Federal OPM Disability Retirement Law under FERS: Valid Arguments

Wittgenstein discusses extensively the concept of “language games” — that various subjects, circumstances and professions may require a different kind of such linguistic anomalies.

Thus, when going to a store to buy a computer, you will enter into an alien type of language game quite distinct and different from other modes of linguistic engagements — where certain terms such as “software”, “connectivity”, “applications”, etc., and a whole host of other strange concepts may be thrown about during the course of a sale.

Such a language game is appropriate within the context of a specific set of circumstances, and other forms may not constitute valid applications.  It would be, for example, inappropriate to suddenly interpose another type of language game during the course of a “computer-speak” language game — like suddenly engaging in “therapeutic” language games, of the X-steps in grief counseling, or marriage counseling, etc.

FERS Disability Retirement: Preparing the Case for Submission

Sometimes, it only takes a matter of weeks; other times, months and months in the preparation period prior to submission of an OPM Medical Retirement package.  It is not something to be taken lightly.  Once submitted, your Human Resource Office will do their portion — of completing the Agency’s Certification of Reassignment and Accommodation, as well as the other and multiple bureaucratic processes.

Then, whether first to be routed through the finance office and then on to OPM, or if you are separated from service, directly to OPM without going through your Human Resource Office at all (except to separately secure a Supervisor’s Statement and the SF 3112D), the bureaucratic process of submitting and being reviewed for an approval or a denial from the U.S. Office of Personnel Management has begun.

FERS Medical Retirement from OPM: Crisis Before and Problem After

A crisis is often the problem which was previously procrastinated.  Allowing it to build up to a point of a crisis-event — an emergency that needs to be immediately attended to — is something which many of us do.  It is the immediacy of anything that finally focuses us to attend to the issue; with our busy lives, we tend to ignore, put off and delay that which does not “have to” be dealt with.

But it is often the problem after that continues to haunt and nag.  We can attend to this or that crisis, but the resultant consequences trailing thereafter will often be the long-term conditions which have a residual impact long lasting, and while the crisis may have been handled, it is the problem after that will often defeat.

Look at our national debt.  So long as our country can continue to borrow, it is not a crisis, and so none of the politicians deem it a necessary issue to discuss.  By the time it becomes a crisis, none of the politicians who are in office today will be there, and so there will never be any accountability.  Yet, the problem after the crisis will remain for decades thereafter, if not longer.

And what about a health crisis?  Delay, procrastinate and disregard — until the health issue becomes a crisis; and the problem thereafter is often the chronic, progressively debilitating disability that remains.

FERS Disability Retirement: Choices and Regrets

The two go hand-in-hand, although we may not necessarily see them as unalterable couplets forever ensconced and inseparable. Instead, we often make choices, then afterwards, express our regrets without having learned from the process of “choice-making”.

Choices available are often unanalyzed and nebulous; left to appear, remain inert and ignored; the “active” part of a “choice” is when we engage in the act of “choice-making” — of engaging our minds with an inactive but available “something” — a choice there, but lifeless until the activation of our choosing invigorates the inertia of indecision.

Regrets, on the other hand, are comprised by the dust of past choices made. Once settled, they remain in the hidden caverns of forgotten memories until, one day or hour, or moment of quietude when we have the time to reflect back, the unsettling of the dust collected is stirred and rises from the ashes, like the mythological Phoenix that appears with wings spread and ready for flight into our imagination and stabbing at the vulnerabilities of our inner soul.

We regret that which we have chosen; and like the past that haunts, such regrets are ever so painful when once we recall the choices available and the ones we made.

OPM Disability Retirement Benefits: The mind’s bookshelf

Entertainment is a peculiar thing in human psychology: happiness accompanies its anticipation, but during the process of “being entertained”, do we recognize our own joy, or are we lost in the suspension of our own inner world while being completely oblivious to the suffering around us?

We toil day in and day out with a singular goal, held by many, to enjoy a period of respite and entertainment — of becoming lost in a movie; of going to a play; of putting headphones on and listening to a favorite song, piece or series of favorites; of pulling from the mind’s bookshelf an episode of imaginative adventures or a wonderland of a dream’s figment.

Entertainment, joy, happiness and contentment are the ingredients of life’s admixture of troubles, trials and turpentine creations in a universe of chocolate-ice-cream-not-quite-right, ups and downs and joining and break-ups; it is a mixed up world where everyone is trying to extract an ounce of pleasure when the last cupful has already been taken.  Then, there is the capacity of the human mind that has just had enough — where too much bombardment of stimuli leads one to withdraw, become reclusive, and seek the solitude of one’s own soliloquy of minds.  It is a rather peculiar concept, is it not?

To withdraw within the mind’s bookshelf — that corner of studied solitude where others cannot share, and only the loneliness of one’s self-induced privacy allows for an entrance and exit to the backrooms of an unlit alcove that is marked “private”, and where no admittance is allowed except by exclusive invitation only.  It is when even the mind’s bookshelf is toppled by the troubled waters of the world that too much stress, too much stimuli and way, way too much intrusiveness begins to overflow.

Medical Retirement from Federal Employment: Magic & the laziness factor

Magic is something we cling on to, if only as a last vestige of the light of hope, flickering ever so delicately against the tumultuous winds of a world gone mad.  In childhood, it was an imagination enlivened by the pure delight of fairytales, mythologies and rhymes of wands in the single sweep where the golden dust of insurmountable problems is suddenly a trail of corrective bygones with mere words of incantations mysterious to eyes agape with wonderment and awe; and in the middle-to-growing times, the words altered somewhat, the concept changed and the linguistic construct evolved to imply an attitude, a hope, an approach to future life based upon hard work, honesty and mere cannibalism of negative thoughts.

To remain positive was to overcome the vicissitudes of reality; to forego immediacy of pleasure, a pathway to self-discipline.  But time has a way of defeating and beating down even the best of men; there are few limits to the unseen enemy, and much which constrains the visible.

Is there magic to be gotten?  That hope without substance which we pray for; that lottery ticket in the face of statistical impossibility; and that verbiage we throw about by inane moments of meaningless contexts — “There is always tomorrow”.  What have we not shed but to which we cling?  To what do we cling that no longer applies?  Or is it mere laziness, the factor that we dismiss but for everyone else?

In modernity, of course, such tendencies and proclivities toward the magic of superstitions have become exponentially magnified through games of virtual reality, and the numerical chimera of Facebook “likes” replacing actual friendships and human bonds.  Then, when reality hits us square in the face, we fall apart all the more easily, for want of preparation in the face of true vicissitudes that shake the cavernous combustions of this world we live in.

Medical conditions are just one of those realities that cannot be ignored.

For Federal employees and U.S. Postal workers who one day wake up to the realization that there is no magic to impart when a medical condition prevents the Federal or Postal employee from performing one or more of the essential elements of one’s Federal or Postal positional duties, and that the pragmatic step of preparing an effective Federal Disability Retirement application may be the best alternative available, the conjunctive one must often face — “and the laziness factor” — is a reminder in two ways:  First, in making sure that you do not allow procrastination to impede the path towards a future for success, and Second, to not be deterred by coworkers and others who criticize ignorantly by alleging that it is all “made up” in order to “game” the system.

The law is what the law is; and Federal Disability Retirement is a system reflecting a progressive perspective on workers who can no longer perform a particular kind of job in the Federal sector and the U.S. Postal Service, but who may be able to remain productive in some other capacity in the private sector.  That is why Federal Disability Retirement annuitants are allowed to make up to 80% of what his or her (now former) Federal or Postal position currently pays, in addition to the annuity being received, and continue to retain the Federal Disability Retirement annuity — precisely because it is a recognition that the Federal or Postal employee is not “totally disabled“, but rather, disabled only from performing one or more of the essential elements of a particular job.

The “real world”, as a grown-up views it, must set aside the magic of make-believe trailing upon a disillusionment wrought in the face of experiential encounters that incrementally beat down and squeeze out the wonderment of childhood thoughts; but hope for a better tomorrow should never be extinguished, and while the flicker of a dying flame emitting light in the deep abyss of despondency overshadowing the magic of bygone days may indeed threaten the future, never allow for the appendage of the laziness factor deter the best step forward in preparing, formulating and filing an effective OPM Disability Retirement application, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset.

Federal Employee Disability Retirement Benefits: The incoherent narrative

The squirrel jumped into the rabbit hole.  Then, the floods came, and Noah didn’t like the color of his shoes because they matched the starboard and not the bow, and when the rudderless drift occurred, then did the turtle finally come out from the squirrel’s nest, high atop the water’s edge. The medical conditions caused a lot of stress, and if it wasn’t for the Supervisor who constantly harasses me, I wouldn’t have filed a complaint against him, but the doctors never said I couldn’t work except when the heart attack occurred and Bessie my dog ran across the street and got hit by a car.

It is, ultimately, more than just a sequence of lettering; greater than the combination of consonants and vowels in logical arrangement; indeed, the language of the narrative must form a coherent whole.  Can a jumble of words provide the requisite narrative in order to meet the legal criteria in filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management?

Must the “Statement of Disability” as reflected on Standard Form 3112A provide a sequence of information such that it:  identifies the medical conditions suffered; informs the OPM administrative specialist of the nexus between the medical condition and the positional duties of one’s officially-slotted job; and meets and addresses, whether explicitly or implicitly, the burden of proof in showing by a preponderance of the evidence that the Federal or Postal employee is eligible and entitled to Federal Disability Retirement benefits?

To all three questions, the answer is in the affirmative.  For, preparing and formulating a Federal Disability Retirement application, submitted through one’s agency (if the Federal or Postal employee is still employed with the Federal agency or the U.S. Postal Service or, if separated from service, not more than 31 days since the date of separation) and then to the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, is not merely stringing together a series of words, phrases, concepts and factual truisms; and it is often the incoherent narrative which not only fails to meet the legal burden of proof in a Federal Disability Retirement claim, but further, is harmed by providing too much information, whether intentionally or not.

The predetermined defeat of a Federal Disability Retirement application is not necessarily denied because of the substantive incoherence of one’s statement of disability; rather, more often than not, it is the unintended divulgence of information neither necessary nor true, which often provides the fodder for the fox to further the stealth of his slyness.

OPM Disability Retirement: The Problematic Loss of Confidence

Confidence is an ethereal character trait; in some ways, it is self-perpetuating, as success relies upon it, and feeds it, which in turn reinforces any lack thereof.  At once fleeting but full, the loss of it can be devastating.

For some, a mere look of doubt or suspicion from others can undermine the fullness of possession one may have had of it just a moment before; for others, whether lack of competence or never having had any reason for possession of it appears to matter not, and like self-esteem in the generation of modernity and “me”, a complete void of accomplishments seems not to overturn those who accumulate an abundance of it.  But weakness or negation from outside sources can be the final straw in undermining that sensitive sense of self, and a medical condition which attacks the body, mind and psyche of an individual can be devastating.

Thus, when the Federal or Postal employee who has confidently strode throughout a long and satisfying career, whose performance has raised eyebrows of accolades beyond mere efforts of competence, and where performance reviews have always included adjectives and superlatives searched out beyond mere templates previously applied with thoughtless automation, the introduction of a medical condition into the life of such a Federal or Postal employee can be like the Martian Chronicles revealing the strangeness of alien cultures clashing in a battle of titans heard beyond the roar of civilizations long lost and forgotten.

Federal employees and U.S. Postal workers who struggle with this, resist the necessity of filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, precisely because the disbelief is overwhelming that, somehow, this loss of what was once taken for granted, could possibly be.  But as “possibility” includes the building of concrete structures in thin air, whereas “probability” involves the hard computation of one’s life and “reality-living” in a harsh and uncaring universe, so the Federal or Postal employee must take into account that past foundations of accomplishments may not uphold the confidence once shared and held by a Federal agency or the U.S. Postal Service.

Confidence, indeed, is like the golden dust sprinkled sparingly by the fluttering angels of yesteryear; and today is a dawn of dying expectations, where the harsh realities of a medical condition must be faced with a freshness of purpose, reserved for that fight which may require one’s presence on a day in future pasts, unforseen and as of yet unfought.

Federal Employee Disability Retirement: The Game of Calumny

If not one’s reputation, what is the remaining value?  If truth is not a goal, then what fills the void?  Yes, from ashes to ashes, and back to dust, and the elements which make up man are constituted by nothing unique beyond the environment from which he originates, and to which he returns; but the linguistic act of reductionism fails to achieve a full embrace, and just like the defensive football player who hesitates for a moment and sees the blur of the ball carrier speed past, so the aftertaste of materialistic reductionism is somehow unsatisfying.

For, to say that X is “nothing more” than an aggregate of atoms is to characterize a masterpiece as a mere collection of colors, and that is precisely Roger Scruton’s point, isn’t it?  Then, there is the game of calumny, of the capacity to try and strip another through slander and innuendo.  For Federal employees and U.S. Postal workers who suffer from a medical condition, that game by other Federal and Postal employees becomes a daily onslaught.

Somehow, it is not enough that one must suffer from the gods of fate and contend with deteriorating health.  Instead, one must further deal with the sudden isolation into disfavor, like lepers of yore shipped to colonies in deserted islands beyond the reach of virulent populations scared of their own shadows.  Slavery was outlawed decades ago, but the treatment of workers barely has changed.

For Federal employees and U.S. Postal workers who must file for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, the game of calumny by one’s “fellow” workers is merely another indicator that we are not merely a collected mass of elements to be spat upon, and that is a positive side to man’s inhumanity; but, then, finding out the truth about one’s fellow man is always better than to live in ignorance thinking that one’s Federal agency or the U.S. Postal Service was going to be supportive through thick and thin.

The time of “thin” has arrived, and it is in the thick of things that one must now fight for one’s rights.
