Tomorrow”, as a word written today, pointing to a dimension beyond; to a vantage and perspective not yet realized, and forever to be referenced by a future date yet unknown.  When read tomorrow, it leads to the next day; and when looked upon the next day, to the following day again; and in this eternal sequence of tomorrows, whether written today, tomorrow or the next day, it forever reminds us that hope lies not in the morass of today’s problems, but in the change of things yet to be realized.

Yes, yes — we all recognize the scoffing that often surrounded the political banner of that famous phrase, “hope and change” — but that is merely because the potency of words, concepts and formulated paradigms lose their efficacy once they are used within a public arena that turns into a campaign slogan. Hope is always for tomorrow; for, without tomorrow, hope remains fallow as the desert that once promised a fertile reserve but never realized the rivers that had dried up because of the changes of the subterranean shifts in tectonic quakes that others failed to predict.

For Federal employees and U.S. Postal workers who suffer from a medical condition such that the medical condition prevents the Federal or Postal employee from performing one or more of the essential elements of one’s Federal or Postal job, the hope for tomorrow will often include the preparation, formulation and filing of an effective Federal Disability Retirement application, to be submitted to the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS and CSRS Offset.

Federal Employee Disability Information: Accuracy

How important is accuracy?  The converse of such a query, of course, is:  Is inaccuracy significant?  One would immediately posit:  It all depends.

Take the following 2 hypotheticals:  An archeological dig is conducted, and it is believed that the site of the ruins is of relevant importance concerning a time-period of “recent” history — say, during the American Revolution.  Given that scenario, the “dating” of the site should be ascertainable within a year succeeding or preceding, such that if the Lead Archaeologist declares that the event in question occurred in 1778, “or possibly in 1779, maybe as early as 1777”, we know that — given the time period in question (1775 – 1783) — such a statement conveys a fairly accurate historical context.

Now, take the same hypothetical, but this time [sic] concerning some form [again, sic] of a fossil that is deemed at least 500 million years old.  If the Lead Archaeologist declares with some hint of irony, “Give or take a few million years more or less” — what would our reaction be?  Is such a “find” just as accurate as in the first hypothetical?  Can a declaration that is numerically off by a few million years (i.e., looking at it in quantifiable terms of 24 hours in a day times 365 days in a year times 2 – 5 million years equals how many hours for those who want a graspable perspective) be called a “science” in any meaningful usage of the term?

Of course, one could argue that even within the first hypothetical, given the limited range of years that comprises the American Revolution (1775 – 1783, or a mere 8 years), to be off by a year or so is also quite an astoundingly inaccurate assessment.  But which is “more accurate” — the one that is estimated within a year, or the one that quantifies it in terms of “millions” of years?  Can one even ask the question of “more or less” accurate, when the very concept of accuracy itself denotes precision and pinpointed, undeviated marksmanship?

For Federal employees and U.S. Postal workers who are considering filing for Federal Disability Retirement benefits, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, the question of “accuracy” can be a crucial one.  How “accurate” does one’s Statement of Disability need to be on Standard Form 3112A, Applicant’s Statement of Disability?  What “precisely” does the treating doctor have to include in the medical report?  How detailed (and therefore, accurately) does the nexus between the medical documentation and the Applicant’s Statement of Disability does it have to reflect?

In all such questions, “accuracy” is a goal to attain in preparing, formulating and filing an effective Federal Disability Retirement application, to be submitted to the U.S. Office of Personnel Management.

For, while the Archaeologist may be “off” by a quantifiable sum of years in a site-dig and suffer little to no consequences, the Federal Disability Retirement applicant must depend upon the accuracy of the law in determining benefits to secure a future yet uncertain, and such an administrative endeavor is likened more to the accuracy of the arrow that is shot towards an apple resting upon the head of a young boy, than of a declaration made that is off by a few million years, give or take, more or less.

OPM Disability Retirement: The Happiness Goal

Whether human happiness is the goal to strive for, or as a byproduct to savor in those moments of sudden revelation, is for each individual to ascertain and abide by.  One can study the sages and philosophers and realize that there is a distinction to be made between joy and happiness, of contentment and satisfaction, and from a sense of peace as opposed to the turmoil of anxious foreboding.

Life is full of moments; but is it for those moments we live, or do such ethereal segments compel us to greater achievements?  From Aristotle’s Eudaemonism to Confucius’ focus upon maintaining the balance between family and normative behavior, or the extreme nihilism of Nietzsche and the existentialist’s embrace of the absurd, the modern approach has been to ensconce happiness as the principle of highest regard.  But life has a way of interrupting every neat packaging of human endeavor.

For Federal employees and U.S. Postal workers who suffer from a medical condition, whether of physical pain, the chronicity of progressive deterioration, or the overwhelming psychiatric conditions which impact mental acuity, cognition, with symptoms of depression, anxiety, panic attacks, etc., the desire for the “happiness principle” is sometimes merely to have a day without the symptoms of one’s medical condition.

Filing for Disability Retirement benefits through the U.S. Office of Personnel Management, whether the Federal employee or the U.S. Postal workers is under FERS, CSRS or CSRS Offset, can be an intermediate goal, and not an “ultimate” one.  For, in the end, if the Federal or Postal employee can no longer perform one or more of the essential elements of one’s positional duties, the loss of job satisfaction will be exponentially heightened either by the agency (through disciplinary procedures or termination of employment) or by one’s self (through frustration of purpose, increasing recognition and acknowledgment of one’s inability and incapacity, etc.).

In the end, the “happiness goal” is often defined by who controls what; and in taking the first steps toward preparing, formulating and filing for Federal Disability Retirement benefits through OPM, one asserts control over one’s present and future endeavors, and fights against the winds of time and mortality by controlling the undetermined destiny of a period of life yet to be deciphered in this complex world of mysteries wrapped in a chasm of conundrums.

OPM Medical Retirement Attorney: The Cauldron of One’s Past

The oversized iron pot hangs over the open fire, and the gurgling of ingredients steams and burps the lid in predictable sequences of rhythmic timing; the aroma is an admixture of sweet and mysterious combinations of one knows-not-what; perhaps of bones, marrow and herbs, here a whiff of something which touches upon the dark recesses of one’s memory, and there a hint of harboring horrors, reminding us of past deeds and loathsome reminiscences.

The figure who stands hunched over the source of pervading uprisings, is covered in a dark shawl; a bony hand gripping the large wooden ladle, mixing, turning, crouching over to sniff and taste; and from the chasm of the figure’s hollow mouth, toothless and echoing a chamber of snorting chafes, the sigh of satisfaction emits, as the cauldron of one’s past is ready to be served.  And so the story goes.

Who among us would want the fullness of one’s past and history of deeds to be revealed?  What pot would hold the full taste of one’s misdeeds, private concerns and actions engaged?

For Federal employees and U.S. Postal workers who are considering filing for Federal Disability Retirement benefits, the process itself sometimes feels like one is forced to partake of a witch’s brew — who will be in the mix?  What private information will have to be revealed?  When will the pot of information be ready?  Who will mix the ingredients?  The mysteries contained within the mixture of the witch’s brew is indeed terrifying.  Every process which is unknown and, moreover, unknowable, is one fraught with concerns and trepidation of purpose.

OPM Disability Retirement Lawyer: Life’s Dispensation

It is often a word which is accompanied with the adjective, “special“, as in “special dispensation”; but a close review of such a phrase would reveal the redundancy of placing the two words together.  For, to have a dispensation is to be offered a unique situation where one is already exempted from the usual and customary rules applicable; and to insert the adjective, “special’, adds little to the exclusionary nature of the occasion.

For Federal employees and U.S. Postal workers who suffer from a medical condition, and where the medical condition is beginning to impact one or more of the essential elements of one’s positional duties occupied in the Federal sector and U.S. Postal Service, it is the disability and medical condition itself which gives rise to the dispensation requested, demanded or otherwise warranted.

That is precisely why resentment, hostility and exclusion occurs as a reactionary response by the Federal agency or the U.S. Postal Service: because special treatment outside of the normal rules of employment tend to engender such negative responses.

Filing for FMLA; requesting an accommodation in order to continue working; becoming entangled in EEO Complaints, grievances and the like — they all set you apart, and require actions outside of the normative parameters of daily relationships within the employment sector.  And that ultimate reaction by the agency, of “sticking it to the guy” even when it involves a medical condition impacting one’s employment and livelihood — one wonders, how can others be so cruel?  It is justified precisely through the psychology of the “herd mentality“, reduced to its most natural form in a single question:  “Who does that guy think he is?”

For Federal and Postal employees, whether under FERS, CSRS or CSRS Offset, it often becomes necessary to follow up with the ultimate dispensation of that which one’s employment offers — that of filing for Federal Disability Retirement through the U.S. Office of Personnel Management.

It is not always the case that an employment package offers an annuity which (A) provides for continuation of insurance benefits and (B) allows one to work in a different vocation while receiving the annuity; but Federal Disability Retirement allows for both, so when the situation arises and there is a dispensation which reveals a solution to a problem, it is indeed a special circumstance which should be recognized as such, while ignoring the redundancy of life’s tautology.

Postal & Federal Disability Retirement: Adrenal Fatigue

One need not be officially diagnosed with Addison’s Disease in order to incur the wrath and ravages of adrenal insufficiency.

Life’s multiplicity of compounding and complex stresses; exhaustion beyond merely feeling “run down” or otherwise out of synchronized balance from everyday feelings of adequacy; a sense of profound fatigue, where cognitive dysfunctions develop, and where symptoms of falling asleep at meetings, where the world appears at times to become a distant echo chamber and what others view as a normal pace appear in dizzying fashion of incomprehensible clatter of distractions; and where visual disturbances occur systematically as one attempts to view the computer screen and perform work which, in previous times, was merely mundane and monotonous, but now requires an effort beyond sheer force of will.

Does modernity and technological stress contribute to medical conditions which may have no name, and often defies pigeonholing because of the mysteries of the human body and psyche?  A broken arm is easy to identify, and normally just as correctable; a cervical or lumbar disc degeneration, perhaps a bit more complex, but often manageable; chronic pain, but for a parallelism between objective testing and pain points, sometimes an anomaly; psychiatric conditions, of greater mystery which has become too often a pharmacological corridor for treatment modalities; but where profound and intractable fatigue more often than not is beyond the capacity to be diagnosed.

However one characterizes it — of adrenal fatigue, insufficiency, chronic fatigue syndrome, or other designations of type; it is ultimately the reality of the daily toil and turmoil with which the patient must contend.  For Federal employees and U.S. Postal workers who experience such a state of physical and psychiatric condition, filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, may be the best and only alternative available.

In the end, adrenal fatigue may be more than an endocrine imbalance; there is often a complex component where multiple medical conditions ravage the body and mind, and as with so many issues in law and life, there is a vast chasm between having a medical condition, being properly treated for the condition, and proving one’s medical condition in law such that one can be found eligible for Federal & Postal Disability Retirement benefits through the U.S. Office of Personnel Management.

Fatigue, whether of the adrenal kind or of resulting impact from a lifetime of stresses, is a basis for Federal OPM Disability Retirement; attending to the condition should always be the first order of business; proving it, the second and subsequent thereafter.

OPM Disability Retirement Attorney: The Aftermath

We like to think in linear prose; that is why, when E. E. Cummings showered the literary world with typographical disarray, a collective groan of discomfort visibly shook the foundations of the art form.

In daily life, it is the capacity of seeing a beginning, continuum and conclusion to a segment of a bifurcated visual horizon, which makes for sanity.  Closure and a sense of termination allows for satisfaction of an accomplished deed.  To be required to maintain a project, a task, an obligation, etc., is to engage in an eternal hell of unendurable agony; but that is, in the end, what must be done for most things, which is precisely why life is a challenge of inestimable proportions.

Federal Disability Retirement is no different; once obtained, one would like to think that closure has been accomplished, and that life is nothing more than forward-looking deeds to be reached like ski slopes allowing only for downward spirals of travel, never needing to look back.  But maintenance of effort is always a requirement; making sure that one is preserving the rights which one has fought so hard to gain, is a daily task, a present obligation, and a necessity of life in Federal Disability Retirement law, as in other sectors of life.

Whether to recognize the earned income cap for Federal Disability Retirement annuitants while still under a certain age, or making sure to be able to re-certify one’s ongoing medical condition and disability — these are never tremendously onerous tasks, but ones which can only be satisfied if one is fully aware of the laws which govern them.

Filing for Federal Disability Retirement benefits by the Federal employee or the U.S. Postal worker, whether under FERS, CSRS or CSRS Offset, is the first step in securing one’s future; the aftermath is the second and many subsequent steps, in ensuring the viability of that which one fought for in the first place, lest history should be repeated and goblins be allowed a resting place where none should be.
