OPM Disability Retirement under FERS: Subjectivity

The “aim” of Western Thought has always been to gain credibility — of attaining to Eternal Truths and Universalities.  In a dinner conversation, the quickest way to denigrate someone’s opinion or viewpoint is to merely say, “Yes, but what you have said is merely subjective; it has no objective basis in fact”.

In a previous epoch, John Adams is attributed to having said that objective facts “are stubborn things; and whatever may be our wishes, our inclinations, or the dictates of our passion, they cannot alter the state of facts and evidence.”  He was making the distinction between the subjective world and the objective universe, and placing greater weight upon the latter.

In modernity, such a statement has lost some of its luster, if not its very essence of relevance, because we live in a post-factual world where objective facts do not hold such an esteemed status, anymore.  And yet…. Even in this world, there are somehow the remnants of elevated claims to greater significance, if something is “objectively” factual, as opposed to subjectively stated.

There is always the implication and inference that when something is deemed “subjective”, and purely so, that it is somehow concocted, imagined, “made-up” — like the child who believes that he/she is a master chef of world renown, when in fact the kitchen set-up in front of him/her is a toy kitchenette made of plastic and wood.

For Federal employees and U.S. Postal workers who suffer from an illness or disability and who need to file for Federal Disability Retirement benefits through the U.S. Office of Personnel Management under FERS, OPM systematically will make deriding and denigrating statements when it comes to “subjective” statements — of psychiatric symptoms, of chronic pain, of profound fatigue, etc.

They will say: “There is no objective verification of your X”.  Really?  Pain is subjective by its very definition; and so are psychiatric symptoms of depression, panic attacks, insomnia, nightmares, feeling sad, etc. How to counter it?  The good news is that the law is on the side of the Federal Disability Retirement applicant.

FERS Medical Disability Retirement: Ostensibly

It is a funny word, in many respects; for, it presumes and assumes what may not actually be the case.  The word, “Ostensibly”, is used to describe that which is apparently so, or purportedly assumed, but may not actually be so.

Thus, one might say of an individual who is wearing clothes appearing to suggest that he or she works in a blue-collar job, and perhaps wears a tool-belt which suggests and confirms him/her to be such, that “he is ostensibly a carpenter”.  How does the adverb qualify the noun?   Because we don’t actually know, do we?

By his appearance and the fact that the individual carries around a tool belt which contains, perhaps, a saw, a hammer, a nail gun and other pertinent and revealing instruments indicating what a carpenter would require, we make an assumption that he is “ostensibly” a carpenter.

Now, it would be strange if you were to ask the individual what his profession was, and he confirmed that yes, he was a carpenter, then to state to a friend later on that “Joe is ostensibly a carpenter”, because if you have confirmed that the person “Joe” in reality is a carpenter and there is no longer an assumption, then to apply the word “ostensibly” would be rather odd — unless, of course, you thought that he was lying and that he only wore the tool belt to fool you, or was a half-wit who was engaging in “make believe” that he was a carpenter, etc.

In other contexts, the term “ostensibly” often applies, as well — as when the U.S. Office of Personnel Management denies a Federal Disability Retirement case and makes a multitude of arguments which, in the end, implies that you are merely “ostensibly” disabled (although they will never use the word itself).

For, what OPM is saying in a Federal Disability Retirement case under FERS in denying the Federal employee’s application for Federal or Postal Disability Retirement benefits, is that while you may allege to be disabled or unable to perform one or more of the essential elements of your job, you are actually not disabled.

If that happens, you will need to contact a disability attorney who specializes in Federal Disability Retirement Law; for, you will need more than an attorney who “ostensibly” does Federal Disability Retirement Law — rather, one who is, in reality and in fact, an attorney who specializes in it.

Federal Employee Medical Disability Retirement: The Award of Not

People today receive accolades for all sorts of things — including, just for being “normal”.  The “Father of the Year” award is given to an individual for just doing what he is supposed to be doing.  A return of a lost item of personal value, or a wallet found in the parking lot — we are all amazed at such honesty.  The term “hero” is bandied about loosely, and applies to everyone and anyone who does what he or she is supposed to be doing.

The ordinary has become the extraordinary, and the negation of a negative is seen as a positive (of course, we all did learn in fundamental mathematics that two negatives = a positive, so to that extent, it is correct).

Performance reviews, too, are given high ratings, even when a Federal or Postal employee is barely making it.  In a Federal Disability Retirement case, this is often argued by the U.S. Office of Personnel Management as a negative when applying for Federal Disability Retirement benefits.  Here, the Award of Not can be a detriment.

How to counter it?  By establishing the medical incompatibility between one’s medical condition and the essential elements of one’s Federal or Postal position.

FERS Disability Retirement for Federal & Postal Employees: The Port

It is the Roman Stoic, Seneca the Younger, who wrote that, “If a man knows not to which port he sails, no wind is favorable”.  It is, in the end, the essence of Stoicism — of living life without complaint and without being impacted by the hardships of the objective world, all the while clinging to a path of virtue unfettered by worldly concerns.  That is why the quote above — of the internal “self” in contrast to the metaphor of the objective world: the winds which guide the ships — encapsulates the essence of the philosophy of Stoicism.

In modernity, it matters little from whence the winds come, for we engineer our own direction through engines and mechanical devices which propel the marine vessel by the power of our own creation.  But of that time when ships relied exclusively upon the breath of gods that blew the winds which filled the sails — it was a time when we relied heavily upon the favor of fate and nature’s appeasement.  Yet, even today, whether by the propulsion of machines invented or reliance upon prayers of guidance, no wind is favorable until and unless a person knows where he or she wants to go.

For Federal employees and U.S. Postal Workers who suffer from a medical condition such that the medical condition prevents the Federal or Postal worker from performing one or more of the essential elements of his or her position, it is important to make a determination as to “where” one plans on going before determining the “how” of the approach.  If a medical condition has clearly begun to impact one’s ability and capacity to perform all of the essential elements of one’s Federal or Postal job, then where one must “go” becomes clearer: You cannot continue to stay at the job precisely because the medical condition prevents you from doing so; and so FERS Disability Retirement becomes the option by default.

Attorney for Federal Disability Retirement Claims: The Whisper of Discontent

Seasons come and go; it is one of those ponderous “throw-away” lines that people utter without much thought, somewhat akin to the customary “hello, how are you” declarative that is stated without a pause as the speaker rushes quickly past without waiting for an answer.

Yes, and there are also winters of discontent — borrowed from the line in Shakespeare’s Richard III, and also, by happenstance, the title of the last novel by John Steinbeck; but more often, it is the whispers of discontent that prevail more pervasively, for “discontent” is not necessarily a lasting emotion, or even one that endures for a season; rather, it is whispered precisely because of its fluctuating characteristic.

We whisper it because we know that, like seasons and emotions, time may heal and further time will alter it; and others may whisper it because the fleeting nature of it may not stand the test of objectivity.  And when the whispers of discontent turn and become the louder shouts of adversity, we often failed to listen carefully and instead ignored the voices that forewarned of foreboding toils.

Medical conditions have a tendency to provide such preludes, as well.  One often knows well before a doctor tells us, whether and to what extent the chronicity and severity of the condition foretells; and whether and to what extent the impact upon one’s Federal or Postal career will be.

The law concerning Federal Disability Retirement requires that the medical condition must “last at least 12 months” — but that does not mean that one must endure a 12-month period of suffering before filing a Federal Disability Retirement application; rather, that the treating doctor or medical provider must provide a prognosis that the medical condition will last, at a minimum, that length of time.

For the Federal or Postal employee who is considering filing for Federal Disability Retirement benefits, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, the whisper of discontent comes about with the realization that the medical condition suffered is impacting upon one’s career by preventing the Federal or Postal employee from performing one or more of the essential elements of one’s job.

Although seasons do indeed come and go, and there may well be winters of discontent, the Federal or Postal employee who hears one’s Federal Agency or the Postal Service whisper utterances of discontent, may deem it advisable to begin to prepare an effective Federal Disability Retirement application, to be filed with the U.S. Office of Personnel Management, before such whispers become a winter of discontent where the avalanche of a proposed removal becomes initiated.

OPM Disability Retirement Representation: The habit that prevents

Kant was known to have followed a daily habitual routine that was marked with such precision that townspeople would set their watches and clocks by his various points of presence — i.e., if he was by the butcher’s shop, it was 3:15:17; if at the corner of Kroenigsburg Street, 3:16:09; and when he turned the corner of 7th and Main, it was 3:20:12.

One wonders if, had he paused at a random street corner to sneeze, would time have stopped, the universe become paralyzed, and the gods of the underworld been defeated in paroxysms of trembling fright?  Or, had he broken the daily routine of predictable sequences of the uninterrupted sojourn, marked by the two-steps-tap-tap with the cane of his choice, over and over again — step, step, tap, tap; step, step, tap, tap — would anyone have noticed?

Certainly, the townspeople would; and perhaps his rigid philosophical outlook, his moral foundation of principles that forever retained the universality of truth — maybe rigidity may have faltered and we would all be the poorer for it.

Could his mind have expanded into other arenas of philosophical discourse had he traveled beyond and broken the habit that prevents?  Does one’s actions of daily monotony determine the “type” of mind, thoughts, conscious processes, cognitive approaches, etc., such that there are habits that limit, prevent, pause or otherwise freeze?

Habit is a peculiar trait for human beings; it offers both solace and a sense of security in the very regularity of its path, somewhat like the repetition of a musical stanza that is both anticipated and relished despite its very predictability.  It becomes a harmful dependency, however, when the habit that prevents begins to forestall, stunt and actively become an obstacle that restrains necessary growth.

For the Federal employee and U.S. Postal worker who suffers from a medical condition, such that the medical condition prevents the Federal or Postal employee from performing one or more of the essential elements of one’s Federal or Postal job, it may well be that the habit that once allowed for success — of being punctual; of overextending one’s capacity in order to accomplish the impossible; of having such a dedication to “the mission” that one’s own health was always secondary — while honorable and laudatory while it lasted, may be the habit that now prevents.

Prevents what?  Of seeking greater health, of changing course in order to set a different goal; of preparing, formulating and filing an effective Federal Disability Retirement application, to be filed with the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset.

Sometimes, the habit that was once a positive trait becomes one that prevents, depending upon changing circumstances and altering contexts, and for the Federal or Postal employee needing to break the habit of always working for the “mission of the agency” or to complete all tasks for the Postal Service, preparing, formulating and filing an effective Federal Disability Retirement application, to be filed with OPM, may be the best next habit that results in more than the monotony of a daily walk, but a step which breaks the routine of all prior steps in order to reach an important goal — one’s health.

These days, the distinction between the two has been almost completely lost.  One must qualify such a statement with “almost”, only because there may still be minority bastions and pockets of hope still holding out that the madness prevailing will someday be overcome.

Somehow, the lines bifurcating the distinction that once were so obvious became obscured, until suddenly it was no longer a matter of just blurry lines, but the lines themselves had disappeared, and no one spoke as if there was a difference to be had.  Facts were confirmed and established “somethings” in either the objective world or of tradition-laden statements that we could all agree upon; opinions were various interpretations of those commonly-accepted facts, interspersed with the subjective content that often prefaced with, “It is my opinion that…”.

We have now discarded even the prefatory admonition, now, because it has become an unnecessary addendum; since there are no longer any facts, and everyone is privileged to hold an opinion, we go ahead and speak not facts because our opinion holds out just as well, thank you very much.

Where did it all begin?  Was it because Plato made too much about the difference between reality and appearance — so much so that he was forced to manufacture his conceptual fiction of ethereal “Forms” that itself became so problematic?  Or was it with Descartes, where certainty of one’s own existence became relegated to the subjective “I”, and so it was bound to become a muddle as more and more philosophers came to realize that, like Russell’s muse about language and the destruction of the traditional correspondence theory of truth, statements made could not so easily be identified as either fact or opinion.

It becomes much more problematic when statutory, reputation, education and logical methodology are altogether discarded and made irrelevant, and so we come back full circle in questioning ourselves, the categorizations we have imposed, and how to get beyond the conundrum of modernity’s own making.

For Federal employees and U.S. Postal workers who suffer from a medical condition, such that the medical condition prevents the Federal or Postal employee from performing one or more of the essential elements of one’s Federal job or Postal position, the question concerning “fact or opinion” is an important one, because the weaving of one into the other is queried in Standard Form 3112A, Applicant’s Statement of Disability.

How one’s answers are formulated and presented; whether they can be verified, established, “backed up with facts” as opposed to being left as mere subjective opinions — are all bundled up and contained within the questions asked, and how you will be answering them.

Fortunately, there is still remaining an approach and methodology of presenting facts as facts, and setting aside opinions and interpretations of the facts, and in preparing, formulating and filing an effective Federal Disability Retirement application, to be filed with the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, it is important to recognize the difference still, and be cautious in completing SF 3112A in light of modernity’s obsessional disorientation on the difference between fact and opinion.

Just the facts, as stated by my opinion.

Federal & Postal Disability Retirement: Life as a frown

Is most of life a frown, with a few smiles which make it all worthwhile?  Or is it perceived as its opposite – of predominantly smiles, with some frowns interspersed throughout?  Is that like the test-question for psychological health, of whether the glass is seen as half empty, or half filled?  Does the answer to the question depend upon the mood of the moment, the ethereal pattern of the day, or the fabric of that which is woven into our DNA by a matrix of unassailable conventions?  There is, to be sure, a weight of paradigms and an interwoven context which cumulatively aggregates into a “personality” of who one is; but can a Rorschach test unravel the depths of a psyche, or does it determine the course of one’s future actions because of the embedded nature of an anguished soul?

One wonders, ultimately, whether language is the conduit of the perception we possess, and that is why the Hindu guru or the Zen monk admonishes to seek silence, and to quell the obstacle of words and voices.  For, does an animal engage in unspeakable atrocities?  Of self-harm or self-immolation, or worse, of mass executions?  Is it not because of the conveyance of language, in communicating thoughts created and linguistic strings of previously-unimagined evils, that we reach the pinnacle of banality (to borrow a phrase from the Philosopher, Hannah Arendt)?  Would a man of such mediocrity as Eichmann have concocted the horrors of mass extermination, but for felicities directed by a conspiracy of greater evils?

Life as a frown; it is to approach the world with a certain perspective.  Life as a smile; it is to reproach the universe for being too downtrodden.  Is there a difference, or merely a play upon words where the distinction is lost once we wipe away the blur from our morning eyes and begin to engage in the work of the day?

Leisure is needed for the miscreant to employ the folly of a wasted day.  Time was that we all had to survive by physical toil, and worry involved how to eat in order to survive.  That is what consumes all of the rest of the Animal Kingdom; to survive, one must eat; to eat, one must toil; and the rest and residue leaves one too exhausted to consider, but for the technology of leisure where thoughts may invade and pervade, in order to create malevolent constructs of linguistic artifices.

For the Federal or Postal employee who suffers from a medical condition, such that the medical condition begins to prevent the Federal or Postal employee from performing one or more of the essential elements of one’s Federal or Postal positional duties, the “approach of life” is an easy matter to conceive of:  the medical condition itself has made the determination for you.  Life becomes a frown, with nary a smile to intercede, when the work of each day is beset with anguish, pain and sorrow.

Preparing, formulating and filing an effective Federal Disability Retirement application, to be filed with the U.S. Office of Personnel Management, actually has a constructive goal and purpose:  To alter the course of a future yet undetermined, and make life as a basket of smiles, to the extent possible in this universe of frowns.

Federal & Postal Employee Disability Retirement: The carousel of life

It is the easiest of analogies to ponder:  of a vision in the humdrum of circularity; different sizes, shapes, and images of artistry; of the choices we make and the alternatives offered; where we sit in life, of the approaches we take and the variable speed of the up and down motion; do we possess the fearless temerity to change midway from a lumbering, elephantine facade to the sleek and pathological ride of a cheetah?  Does the music have the concordant synchronicity such that it is neither an annoyance nor a distracting disturbance?  Or do we even take note of the loud cacophony of the blaring entourage, or merely as a backdrop to the excitement in the very ride we undertake?

Some recent intellectuals have argued that human beings comprehend their interaction, environment, place and significance in this world, only through the thought-process of analogical thinking; that the intersection of words, linguistic culpability and attachment of language games to encounters with the objective, impervious world of reality, becomes elevated to that Rorschach moment when the obfuscating inkblots of an objective universe otherwise indistinguishable from the insular parallelism of one’s own conceptual constructs suddenly explodes with insight and vigorous apprehension.

That was the problem with the nascent approach of existentialists; somehow, we all recognized that something was missing.  But instead of taking a right turn, that missing “something” took the wrong path down the corridors of Foucault and Derrida, and allowed for deconstruction to embrace the self-destructive charisma of nothingness.  How we understand the world; what we impart to it; the self-image of whence we came; and the walking pictures we carry about in the chasms of our psyche; they all matter, and the narrative of our lives become written the longer we survive in this anachronism called “life”.  We have become misfits in a virtual world of our own making.

The metaphors we establish within ourselves; the analogies we create to comprehend; the novel within each of us and the narrative of carefully chosen ideologies; all cumulatively define the essence of our being.  And thus as we ride the carousel of life, or watch ourselves ride from a distance, matters little to those who have decided to sit this round out; and yet, they, too — whether from afar or in a slumber of repose, must by necessity hear the music which plays regardless of whether one rides the circularity of the metaphor.

For Federal employees and U.S. Postal workers who suffer from a medical condition, of course, such an analogy can be a poignant reminder of the current state of turmoil.  Perhaps the analogy takes on greater significance if we posit a mechanical failure — of stoppage of the rhythmic ride, and where the music also blares a discordant trumpet of shattered symphonies screeching with discomfort down the sensitive eardrums of the bystanders.

Federal employees and U.S. Postal Service workers who suffer from a medical condition, such that the medical condition prevents the Federal or Postal worker from performing one or more of the essential elements of the Federal or Postal positional duties, have a clear choice to make:  Stay on the broken carousel; get off and walk away with nothing; or, of greater benefit and reward, to prepare an effective Federal Disability Retirement application and submit it to the U.S. Office of Personnel Management.

If the Federal or Postal employee is under FERS, CSRS or CSRS Offset, and has the minimum years of service in order to become eligible, then it is time to consider that it is not the carousel of life that has broken, but merely failure of the operator to take into account the suitability of the particular vision with the individual embracing that concept.  It is not always the rider’s fault; sometimes, the faulty ride itself has miscalculated the algorithm of synchronizing the music to the roundabout.  Think of it in terms of the man behind the curtain in the Wizard of Oz — but then, that is for another blog altogether.

OPM Retirement Benefits for Disabled Employees: Discovering the natural teleology

It is for that function or use in society that we strive in our early years; while some may argue that the extrinsic relationship between career and one’s natural abilities make for an artificial coalescence of man-to-meaning, nevertheless, the adaptation to societal needs results in the correspondence between man’s inherent want and the contribution to a greater good.

But what happens when, later in life, the fusion of ability with societal need is abandoned?  What if work no longer can be performed, goals cannot be met, and wants cannot be fulfilled?  We are in a phase where we preach to our children that they should find a career in which natural talents are utilized, where inner satisfaction is achieved, and a sense of accomplishment is fulfilled.

A generation or so ago, we merely thanked society for offering a decent wage and a higher standard of living.  Then, something went awry — the gap between the worker and management became a wider chasm of discontent; magazines and video clips revealed the limitless narcissism of wealth and unfettered greed; and mediocrity of talentless actors revealed that even they, too, can achieve stardom despite lack of any appreciable achievement.

For Federal employees and U.S. Postal workers who suffer from a medical condition, such that the medical condition prevents one from performing the pathway of a chosen career with the Federal agency or the U.S. Postal Service, the separation from one’s work and position may take an unspoken toll — not just because of the medical condition, but further, as a result of losing the natural teleology the Federal or Postal worker had striven so strenuously to achieve.

Filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, whether the Federal employee or Postal worker is under FERS, CSRS or CSRS Offset, is never an easy road.

Others may believe that securing an annuity because of one’s inability to perform one or more of the essential elements of one’s Federal or Postal positional duties is tantamount to winning a lottery of sorts, but the reality is that most Federal or Postal employees who file for OPM Disability Retirement benefits, if given the choice, would forego the benefit if the medical condition would resolve itself and health would dictate the course of one’s future and fate, and not its corollary, of illness and a chronic medical condition.

Throughout youth, one always strove to discover the natural teleology for value and place in society; when that essence of human need is suddenly lost or severed, it is time to reignite that loss of self, and to prepare an effective Federal Disability Retirement application in order to enter into the next stage of life’s arena of meaning, value and worth.
