OPM Medical Retirement: Insularity of Silence

It is of comfort when needed; like a cocoon, or perhaps the desire of reverting back to a womb-like existence; and in times of sorrow, the need to be left alone.

Silence is often uncomfortable for many; in this world of endless cacophony, where noise is the necessity of Heidegger’s suspicion that we work, play and engage in hobbies merely to avoid the reality of our existence, of eventual mortality and the thought of nothingness; and of the constant clatter of social media, of being “connected” — in the midst of it all, insularity of silence is often a welcomed respite.

One only has to stay a night in a rural part of this country to realize the pervasive pollution of lights, sounds and — noises.  Lights can often give some comfort, for to “see” is the prevailing basis of a sense of safety.  Sounds, too, when they are familiar, create an invisible network of familiarity, and thus appease our fears.

Noise — that clatter of unfamiliarity, jumbled together — is what we often need escaping from.  Sometimes, silence itself is a comfort, and the insularity it provides can be the blanket of warmth we require.  For, are we organically organized to receive a constant and incessant barrage of metallic clanking?

For Federal employees and U.S. Postal workers who suffer from a medical condition such that the medical condition prevents the Federal or Postal employee from performing one or more of the essential elements of one’s Federal or Postal job, the insularity of silence often becomes a detriment, only because being silent and “bucking up” each day and working without complaining is often what OPM will argue as the basis of a denial.

FERS Employees Medical Retirement from the OPM: In a Vacuum

We often try and look at a thing “in a vacuum” — meaning, by viewing it without relation to other things, we believe that we can approach the viewpoint in a more “objective” manner.  But objectivity itself takes on many forms, and often objects, words, concepts, etc., possess their meaning and identity precisely because of the relationships established, and when you strip away the nexus between A and B, the loss of meaningfulness is profound.

Such is the case with Federal Disability Retirement Law.  While Social Security requires a higher standard of “total disability”, and thus will view a medical condition within categories of differentiated severities, a medical condition in a Federal Disability Retirement case cannot be viewed in a vacuum but, rather, in relationship with the type of duties the Federal or Postal worker must perform.

When a Federal Disability Retirement application is being reviewed by the U.S. Office of Personnel Management, they will often try and argue the case in a vacuum — for, that is to their advantage, in order to deny a claim.  But it is the job of the attorney representing a Federal or Postal worker to point out the statutes and case-law, and to always bring OPM back to the reality of their legal obligations — that a medical condition can never be viewed in a vacuum, but only in its relationship to the positional requirements of the job.

OPM FERS Disability Retirement: Coordination of Elements

There is no question about it: It is a complex process.

Administratively, it must be passed through multiple levels of agency review in order to get a completed packet — the Supervisor’s Statement (SF 3112B); Agency’s Efforts for Reassignment and Accommodation (SF 3112D); effectively answering the Applicant’s Statement of Disability such that it provides the proper nexus between each of the questions on SF 3112A — for, although it may not be so obvious, the questions must both be answered separately as well as viewed in the totality of each as being a component fitting in with each other, in order to answer it to completion.

Then, there is the coordination of internal and external elements, and the intersecting impact within and without — of a medical report effectively prepared and consistent with the history of treatment modalities; of a nexus persuasively argued establishing the connective impact between the medical condition and the essential elements of the Federal or Postal job elements; and the interconnectedness of essential elements to the physical or cognitive inability to perform one or more of the essential elements, etc.

Throughout the process — whether for a denial and a rebuttal response at the Reconsideration Stage, or at the initial preparation stage in the First Stage; or, even of an appeal to the U.S. Merit Systems Protection Board — the coordination of elements is important in preparing, formulating and filing an effective Federal Disability Retirement application to be submitted to the U.S. Office of Personnel Management.  Consult with an attorney who specializes in FERS Disability Retirement Law in order to more effectively establish the coordination of elements.

OPM Disability Retirement Benefits under FERS: Ballast for the soul

It is a plagiarized phrase, from a short story written by Brazil’s (often-considered) greatest writer, Machado de Assis.  It is that heavy material, where a large quantity of gravel, iron, metals, etc., placed low in a vessel in order to provide stability; the weight itself is what “grounds” the vessel so that the torrents of waves and storms of fury will not topple it.  Or, it can refer to the coarse gravel used in order to set railroad tracks, again allowing for stability of a foundation to prevent shifting, sinking or damaging movement.

When combined with the term, “the soul”, the concept created is one of conjoining the dual ideas of (a) providing a foundation with (b) an ungraspable concept of an entity that many believe does not even exist.  The “soul”, of course, is a controversial subject; for, it still remains from the vestiges of religious and philosophical discourses, and refers to an abiding entity that defies mortality, retains an identity beyond one’s physical appearance, and contains the essence of who a person is, whether in physical form or not.

Does the soul “need” a ballast?  Without it, does it merely flit about without duration or direction?

As a literary concept, it refers to the stability that individuals need in order to become more serious, more focused, and perhaps even more “mature”.  As a general idea, it comes to convey the concept of pragmatism and the need to be “grounded” in a universe where there exists so many beliefs, so many paths to get off course; and the dangers inherent in pulling people aside from living an authentic and fulfilling life are many, as evidenced by the number of wandering souls left to rot on the roadside of discarded souls.

What is the ballast for the soul?  Is it to be married and have a family?  Is it the immediate family one already has — or the extended one?  Or can a cadre of friends and one’s immediate neighbors provide the ballast for the soul?

For each individual, the answer to that question may differ and remain a mystery; but what is clear, mystery or not, is that the vicissitudes of life’s choices, without a ballast for the soul, are so numerous and of such great variety, that liberty of endless choices endangers the essence of every person. Health itself can be an unknown ballast; for, with it, we take for granted our ability to accomplish so many things in life; without it — when it is “lost” — we suddenly realize that the ballast of health can upend that which we took for granted — career; stability; sense of worth; sense of self.

For Federal employees and U.S. Postal workers whose ballast has been lost because of a medical condition, it may be time to prepare, formulate and file for Federal Disability Retirement benefits through the U.S. Office of Personnel Management.  Medical conditions are often the storms of life which topple the vessel once the foundation of stability has been robbed, and Federal Disability Retirement benefits can restore one’s sense of security such that a re-focusing upon the priority of health and well-being can be attained, so that the ballast for the soul can be reestablished in a world full of turmoil and tumult.

Federal Disability Retirement: Tempering euphoria

Life presents a wide spectrum; it is the limitation of one’s mind that restricts the expanse of that endless stream flowing on either side.  Euphoria rises to the pinnacle of that swinging pendulum; the high that reaches, follows upon a subsequence reversal of the tidal wave, and comes crashing down in fits and tumults of dismaying turbulence.  Does it necessarily need to be contained?

In modernity, and in society generally, there is a level and pitch of discomfort when intense feelings and exuberant outbursts of excitement surpass a certain arc of acceptability; there is no rule or law governing the demarcation where acceptance, discomfort and outright rejection are dissected, but it is there nonetheless.  It is like the line between light and darkness created by a campfire in the twilight on a beach that reaches forever beyond the darkness of the sea; yes, somewhere the glow of the fire ends and complete darkness begins, but we can never perceive with clarity where that boundary lies.

Some neuroscientists ascribe to the view that the extreme of euphoria occurs when there is a simultaneous, concurrent activation of all hedonic trigger-points with the brain’s rewarding system of stimulus-responses, but surely many have experienced such a state without the coalescence of such a perfect storm?  As the antonym of dysphoria, it is perhaps another hidden vestige of our evolutionary past, where intensity of emotional response was necessary for survival in a state of nature.

In civilized society, however, tempering euphoria – except in limited circumstances of heightened stimulation within the privacy of one’s home and restricted to context-appropriate circumstances – is what is expected, presumed and demanded.  There is always somewhat of an experiential oxymoron when a person manifests an unfettered state of euphoria; somehow, we all suspect that behind the uncontrolled exuberance will follow a “down” state which closely aligns itself with depression and despondency.

Is there really anything wrong with unrestrained expressions of pleasure and happiness?  Or, are we just being old fogeys and fuddy-duddies when we raise an eyebrow to such unsolicited declarations?

For Federal employees and U.S. Postal workers who have filed a Federal Disability Retirement application through the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, the issue of tempering euphoria is applicable within the context of having contact with the U.S. Office of Personnel Management.  Waiting for months upon tiring months for OPM to respond can be exhausting.  Then, when a decision is made, one can become overwhelmed by the sheer revelation of information, whether euphoric or dysphoric.

Why tempering euphoria is important, is because filing for Federal Disability Retirement through OPM is a process, and must be seen as such.  There are many potential “stages” to the administrative process, and the bureaucracy as a whole does not lend itself well to emotional states of responsive exuberance.

In the end, it is not only civilized society that sees the benefit in tempering euphoria through normative means of behavioral reactions, but for the very sake of keeping expectations and emotions in check, tempering euphoria is a necessary mandate when dealing with the juggernaut of OPM’s indifference in the multiple stages of a Federal Disability Retirement application.

Federal & Postal Disability Retirement: The advantageous disadvantage

In life, we often fight over things even when the goal has already lost its meaning, or the resources expended far outweigh the benefit to be gained.  We take advantage of things, people, and other concerns, despite knowing the consequences of harm to the very essence of our being.  It is as if the evolutionary core of our DNA determines our actions, like addiction upon the dawn of broken promises and childhood wisps of tearful mournings left behind.

Determination of actions despite knowing, and despite the constant drum of billboards, radio advertisements declaratively preaching against, and the distant voice of one’s nagging mother — ineffective reminders like shadow boxing before the perfect storm.

For Federal employees and U.S. Postal Service workers who struggle daily with a medical condition, such that the medical condition prevents the Federal or Postal worker from performing one or more of the essential elements of one’s positional duties with the Federal agency or the U.S. Postal Service, the daily fights and taking advantage of the slow process of justice in remaining in the Federal job or the Postal position, is a toil of principle; but of what gain is there if one’s soul is being destroyed?

The Leviathan of Legendary Lore bespoke of creatures who destroyed without care or compassion; and today’s metaphor of such monsters are represented by gargantuan bureaucracies which crush without blinking an eye, unaware of just another number in a long line of conquests like unnamed tombstones in an abandoned graveyard.

Filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, is a step towards taking advantageous advantage over a situation which has become untenable; the procrastination and delay in order to fight the Goliath of modernity, is to remain in a rut where one may continue to take advantage of a disadvantageous situation, and remain in the clutches of a slow torture, like the frog who sits comfortably in a pot of warm water, unaware that it sits on a stove set for boil.

Postal & Federal Disability Retirement: Adrenal Fatigue

One need not be officially diagnosed with Addison’s Disease in order to incur the wrath and ravages of adrenal insufficiency.

Life’s multiplicity of compounding and complex stresses; exhaustion beyond merely feeling “run down” or otherwise out of synchronized balance from everyday feelings of adequacy; a sense of profound fatigue, where cognitive dysfunctions develop, and where symptoms of falling asleep at meetings, where the world appears at times to become a distant echo chamber and what others view as a normal pace appear in dizzying fashion of incomprehensible clatter of distractions; and where visual disturbances occur systematically as one attempts to view the computer screen and perform work which, in previous times, was merely mundane and monotonous, but now requires an effort beyond sheer force of will.

Does modernity and technological stress contribute to medical conditions which may have no name, and often defies pigeonholing because of the mysteries of the human body and psyche?  A broken arm is easy to identify, and normally just as correctable; a cervical or lumbar disc degeneration, perhaps a bit more complex, but often manageable; chronic pain, but for a parallelism between objective testing and pain points, sometimes an anomaly; psychiatric conditions, of greater mystery which has become too often a pharmacological corridor for treatment modalities; but where profound and intractable fatigue more often than not is beyond the capacity to be diagnosed.

However one characterizes it — of adrenal fatigue, insufficiency, chronic fatigue syndrome, or other designations of type; it is ultimately the reality of the daily toil and turmoil with which the patient must contend.  For Federal employees and U.S. Postal workers who experience such a state of physical and psychiatric condition, filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, may be the best and only alternative available.

In the end, adrenal fatigue may be more than an endocrine imbalance; there is often a complex component where multiple medical conditions ravage the body and mind, and as with so many issues in law and life, there is a vast chasm between having a medical condition, being properly treated for the condition, and proving one’s medical condition in law such that one can be found eligible for Federal & Postal Disability Retirement benefits through the U.S. Office of Personnel Management.

OPM Medical Retirement Law Blog: The Mannequin

The garment may alter, but the pose remains stilted; and no matter what angle the inertia of fashion may be looked at, the expression remains impassive and impenetrable.  Mannequins pose for the public, display the wears without complaint, and fill spaces without disturbances or complaints.  They simply “are”.  Such an existence — of an uncomplaining coexistence with eyes meant to attract upon the changing appearances intended to detract — is often the very definition of a Federal employee or a U.S. Postal worker.

Like mannequins stilted in front of a display window, the Federal and Postal worker is often “there” for years and decades, quietly performing the work that is assigned, accomplishing without accolades but for internal performance reviews and peer ratings, expected to remain silent but for the wears which are displayed.  But then an illness, a medical condition, a disability suddenly enlivens, and the once quietude of existence becomes a focal point of harassment, workplace hostility and trends of gossip.

That mannequin was a person, after all, and interest is remarkably shown when ignoring and repetitive superficiality of meaningless salutations once pervaded the office or work environment.

For Federal or Postal employees, filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, whether the Federal employee or the U.S. Postal worker is under FERS, CSRS or CSRS Offset, is often the best option remaining.

Federal OPM Disability Retirement: Life’s Spare Parts

They are left as insignificant cast asides, unused and unusable until an urgency of need mandates their sudden relevance; and in a changed moment, their utility determines the worth and value of existence and retention in the clutter of overabundance.  Like the spare tire that is never used, spare parts imply potential need, but the actualization of relevance occurs only when necessity dictates; otherwise, they are like the proverbial bench warmer on a sports team replete with talent and competitive excess.

Most people are seen and treated like spare parts; irrelevant entities taking up limited space, occupying a determined confluence of time, and enjoying the dimensions within a universe where black holes of irrelevance and clutter enjoy an overabundance of regularity.  If utility is the criteria of significance in a materialistic world, then most of us are relegated to irrelevance and uncompromised anonymity.

For Federal employees and U.S. Postal Workers who suddenly find themselves with a medical condition, such that the medical condition impacts one’s ability and capacity to remain relevant in the Federal Workforce, a primary concern is often the loss of status and stature within the employment world.

We all want to belong, to be making a “difference” of sorts; and even in the midst of a faceless bureaucracy, it is nice to be appreciated and receive periodic accolades for accomplishments otherwise unknown and undetermined.  But a pause tells us that relevance is short-lived and rarely endured; the terrain of untended graveyards throughout the world echoes the quietude of forgotten hopes and dreams, and in the end, it is only family and private relationships which matter.

OPM Disability benefits is a necessary venue of purpose; for Federal employees who cannot perform one or more of the essential elements of one’s job, it is a needed benefit in order to escape the toil of employment and allow for recuperation from one’s medical condition, and then to find greater relevance and opportunity in the private sector, and be allowed to make up to 80% of what one’s former Federal or Postal position currently compensates.

Persisting in an occupation which one can no longer do, is a foolhardy endeavor, at best; clinging on to a mistaken identity of significance, to the detriment of one’s health, is a death sentence determined by one’s own vanity.  For Federal and Postal workers who have a medical condition which prevents one from performing one or more of the essential elements of one’s positional duties, filing for Federal or Postal Disability Retirement benefits, whether one is under FERS, CSRS or CSRS Offset, is the choice of wisdom, given the utilitarian perspective of the employment world.  It is a benefit which must be proven, and one must meet the burden of proof by a preponderance of the evidence with the U.S. Office of Personnel Management.

Considering the perspective of Federal agencies and the U.S. Postal Service, wherein individuals are mere spare parts to be discarded at the behest of those who consider themselves royalty within a universe of mediocrity, it is best to recognize that life’s spare parts find best their meaning and value when once a person escapes the treadmill of monotonous insignificance.

Delaying the Filing of Your OPM Disability Retirement Application

Delay temporarily suspends for a time in the future; sometimes, at the cost of immediacy of pain, but the human capacity to ignore and obfuscate allows for procrastination to be an acceptable act of non-action.  But certain issues defy the control of delay; medical conditions tend to remind us of that, where attempted suspension of dealing with the pain, the progressively debilitating triggers, or the panic attacks which paralyze; they shake us to the core and pursue a relentless path which betrays procrastination.

For Federal employees and Postal workers who suffer from a medical condition, such that the medical condition prevents him or her from performing one or more of the essential elements of one’s job, filing for Federal Disability Retirement becomes an employment option.

When to file has some room for delay; it is, after all, the underlying issue which must be attended to first and foremost — that of the medical condition.  But the Statute of Limitations in a Federal Disability Retirement case imposes a structural administrative procedure which cannot be ignored.  The Federal and Postal worker who is separated from Federal Service must file a Federal Disability Retirement application with the U.S. Office of Personnel Management, whether the Federal or Postal worker is under FERS, CSRS or CSRS Offset, within one (1) year of being separated from Federal Service.

So long as the Federal or Postal worker is on the rolls of the agency, the tolling of the statute of limitations does not begin; but once separation from service occurs, the 1-year clock (with some exceptions, but ones which you should not rely upon to subvert the statute of limitations) begins.

Delay for a specific purpose is sometimes acceptable (if one is still on the agency rolls), as in undergoing a medical procedure or seeing if a treatment regimen will work; but delay beyond the bureaucratic imposition of a statute of limitations is never one which should be allowed, as the benefit of a OPM Disability Retirement annuity will be barred forever.
