning argument?

The danger of a soliloquy is that the lone figure who tries to figure things out on his or her own may not have all of the facts or information at hand which can lead to the right decision being made.  An unheard conversation undertaken and engaged by a singular voice may be no discussion at all; it may merely be a wrong-headed delineation based upon errors in fact and missteps in logical analysis.  That is why it is important to consult a person who specializes in a field and is knowledgeable at the outset, so that the facts gathered and the analysis conducted are sound methodologies based upon superior analytical insights and resulting in expert advice.

Federal & Postal Disability Retirement from OPM: Feelings

There are appropriate contexts within which to consider them, as well as places, insertions, events and conversational modalities where it is partly or entirely irrelevant; but as with most things in life, the boundaries that bifurcate are not always clear and distinct.  When one is considering purely subjective circumstances, it is clearly the “appropriate” moment — of personal relationships; of a vacation to be taken; of emotions being considered.

In a court of law, it is probably not the best approach to take with a judge; although, in the sentencing phase or the “damages” argument to be made to a jury, it may be the singular force of persuasive impact that makes not only the distinction unclear, but the decision quite the decisive edge.

“Feelings” are to be reserved for puppies, late nights in bed with a fever, and how the toes tickle when lying on a grassy knoll in the middle of summer when the lone ant walks along the pathway of your bare skin.

Do we dare admit to them?  When you are in a heated argument, is it not an oxymoron to shout, “Feelings don’t have anything to do with it!”  For, what is the criteria to be applied when making a decision based upon them?  Does the spectrum of emotions never cloud one’s judgment?  Or can we, as we often claim, set them aside so easily, like so many automatons in those doomsday movies that have become popularized, where androids and mechanized juggernauts that have taken over the earth and tried to suppress humanity are now the very beings whom we always wanted to emulate?

And what of the French Existentialists and the horror of reaction to that old favorite, “Invasion of the body snatchers” — what was it that made it so fascinating, where beings were stripped of their souls and emotions were all of a sudden undone, extinguished and no longer relevant, where bodies devoid of feelings walked about the earth like so many empty tombs?

Feelings are funny animals; they make up so much of who we are, and yet we spend a lifetime trying to avoid the very essence of that which makes up who we are.

For Federal employees and U.S. Postal workers who suffer from a medical condition, such that the medical condition prevents the Federal or Postal Worker from performing one or more of the essential elements of the Federal or Postal job, the anomaly concerning “feelings” becomes quickly apparent: for, confronted with having to prepare an effective Federal Disability Retirement application before an administrative body — the U.S. Office of Personnel Management — you are asked to remain “clinical” and antiseptic in the face of “proving” the medical evidence by the cold calculus of “the law”, and yet at the same time you are trying to convey your “feelings” with respect to the impact of the pain, the anguish of anxiety or the daily levels of profound fatigue felt.

It is a tightrope, balancing act that must be done with expertise, subtle techniques and an interspersing of line-crossing deftly engaged. Completing the SF 3112A, Applicant’s Statement of Disability, is the single most important form in preparing a Federal Disability Retirement application, aside from gathering the proper medical documentation and making the persuasive legal argumentation.

For, in the end, that lifetime of trying to suppress those “feelings” must be utilized carefully, yet at the same time you have to be persuasive enough to touch upon the emotional makeup of a fellow human being who, also, likely has had to suppress those same feelings in order to apply “the law”.  Go figure.

Federal Disability Retirement: The dead, the dying and youth

Have you ever seen a flower arrangement that weaves together deadwood with bright and colorful summer explosions?  They tell us of that which reflects modernity:  The dead are forgotten in the background; the sick and dying are mere echoes fading quickly into a distant past; and it is only the vigorous who dominate and forcefully remain in the forefront.

How a society coordinates the interaction between the triad of life’s complex ingredients reveals the extent of its inner soul and character.  For, how many of us truly want to live in a pure State of Nature, where only the brute strength of predatory behavior would rule?  How many of us would survive in such a dystopian world, and for how long?

How we treat the remains, vestiges and memories of those gone; what we do with the ones still alive but deteriorating, suffering and lonely in their abandoned abodes; and whatever is left for the youth, what value of transference is imparted from the traditions longstanding, the obligations imparted, and the core values embraced – these determine the viability of a society in turmoil.

For, the dead reveal in constancy as to who we are by giving us a past; the dying, what we are made of by the example of how we treat the least of our community; and the value of youth is inherent in the lineage existent for the future continuation of a viable and vibrant tradition; and it is always the interrelationships between the tripartite worlds that determine whether and how.

We tend to want to compartmentalize, then to isolate each into their individual components such that one never interrelates with another.  But reality often will force a society to reflect upon such an artificial manner of conceptual isolationism, and sometimes it is by mere change of perspective that can lead to a paradigm shift of sorts.

Thus does this happen when we see a flower arrangement that artfully weaves the deadwood of winter with the vibrant colors of spring, and allow for even the panorama of fall leaves to still reveal beauty and breathtaking insights, and allow for the youth of summer blossoms to radiate, while at the same time giving deference to the others in the haiku of life.  It is often through a metaphor like this on a macro-scale that we can then glean a reflective outlook upon the microcosm of our own lives.

For the Federal employee and U.S. Postal worker who sees him or herself as “less than worthy” – somewhat like the dying twigs in a flower arrangement otherwise filled with vibrancy and youth – all because a medical condition is becoming chronic and debilitating, one needs only look upon a flower arrangement that encompasses the triad of life’s natural flow.

Perhaps the agency is like those exploding blossoms of summer; and, more likely, the Federal Agency and the Postal Service will relegate the deadwood into the trash heap of corner offices and ignore those who are less productive.  But that is not a reflection upon the Federal or Postal employee who suffers from a medical condition and can no longer perform all of the essential elements of one’s Federal or Postal position; rather, that is an indictment upon the Federal Agency and the Postal Service itself.

Filing a Federal Disability Retirement application, to be submitted to the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, is merely another way to maintain the constancy of society’s unstated promise – much like the flower arrangement that intersperses the dead, the dying and youth – by asserting that legal rights still matter, and a medical condition does not necessarily mean that one’s career is just more deadwood at the back of the arrangement, but can still reveal a promising future for greater productivity in the private sector of life.

FERS & CSRS Disability Retirement: Life Lessons

Most of us stumble through it, and somehow end up down unexpected corridors of unplanned venues; and then we have the nerve to think that we can have kids and impart wisdom we never learned, refused to lived by, and rarely listened to.  It is said that hypocrisy is the characteristic of the common farce; it just happens to infect everyone else, and never ourselves.  But there is an evolutionary determinant even in the comedy of life; it used to be that Western Philosophy would teach us to always seek out the substance of a thing, and to recognize mere attributes and appearances for what they are — recognizing that superficiality conceals the essence of Being.

Now, there are popular books which tell us that “faking it” is okay, so long as everyone else is too stupid to know it.  Then, there is our job, our careers and that vocation at which we spend the majority of our lives pursuing.  One day, we wake up, and find that the manifestation  of a medical condition makes it impossible for us to continue.

What do we do about it?  Procrastinate.  Deny.  Avoid the issue.  But reality has a way of ignoring our pleas of ignorance and avoidance.  Harassment at work; Letters Warnings; imposition of a PIP; Proposed Removal; Removal.  It is not that we did not see it coming; we just hoped that life’s lessons would make a detour around our individual circumstances.

Fortunately, however, for Federal employees and U.S. Postal Workers, there is a consolation benefit in the event that a life lesson involving a medical condition impacts the Federal or Postal employee’s ability and capacity to perform all of the essential elements of one’s positional duties as a Federal employee or U.S. Postal Service worker.  Filing for Federal Disability Retirement benefits allows for the Federal or Postal employee to have “another chance” at life’s misgivings, by providing a base annuity, allowing for work in the private sector on top of the OPM Disability Retirement annuity, and to garner a time for restorative living in order to attend to the medical conditions by retaining and maintaining one’s FEHB.

In the end, there is a conceptual distinction to be made between “Life Lessons” and “Life’s Lessons”; the former is what our parents and the juggernaut of historical inevitability tried to teach, and which we deliberately ignored; the latter is that which impacts us daily and personally, and to which we must by necessity respond.

For the Federal employee and U.S. Postal worker who suffers from a medical condition, such that the Federal or Postal employee must file for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, the lesson of life — whether as Life Lessons or as Life’s Lessons, is to take that stumbling former self who ended up in the corridors of the Federal Sector, and to straighten out the future course of events by preparing, formulating and filing an effective Federal Disability Retirement application through OPM.

Federal Disability Retirement: A First for Everything

We enjoy being “first” in everything.  Whether to engage in unique and bizarre attempts to gain recognition in the Guinness Book of Records, or to compete in a sports event, or perhaps to merely collect first editions of coins, books, etc., the penchant for being identified as the star in front of the line is ingrained.  Yet, when it comes to encounters of a new kind, where the stakes are no longer merely recognition or status of record holdings, the fear, angst and trembling overwhelms.  And so it should, when expertise and esoteric knowledge provides an advantage where necessity of purpose rises to the level of need.

For Federal employees and U.S. Postal Workers who suffer from a medical condition, such that the medical condition prevents the Federal or Postal worker from performing one or more of the essential elements of one’s Federal or Postal positional duties, preparing, formulating and filing for OPM Disability Retirement benefits, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, is always a “first”.  For, such tenancy of priority is no longer for entertainment or stardom; rather, it is to attain a level of basic needs where peripheral concerns become a centrality of purpose.  But fear should never prevent the penchant for paving the way for priority of purposes, and angst should never replace the vibrancy of entering arenas of new knowledge and categories of unknown mysteries.

OPM Disability Retirement: Which Forms, How to Fill Them Out, and What to Put

Filling out forms is a part of life.  At some stage in our lives, we are required to complete forms.  For Federal employees and U.S. Postal workers who suffer from a medical condition, such that the medical condition prevents the Federal or Postal employee from performing one or more of the essential elements of one’s positional duties as a Federal employee (which encompasses the full spectrum of positions, from secretaries, administrative assistants, to scientists, Information Technology Specialists, 1811 Law Enforcement Officers, etc.) or a U.S. Postal worker (including Craft employees, Managers, Postmasters, Supervisors, etc.), preparing a Federal Disability Retirement application may become a necessity.

Thus, the act of “form filling” must be confronted.  On computers, of course, if you have been completing online queries, the “autofill” option may be presented.  But the limitation of such an option, and the unavailability of that choice, should become readily apparent when attempting to complete the various “Standard Forms” required of a Federal Disability Retirement application.

For any remaining CSRS employees intending to file for OPM Disability Retirement benefits, the series embodied under the designation of SF 2801 must be completed, along with the SF 3112 series.  For all of the rest of the Federal employees and U.S. Postal workers who came into Federal or Postal Service after around 1985, and who are under FERS, the SF 3107 series must be completed, and as well, the SF 3112 series of standard forms.

Thus has the question, “Which Forms?” been answered.  As for the remaining two questions:  How to fill them out and What to put —  the “how” is, to put it mildly, with care and trepidation; the “what to put” is too complex to elucidate in this forum.  The series of “informational” forms — SF 2801 series for CSRS employees and SF 3107 for FERS employees — are fairly straightforward (e.g., full name, date of birth, Social Security number, agency name and location, military service, etc.).

It all comes back to the SF 3112 series which becomes problematic — for that is where the Federal and Postal employee must “prove” the nexus between one’s positional duties and the medical conditions by which one is prevented from performing one or more of the essential elements of one’s positional duties.  For that, the Federal and Postal employee must go “outside” of the boundaries of the forms themselves, and consult documentation obtained from the doctor, and make legal arguments based upon wise counsel and advice.

As with much of life, it is never as easy as a bureaucracy promises; indeed, the complexity of life is in the very bureaucratization of administrative forums.
