Is life a continuum of difficulties, with a punctuated exclamation point when a respite interrupts and pauses?  Or, is it the opposite — of relative calm with isolated islands of difficulties?

Federal Employees Retirement System (FERS) Disability Retirement: Myth of the Unbiased

The “uninterested” or “unbiased” party — does such an entity even exist?  In parochial terms, it is to say that “X has no skin in the game” — meaning thereby that an individual has no preference, no “money placed as a bet” on either team; has never expressed any weighted opinion as to one or the other — in other words, he or she is an “unbiased” participant.

But there are other factors beyond whether or not a person expresses a preference, are there not?  Of an irrational dislike of one over the other; of a self-interested desire to “win” by picking one over the other; or perhaps of simply being bored and wanting to be a contrarian by choosing one over the other.

Thus, in a Federal Disability Retirement application before a “medical specialist” at the U.S. Office of Personnel Management, to identify an OPM reviewer as someone who is unbiased or uninterested, is to miss the point.  Yes, allegedly, OPM is supposed to be unbiased and uninterested, and merely apply the law and review a Federal Disability Retirement case in an objective manner.

Federal Employee Disability Information: Mortality averted

Does it occur when the body is entombed?  Or, perhaps, like children who play “king of the hill”, the exhilarating feeling that overwhelms when once you are alone on top of the hill, unchallenged, identified as the winner of a game otherwise known to be silly but at least for the moment, a sense of immortality, where mortality is averted for a day, a second, a moment or in likened eternity.

Is the “winner” of life he/she who has the most toys at the end?  Is that why old men divorce their best friends after 30 years of marriage, only to remarry immediately to a person some generation or more younger, so that mortality can be averted?  Is there unequivocal, scientific proof that fad diets, working out at gyms, avoiding dangerous leisure activities like bungee jumping without making sure that the cord is shorter than the distance between Point A and the chasm’s end below — do any or all of these ensure mortality to be averted (surely, not the last of the series implicated, although the exhilaration felt just before the cord strains to restrain must bring about a rush of sensation before the concept of causality is tested for the last time)?

Do we surround ourselves with things that last beyond the days of antiquity only to remind ourselves that some things in life do, indeed, remain beyond the time of our own demise? Why do people write out wills and instructions detailing post-death affairs, knowing that we will not be present to oversee the execution of our wishes?

It is, indeed, a puzzle — of transporting ourselves in consciousness to a time beyond and planning for a moment when we are no longer here; yet, to race furiously during our lifetimes to make sure that others have some semblance of a memory of our existence.  How many tombstones lay fallow in graveyards just around the corner, unvisited, untended and forgotten, except in echoing whispers of yesteryear’s cousins who once stole the golden chalice of mortality’s laughter?  And what about the middle ground — that time of illness and deteriorating health, when we are reminded that mortality is, indeed, just around the corner, and the not-so gentle nudge that pulls us in that direction?

Lawyer Representation OPM Disability Retirement: Perspective versus reality

One may counter that the contrast is no different than that which we encounter daily, especially in this universe of millennials and post-millennial era – of opinion versus fact, or truth versus falsehood (and now the new one, of “news” versus “fake news” or “facts” versus “alternative facts”).  But “perspective” versus “reality” has some subtle nuances that need to be explicated.  For one thing, one’s perspective may be identical to the reality one possesses a perspective upon; or, more likely, it is merely an interpretation that may differ from someone else’s.

One could, of course, argue that all of reality is merely a perspective, and this would comport with the Kantian view that our phenomenological experiences can never depict the “noumenal” universe (Kant’s verbiage) that is outside of the categorical impositions of our human make-up, and that therefore the human perspective is something that cannot be avoided, anymore than a dog’s perspective can be assumed or challenged, or a bat’s perspective (refer to Thomas Nagel on that) would be understood or comprehended by a human’s perspective.

In other words, we can never completely disown the perspective imposed by the innate structures of our own “kind”, and thus it may be an error to ever represent a contrast between “perspective” and “reality” (thus the misnomer of the title above, “Perspective versus reality”), but should always encompass and embrace a commensurate connection of “Perspective of reality” (a consonance of the two) or “Perspective and reality” (a conjoining compatibility of both).

Yet, we know that certain people interpret things differently from what we believe constitutes an accurate portrayal of “reality”.  However, so long as we stay within certain confines of accepted normative interpretations, we rarely contest or openly disagree with alternative depictions, unless it is to obtain a consensus that somehow disproves the validity of the other’s portrayal (i.e., “Yes, but John, Joe and May agree with me”, as if quantification of perspectives somehow diminishes the accuracy of another’s; as opposed to saying, “Well, Copernicus thought otherwise while the rest of the world continued to maintain a geocentric perspective of the universe” – unless, of course, you are ignoring the “rest of the world” to include China, Japan, etc.),

Yet, there are factors that have to be considered when discussing the distinction between “perspective” and “reality”, and one of them often involves medical conditions – an element of reality that often skewers perspective.  That is why, for a Federal or Postal employee who is considering filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, the importance of relying upon accurate information, good and sound legal advice, and a straight and narrow path towards a successful outcome with the U.S. Office of Personnel Management (no matter the length of time it may take these days), is important.

We have all seen it; the question is, how is it recognizable?

Well, one way is by the contrasting identification with other features of the human façade.  Here, Plato’s attributed observation that the eyes are the window to one’s soul, is that comparative characteristic that reveals the veil of the phony smile that uncovers more than words will tell.

It is that disarming act that defies sincerity but only is manifested when it is too late; of the knife that stabs one in the proverbial back just after the smile has been issued, like a letter that arrives with such anticipation of joy and yearning, only to begin with the proverbial warning, “Dear John”.

The phony smile is well known; it is perverse and pervasive throughout literature.

“Did you see that smile?”

“Oh, I can’t stand that person – what a phony!”

The eyes – did you get a look at the cold stare as he smiled?

“Yes, he smiled, but those teeth that bared could have cut your heart in two!”

And so the phony smile has made its way through the analogs of time, truth and tempestuous and temperamental tumults, but has survived precisely because it is a smile that phoniness cannot always be certain to be questioned.  It is, as with words in insincere voices, the action that follows that determines the validity of the smile itself.

Federal Employee Disability Retirement: Games

It is primarily a form of play or sport; but in other contexts, used as a verb, it can imply or denote the manipulation of rules in order to attain a result through unfair or unscrupulous means.  As a sport, some engage in the competitive aspects of life itself, outside of the boundaries of organized or even recognized activity — as in playing “mind games” or harassment for purposes of torturing and victimizing.

Fiefdoms tend to encourage that sort of gamesmanship; and while Feudal Lords no longer exist in an official capacity, they continue to pervade through vestiges of barbarity concealed in the cosmetic niceties of polite society.

Perhaps, in some form during the Darwinian lineage of evolutionary survivorship, when brute strength alone resulted in the genetic alterations through environmental forces necessitating unrelenting characteristics in the expansion of the species, the voice of reason was lost, the soul of empathy extinguished, and the fathomless essence of humanity became a whisper of past hopes and bottomless faithlessness in epochs forever forgotten.

Private entities charge more; exclusive arenas tend to be out of reach; and it is, ultimately and as in all economic realities, determined by an admixture of supply (how many are allowed) and demand (how desirous is the goal of entrance and acceptance).  For every admittance, there is a price to pay.  Often, it is not merely the affirmative transfer of money or goods, but rather, the negative aspect of what one must “give up” in order to attain the end.  It often involves a comparative analysis, an economic evaluation of gain versus loss, and in the end, the emptiness of the latter being overtaken by the value of the former.

Federal Medical Retirement: The Other Side of Darkness

Darkness can take many forms; of the physical omission of light, the loss of visual capacity, or the mood of a person within the context of modernity, complexity and loss of moral intransigence.  Light provides the energy of life, and when that core vibrancy is sapped and depleted by either or all of the sources of light, then darkness prevails.  Once extinguished, the last remaining flicker persists only through sheer self-determination, a plan for future reigniting, or the delicate cherishing of a hope still unforeseen.

OPM Medical Retirement: Of Vultures Riding the Currents of Time

Watch the vultures float the currents of time, gliding high above, awaiting a trail of destruction behind.  Universally, across the globe, they have similar outward appearances; with wide wingspans for the ability to soar and patiently await high above, watchful for death and decay to progressively come to fruition.  Is it the scent of decay, or the fading gaze of death which attracts?  Or, perhaps, weakness and state of debilitation has a natural aura which draws?

The weak among us becomes a magnet for prey; the scavengers of time become the savagery of timelessness.  Despite our declaration for civility and sophistication, the brute essence of man comes to the fore when elements of weakness manifest. Sympathy and empathy constitute window dressings for civilization’s social contract; a concession to effeminate yearnings voice that of the spectacled class.

Look at the brutality of Federal agencies when once a Federal employee or a U.S. Postal worker announces an intent to file for Federal Disability Retirement benefits.  Suddenly, the skies are filled with gliding wingspans of watchfulness.  No one seemed to care before; now, the sunlight is blocked by widespread fans of feathery flurries.
