Federal & Postal Worker Disability Retirement: Myths, Idioms and Old Proverbs

They exist for a reason; of a story and narrative of a people’s existence; of meaning derived from experience; of a truth handed down from generation to generation.  We may dismiss them because of their age and applicability; for, in modernity and in each successive generation, people tend to think that past generations know nothing, and that it is only the present brilliance of youth who have experienced life.

Yet, myths, idioms and old proverbs continue to remain true, and for those who believe that history is merely a regurgitation of things which have happened before, it is wise to heed and listen.

For Federal employees and U.S. Postal workers who suffer from a medical condition such that the medical condition prevents the Federal or Postal employee from performing one or more of the essential elements of one’s Federal or Postal job, believing in myths, idioms and old proverbs can cut both ways.  For example: The myth of the invincibility of the ferocious dragon — the U.S. Office of Personnel Management — can be dispelled by hiring an OPM attorney who has been overwhelmingly successful in winning OPM Federal Disability Retirement cases.

FERS Disability Retirement: Countering OPM’s Denial

OPM’s Denial of a FERS Federal Disability Retirement application can be a disheartening encounter.  OPM does a thorough job these days of selectively extrapolating portions of medical notes and records, isolating each one, then minimizing them in order to arrive at a singular conclusion: You have no case.

Not only that, the tone and tenor of the Denial Letter will make you believe that — not only do you not have a case, but — You never had one; it is so weak that it is a wonder that you ever even thought you had a case; and, moreover, to even request for reconsideration is an act of futility.

How do you counter such a denial?  The first and most important step is to recognize that OPM’s denial of a Federal Disability Retirement application is meant to make you feel like you never had a case.  That way, a certain percentage of denied Federal Disability Retirement applicants will simply walk away without ever filing for Reconsideration.

Oh — of course, they will at the end of a Denial Letter inform you of your “right” to file for reconsideration, but that is after itemizing a litany of reasons why you have no case at all.

The second important step is to contact an attorney who specializes in Federal Disability Retirement Law.  For, in the end, how you counter an OPM Denial of a Federal Disability Retirement application is by applying the LAW, and only a specialist in Federal Disability Retirement Law will be able to effectively counter OPM’s denial.

OPM FERS Disability Retirement: Coordination of Elements

There is no question about it: It is a complex process.

Administratively, it must be passed through multiple levels of agency review in order to get a completed packet — the Supervisor’s Statement (SF 3112B); Agency’s Efforts for Reassignment and Accommodation (SF 3112D); effectively answering the Applicant’s Statement of Disability such that it provides the proper nexus between each of the questions on SF 3112A — for, although it may not be so obvious, the questions must both be answered separately as well as viewed in the totality of each as being a component fitting in with each other, in order to answer it to completion.

Then, there is the coordination of internal and external elements, and the intersecting impact within and without — of a medical report effectively prepared and consistent with the history of treatment modalities; of a nexus persuasively argued establishing the connective impact between the medical condition and the essential elements of the Federal or Postal job elements; and the interconnectedness of essential elements to the physical or cognitive inability to perform one or more of the essential elements, etc.

Throughout the process — whether for a denial and a rebuttal response at the Reconsideration Stage, or at the initial preparation stage in the First Stage; or, even of an appeal to the U.S. Merit Systems Protection Board — the coordination of elements is important in preparing, formulating and filing an effective Federal Disability Retirement application to be submitted to the U.S. Office of Personnel Management.  Consult with an attorney who specializes in FERS Disability Retirement Law in order to more effectively establish the coordination of elements.

FERS & CSRS Disability Retirement: The perfect person

By all accounts, he or she doesn’t exist, except perhaps in theoretical constructs of theological paradigms; and of academia, where one may argue some alternate version of Anselm’s argument by positing that, because the concept of perfection could not be thought of without the reality of a Being constituting perfection, ergo a perfect Being – God – must by necessity exist.

Yet, we live “as if” the perfect person exists – either imposing such a standard unknowingly, unwittingly and unwillingly upon our own selves, or by thinking that movie characters actually exist somewhere in the ephemeral world of Hollywood, Instagram and Facebook concoctions that only put forward to the public’s eye the image of perfection.

We overlook the distorted concept of perfection when we say of a movie character, “Oh, he’s not perfect; he drinks too much, cheats on his spouse and is violent.”  Yet, the make-believe character still solves the mystery, is philosophically coherent when drunk, and somehow remains an attractive character despite all such character flaws.  In other words, despite the appearance of flaws, we make gods of characters we create.

It is the same on the Internet – despite the knowledge by all that there does not exist the perfect person, nevertheless, we allow for Facebook postings and Instagram photographs of meals, dogs, kids, families, selves and neighborhoods as the perfect depiction of unblemished lives.  And of ourselves, perhaps the greatest of culprits alive – for perpetuating the mythological depiction by engaging in the flim-flam of projecting the existence of the perfect person.

Yet, what is the alternative?  No one wants to hear the perpetual whining of the constant apologist – that person who points out his own failures and shortcomings at the drop of the proverbial hat; of he who apologizes for the slightest of errors, the scent of a mistake and a hint of failure to reach perfection.  Name a movie character or a movie, excepting a comedy, where the character is merely a bundle of imperfections and unattractive to boot.  Even Inspector Clouseau in the Pink Panther series, played long ago by Peter Sellers and by others more recently, captured the culprit in the end, despite all of the blunders and pitfalls.

In the end, we all participate in the grand larceny of perpetuating the existence of the perfect person – until we are hit with a medical condition, and the façade then suddenly falls apart.  Yet, everyone else continues in the charade.

For Federal employees and U.S. Postal workers who can no longer keep up with the make-believe world of the perfect person because of a medical condition, where the medical condition prevents the appearance of the perfect person to perform all of the essential elements of the Federal or Postal job, it may be time to admit imperfection by preparing, formulating and filing an effective Federal Disability Retirement application, to be submitted ultimately to the U.S. Office of Personnel Management, whether the imperfect Federal or Postal employee is under FERS, CSRS or CSRS Offset.

For, in the end, it is the perfect person who embraces the imperfection of this world, and that is at least a beginning for the Federal or Postal employee who must continue to face the Federal Agency or the Postal Service in facing the reality of living imperfectly in this all too perfect universe.

Disability Retirement for Federal Employees: Moments of clarity

There are those moments, aren’t there?  It may come as a flash, in the middle of the night, while walking quietly in the woods (or in one’s back yard, pretending that it is in the middle of somewhere’s nowhere, despite the loud humming of lawn mowers and air blowers whoosh-whooshing in the distant yonder over the fence beyond); and it need not be because of some eureka moment or because of problems faced and meditated upon.

There are moments of clarity in life, and they may be identified and described in various ways – of periods of inspiration; of a heated splice of madness; an awakening from a dream despite lack of sleep.  Or, perhaps a spark of genius came about.  A childhood memory, a dream once vanquished, a feeling of regret later in one’s life; these are the crumbs that gather in the corner of the dinner table, left behind like the ghostly apparitions of yesteryear’s hopes and unfulfilled cannibals of thoughtless mimes; and yet they can haunt or stir.

Such moments of clarity can bring about change; or, we can repress, suppress and ignore them, and allow them to wither away like flowers left in the pot of life’s mish-mash of events, and slowly they die, weakened by lack of care and ignorance of beauty.  Medical conditions themselves can bring about such moments of clarity; of the futility of trying to maintain appearances, and instead of facing a reality that is sharpened by pain, anguish and society’s definition of what it means to be productive.

Health is indeed a gift; poor health, or deteriorating health, brings about a different kind of gift – one that sometimes allows for those moments of clarity.

For Federal employees and U.S. Postal workers who suffer from a medical condition, such that the medical condition brings about a realization that the Federal or Postal employee is no longer able to carry on as before, and that preparing a Federal Disability Retirement application, to be submitted through the U.S. Office of Personnel Management is now a necessity, it may well be that such a conclusion of a necessary change in one’s life came about because of one of those “moments of clarity”.

Don’t ignore it, as it may not come about again.

Instead, like warnings, clues and prognostications of impending necessities, the need to listen carefully to one’s health and mind may be just a moment of clarity that your body is simply telling you something.

A wise person once quipped that, If you don’t like the weather in this area, wait a day and it’ll come around.  The greater meaning of such a kernel of wisdom, of course, is that it is a microcosm of a wider reflection concerning life itself; wait long enough – sometimes a week, a month, a year, or a few years – and circumstance have a tendency to alter the course of one’s life and therefore one’s perspective.

Life can, indeed, change in a day; one day, you are happily drifting along, believing that nothing could be better; and the next, a calamity ensues, the human experience becomes a “topsy-turvy” matter and suddenly sours upon the smiling demeanor we carried just a moment before.

Or, one may begin the day in a negative and foul mood, but something changes, alters, moderates and impacts, and we come home despite the turmoil of work and daily problems with a smile on our face, and when asked “what is wrong?” (as opposed to, “What is right?”), we smile distantly and refer to the sunshine, the weather, the flower smelled on the road home, or that Frost-like metaphor of having taken the road less traveled on the way there.

Or, perhaps it is the simple recognition that there is more to life than one’s own narrow perspective, that suddenly creates the change in the day of one’s life.

For Federal employees and U.S. Postal workers who suffer from a medical condition, such that the medical condition prevents the Federal or Postal employee from performing one or more of the essential elements of one’s positional duties as assigned, the idea that life can change in a day is as real as the sun rises and is expected to rise.

The process of filing a Federal Disability Retirement application is a long, complex and bureaucratically difficult process, and often the process itself can be a defeating proposition as one awaits for a positive decision.  A denial from the U.S. Office of Personnel Management can have a devastating impact, and a second denial at the Reconsideration Stage can have a further deleterious effect.

With each decision, life can “change” in a day.

On the other hand, an approval effectuated from OPM can also have that same effect – of a change in one’s life, all in a day.  That is the ultimate goal – change, but in a “positive” sense; for, to remain static is to become an inert substance, and life, if anything, is a continuum of constant flux and change, like the weather that can never be correctly forecasted, and the life that can never be accurately predicted.

Medical Retirement from Federal Service: Profiles in Discourage

It is, of course, an obvious play off of the 1957 Pulitzer Prize winning work (publication date of 1955), describing 8 U.S. Senators who displayed courage in the face of criticism (an inherent oxymoron?).  Whether or not, and to what extent, Kennedy himself wrote the work (Ted Sorenson, John F.’s speechwriter, finally conceded in his 2008 autobiography as much) has become historically irrelevant, for the legend has become the man, and has replaced the truth of clear lines that once constituted the demarcation between fantasy and reality.

Ancient references to “Camelot” and metaphors about some obscure “torch” being passed through a generational transfer of linguistic fluff, have all cumulatively obscured the stark nakedness of that which makes people and events accountable.  The irony of real life always goes well beyond any fictional attempt to deceive; at least, by designation ascribed, we know what to expect of the latter; but then, there wouldn’t be anything like irony without the absurdity of the former.

Look at the recent allegations of the murky money-trail from Malaysia as the source of funding for the movie, “The Wolf of Wall Street”; how much more deliciously ironic can it get, where a movie depicting blatant corruption is paid for by the very manner in which the moguls of Hollywood are allegedly attempting to make a point about?  What prompted the short-cutting which undermines the title of the work credited to the 35th President?  Is it merely the old adage that the “ends justify the means” — and that not writing a work but claiming its authorship is allowable because the greater good of fame and the road to the presidency will account for such deception?

It is, in the end, the title itself which makes for the irony; for, in a work which describes the integrity and character traits of the subjects within, it is precisely the lack of such which presumes a contradiction without.  And that is the connection with Federal employees and U.S. Postal workers of today — for the entities which employ them represent the “official” face of this country, and yet the way they treat Federal employees and U.S. Postal workers when Federal employees and U.S. Postal workers suffer from a medical condition, such that the medical condition prevents him or her from performing all of the essential elements of the Federal or Postal position, reflects upon a discernible and palpable profile in discouragement (the suffix is added to make the sentence grammatically correct, although poetic license has been taken in the caption of this blog with the title, “Profiles in Discourage” in order to remain consistent with its alter-ego of the work by JFK and Sorenson).

One could argue, of course, that because there is the statutory right of all Federal employees and U.S. Postal workers to file for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, whether the Federal employee or U.S. Postal worker is under FERS, CSRS or CSRS Offset, therefore any maltreatment or mistreatment of a Federal or Postal worker based upon the medical condition becomes a moot issue.

But that is precisely the point — treatment of the Federal employee or U.S. Postal worker in the process of engaging the long and arduous bureaucratic process of filing an OPM Disability Retirement application, should reflect an integrity of cover-to-content.  For, in the end, it is not the cover, nor the first impression which matters, but like the historical characters which are insightfully described in the book itself, the title should always match its claimed authorship.  But, then, of course, we would be left without the delicious irony of man’s daily folly.

Federal & Postal Disability Retirement: The Goldilocks Principle

Most of us are familiar with the fairytale; but in modernity, the principle extrapolated has been extended thus: the natural pendulum of occurrences must fall within a certain set of margins, as opposed to reaching the outer limits of extremes.  And, indeed, most things settle into a comfortable compromise of corollary constancy; it is precisely because of the anomaly of extremes that we take special note of the exceptions which develop and manifest.  And that is always the continuing hope of most individuals — for a reaching of compromise, and static settling into a middle ground, etc.

But for Federal employees and U.S. Postal workers who find that a medical condition begins to impact one or more of the essential elements of one’s positional duties with the Federal government or the U.S. Postal Service, the Goldilocks Principle will often fail to apply.  Increasing pressure is brought to bear (no pun intended) upon the Federal employee or U.S. Postal worker who shows signs of vulnerability; perhaps an initial verbal warning, then a written admonishment; then, the placement of a PIP within the constant environment of hostility; restrictions upon leave usage, and finally, a proposal to remove.

Medical conditions require priority of purpose and attending to the medical condition itself.  Actions by agencies and the U.S. Postal Service often serve to exacerbate the medical condition.  Filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, whether the Federal employee or U.S. Postal worker is under FERS, CSRS or CSRS Offset, is an option which should be considered earlier, than later.

In the end, of course, the Goldilocks Principle is somewhat relatively determined by where those margins or goalposts are placed; for, in preparing, formulating and filing for Federal Disability Retirement benefits through OPM, the realization that the middle ground of comfort is far from the fences of the extreme, depends upon where the Federal or Postal employee is standing, in relation to the medical condition, the harassment received, and the empathy shown (or more precisely stated, the lack thereof) by the agency and the U.S. Postal Service.

Federal Disability Retirement: The Structural Problem

It is what we never want to hear, and fear most:  that statement from an “expert” who informs us that it is a “structural problem“.  Not cosmetic; not superficial; not unessential; but that word, concept and image which goes to the very heart and foundation of the damage:  the center of the universe.  When the damage occurs there, and the rotting vein of progressive deterioration touches upon that central nervous system, then it becomes “structural”, and all of the rest may come falling down in a sudden dustheap of crumpled carcasses.

So long as it involves only the peripheral concerns, we keep telling ourselves that it doesn’t matter, that the foundation is still solid and they are mere extremities of lesser concern.  We do that with pain and other irritants of life.  And with medical conditions that don’t double us over or completely debilitate us.  So long as there remains a semblance of structural integrity left, one can go on and continue without regard to the symptoms which become telltale signs of impending doom.

For the Federal employee and the U.S. Postal worker who has arrived at the point of finality where one can no longer just venture forward, filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management becomes the best remaining option.

We wait because it is in the very nature and essence of procrastination that the inevitability of ignorance, neglect, disregard and sidestepping can delay the confrontation with that which we fear to know, refuse to acknowledge, and take comfort in detracting from the encounter with the truth of established verifiability.  As with science, the flat earth, and the view from a geocentric universe, no one wants to be told that there is a structural problem.

Too often, the Federal and Postal employee who finally comes to a point of needing to admit that preparing, formulating and filing for Federal Disability Retirement benefits, whether one is under FERS, CSRS or CSRS Offset, is and has become a necessity because he or she has worked until the last straw was placed on the back of the proverbial camel.

Medical conditions announce harbingers of events to come, by symptoms calling for attention and attentiveness.  While the news from the architect that the problem is a “structural” one may not be welcome, it was always an indicator that the inevitable was on the fast-track of necessity and predictability; we just turned our heads aside in hopes of another day.

The Self-Image of a Postal or Federal Employee after a Disabling Injury or Other Medical Condition

Thurber’s Walter Mitty is not an anomaly; each of us carries a fiction within our insular souls, of lives extended into a world of fantasy, trespassing between daydreams and thoughts of heroic deeds beyond the mundane routines of daily living.  Perhaps there are those in the world whose lives are so adventure-filled that such retinues of alternative parallelism within universes of imaginations becomes unnecessary; but that is a rarity, as human beings are partly unique because of the creative outreach beyond the present circumstances of life.

It is only when such creative imaginations directly encounter and contradict the reality of life; where one begins to imagine beyond the imagination, and talk and act “as if” the virtual reality constitutes the real reality, that problems can occur.   The fragile demarcation between sanity and insanity may be arbitrarily imposed by an unforgiving society, but it is a boundary wide enough to entrap the unwary.  Medical conditions have a tendency to stretch that line.  Whether because of the stresses encountered in this age of modernity and technological complexity; or perhaps the inability to adapt, where evolutionary tools have not been able to keep up with the pace of change; whatever the reasons, medical conditions force the facing of reality, the starkness of our mortality, and the need for change.

For Federal employees and U.S. Postal workers who suffer from a medical condition, the primary need is often the time of recuperation.  But the unforgiving nature of Federal agencies and the U.S. Postal Service will often refuse to grant that necessary time in order to reach a plateau of recovery.  Federal Disability Retirement benefits, filed through one’s agency (if you are still on the rolls of the agency, or have been separated but not more than 31 days has passed) and ultimately to the U.S. Office of Personnel Management, is a means to an end.

Often, one thinks of “disability retirement” as an end in and of itself; but because Federal Disability Retirement allows for, and implicitly encourages, the Federal and Postal worker to consider employment opportunities outside of the Federal Sector after securing Federal Medical Retirement benefits, it should instead by seen as an intermediate component of one’s life.

Making a living is a challenge enough; the loss of one’s self-image through the impact of a medical condition can be a devastating interruption to the challenge; but for the Federal and Postal employee who can secure a Federal Disability Retirement benefit, the interruption can be seen as a mere interlude, for greater opportunities extending into the future, and thereby allow from the daydreams of Walter Mitty to be enjoyed as mere reflections of pleasure, instead of wishful swan songs of a closing chapter as the curtain descends upon the epilogue of one’s life.
