Lawyer Representation for Federal Disability Claims: “Too busy to…”

It is the accent and the inflection upon a syllable that sometimes makes all the difference.  Take the following examples:

“I am too busy to…”

“I am too busy, too.”

The extra consonant in the last word makes all the difference; for, in the former statement, if it is stated in response to a call for help, it dismisses the request by informing the other person that one is simply unable to offer any assistance.  In the latter response, the subtlety of the answer should not be overlooked.  For, it is a statement of one’s own conglomeration of activities; it is not a refusal or even a rejection of a request; rather, it merely describes the current state of parallel universes that may or may not still allow for lending a hand.  Thus:

“Hey, Jim, can you lend me a hand?”

“I am too busy to.”

(Outright rejection)

Or:

“Hey, Jim, can you lend me a hand?”

“I am too busy, too.” Nevertheless, Jim walks over and lends his assistance.

Can a single consonant make such a difference?  Without the written word, can the mere inflection, intonation and syllabic accent of a lingering “o” allow for the subtlety of differences otherwise unseen except with the written word?  Would it make a difference, if it was stated in a southern drawl, a foreign accent or in “broken English”?

When one pauses and considers the consequences of language and its effects upon discourse, it makes one pause and shudder, that even in this age of Twitter and abbreviated language compositions and the irrelevance of grammar upon our daily lives, that distinctions can still cause a difference.

Are such modulated intonations significant?  Perhaps they are rarely, if ever, “life changing” events, but nevertheless can effectuate confusion or miscommunication such that disagreements may arise.

Language is the tool of communication and the effective conveyance of thoughts and conceptual paradigms.  This is important to remember for Federal employees and U.S. Postal workers who are considering preparing, formulating and filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, whether the Federal employee or U.S. Postal worker is under FERS, CSRS or CSRS Offset.

For, in the end, it is the written word that is the sword of a triumphant Federal Disability Retirement application, or the injury that defeats the same, and whether the extra consonant may make the difference depends upon the effectiveness of the rest of the application.

Federal Employee Disability Retirement: Comfort in regularity

There are those who relish the seas of daily change and the excitement of altered circumstances in daily discourse.  But as the rhythms of a seasonal perpetuity teach us of Nature’s need for regularity, so the biorhythms imparted can often form avenues of predictable patterns.  There is comfort in regularity (no, for those with singular minds, we are not here referring to the constancy of utilizing bathroom facilities; although, there is also some truth in that perspective, as well); of engaging in the monotony of expectations, unchanging circumstances and boredom of daily redundancy.

If we interpreted Bishop Berkeley’s philosophy to the extreme, each time we were to leave a room, the physical world we left behind would vanish; upon our re-entrance into the “same” room, it would again materialize, but who knows if the armchair in the corner with the slight tear in the seam of the cushion has not been moved several inches to one side or the other?

Wasn’t that always the fear in Star Trek, when Scotty would push the lever for the transporter, and the molecular deconstruction of the individual would occur – but the danger involved the potential interference within that short timeframe, when the reconstitution of matter might bring about a missing limb, a lesser intellect, or leave on the dinner table in the previous location one’s eyes, nose or mouth?  But the digression into science fiction merely points out the obvious; whether via molecular transporter or physically walking from one room into another, the expectation of “sameness” is what we rely upon, in order to maintain a sanity which otherwise would be lost in a sea of constant change.

It is, ultimately, the paradigmatic confrontation between the age-old perspective of two old philosophical grouches – of Parmenides and Heraclitus; of permanence seen in a world of a singular whole as opposed to the constancy of an ever-changing universe.  Note that, in either perspective, there is a regularity that is sought and discovered:  the expectation of consistent change constitutes that regularity we seek; and the regularity of a singularity of permanence reinforces that comfort in the same.  That is what we forever sought and continue to seek – and it is in the comfort of regularity that we maintain our balanced perspective.

That is why the turmoil of change is often devastating for Federal employees and U.S. Postal workers who suffer from a medical condition, such that the medical condition begins to prevent the Federal or Postal employee from performing one or more of the essential elements of one’s Federal or Postal position.  The inability to perform all of the essential elements of one’s positional duties is frustrating enough; such alterations often require accommodations, but when such requests are rejected, it is like a verdict upon one’s worth by the agency or the Postal facility:  You are not worth the trouble of change.

Yet, that change or alteration in the schedule, flexibility of attendance, or other minor adjustments, are often of no greater effort by the Agency than Scotty pushing the lever to initiate the power of the transporter.  But, then, Captain Kirk was quite good at making adjustments and ad-libbing as he went along – something that most Federal agencies and the Postal Service are unable to do; and that is when preparing, formulating and filing an effective Federal Disability Retirement application becomes an ever-present need that will ensure the comfort in regularity of purpose, goals and future security.

Medical Retirement from Federal Employment: And then we die

(It is the parenthetical previous statement that ultimately matters, left blank to be completed, and never to be presumed).  Actions of finality, or seemingly so, tend to create an aura of despair and angst.  Once, in a world where purpose was never questioned, and the teleological end of man never brought forth the hint of doubt, the cohesiveness of society’s resolve was never a pause.  It is the modernity of hesitation, trepidation and loss of judgment that brings us to the pit of incessant questioning, as opposed to “doing”.  This is a maddening world, where the rise of Existentialism and post-modern impotence leaves us to seek therapy at every turn.

What we do in our lives before that terminal event; what dreams we once possessed before the souring of cynicism overwhelmed us; and of those lazy summer nights when the dancing illumination of fireflies dotted the canvas of a blackened void, when thoughts would drift beyond the mere mediocrities of present lives, current circumstances and seemingly unassailable realities which constrained, restricted and limited the dreams shattered by the reality of our travails; it was then that a glimmer of hope, an expectation of possibility, and a hint of potentiality yet unrealized, would creep into the essence of our souls.

Fairytales matter, because youth cannot survive another day without some fantasy of hope; and doors left unopened and locked with the resolve of “forever” will only diminish and destroy, where the need for tomorrow yet shouts in a rashness of desire.  To shut the pathway to dreams or to construct obstacles for the mere sake of obstruction is to strangle that parenthetical gleam of light yet unextinguished and to betray the angels who look down upon us with the remnants of wings to be unfurled, in hopes of fluttering to pass by with a smile.

Perhaps, one day, there will still be such follies to believe in.  For now, there is only the toil of daily grind, and thus are we left with the question implicit in the statement:  And then we die.

In Muriel Barbery’s work, The Elegance of the Hedgehog, a youthful life of advantage but of seeming meaninglessness is traded with an older woman’s upward trajectory once lost in the anonymity of class distinctions, and the theme throughout encompasses the essence of a life’s worth.  We all want to embrace meaning and value in the life which has been given; have we fulfilled our potential?  Did the dreams we once possessed, handed to us like jewels on a plate of limitless infinity, become realized, or was it a wasted phantasm like a handful of sand squeezed and escaping through the crevices of our closed fists?

For Federal employees and U.S. Postal workers who are considering filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, the questions garnered by thoughts of future insecurity are natural and plentiful.  It is, in many ways, similar to the refrain repeated herein:  And then we die.

Once a Federal Disability Retirement application is approved, and the Federal or Postal employee is separated from the Federal agency or the U.S. Postal Service, one wonders:  Was my work of any lasting value?  Did I leave an imprint upon the shifting sands of a prior existence?  Did I make a difference?

FERS & CSRS Disability Retirement: The complexity of human experience

We take for granted much, and dismiss with careless appreciation the residue of crumbs begotten.  The idiom that refers to the final straw which breaks a camel’s back — why does the foreign species have an impact upon a culture which is unfamiliar with such a beast of burden?  Is it that, despite the images produced against the background of pyramids and pharaohs of a bygone civilization, the essence and theme of the proverbial statement resonates, whether replaced by a horse, a donkey or an ox?

The idea that tolerance to, and capacity for, a seemingly limitless weight of workplace bombardment, whether in translated terms of physical endurance or cognitive stress, is encapsulated by that transcendent cultural expression that there is, indeed, an invisible boundary of and for the human experience.

It is complex; the physical deterioration can presumably be witnessed because of the appearance exhibited; but it is the inner psyche and psychological harm, over untold times and lacking of precision of limit, which tests the stress points of fractures barely visible and likely detrimental.  Stress fractures may be subtle and sometimes inconsequential; but the incremental aggregation if left unreinforced will refuse to withstand an eternity of disrepair.

The complexity of human experience begins with the narrative carried by childhood memories; advances in fits and starts during the “difficult” period of transition from innocence to adulthood; and becomes cemented within the casement of early independence, where the spectrum and balance between love and hate, idealism and cynicism, and a mixture of hope denied by reality, coalesce to form the compendium of what the essence of a person becomes.

On that journey of filling the narrative, some become tested by greater or lesser traumas; and whether one ascribes “fault” to actions which result in consequences otherwise foreseeable, the reality is that those experiences encountered mold the character of the human narrative exposed.

For Federal employees and U.S. Postal workers who suffer from a medical condition, such that the medical condition may cut short one’s career in the Federal sector or the U.S. Postal Service, it is the complexity of the human experience which preceded that moment of realization that a medical condition may prevent the Federal or Postal employee from performing one or more of the essential elements of one’s positional duties, which will determine the future course of actions and lay the groundwork for a brighter tomorrow.

Whether under FERS, CSRS or CSRS Offset, the central point of idioms which transcend time, cultures and limitations of perspectives in modernity, is that we refuse to become relegated to a mere statistical footnote by allowing for that last straw which breaks the camel’s back, and instead insist upon allowing for that beast of burden to survive another day, if only to impart some wisdom to a world which no longer recognizes the complexity of human experience.

Federal & Postal Disability Retirement: The caustic nature of disdain in parity

In human history, class structure — whether of bloodlines or lineage; of wealth or claim to title and royalty; or of validated descendants from ancestral superiority — has been the norm.

Then, along came a religious figure (unnamed herein to avoid risk of inflammatory offense and preventing the potential for implosions of alarming hashtags in fits of fear and panic) who posited the notion that the “poor” (that class of mass populace which comprises the greater part of the world) should take “pity” upon the “rich” (those in the minority of the greater class struggle who control and manipulate the invisible levers of the world) because of the difficulties inherent in obtaining the proper credentials to enter through the proverbial pearly gates.

He went further in word-pictures of masterful storytelling, painting images of hellfire, suffering and punishment for those who mistreated the former, and where rewards, awards and commendations bestowed were merely of a temporary and ephemeral nature, whereas the eternal damnation based upon pleasures enjoyed in the temporal world would last well beyond the palliative superficiality of currency beheld.

The problem unstated, however, when the concept of “pity” was introduced, was twofold:  First, the validation of such a feeling and perspective made equals of those in unequal circumstances, and one could even argue, reversed the roles maintained for societal conformity and stability, and enforced a parity of stature; and, second, the emotional and psychological make-up comprised in the very heart of “pity”, is akin to “disdain”, and is a close cousin thereof.  Yes, yes — the one attaches to charity, a desire to assist and retains elements of empathy, sympathy, etc.; but it is more than that.  “Pity” allows for parity of status and stature, just as “disdain” reverses the roles of societal convention.

That religious figure of yore (though we may impute total and complete omniscience upon the fella) injected into society a heretofore unnecessary and problematic component of societal disruption.  It is, indeed, the caustic nature of disdain, which can evolve from pity, that presents itself as the poison which kills and the infectious spreading of ill-will and discomfiture.  The feeling of unease quickly spread throughout nations and continents, and we are in the state we find ourselves in modernity, because of that uninvited infusion of dissatisfaction.

For Federal employees and U.S. Postal workers who daily toil with a medical condition, and face the onslaught of the Federal workforce and the Postal groups, the problem of pity and disdain, and their combined causticity is well-known.  So long as you were healthy and fully productive, your coworkers, Supervisors and Managers treated you within the well-defined “class-structure” of acceptable conduct and behavior.  Once it was “found out” about your medical condition, suddenly their attitude and treatment towards you changed, and altered dramatically, or perhaps (in some instances) in incremental subtleties of quiet reserve but spiteful turns.

Perhaps some “pitied” you, and you them; but such feelings have turned to disdain — not on their half, but from your perspective. Why?  How?  You are the one with the medical condition, who cannot perform all of the essential elements of your Federal or Postal job, so what right have you?

Precisely because of that historical figure of yesteryear; that the true essence of human nature is to be cruel, and thus the best alternative remaining is to prepare an effective Federal Disability Retirement application, to be filed with the U.S. Office of Personnel Management, in an effort to preserve the last vestiges of a class structure quickly fading in this world where the caustic nature of disdain in parity still survives.

Federal Employee Disability Retirement: The mere asking of a question

In modernity, the asking of the question in itself raises a suspicion.  Being curious no longer kills the cat in some obscure, proverbial manner; to inquire immediately brands the individual and categorizes the questioner based upon the query of conventional consciousness.  Thus is debate of any kind quelled; for, to engage in a dialectical process requires a prefatory landscape of imaginative fertility; but in an atmosphere of poison and shallow interests already consecrated, there can be no classic form of “give-and-take”, of a level of intellectual inquiry required for the pursuance of excellence, improvement or uncanonized thought processes.

Can society ever escape from this cycle of self-immolation, where intellectual integrity is questioned, when speakers are shouted down at quiet lecture halls of solicitations for a teleology of thought, and at a level of purposive questioning, as in the days of yore when the pestering Socrates questioned every convention of the powerful and influential?

It will be difficult, if only because the widespread de-coupling of thought from information, separated by the force of modern technology, where deviation from identity is difficult to maintain, has made drones of us all.  Fortunately, law is, and remains somewhat in a sacrosanct manner, an arena which allows the simple query to survive, if only within the compound of argumentation for a cause.

For the Federal employee and U.S. Postal worker who becomes the victim of one’s own bureaucracy, where a medical condition requires an accommodation but the Federal Agency or the U.S. Postal Service is unable, or unwilling, to pursue avenues to allow for the continuation of one’s chosen career, preparing an effective Federal Disability Retirement application, to be submitted to the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, is often the best and only alternative to pursue.

The battle of inquiry and improvement — for, if you think about it, they go hand in hand in that the only way to “improve” anything is by questioning the status quo — may have to come to an end; and as it takes effort to expend to question and contend for greater heights and levels of excellence, so the Federal or Postal employee who suffers from a medical condition, such that the medical condition no longer allows for the Federal or Postal employee to perform all of the essential elements of one’s positional duties with the Federal agency or the U.S. Postal Service — the energy expended in other areas must now be preserved to attend to one’s medical condition and the deteriorating health of one’s body, mind and soul.

Sometimes, the mere asking of a question must be left alone, where silence is the golden ray of future radiance, and where youth may be the proper province to leave behind a generation of upstarts who never had the opportunity to ask that ever-childhood query, “Why?”

Early Medical Retirement under FERS & CSRS: Of spare things left in the world

We don’t seem to have a capacity to share of those things which we have no need, anymore.  Does scarcity of resources result in “doubling down” in ways formerly described as miserly in deed?  Does the free market principle of supply and demand explain the loss of social grace in responding to need?  What ever happened to the spare tire, the jingle of spare change, and the ephemeral absence of spare time?  Has society come to a criss-cross of contending forces, where the explosion of population growth, the rise of the middle class in developing nations around the globe, coupled with the exponential depletion of finite resources, have cumulatively coalesced to an incandescent compromise of character crisis?  Does the lack of everything mean that we can spare no more for others, or provide assistance in the event of need?

As for the spare tire issue, the fact is that modern technology has extended the wear of tires, and many people have lost the knowledge or skill to use a jack or a lug wrench.  This, combined with fear of scams and roadside robberies, in conjunction with the durability of today’s tires, has resulted in the widespread consequence of calls for help defined as a cellphone dial for professional roadside assistance.  Further, society has deemed that any caricature of a ‘damsel in distress’ is tainted with a misogynist attitude; and we certainly would never want to be charged with an ‘ism’ at the cost of helping another.  And of spare change?

Homelessness has been relegated to either a non-existent phenomenon until a different political tide rolls in, or has otherwise been linguistically redefined as an alternative lifestyle.  What remains, then, is our spare time — which we have no more of, despite the constant drumbeat to the contrary that the aggregate of modern technology is always supposed to ‘save us time’.  Isn’t that what we are told each time a new gadget is foisted upon us?  That it will save time so that we have more time for greater and more important things — like politicians who suddenly leave office or fail to seek another term in order to spend “more time” with family.  Right.

The fact is that we are left with very little of anything, anymore, other than to stare vacuously into the fluorescent chambers of computer screens and smartphone apps.  Yet, spare time, spare tires and spare change — while apparently mere arbitrary anachronisms of antiquity, alas, fading into the dim light of change itself — reflects a community of sharing now lost as art was once a defined form.

For Federal employees and U.S. Postal workers who suffer from a medical condition, where the medical condition prevents the Federal or Postal worker from performing all of the essential elements of one’s Federal or Postal positional duties, the idea of sparing a person a break, has gone the way of other spare things.  Neither the Federal agency nor the U.S. Postal Service has any spare time to spare anything, anymore, and certainly no more than the rest of society can spare.

Filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, can be likened to the spare tire in the back of the trunk, which is always there but forgotten but for the time of crisis or need.  When the Federal or Postal worker can no longer perform one or more of the essential elements of one’s positional duties with the Federal agency or the U.S. Postal Service, then preparing an effective Federal Disability Retirement application to OPM is like getting out that spare tire.

The problem is, as most people have lost the skill to use the ‘other’ implements hidden beside the spare tire — like the jack and the lug wrench — so the proverbial roadside assistance may be required.  As for spare change and spare time?  Pockets are a requirement for the former, and future fashion will determine the necessity of an antiquated design, as will inflation and online banking for the need of coins or paper money at all; and as for the latter, we are told that we have more of that than ever before; just not enough to spare for others.
