OPM Disability Retirement Law: The Reason Why

It all began in childhood — of the question voiced; of the curiosity engendered; of the simple: Why?

If a parent does not possess the knowledge to respond, the better answer would be: “I have often asked that myself!  I don’t know the answer to that, but let’s go to a reliable source and find out, together, what the answer to that fascinating question is!”  And with that question in hand, you can go to an encyclopedia, a dictionary, or some other source — from a hard copy of a book (wow — isn’t that an outdated thought!) to an online source of dependability — and satisfy a child’s wonder of curiosity.

For, the reason why is always just the beginning to an answer beyond, which is a perpetual and never-ending process for a curious mind; and in the end, the question of “why” is merely the beginning, and never the end, and it is the process of engaging the world in acquiring knowledge which is the important “thing” to consider.

FERS Disability Law: Falling Through the Cracks

Where did that phrase originate from?  It often refers to small things slipping through without getting noticed because of their insignificance, whether because of size or lack of notoriety.  Children who lack popularity are often thought to be in danger of falling through the cracks — of not being given their due attention; of being ignored; of failing to be noticed.

The amazing thing is that we ever even notice it at all; for, by and large, most of us fall into the category of enforced anonymity — of being in danger of falling through the cracks.  Whether you are the “star” of the class or the “appointed one” whose every move is ooh-ed and ahhh-ed — most everyone else is of the ordinary ilk, unnoticed, ignored or otherwise already having fallen through the cracks.

Medical Retirement from Federal Employment: Success or Failure

We tend to overstate such concepts.  Life is never static; the measure of a person’s character, career, family or friendships cannot be conclusively determined by some global, singular standard.  There is a spectrum to be applied — of periods where a measure of success is attained, and other times when some judgment of failure may be appropriate.

Rarely can an entire life be measured by such an all-encompassing criteria.

Permanent Disability Retirement from Federal Employment: SSDI & VA Claims

Corollary successes can have a persuasive impact upon an OPM Disability Retirement application — but one must also understand the difference between a “persuasive” impact as opposed to a “determinative” impact.

An approval of disability benefits from the Social Security Administration (SSDI) edges closer to a “determinative” one as to its impact upon a FERS Disability Retirement application.  Note the operative term, however — “edges”.  Under Trevan v. OPM, such an approval from SSDI — so long as the medical basis upon which it was filed is identical to, or fairly paralleling that submitted with the FERS Disability Retirement application — is strongly persuasive upon an OPM Disability Retirement claim.  However, it must still be argued, and certain elements of the SSDI Claim must be shown to OPM for that “persuasive” effect that “edges” towards a determinative impact.

VA Claims — even if you are deemed “Permanent and Total” — are closer to a “merely persuasive” influence upon a FERS Disability Retirement claim.  That is, the higher the ascribed percentage in a VA Disability claim, the greater the chance that it will influence or “persuade” OPM that the FERS Disability Retirement application should be approved.

Filing for FERS Disability Retirement: The identity of choice

In the end, do we?  That is — do we have a choice when it comes to our identity?  Of course, in this day and age where word-play has become completely malleable, and where Truth and Falsity rarely matter except when tested against the exigencies of the objective universe (i.e., as when crossing a street and someone says, “Be careful, a bus is coming”, and you suddenly realize that the truth or falsity of such a statement can actually have real-life consequences), the question becomes: How does one define one’s use of the word, “identity”?  Is it based upon the aggregation of objective and subjective statements, beliefs, opinions and perspectives?

In other words, are we merely the compendium of cumulative voices based upon: Our birth certificate; the driver’s license in our wallets; the memories retained by our parents, grandparents and relatives; how our friends view us; what our spouses believe us to be; what the neighborhood dogs recalls from sniffing at our feet — the cumulative aggregation of all of such factors?  Is who we are — our “identity” — different from who we believe we are?  If everyone believes X to be such-and-such but X believes himself to be a secret agent working for a mysterious foreign entity, what (or who) determines the reality of our identity?  Or, is “identity” based upon the collective perspective of a community that “knows” that individual?  Can we “choose’ our identity, and if so, completely or only partially?

For Federal employees and U.S. Postal workers who suffer from a medical condition where the medical condition begins to impact one’s ability and capacity to continue to work in one’s Federal or Postal job, there is often a concomitant “identity crisis” that accompanies the medical condition.  No longer are you the stellar worker for the Federal Agency; no longer are you the reliable provider who slogs through the daily toil as a Postal employee; instead, your identity is one of having a medical condition that limits, prevents, subverts or otherwise alters the way in which you live.

Filing for FERS Disability Retirement becomes an alternative that must be chosen, and that “choice” may alter who you are and what others may think about you.  But in the end, you do have a choice: The essence of who you are remains always within; the identity of choice is not altered merely because you file for a benefit that must be pursued because of a medical condition that was incurred through no fault of your own; and anyone who thinks otherwise never knew you to begin with.  For, in the end, the identity of choice was and remains always within the purview and power within each of us; we just didn’t know it.

OPM Disability Retirement Retirement: 2019, The New Year

It has a familiar ring to it; of a harkening to a recent past that has a melodic cadence reminding one of a famous book by George Orwell.  It is because of the “19” that we are reminded of it.  Can it have already been 35 years in passing?  “But it’s not quite as bad as all of that,” we say, and perhaps such a sentiment is right: Pox on the negativism of predictions of doom!

No, we do not have flat screens forced upon us which spy into our lives; instead, we went out and purchased them ourselves — voluntarily — and realized only later that the camera embedded can, indeed, record our every movements.  And we learned that all of that personal information shared with friends and family have been stored and disseminated to forums and facades not otherwise intended; and so everything private has become public, and there is nothing left but the shell of who we are.

But enough of that; we celebrate the coming of a new year not for the unwanted fears of the past, but because the future can always bring about change, greater prosperity and a glimmer of hope for things yet to come.  It may well be that 2019 is that very year we have been waiting for — a dawn of new beginnings.

Medical Retirement under FERS & CSRS: The Priority of Me

The “Me Generation” has now passed, and it is no longer in vogue to focus upon the “Me, Me, Me” refrain that once permeated societal acceptance of the selfishness allowed.  There followed, in some quarters of social consciousness, a turning away from the “self” and instead focused upon empathy for others, service towards a selfless society, and a cohesion that was glued by a conscientious attitude of selfish disregard.

Except, of course, in the quiet workings of those more devious than the rest of us, it merely became a marketing tool in order to create greater wealth while declaring that it was for the greater good of society.

Thus did it become advertised that drinking a certain brand of coffee was “good for the world”, that buying certain products “helped the environment”, and driving certain vehicles cut down the pollutants and emissions in order to “save” the planet — all the while, those very same companies reaped profits and the people flew around spewing vast amounts of exhaust plumes into the blue skies above.

The fact is, the Priority of Me has never changed in this universe, ever since the first man or woman looked into the reflection posed from a placid lake or pond and saw that there was a “Me” distinct from a “You” or some other.  From that moment onwards, the Law of Self-Regard would take hold.  The “priority of me” has not changed; it is reflective of a society that constantly advertises cosmetic artifice and promotes youth, beauty and first impressions as the mainstay of relevant values.

Ultimately, one may ask, is there anything wrong with such an ordering of priorities?  If not me, then who?  If not you, then why not me?

For Federal employees and U.S. Postal workers who suffer from a medical condition such that the medical condition prevents the Federal or Postal worker from performing one or more of the essential elements of one’s Federal or Postal job, it is important to recognize that the priority of me extends to the Federal agency and the Postal facility throughout — for, once you divulge the fact that you intend to file for Federal Disability Retirement benefits with the U.S. Office of Personnel Management, whether you are under FERS, CSRS or CSRS Offset, they begin to treat you as an “outsider” who can no longer benefit the “priority of me”.

Medical conditions necessitate a reordering of priorities, and it is important to make that “me” as a greater priority by focusing upon one’s health; but always remember that the “Me Generation” that purportedly had passed has, in fact, never disappeared, and the Federal Agency or the Postal Service will begin to systematically exclude you in favor of themselves — or, from their perspective, making themselves as the “Me Priority”.

No, the “Me Generation” never disappeared; instead, like a chameleon, they simply changed their appearances.

Federal Disability Retirement: The Trail of Tears

History is replete with the metaphor of maltreatment; it is the silent graves that cannot speak, anymore, which haunts a nation’s soul.  It is a reminder, of sorts; a way of understanding and revisiting the history and essence of a nation – of the westward expansion and the decimation and systematic thievery against a civilization that was doomed from the start.  But trails soon get overrun by either settlements or city construction; and tears quickly dry up so that the agony of a peoples once felt become a mere memory told in narratives and tales by old men and forgotten women who no longer matter.

Reservations were demarcated and a defeated populace was shuttled into forgotten corners of the world, left to sputter amongst themselves in wallowing memories of defeated battles and violated treaties; and, as modernity replaced the fading residue of an inglorious past, only the diaries and annotations of eyewitnesses maintained a memory of coherent violations otherwise set aside to make room for future time.  Does each one of us, in addition, have a trail of tears?  Do we shed them in the privacy of our scorned thoughts, left to the isolation of our own destroyed lives?

The Medicine Man of yore could not stop the onslaught of that which we deem “progress” and “modernity”; and in the end, it was modern warfare that doomed any resistance to change.  The medical doctor of today, like the appeals of yesteryear to the Great Spirit, can only stem the tide of a progressive and chronic disease; the methodology may have changed, from fasting and foreboding fortunetelling to pharmacological modalities and surgical intervention, but when a diseased body or mind continues to deteriorate despite such intercession, the personal trail of tears follows a parallel course of those we once trampled upon.

History is what it is – acts committed by ancestors, certainly, but ones which most of us could neither control nor protest against.  But that which we can determine – like the destiny of a future for a Federal or Postal worker who must contend with a medical condition that continues to debilitate and constrain – should be accomplished within the confines of the laws which predominate, lest one’s personal trail of tears begins to parallel that of a past now long forgotten.

Medical Retirement for Federal Employees: Trepidation

In this universe where pause reflects cautionary exposure, the Darwinian model of survival of the fittest prevails.  Ours is a society that lacks any patience; the youthful generation deems their “place” as a rightful commodity to assert without bashfulness; the old are shoved aside into old folks’ homes and nursing facilities, all the while as we give lip-service to the importance of love, family and care for one another.

It is easy to give utterances of inane and meaningless trope, of generalizations about values and moral circumlocutions of apparent profundities; much harder is to sacrifice what we want, desire or otherwise deem the encampments for our “personal bests”.  “Rights” asserted in your face constitute the norm of this generation; conformity to the quietude of societal conventions, of cohesions above dismembered cacophonies of ingratitude, are mere fodder to be cast aside.

Trepidation is a personality defect; as in the days of yore when tremulous fear, alarm or agitation constituted a pause which threatened the capacity to survive, so in modernity there is no room for such diminution of evocative negation.

Perhaps, in some other corner of the world, in a society which still values the careful fostering of human relationships, a person’s pause and trepidation to immediate action would be overlooked and unnoticed, if not merely because the significance of such hesitation would be considered nothing more than a throw-away phrase, somewhat like, “Oh, you know Betsy, she always has to have a few days before she does something!”  But we don’t have “a few days” in this corner of civilization, where daily predatory advancement is the means to success, and why disabled people are merely used as referential legal maneuvers, but otherwise shoved aside into dark corners where alleged accommodations are granted within the strictures of malleable definitions.  No, it was never curiosity that killed the cat; it was always trepidation of cautionary hesitancy.

For Federal employees and U.S. Postal workers who are considering filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, the notion that the Federal or Postal employee may have some initial feelings of trepidation before engaging the process, is both understandable as well as self-defeating.

The reality is, we have to engage the world we live in.  And the world we occupy is this little corner of the globe, where patience is lacking, hesitancy is scoffed at, and delay is deemed a purposeless abyss of wasted time.  The bureaucratic morass itself will take a long, long time, just to receive a decision from the U.S. Office of Personnel Management.  Trepidation is not a personality trait which is healthy for the process, and unfortunately, it is a counterintuitive characteristic that only serves to exacerbate the medical condition itself.

Federal Disability Retirement: Benefitting from doubt

What does it mean to “give” one the “benefit of doubt”?  Is it something that is granted automatically, or must one “earn it” through labor, circumstances or sheer luck?  What are the elements that lead to it, and why are some people accorded such grace while others are treated with impunity of disregard?

Take the following hypothetical:  You are at a party with friends and acquaintances; you sit with a number of people, and among them are a very close friend and confidante, as well as a mixture of those whom you somewhat dislike and otherwise consider an “undesirable” of sorts.  Well, let’s be honest – you despise especially this one person, and hope daily that that individual will die a horrible death in a slow, agony-filled manner.  You may even daydream of torture and mayhem, and how your laughter at such pleas for mercy fills your inner soul with delight so devious that it even frightens you to consider your own meanness and ferocity of unsympathetic attitude towards this one subhuman miscreant.

During a lively conversation – we shall call the “friend” X, and the one whom you wish the horrible and slow torture ending in death, Y – the former (X) says something that refers to you in an obscure and somewhat polysemic context.  You pause and consider; then dismiss it; for, as a friend, you give the benefit of the doubt that the utterance was said innocently and without any underlying meaning of harm or tincture of criticism.  Then, later, Y says something as well –  perhaps a reference to you, your group of people or your team effort in a project – and with obvious sarcasm, says, “Yeah, right”.

Now, had X said the same thing, it might have been taken as a joke; but when Y says it, you burn with inner turmoil and it is just a miracle upon a hair’s breath that you don’t throw the contents of your drink across the circular gathering, right at the individual’s face.  For Y, you failed to give the “benefit of the doubt”.  Why?  Is it because such granting of unconditional grace must necessarily be encircled by a context of relational warmth, and lack of it provides grounds for withdrawing or withholding any such unilateral mandate?  Is the spectrum of doubt’s convergence and emergence correlated to the level and extent of trust and friendship already established, or can it also occur in the vacuum of dealing with strangers?  As to the latter – dealing with strangers – we often coin as an act of the foolish or resulting from innocence and inexperience, don’t we?

For Federal employees and U.S. Postal workers considering the option of filing for Federal Disability Retirement benefits through one’s Federal agency or the U.S. Postal Service, then on to the U.S. Office of Personnel Management, whether the Federal or Postal worker is under FERS, CSRS or CSRS Offset, the issue of giving various individuals the “benefit of the doubt” will come up in numerous contexts and encounters – from discussing one’s medical issues with a Supervisor or Manager, to informing the Human Resource Department of one’s Federal agency that one intends upon filing for Federal Disability Retirement benefits; and such encounters, by necessity, will often involve that nagging feeling as to whether to grant (or not) the benefit of the doubt.

In the end, “doubt” is more likened to an intuition – like the hair reflexively standing on the nape of one’s neck as a warning against impending danger – and has more to do with our Darwinian background than any societal conventions we deem applicable, and when dealing with Federal agencies, it is often prudent to not grant that ultimate grace of unilateral conformity – and, instead, to withhold giving the benefit of the doubt in almost all circumstances.
