CSRS & FERS Medical Disability Retirement: The Universe of the Possible (Part II of II)

When avenues are closed off, the human psyche tends to shut down; and when grounds manifest fertile regeneration and bountiful splendor, the endless state of the possible opens like the gaping eyes of a child in excitable wonderment.  That is why internet companies attempt to artificially recreate atmospheres of creativity and prior glory days of unbounded imaginations.  But whether simulating a couch plopped in one’s basement or garage, and making it appear as if the environment is similar to those past dawns of tinkering with one’s imagination in the unheated, primitive conditions of one’s youth, is questionable.

For the Federal and Postal employee who is faced initially with a medical condition, such that the medical condition impacts one’s ability to continue in the vocation and career choice of one’s following, the limitations which the present condition places upon one’s future often seems daunting.

But there are options available.

Federal Disability Retirement allows for those options to open up; for, once the Federal or Postal employee obtains an approval for Federal Disability Retirement benefits from the U.S. Office of Personnel Management, that (now former) Federal or Postal employee may go out into the private sector and earn up to 80% of what one’s former position currently pays, on top of the Federal Disability annuity. Many start their own businesses; others perform consultative work or work part time, thereby controlling the stresses and the extent of activity able to be tolerated within the restrictions of one’s medical conditions.

The avenue of the possible can only reopen once you recognize the reality of the probable; and in order to tap into the fertile imaginations of a brighter future, the roadblocks once observed must be moved in order to travel down the path of viable alternative routes.

Medical Retirement Benefits for US Government Employees: Footprints

This winter, inclement weather has befallen us with a vengeance.  Snow remains on the ground, upon ice, upon frozen ground; and more is expected.  Under such circumstances, footprints of unidentified creatures traversing the loneliness of the dead of night are left behind.  Some, we quickly dismiss as representing a known animal; others, one is less sure of.  They tell us of their presence the previous evening or nightfall, after everyone is tucked away and the dog went out for her last run.  They reveal to us that things occur even in the absence of our presence.

We often fail to realize that life continues on a linear path despite our exit from a particular place, scene, or the world at large.  Whether in gradual dissipation from everyday presence to sporadic appearances, or a sudden and immediate departure with never a return, the rest of the scene continues on, and life and livelihoods proceed on a progressive path of history.  What footprints we left behind may remain as an impression for a day, a week, or perhaps longer; but never for eternity.  It is always difficult to depart from the daily course of patterned lives.

For the Federal and Postal Worker who has been regularly involved in the daily operations of an agency, a department, etc., with interactions with supervisors, coworkers, and multiple others just by appearing and being there each day, the pattern interrupted by a medical condition is a devastation beyond words.  Federal Disability Retirement is not something which Federal and Postal Workers want to pursue; it is, instead, a benefit which is applied for through the U.S. Office of Personnel Management, most often with hesitation, trepidation, and as a last resort.

Remembrances of footprints are not what lives are lived for; rather, it is the impressions left behind by those who have toiled hard to the very end, and who are remembered for their humanity, that makes all the difference in the world.

For Federal and Postal Workers who have left such a mark, those footprints remain in the minds of those who cared.

FERS & CSRS Disability Retirement for Federal and USPS Workers: Subtraction

The principle of abundance implicates progressive and unending addition, resulting in the exponential explosion of accumulation; and in a society which preaches acquisition as the hallmark of success, the reversal of that idea — of subtraction — is anathema and constitutes a failed life.  Subtraction is to do without; and the reduction of acquisitions is considered tantamount to failure, where success is measured in terms of the quantity one possesses.

The young man begins life with little more than change in his pocket; and from there, the trajectory of what is considered a qualitative life means that there is always addition, as opposed to subtraction.  That is why it is difficult to accept stoppage, or negation, and lessening; because the normative value we accept from the beginning is tied to accumulation.

For the Federal and Postal Worker who suffers from a medical condition such that the medical condition begins to impact one’s ability to progress in one’s career, it becomes a difficult time because sacrifices must always be made, and the negation of progressive accumulation becomes a fact of life.

But one must always look upon such events in their proper perspective, and filing for Federal Disability Retirement, whether the Federal or Postal Worker is under FERS or CSRS, through the U.S. Office of Personnel Management, is often the first positive step.  It is the stoppage to the trajectory of decline, and allows for the Federal or Postal Worker to stabilize a chaotic situation, and to move forward with some semblance of financial security, and the hope that a new career or vocation may be entered and engaged down the road.  For, Federal Disability Retirement allows for the annuitant to earn income up to 80% of what one’s former Federal or Postal position currently pays, in addition to the receipt of one’s OPM Disability Retirement annuity.

Subtraction for the Federal or Postal employee need not be forever; to live without is merely a temporary situation, and the trajectory of the modern success principle may be reinvigorated yet.

OPM FERS/CSRS Disability Retirement: That Sense of Doom

It can often be noted in the quivering voice at the other end of the telephone line (or, would it be more accurate to state, in the modern vernacular, at the “other end of the satellite signal”?) — that sense of impending doom that filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management will encompass.

But such a sense of the negative is a misguided view of Federal Disability Retirement.  For, the Federal or Postal Worker who is contemplating such a course of action should recognize and realize that it is essentially a positive endeavor — one which will allow the Federal or Postal worker to start a second vocation or career, and make up to 80% of what one’s former position currently pays.

Federal Disability Retirement is merely an acknowledgement that there is an inconsistency between one’s medical condition and the type of job in which one is currently employed; it does not preclude one from working altogether, unlike the stricter rules and regulations involving Federal Worker’s Compensation benefits (OWCP/Department of Labor) or even SSDI (with a much lower cap in one’s ability to earn additional income).

And that feeling of doom?  It is like what the British Philosopher Bertrand Russell once quipped when asked about the source of one’s anguish when confronted with a metaphysical conundrum:  “It is likely merely an upset stomach”.

OPM Disability Retirement is an avenue which should be seen in a positive light, and that sense of doom one often feels should be set aside, and the reality of one’s situation and the brightness of one’s future should always be emphasized.

Postal and Federal Disability Retirement: A Sudden Awareness

One often muddles through life, so long as nothing extraordinary occurs.

A medical condition may begin to impact the Federal or Postal employee, perhaps in a peripheral, non-threatening manner, at first; then, over time, a series of events occurs; perhaps, like the domino effect we witness in a causal calamity of sequential occurrences, to wit:  the medical condition; a second condition, this time requiring a new medication regimen; side effects; further manifestations of symptoms; a new diagnosis; missing more work than usual; sidelong glances from supervisors and coworkers; and before one realizes the full import of what has happened, one suddenly becomes aware that no longer is one considered that “star employee” by the agency, but a malingerer, a problem-child, and one who is teated in a fashion as in the old remnants of leper colonies.

When such a time erupts, and at a moment of such awareness, it is time to consider preparing, formulating and filing for Federal Disability Retirement benefits from the U.S. Office of Personnel Management, whether under FERS or CSRS.

While not offering the perfect solution, it does allow for the Federal or Postal employee suffering from a medical condition, a way out of an otherwise untenable position:  a time for recuperation; a level of financial security; a potential for engaging a second vocation and earning additional money above and beyond the disability annuity.  That sudden awareness is an indicator; in a similar manner to the revelation of symptoms, which is a signal of the body trying to warn a person of an impending medical crisis, so the awareness that one’s peers, coworkers and supervisors are viewing you in a different light is a triggering mechanism which should be heeded.

Federal Worker Disability Retirement: After the Storm

Particularized geographical locations will have differing stories.  Rarely are two stories the same, and indeed, that can be the case even between neighbors who are twenty feet apart.  It is the uniqueness of each situation which defines the situation.  A storm can come — whether in terms of the “objective” world, or perhaps through psychological and emotional turmoil —  without but a passing notice to a friend, neighbor, or coworker.

For the Federal or Postal worker contemplating preparing, formulating and filing for Federal Disability Retirement benefits from the U.S. Office of Personnel Management, whether under FERS or CSRS, the “storm” which must be endured is the medical condition itself, and its impact upon one’s livelihood, one’s life, and future stability for one’s family.  It is a process which is independent of one’s geographical location.  It is a condition which, often, coworkers only suspect, and is unfortunately hidden and kept from supervisors and managers, for obvious reasons.

The physical storms which come and go will leave behind a trail of visible devastation; what agencies and supervisors do will often leave residual damage far greater than physical devastation can betray.  It is the storms of daily life which need attending to, as opposed to a one-time life-event.  If that “storm” of a medical condition has come to a flashpoint where one can no longer work at a Federal or Postal position, then it is time to begin preparing to file for Federal Disability Retirement benefits.  Only the individual who suffers — silently, and in fear — can make that determination.

Federal Employee Medical Retirement: The Pilot

It is actually a misnomer to connect the terms “automatic” and “pilot” , precisely because the former term completely and unilaterally undermines the latter.  Think about it:  the entire concept of the term “pilot” denotes and encompasses the ability of an individual to control the destiny, direction and distance of that which he is maneuvering; once it is turned over to an engineering phenomenon which performs the activity with data already inputted by others, such control is lost, and the fullness of what it means to pilot a vehicle becomes meaningless.

It is, ultimately, a question of who controls the destiny.

For Federal and Postal employees contemplating preparing, formulating and filing for Federal Disability Retirement benefits from the U.S. Office of Personnel Management, whether under FERS or CSRS, the question is often one of being pulled and controlled by one’s circumstances, or becoming the pilot of one’s destiny and proceeding to dictate the terms and timing of one’s future.

Agencies by nature like to have control; whether it is in hiring, promoting, separating or engaging in adverse actions, agencies enjoy being the determining entity in all aspects of a Federal or Postal employee’s life.  One can wait for an agency to make a determination on one’s career or future; and, to that extent, they become the “automatic pilot” of one’s destiny.

It is up to the Federal or Postal employee to make a decision as to whether or not one should erase the former term, leaving one with the unmistakable role of being the pilot who determines one’s own destiny.

Federal Disability Retirement: Return from Thanksgiving

Thanksgiving was a time of quiet reflection; of family, friends and faith; of taking a slice of quietude and having conversations, about the past, present; and somewhat about the future.  I realize that those who need legal assistance in filing for Federal Disability Retirement benefits under FERS or CSRS have important and weighty issues on their minds — of medical conditions which will not go away; of financial obligations; of Supervisors who are unsympathetic; of Agencies which will not or cannot accommodate; of impending personal improvement plans; of upcoming projects or workloads which may not be completed; of uncooperative agencies and downright mean coworkers; and the stresses of thinking about filing for federal disability retirement benefits under FERS or CSRS, and the future and what it holds.  With Christmas and the “holidays” around the corner, it is often a time of greater stressors.  Remember that one avenue of relieving stress is to become informed.  Read up on what is out there, and ask questions.  The answers provided may be able to set aside some of the stressors.

OPM Disability Retirement: Future Perspectives

People often act without forecasting prospective issues. In filing for disability retirement, it is important to take into account the emphasis and basis upon which one files for Federal Disability Retirement, because when an approval is given by the Office of Personnel Management, OPM identifies the specific medical disability upon which they granted the approval. As such, it is important for the applicant to base the application upon the medical condition/disability, in the sequence of importance, the most serious to the least serious.  This is important not only for purposes of winning disability retirement cases, but further, with a view to the future:  when the random Medical Questionnaire is sent to a disability retirement annuitant, if the medical condition upon which you were approved for was a minor, “least serious” medical condition, then 5 years or 10 years down the road, it may well have “resolved”, which puts you in danger of losing your disability retirement benefits.  This is why it is important to have a view to the future, and guidance and advice from an attorney is important in securing that future investment.  For, ultimately, obtaining disability retirement benefits which could potentially be the primary source of income for the next decade or two, is an investment for the future.
