Federal Medical Retirement under FERS: Moral Probity

We don’t talk in those terms, anymore.  As “morality” has failed to survive without a religious context, so “probity” becomes a vacuous concept precisely because — without the former — there is no need for the latter.  It is a concept from a former age; and the loss of it is profound not because “religion” itself — in and of itself — is a necessary condition for moral probity, but because the ancillary benefit of its inherent value itself was of some cohesive worth.

Kant, of course, attempted to universalize a moral basis without regard to established religion, but the societal context which accepted without question the moral laws proposed was already “religious”, in the sense that the dominant culture existed within the context of accepted moral norms.

Today, “moral probity” is at best an outdated concept, and at worst, completely irrelevant.  To probe is to seriously analyze and judge; moral probity is to take that concept of analysis and apply it to the innermost sanctity of our core values.  Moral probity, in the end, is gone because morality has become a concept of the past, and probity — alas, if only it were not so — requires a seriousness which is generally no longer acknowledged of worth in engaged effort.

For Federal employees and U.S. Postal workers who suffer from a medical condition such that the medical condition prevents the Federal or Postal employee from having the moral probity to consider what is important in life, what is not; what should be prioritized; what excesses and ancillary components need to be discarded, etc. — consider that the parallel concept to moral probity is to shed yourself of that which impedes your maturity and growth.

Dealing with a medical condition is difficult enough; the total focus upon your career has been an all-encompassing activity, but when a medical condition enters the picture, you have to come to the realization that health comes first and everything else is secondary.  Moral probity requires you to recognize the sequence of priorities in life, and getting your health back should be foremost on your list.

OPM Disability Retirement Law: That Insular World

We can walk around without anyone knowing about the thoughts being thought; perhaps a grin may betray an inkling, or a sly smile triggering a suspicion; but isn’t that the beauty of the insular world?  We can escape into it; lock the doors; think our thoughts in the privacy of that insular world.  And of pain?

Wittgenstein asserted that there can be no private language game of One — i.e., of one person creating a language where only that person can speak, think, talk in that private language game, etc.  This is because language, by definition, is a vehicle and conveyance of communication, and if it only exists in that insular world of One, then it is not a language, but mere gibberish.

Again, what of pain?  Is pain similar to a private language game of One?  Certainly, others experience it — or so we are told.  But if someone says, “I am in pain” to a person who has never experienced pain, how can the second person understand what the first person is attempting to convey?  Say that the second person has in fact experienced pain — how do we know that what the second person has experienced is the same as what the first person is experiencing?

Pain, by definition, is subjective, but often with objective evidence correlating to the experience of pain.  But like the private language game of One, it is an experience which is possessed by only the person undergoing that phenomenon of feeling it.

For Federal employees and U.S. Postal workers who suffer from a medical condition such that the medical condition prevents the Federal or Postal employee from performing one or more of the essential elements of one’s Federal or Postal job, be aware — beware — that the U.S. Office of Personnel Management will often argue that your pain is merely subjective, and has no objective basis to prevent you from performing your job.

It is doubtful that the OPM Medical Specialist is making the same argument as Wittgenstein was, but nevertheless, to counter the absurdity of OPM’s arguments, you may want to contact a Federal Disability Attorney who specializes in Federal Disability Retirement Law and hire someone who is familiar with the laws, regulations and legal case-laws which can counter that insular world of OPM’s vacuous arguments.

Disability Retirement under Federal Employees Retirement System (FERS): Does Sequence Matter?

So, when you are building a house, for example — does it matter whether you start with a solid foundation?  Or do you start with the roof and move downwards?  Or in writing a short story — does a writer finish the conclusion, then work backwards?

That actually doesn’t sound so strange, does it? — because it is often the “idea” of an ending which prompts the writer to write a story; but when it is presented to the reader, what is the sequence?

Is the reader given the ending, first, then the narrative of how the ending came to be?  Yes, even that — some creative writers have accomplished that, and sometimes quite effectively.  But that is a deliberate style of presenting a story — where the sequence is reversed for dramatic purposes, and so even when the ending is first, sequence, in fact, matters very much.

OPM Disability Retirement: Desperation in a time of crisis

There is the crisis, perhaps born of a lingering problem allowed to fester and froth until the boiling point allowing for a simmering of persistent steam to rise and spill over; and then, of our reaction, our departure point where sanity and coherence become overwhelmed and replaced with a sense of doom.

We have all been through a crisis; it is part and parcel of a life lived; and though we never ask for it, it comes when least expected, when we are most vulnerable, and when we believe that we can no longer withstand the tornado of unbounded fury.

There have been moments where the crisis naturally passes, and we simply must await its presence and ultimate disappearance.  Then, there have been ones where we have the strength to muster, to counter and fight, and to overcome — and those are the ones where preparation in youth in replenishing and fortifying one’s strength of character and resolve allowed for the abundance of that inner reserve to take over, almost as if a transcendent, supernatural force took control and led one to greater heights of one’s capacity to withstand and defeat.

Then, at other times, where human strength alone may not have been enough, and it was the support of others — friends, family members, and even the family dog, who allowed one to survive and to continue on.  But it is the last within the list of responsive capabilities — where the crisis comes, and one’s sense of desperation in a time of crisis becomes apparent, and that is when the danger-point comes to the fore.

Desperation in a time of crisis is when one’s strength has been sapped; when the vulnerabilities are revealed like an open sore inviting infection to spread; and when no amount of support from family or friends can appease the soul of the epiphany of sorrow that will not be comforted and where the heaving sobs of despair cannot be stopped.  It is those times when some glimmer of hope must be shone, for it is desperation in a time of crisis that brings a person to the edge of the proverbial cliff, where the jagged rocks of life below foam with an unwary eye of remorseless undercurrent in dousing the flame of life’s gift.

OPM Disability Retirement Help: Different Standards

To overdress is almost always acceptable; to underdress — well, while it may be acceptable, you may have to endure being the subject of curiosity and quiet whispers of raised eyebrows.

There are different standards for every occasion, endeavor, event or engagement; some high, others low; a few enforced without exception while still maintaining a sense of decorum and the rest of them left to ignored apathy where anything goes.  Some private clubs seem to thrive upon the exclusivity of standards maintained so high that few can meet the exceptionalism applied, while those more accessible to the public allow for flagrant violations with nary a nod or a wink.

Postal & Federal Employee Disability Retirement: The festering mistake

There are mistakes; then, there is the compounding one where we fail to identify X for what it is, and continue to make excuses by deflecting with Y, excusing with Z or replacing it with XX.  This is called the “festering mistake” – that mistake which, like a wound that could easily have been attended to, is allowed to become infected, then spread, then become so serious as to require further and drastic means to save a life.

Think about it: it may have begun with a minor cut; it is dismissed and ignored; and from there it can develop into a spreading infection, sepsis, incurable and incalculable damage.  That is what often results from ignoring a mistake; failing to recognize the mistake and attending to it; refusing to identify the mistake and attend to the symptoms; avoiding the direct confrontation and culpability of it with unintended consequences of greater reverberations beyond that which was originally the core of it.

We all make mistakes; it is the festering mistake that leaves us devastated – not only for the mistake itself and the growing complexity of trying to make up for lost time in failing to attend to the mistake itself, but further, for the failure of identification.  Just as the seat of wisdom is the recognition of one’s own ignorance, so the engine of success is the identification of mistakes early on.

Medical Retirement from Federal Employment: The cadence of coherence

There is truth, then the ring of truth.  The former may extract a pound of flesh or a quart of blood from the reader, yet allow the subtle entrapment quietly releasing the cornered soul merely by being unpersuasive.  The latter, despite often lacking in some essential details, will nevertheless engulf the audience, whether intended or indirect and unaware, into a comatose purring of half-conscious slumber, where acceptance of an argument because of a danger of violating the pleasantry of the moment is more important than embracing the facts themselves.

That is, of course, what is ultimately “wrong” with the writing style of a diatribe; it is the seething, subterranean anger in the undercurrent of a volatile eruption like the bursting lava from an unconstrained volcano where civilizations perish and survivors flee with but the clothes on their backside, which fails the purposive teleology of a barrage of words.

The persuasive outlier must possess the heart of a musician, the humor of an invited conversationalist, and the soul of a philosopher; otherwise, the dinner audience may begin to yawn and request to excuse themselves for various reasons, including an early exit for want of company.

The truth is, truth itself is boring.  It needs sugar, spice and all that is nice; wrapped in paper which stands out, but refuses the ostentatious condiments of vulgarity in a universe surrounded by stellar vacuity.  Convincing truth, on the other hand, possesses a disposition of a rhythmic melody, orchestrated with precision by a master with a conductor’s baton not made of any particular wood, but where the waving and weaving flows in consonance with the confluency of nature, artifice and linguistic pablum.

In any effective narrative, there must always retain the cadence of coherence.  That is often the “trouble” with Federal Disability Retirement applicants who formulate his or her own narrative of persuasive concoctions; will the U.S. Office of Personnel Management drink of the vitriol seething beneath the surface of turmoil?  Will the obvious diatribe translate into a persuasive cadence of coherent ideations?

OPM Medical Retirement from Federal Government Employment: Forms, Formats and Conformity

Forms rule; formats pervade; conformity to previously formatted forms are imposed both by the forms themselves, as well as through the delimiting presentation proposed by the formatted appearance.

Forms represent bureaucratization of an industry once known as a mere whippersnapper, but which now has grown into a behemoth and overpowers all with its industrial strength and dominance.  Formats demanded by such Leviathans of leveraged leaders in lapidary loquaciousness lead leftovers left scratching lonesome and lackluster lilliputians (leaving aside luckless left-handed leeches left to lollygagging lamentably).  Conformity by all others reflects the power of forms and formats, as everyone wants to be like everyone else, and rebels who defy the standards of sameness threaten the very essence and structure of a society comfortable with a herd-like mentality.

Federal employees and U.S. Postal workers know this concept well; for, while youth may enter into the Federal Sector or the U.S. Postal Service with grand ideas of “conquering the world” with “new and innovative” ideas never before thought of (why is it that the young believe that they alone came up with the idea of a wheel, or that defying one’s parents is something that cave-teenagers never engaged previously in epochs long forgotten?), it takes but a mere few years before the spirits are dampened and the fury of imaginative flames are extinguished.

For Federal employees and U.S. Postal Service workers who suffer from a medical condition, such that the medical condition necessitates preparing, formulating and filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, encounter with, and confrontation of, another set of “forms” with a specific “format” which must follow a baseline “conformity” must again be faced.

Most Federal and Postal workers are under the Federal Employees Retirement System (FERS) and must complete two series of forms for purposes of filing for Federal Disability Retirement:  SF 3107 series, including the Application for Immediate Retirement and Schedules A, B & C; as well as the SF 3112 series, along with the onerous “Statement of Disability” as formatted in SF 3112A. For those rare dinosaurs under the Civil Service Retirement System, the SF 3107 series is not for you, but rather, it is the SF 2801 (when are you all going to fade away so that the government can save some money by throwing aside those forms?).

Just remember this:  Forms are formatted for a specific purpose; and while conformity is necessary in order for streamlining in favor of an overworked bureaucracy, in the end, the purpose of all three — forms, formats and conformity to the first two — is to achieve an end-goal, and in preparing, formulating and filing for Federal Disability Retirement benefits through OPM, that achievement is attained by getting the necessary proof and documentation over to OPM, in order to get an approval of one’s Federal Disability Retirement application, whether the Federal or Postal employee is under FERS, CSRS or CSRS-Offset.

OPM Medical Retirement Law: The Editorial Process

Every writer dreads the process; on the other side of the proverbial fence, it is the joyful perverseness of the editor, with markers in hand and metaphorical scissors and knives to slash and cut, the necessity of reducing and whittling away the creative volume of words forming descriptive paragraphs and the infancy of a birth of genius, or so one always thinks about one’s own work.

Everyone has a story to tell.  How cogent; whether systematic in logical sequence; the relevance of certain statements, sentences, and sometimes paragraphs and chapters, may undermine the greater purpose for which something is written.

The story to tell must always be refined and bifurcated into categories of recognized goals:  Who is the audience?  What is the purpose of the piece?  Is there a thematic foundation?  Who will be interested?  What is the appropriate forum for publication?  These questions, and many others, are rarely asked (or answered) beyond the egoism of the compelling need to tell.

For Federal employees and U.S. Postal workers who have a story to tell, the telling of the story is often the basis upon which one files for Federal Employees Disability Retirement benefits through the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset.  Sometimes, the story must be told in another forum — to the Office of Worker’s Compensation, or perhaps to an EEOC venue.  Will the stories change with each telling to a different forum?  Perhaps not the core of the story, but certainly some of the relevant details.

As with preparing and formulating one’s Statement of Disability for a Federal Disability Retirement application, the facts to be told, the focus to be emphasized; these all depend upon the audience of one’s target.  It is not a matter of changing or omitting; it is the necessary editorial process which makes for good print.

For the Federal and Postal employee who tries to go it alone, rarely can one be the writer and editor at the same time; and it is likely the editorial process which results in the successful outcome of any writing endeavor; and while the acclaim and accolades of success spotlight the named individual, the printed byline and the recognized author, it is the behind-the-scenes process which really wins the day.

Federal & Postal Employee’s OPM Medical Retirement: Disjointed Lives and Divergent Paths

Life brings with it anomalies and conundrums which make for bumpy rides.  Despite protestations to the contrary, the older we get, the more we seek repetition, thoughtless inaction and monotony of purpose.

Change is for youth; otherwise, why does the parapet of innovation occur (with some minor exceptions) within the fertile mind of those in early adulthood?  Technological discoveries and scientific breakthroughs are formulated within the first third of life; managing a staid environment is left for the second third; and in the final slice of the corrupted remains, we expect quietude and unobtrusive solitude.

Medical conditions tend to disrupt and destroy.  Where once the agency or the U.S. Postal Service enjoyed concurrent and parallel lives with the “productive” Federal or Postal worker, the introduction of a medical condition impacting upon one’s capacity and ability to perform “efficient service” for the Federal agency or the U.S. Postal Service, comes into doubt, and it is precisely within the context of the disjointed teleology of intended purposes, that the divergence of paths must take its course.

Fortunately, the Federal system of compensation has preemptively considered such a scenario — by offering Federal Disability Retirement benefits for Federal and Postal employees under FERS, CSRS or CSRS Offset.  Federal and Postal employees who are no longer able to perform one or more of the essential elements of one’s positionally-required duties, as delineated and described in the official PD of one’s job, have the option of filing for Federal Disability Retirement benefits.

Ultimately, such a Federal Disability Retirement application must be submitted to the U.S. Office of Personnel Management — through one’s agency, if one is still on the rolls of the agency or the U.S. Postal Service, or separated but not for more than 31 days; or, directly to OPM if the Federal or Postal employee has been separated for more than 31 days.

In the end, it is not the disjointed life or the divergent path which will determine the headstone of time; rather, it is the residual influences we leave and heave upon the next generation of confused minds which will make a difference, and whether the staid quietude we seek in the sunset of generational transfer of responsibilities can allow for another alteration of paths, as one who decided to create a new trail by following Frost’s road not taken.
