Office of Personnel Management (OPM) Disability Retirement: Don’t Be Fooled

This is a legal process.  Don’t be fooled with the following: “Yes, it is just a matter of filling out a few forms.  Get your medical records, complete the forms and submit it all to your Human Resource’s Office”.  But what about the decades and decades of case-law and legal precedents surrounding the Federal Disability Retirement process?

Don’t be fooled — The U.S. Office of Personnel Management is not in existence to merely rubber-stamp each Federal Disability Retirement application submitted by Federal and Postal employees under FERS.  Rather, OPM is determined to find an excuse — any excuse — to deny the claim and to make it appear as though you never had a chance at qualifying.

If your attendance has become a problem, OPM will argue that your medical conditions are not serious enough to warrant your inability to make it into work.  If you have stellar performance reviews, OPM will point to them and argue that, See?  Your Agency says you are doing a great job, and therefore your medical conditions are not serious enough to preclude you from performing your job duties.

If “conduct” is ever an issue, OPM will point to it and say, So you got into trouble with your agency and now you are trying to fool everyone into believing that you have a medical condition.  Again — don’t be fooled.

OPM Federal Retirement is a serious legal process, and you should be forewarned that you will need an attorney to argue your case for you.

Federal Disability Retirement: Tomorrow and Beyond

We prepare for tomorrow, and plan for beyond.  There is a difference with a distinction.  For, tomorrow is soon upon us; the “beyond” is an obscure timeframe that dictates minimal physical effort, but much cognitive input.  We can “deal” with today and tomorrow — of pushing forward, setting aside worries and anxieties; but it is the “beyond” that takes a toll when too many uncertainties, unpredictables and unknowns coalesce to present a dark hole that cannot be managed.

Hope is based upon a future that can be imagined, and when the imagination becomes damaged to the point where human creativity can no longer foresee the proverbial “light at the end of the tunnel”, then the darker caves of the mind’s chaos can overwhelm.  Medical conditions tend to do that, especially when they become chronic and intractable.

This most recent pandemic can also undermine one’s sense of hope, and dash the plans for the “beyond”.  But for now, it is the “tomorrow” that we all need to focus upon, and for Federal and Postal employees looking to “solve” the problem of one’s inability to perform one or more of the essential elements of one’s Federal or Postal job, it is enough of a chore just to consider filing for FERS Disability Retirement benefits.

OPM Disability Retirement: Consider the Alternatives

It is a prefatory phrase that forces one to weigh the choices that are available, and by doing so, be compelled to finally make a needed decision.  Decisions are often hard to make.  There are some who become paralyzed merely in being presented with various choices in life, while others appear to breeze through the elimination process rapidly, arriving at a confidently-made decision without much effort.  Or seeming so.

Are some people born as “decision-makers”, while others fret and fume over whether to choose between a chocolate flavor or a vanilla?  How are children taught to make decisions, and for those who become anxious at every turn of being presented with alternatives, is it because such an individual was never taught as to the methodology of “sound” procedural processes in arriving at it?

For Federal employees and U.S. Postal workers who suffer from a medical condition such that the medical condition prevents the Federal or Postal employee from performing one or more of the essential elements of his or her job, consider the alternative: Continue working and deteriorating health-wise in your condition; face increasing pressures at work, resulting in possible termination; resign and walk away with nothing; or, begin the process of preparing, formulating and filing an effective Federal Disability Retirement application, to be filed with the U.S. Office of Personnel Management.

Disability Retirement for Federal & Postal Employees: Lost Causes

It is that famous line from the 1939 movie, “Mr. Smith Goes to Washington” which is evoked by the phrase, “Lost Causes” — of the near-defeated Senator Smith who reminds his father’s old friend that once upon a time, even he had believed that such were the only ones worth fighting for.

It is an idealistic movie; perhaps, even naive.  Was it because of the time in which it was made?  Would — could — such a film be produced in this day and age?  Could there really have been such an individual with unfettered idealism in this era where cynicism and tribal warfare abounds with unlimited and unrestricted savagery?  Do we even have a conscience, anymore, which is required to fight for those “lost causes” that need an advocacy unblemished by the dirt of pessimism?

For Federal employees and U.S. Postal workers who suffer from a medical condition such that the medical condition prevents the Federal or Postal employee from performing one or more of the essential elements of one’s Federal or Postal job, perhaps the medical condition itself has resulted in a perspective that one’s own career, and even life itself, has become one of those “lost causes”.

Filing for Federal Disability Retirement benefits is not the “end all” of a solution to a lost cause, but it does provide a glimmer of hope so that the Federal or Postal employee can re-focus his or her attention upon regaining one’s health.  But there is a sticking point — the U.S. Office of Personnel Management.  A denial from OPM can make it appear as if our Federal Disability Retirement application has become another one of those “lost causes”.

Consult with an experienced FERS attorney who specializes in Federal Disability Retirement Law to see whether or not what you perceive as a “lost cause” is worthy of a cause to fight for, and don’t give up so easily; for, in the end, what Senator Jefferson Smith said is what keeps that flame of hope alive — that the only causes worth fighting for are those “lost causes” that everyone else had abandoned.

Disability Retirement for Federal Employees: Minor pleasures

At what point does the transference occur?  Minor pleasures are those interludes in life that make for everything to become, and remain, worthwhile; sometimes, because of various tumults in our lives, the designation of “minor” becomes altered, and becomes “major” – like the dream fulfilled of that kid who toiled in the minor leagues for so many years and finally got his big break by being called up to the majors.

Is such an indication of a metamorphosis a harbinger of something else?  If the minor pleasures of life – coffee with a piece of chocolate; reading a favorite book; a swim in the ocean; an early morning walk (or run) with the dog; or even a weekend, afternoon nap – are suddenly taken away, what (major) consequences would accrue?  Does subtraction of it, or negation of the enjoyment, determine the substantive input and extent of the designation?

If it is missed to the point where it makes you miserable, does it indicate that it was never “minor” to begin with, but of major proportions all along, but you just didn’t realize it?

How about its opposite – a “minor irritant” – does that possess a meaning encompassing a parallel but corollary effect?  What if your “significant other” engaged daily in a habit that irritated you, but in a minor way – you know, those things that, when you were dating (or, to show your age, applying the anachronistic terminology of “courting”) or just hanging out together until you both decided to make the arrangement permanent, it all seemed “cute” and attractive, but now is a bothersome dig, but not enough to engage a war over – like blowing one’s nose loudly in public, or picking one’s toenails and leaving the remains on the bathroom floor; or leaving a door unlocked, etc.

At what point does a “minor” irritant become a major one?  When you get into a fight and you point out the laundry list of such irritants?

But take it in another sense – all of a sudden, that significant other dies or departs, and you realize that all of those irritants are suddenly missed, and you actually wish that you were tormented by them, because they amount to minor pleasures that awaken the dull sensibilities of life’s monotony.

Medical conditions can be like that – like a minor irritant that becomes a major complaint.  Or, the absence thereof can be the minor pleasure, where you remember that once, not so long ago, you were fit and healthy, and just the mere fact of a medical condition’s absence is a minor pleasure in life.

For Federal and Postal employees who suffer from a medical condition, such that the medical condition prevents the Federal or Postal employee from performing one or more of the essential elements of one’s Federal or Postal job, the question is, What is the point of life’s minor pleasures?  Is it to make everything else tolerable, or to be enjoyed regardless?

Filing a Federal Disability Retirement application is often not just a necessity, but a path towards regaining a sense of balance – of asserting those minor pleasures in life that have been erased and eradicated because of the constant harassment at work and the hostility that kills all joy.

Preparing an effective Federal Disability Retirement application, to be submitted to the U.S. Office of Personnel Management, is just the first step in the long road towards getting an approval from OPM. But it is a worthwhile step, especially if the goal of life itself is to enjoy those minor pleasures of living – like attending to one’s health as a priority in order to once again relish those minor pleasures.

OPM Medical Retirement: When we used to speak of meaningful things

Perhaps the negation of ideas trickles down, just as water from a crack in the roof tiles; of Derrida, Foucault and the deconstruction movement after the lengthy period of disillusionment represented by the French Existentialists headed by Camus and Sartre; for, if meaning constitutes parity and the loss of hierarchies and paradigms in crumbling corners of inconvenient truths, then Orwell’s prediction of how totalitarianism will infect society with the tools of our own making, will come about sooner than we thought possible.

Let us not speak of Logical Positivism and how the expungement of ethics and metaphysics from kitchen table discussions resulted in the loss of meaning, value and truth; for, if validity of a statement is determined from on high in the ivory towers of Russell, Wittgenstein and Ayers, et al., one has only to look at the state of British society today to realize that while the island continent allowed for profundity of thought in the isolation of its heyday, its impact and influence should have remained contained in order to spare the rest of mankind.

There was a time when we used to talk about meaningful days.  Oh, it doesn’t refer necessarily to what is said, but more as to the discretion of what is kept silent.  For, it is the pause between thought and spoken word which reflects the depth of thoughtfulness; and, in modernity, the comma of silence between the typed garble considered a sentence, and the push of that button which shoots it into the eternal space of the Internet.  Just take a cursory preview of random Facebook and Twitter pages; of the inane, the insane and the intemperate; there was once, long ago, a time when work and toil to put bread on the table prevented the leisure of thoughtlessness allowance for indiscretion of a spoken word.

To be wrong is one thing; most mistakes are correctible and even forgivable; it is the engagement of lack of thought, discretion and unadulterated vacuity of breathtaking stream of words spoken, shared and disseminated without care, which destroys the society of binding values and becomes replaced with angry shouts of rights and privileges, and more so by those who engage in the self-immolation of devaluating acts.

Greater quantification of information does not implicate knowledge, leaving aside the concept of wisdom; instead, as Orwell knew so well, words mean something.  We tend to think that the more said, the greater volume of voice, and the increased amassing of a library of information, somehow leads to a smarter society.  It is, instead, quite the opposite, and the negative effect of thrashing about to escape from quicksand; the more we say, the stupider we appear.

Medical Retirement from Federal Government Employment: The power of dialectical shrewdness

The Middle English noun form of the term connotes a conniving and negative tone, as in the focus of Shakespeare’s play, “The Taming of the Shrew”; but the adjective form merely denotes a practical astuteness in utilizing scarce resources in creative and constructive ways, whereas the altered noun form of “shrewdness” simply extends upon that kinder, gentler meaning.  When truncated as a compound concept with the term encompassing language and communication, however, it is meant to imply a practical force of conveying which sheds itself of unnecessary embellishment and unrequited force of utterance.

We live by narratives.  They form the foundation of who we are, the essence of that image which we carry about, and we readily push the proverbial “button” of the subconscious when queried about our past.  It is not so much that Grandpa or Uncle Ben are getting senile when they repeat the same stories, tell the parallel jokes, or convey the identical remarks from the previous merriment of holiday cheer; no, the narratives kept deep within the treasure troves of the inner soul and psyche are mere traces of a recording played with repetitive muse.

Can they be altered or amended?  Of course.  Can corrections occur? Always.

That is why, when a third party is invited to dinner, who by happenstance was present to confirm or deny a shared and common experience, or to correct a detail not heretofore known (it turns out that Grandpa wasn’t quite at the “first” landing of D-Day, but arrived a few days later as part of a “clean-up crew” in a more “administrative” capacity), the sudden need to rearrange and reorder the ensconced narrative forever frozen in a timeless eternity of thought, historicity and remembrances, becomes more of an irritation than a grudging concession.

That is why it is vitally of importance when a Federal employee or U.S. Postal worker who is preparing an OPM Disability Retirement application, to recognize a need to depart from the automaton-workings of life’s daily routine.  Language is more than a conveyance of directions and recipes to prepare a meal; it is the manner of osmosis for higher animals and angels unseen in a universe of trolls and trollops.
