Federal & Postal Disability Retirement from OPM: Holding a grudge

Doesn’t holding a grudge imply a certain level of intelligence?  Do other species have the capacity for holding a grudge?  Certainly, some breeds of dogs do — of getting into a growling match, or one of those “baring the teeth and gnarling sounds”, but with very little harm done; but if it is not “finished”, will come back and engage in some more noisy combat until one or the other is satisfied that neither a grudge nor a kiss will any longer be necessary.

“Having a grudge” can last a moment or a lifetime; “Holding a grudge” is comprised of the tenure of the grudge being held, and not as to its intensity of feeling.  Some grudges may be sweet and delicious; others, a gnawing sense that does greater harm to the holder than to the one for whom it is held.  There is, in the end, a difference between a grudge and a sense of resentment, although the former may include the latter, but the latter does not necessarily entail the former.  Siblings and best friends are famous for holding grudges; it reveals the level of hurt and care that becomes deep-seated when once betrayal cuts and bruises.

For Federal employees and U.S. Postal workers who suffer from a medical condition such that the medical condition begins to prevent the Federal or Postal employee from performing one or more of the essential elements of one’s Federal or Postal job, it is often an easy path to find oneself on where one was once the Federal Agency’s “star employee”; then, a medical condition sets in, and suddenly the congratulatory accolades become silent, and unilateral actions are taken by the agency which begins to foment resentment…and a growing “grudge match” begins.

Administrative sanctions are imposed; a PIP is initiated; perhaps, even removal from Federal Service.  Yet, all along, you are thinking: “I have a medical condition; why are they treating me this way?”  Grudges, indeed, often are held because of mistreatment or maltreatment; and it is often worse when there is no face or name to be placed with the grudge, but merely a large Federal Agency or the Postal Service that cares not a twit about your medical condition.

The best thing to do in such circumstances is to prepare, formulate and file an effective Federal Disability Retirement application with the U.S. Office of Personnel Management and “move on” beyond the sense of resentment and grudge-holding that can destroy a life further than the medical condition itself.  Yes, holding a grudge does imply a certain level of intelligence, but to hold one for too long shows a significant level of stupidity, as well.

Lawyer Representation for OPM Disability Retirement: Myopic view

One goes through life struggling just to get through each day.  Life is hard.  Yet, as parents we are scolded into feeling obligated to paint always the positive picture to our children:  That you can work hard and achieve anything; that dreams are there to be realized; that life is a bowl of fairytales waiting to be realized.

Then, of course, children take that viewpoint and filter it through selective and narrow life encounters: The recent Royal Wedding that purports to convey a fairytale-like romance blossomed into reality’s harsh discourse (so long as you don’t read the gossip-columns about the private lives of those involved); the Wall Street trader that makes her first billion; the internet start-up company that offers an initial IPO of a cool 5 billion; and the one who inadvertently wandered into a corner mart store, bought a lottery ticket with his last dollar and won a 50 million dollar jackpot.

We don’t delve into statistical improbabilities of such events actually happening to ourselves, let alone our kids; but there you have it — dreams are here to be realized, grasped, within the reach of a blink’s dream away.

Then, adulthood, reality and the daily grind sets in; the myopic view is the one that strives to earn a living for this day, next week, or even for the month; because, in the end, the “long” view — of planning ahead, thinking about the future or even about the day after the short term — are somehow out of one’s reach, leaving aside being too fuzzy to consider.

For Federal employees and U.S. Postal Workers who must contend with a medical condition that no longer allows for the Federal or Postal employee to perform all of the essential elements of one’s Federal or Postal job, the myopic view of life is the familiar one:  Get through this day; try to limit the pain or mental anguish; try not to make any waves at work; try and remain anonymous, or less noticed than yesterday.

It is the shortsightedness of our lives and the manner in which we live, that becomes the salt upon the wound of our own making.

Preparing, formulating and filing an effective Federal Disability Retirement application, to be filed with the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, is at least thinking about tomorrow, or the day after.  For, the problem with the “short-term” is that it keeps dragging into the “long-term” of our lives, and preparing an effective Federal Disability Retirement application can at least turn the short-term of misery into the long-term of some semblance of future security, in order to attend to the priority of both the myopic view and the far-sightedness of our future: one’s health.

Federal Disability Retirement Representation: Hope springs

“Eternal”, of course, is the ending and attachment that most would declare if asked to fill in the blank.  How many of us know of the origin of the statement, what it means, from whence it comes (yes, yes, a Google search is only one finger button away)?  It is often an afterthought – a “throw-away” line that one scatters about in response to someone else’s statement about “hoping to do X” or having “hope that X will happen”.

The reactionary response that is commonly stated is, “Well, of course hope springs eternal.”   The origin of the saying comes from Alexander Pope’s work, “An Essay on Man”, where he wrote:

Hope springs eternal in the human breast:
Man never is, but always to be blest.
The soul, uneasy and confined from home,
Rests and expatiates in a life to come.

What was he referring to?  It could be interpreted in many ways – of a reference to a life hereafter and the reason for living, struggling and being tormented in this life, with a view towards an eternal reward; or, that so long as there is hope, things will change for the better if you just stick around long enough.

Without hope, the devastation of life’s turmoil may never allow for a person to get beyond this day; it is with hope that is kept in the human breast that the eternal promise of a better tomorrow becomes possible; for, otherwise there is just fatalism to look forward to, or as Pope stated, a state of existence where “Man never is”.

The word-pictures evoked from Pope’s work are beautifully put, and provide images that allows for multiple interpretations.  The word “springs” is a carefully chosen word, for it gives the idea both of calm (as in the tranquility of a running spring) as well as a jump forward (as in “spring forward”), and thus establishes multiple meanings when tied to the reference point of “hope”.

Hope, ultimately, is the ingredient that allows for life to live for a future yet undetermined and yet to be defined.  That is what is important for Federal and Postal employees who suffer from a medical condition, such that the medical condition is beginning to prevent the Federal or Postal employee from performing one or more of the essential elements of the Federal or Postal job.  For, what other hope is there than Federal Disability Retirement benefits?

As the ongoing medical condition and the deteriorating aspect of the medical condition begins to squeeze out any hope left; and the impact it is having on one’s career and future starts to question the viability of any hope to be had; it is hope from X to Y – i.e., a future with a difference – that allows for hope to foster and thrive.

That is why, for the Federal or Postal employee who recognizes that hope in continuing in one’s job is no longer a reality, it becomes important to consider preparing, formulating and filing an effective Federal Disability Retirement application, precisely because hope springs eternal.

OPM Disability Retirement: The Wake-up Call

It can be requested pursuant to a prior arrangement or, with today’s technology, prewired on one’s own electronic device.  Time was when there existed an employed switchboard operator sitting in front of a pock-marked surface deftly inserting plugs of a dozen or more connections simultaneously, like an octopus whose coordinated extremities swirl about under and over with cross-purposed entanglements, pulling and inserting, with headphones half dangling, calmly stating, “This is your wakeup call.  Have a good morning!”

Then, of course, there is the other, more unwelcome meaning, of a negative connotation concerning an event or occurrence which portends of that which one may have always known, but only now realizes because of the impending doom.

For Federal employees and U.S. Postal workers, it may be the chronicity of the medical condition; or, the increasing outside pressures continuing to pile on, of leave-usage restrictions, suspension letters, placing you on a PIP, or the ultimate proposal of removal.

Whatever the proverbial wake-up call, it is time to prepare, formulate and file for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, whether one is under FERS, CSRS or CSRS Offset.   The call itself is merely the beginning of the process; there is the entirety and complexity to undergo, including the gathering of the compendium of medical documentation, the formulation of one’s Statement of Disability and the coordinating of all of the elements of the case, and then the submission and waiting.

The bureaucratic and administrative components of the process can sometimes appear to be archaic and somewhat anachronistic; but like the switchboard operator of yesteryear, the necessity of the service is never in doubt; it is merely the apparatus of change which remains relevant, and properly, and effectively preparing, formulating and filing for Federal Disability Retirement benefits is a mandate of action compelled by the wakeup call entitled “Life and the inevitability of change“.

FERS & CSRS Disability Retirement: Pretending

It is the creative imagination which ultimately separates man from his counterpart; and, in the end, those costumes we display, and wear as vestiges of who we were, what we have become, and how we want others to appreciate us — in the aggregate, they reveal either our pretending selves, or at the very least, our pretentiousness.

For Federal employees and U.S. Postal workers who have a medical condition, such that the medical condition necessitates filing for Federal Disability Retirement benefits under FERS, CSRS or CSRS Offset, the extension from childhood through adulthood is best personified in the ability and capacity to “pretend” — assume the role of the loyal civil servant; march on in quiet suffering; brave through in silent grief the turmoil of a progressively worsening medical condition.  But when “pretend” encounters the reality of pain and self-immolation of destruction and deterioration, there comes a point in time where childhood fantasies and dreams of want and desire must be replaced with the reality of what “is”.

That annoying verb, “to be”, keeps cropping up as an obstacle of reality, forever obstructing and denying.  Reality sometimes must hit us over the head with harsh tools of sudden awakenings; for the Federal or Postal worker who must consider filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, the wake-up call is often the alarm-clock that rings after a long weekend, when rest and respite should have restored one to healthy readiness on the workday following, but where somehow the face of pretending must still remain.

OPM Disability Law: The Fatigue of Profundity & Requirement of Repetition

Profundity is overvalued.  With the advent of the internet and information technology, the widespread dissemination of seemingly esoteric array of knowledge and know-how (yes, there is a distinction with a difference between the two), everyone is vying for the heard voice, and the break-out from the herd.  One becomes easily fatigued by seemingly deep insights, or “new” data and facts upon otherwise mundane concerns.

Repetition is considered as a trait of boredom; but the longer one lives, the more one recognizes that there is truly little new under the sun, and the apparent newness of X is merely a regurgitation of the old Y of yore.   But repetition does have its own uniqueness of value, and inherent strength of significance.  For, often, a person who turns the same corner as thousands, and tens of thousands before, may be encountering the next block for the first time, and what those before him or her did has little to no significance to the epistemologically privileged experience for that singularity of uniqueness.

Thus, for Federal employees and U.S. Postal workers who experience a medical condition, such that the medical condition begins to impact one’s ability and capacity to perform the essential elements of one’s job, the knowledge that many, many Federal and Postal employees before were able to file for, and get approved, Federal Disability Retirement benefits through the U.S. Office of Personnel Management, so long as one is under either FERS, CSRS or CSRS Offset, the comfort of which one may partake rests in the fact that one is not alone; yet, it is not purely a “repetition” of sameness but a genus of similarity; for, as each medical condition and every circumstance reveals a uniqueness which must be dealt with individually, so each Federal Disability Retirement case must be handled with care.

At the same time, however, it is of value to recognize that repetition of relevant laws, statutes and regulations, cited in the ordinary course of preparing an effective Federal Disability Retirement application, is necessary for success in obtaining the benefit.

From the standpoint of OPM, the fatigue of profundity comes in failing to view a particular case with “new eyes”; from the viewpoint of the Federal or Postal worker who is filing for Federal Disability Retirement benefits for the first time, it is the inability to recognize the requirement of repetition which often results in an ineffectual formulation of one’s case.
