Federal Disability Retirement under FERS: Spectator Sports

Psychologists and commentators in general have had a field day (yes, the bad pun is intentional — but who can avoid it?) with analyzing and providing “expert” opinions on the matter, which essentially plays with (yes, yes, another bad pun) the following question: Why are people so enamored by watching others play a game?  What is it about the concept of spectator sports that draws such a crow?  What is it about being part of a “team” that results in people acting in such bizarre ways?

It is, of course, an easy transition to other areas of one’s life — from spectator sports to the political rally; of parades and cheering crows; of legions of a cheering populace gathered to welcome the Roman troops returning from battle; of D-Day and V-J Day; of the stadiums filled for the World Cup in Soccer to the excesses of the Super Bowl; of March Madness and the tradition of Friday Football (High Schools), Saturday Football (Colleges) and Sunday Pro football games; and what the Covid-19 Pandemic reflected when everyone was shut in, but with curtailed capacity to view such spectator sports.

What does it reveal about us?  Had the Romans, with their vast coliseums, already figured out the human psychology — of the need for spectator sports — in order to satisfy the blood-thirsty need of a restless populace?

OPM Disability Retirement Benefits: Word Games

Playing word games — like the New York Times Spelling Bee, or “Wordle” (a game which was just recently bought by the New York Times, and thus will likely require a fee in order to play) entails some reflection and methodology of thought.  Word games are meant for fun; they are often challenging, and prompt us to engage in an intellectual exercise devoid of reality.

There are, of course, other “word games” — ones which are played in the field of reality and the objective world.  It is how human beings engage with one another, and it is seen each day throughout the world in courtrooms and battles utilizing and applying the law.  Unlike word games where there are no real consequences in “real life”, the other kind of word games results in an impactful determination upon individual lives.

FERS Federal Disability Retirement Law is no different.  As every Federal Disability Retirement application is a paper presentation to the U.S. Office of Personnel Management, it must by necessity involve a certain level of word games — of presenting the applicable case-law; of formulating the proper language; of engaging in the give-and-take of legal argumentation, etc.

Wittgenstein called it a “language game”, but in the end, they amount to the same thing: Words, as parts of a language, engaged in a “game” which must be played.  And in doing so, it is a good idea to contact a FERS Attorney who is experienced in the word game of Federal Disability Retirement Law, lest the twisting tunnels of legal language lead you to the ends of the earth where a gaping hole of a denial from the U.S. Office of Personnel Management leaves you speechless in a word game of real-life consequences.

OPM Medical Retirement: Tomorrow and the day after

Tomorrow is for delay; to procrastinate, the day after.  Isn’t that the adage that recognizes what is truly going on — of saying, “Oh, I will get to that tomorrow”, but when asked about a project you dread (perhaps the unfinished novel that has sat in the bottom desk drawer for the past year; the basement that needs cleaning; the shed where all unused items and discarded castaways need “straightening up”, etc.), it is always to be accomplished “the day after tomorrow”.

Why is it that tomorrow may yet come and become realized, but the day after that somehow never arrives?  Is a single day delayed beyond the thought of tomorrow somehow too far from the reality of today such that it never arrives beside the closeness of tomorrow?

Saturday brings the smile of Sunday yet to be enjoyed, and leaves Monday too far to worry about, just as Sunday brings the anxiety of Monday because Monday is merely tomorrow and not the day after that.

For Federal employees and U.S. Postal workers who suffer from a medical condition such that the medical condition prevents the Federal or Postal employee from performing one or more of the essential elements of one’s Federal or Postal job, the delay in postponing the preparation of a Federal Disability Retirement application, to be filed with the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, is often understandable because it is, indeed, a “major step” into the unknown beyond, where careers must change, life enters a period of upheaval and the future holds a modicum of uncertainty.

But while delay until tomorrow may be reasonable, don’t let the “Day after Tomorrow” catch you into a trap where tomorrow never comes except in a rush where tomorrow’s exigency suddenly becomes an emergency too far delayed.

Filing for Federal Disability Retirement benefits is something no one thought about for tomorrow; but tomorrow quickly becomes today, and for the Federal or Postal employee suffering from a medical condition, the today that was once tomorrow’s comfort of delay will not change the reality of what must be done the day after.

Federal Disability Retirement: The Pathway of Choice

Pathways are peculiar entities; pre-Google Map times, they were a maze of forbidden routes, romanticized by a generation who were familiar with the television series, Route 66, and about hitchhiking, wrong turns, Robert Frost’s famous poem and Rand McNally road maps.

Now, of course, Google guides, directs, and (sometimes) allows for avoidance of unnecessary delays.  But is it the pathway of choice, and even more importantly, is the pathway chosen the best one for each one of us, the most advantageous for us, and the one which ultimately is in our best interests?  If the pathway that is chosen is simply so because all others are never known, or merely because that is the Robert-Frost-look-alike, when in fact it is delimited because of our lack of knowledge, is it really out of choice or of necessity?

Perhaps the career chosen is not turning out to be the realization of one’s dreams; or, as sometimes happens, an unfortunate set of circumstances has intervened — like a medical condition — and suddenly the pathway of choice that we thought would fulfill our hopes and dreams no longer seems possible; then what?

For Federal employees and U.S. Postal Service workers who suffer from a medical condition such that the medical condition no longer allows us to perform all of the essential elements of the Federal or Postal positional duties, the pathway of choice for the immediate future may seem constricted:  Stay put and suffer; walk away with nothing; or, prepare, formulate and file an effective Federal Disability Retirement application, to be filed with the U.S. Office of Personnel Management.

That is the tripartite fork in the immediate road on the way to one’s pathway of choice; but then, there are other “forks in the road” beyond, such as being able to work at another job after one has been approved for Federal Disability Retirement benefits, whether in the private sector or in a state, county or municipal employment scenario.

Don’t be restricted to the immediacy of one’s pathway of choice, for there are many forks beyond, and the pathway of choice as dictated by Google maps only tells you which turn to make in the next quarter mile, and not about what may be chosen in future lives yet unforeseen.

Federal Employee Disability Retirement: Witnessing the residue

Most of us merely witness the residue; the process itself, the events leading up to the conclusion, and “during” as opposed to the “after”, and all of the miniscule details that make up “in between” are invisible, ignored, unimportant or simply not thought of.  We see the “end product”, only, and that is how it should be.  We don’t have time to watch the apple tree grow from a seedling; for sausages to be made; for politics to be compromised; and for other people’s problems to fester.  And even if we did, what difference would it really make?

We assume much – that characters we see in movies made from “based on a true story” (whatever that means – and how much artistic liberty was taken with the details of such a “true story”, and what part is true and what is not?) productions went to the bathroom in between shooting at each other and becoming heroes; or that when children are seen, there was once love between the couple (although, that can turn out to be a wrong assumption where adoption or other arrangements have been made) even if the residue we witness shows only acrimony, bickering and constant arguing.

For Federal employees and U.S. Postal workers preparing to file for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, “both sides” witness the residue – from the Federal Agency or Postal Service’s side, they witness the residue of a filing for a disability retirement, without knowing the long and arduous struggle that the employee had with the medical condition prior to coming to such a decision.  Or, for that matter, from the viewpoint of the supervisor or co-worker, such a decision may come as a complete surprise.

Conversely, from the viewpoint of the Federal or Postal employee who is filing for Federal Disability Retirement benefits, witnessing the residue of the Federal Agency’s reaction or the co-workers and supervisors who make comments, or say anything at all, is often an interesting phenomenon for its complete lack of understanding or empathy.  They simply didn’t know, didn’t care or didn’t take the time (or all three) in showing any concern during the long struggle with the medical condition.

The key, however, in witnessing the residue, is with respect to the U.S. Office of Personnel Management – the Federal Agency that reviews and makes a determination on all Federal Disability Retirement applications.  For OPM, it is important to formulate a concise narrative in answering the questions on SF 3112A, Applicant’s Statement of Disability.  How much of the history; to what extent the minutiae and details of the past; and the precision of establishing the nexus between the medical condition and the job duties – these are all important in the proper preparation, formulation and filing of an effective Federal Disability Retirement application, where witnessing the residue may be a void too important to neglect.

Medical Retirement from Federal Government Employment: Life’s Joke

The funniest line in literature comes from Carl Sandburg’s “Potato Face Blind Man” stories, where he describes the reason for the wooden mug:  “There is a hole in the bottom of it.  The hole is as big as the bottom.  The nickel goes in and comes out again.  It is for the very poor people who wish to give me a nickel and yet get the nickel back.”

Satire has often been overly-discussed, and attempting to explain why a particular scene, line or story is amusing, is somewhat like trying to explain to a Martian why Bradbury’s chronicles fascinated the young:  it just is, and either you get it, or you don’t.  It is, perhaps, the incongruence between expectation and reality; of a projection of incommensurability that occurs when a portrayal doesn’t quite meet the anticipation of “should”.

In Sandburg’s description, two such anomalies occur:  First, that the figure who holds the mug does so with the expectation that passersby will drop a nickel out of a sense of pity; but second, and poignantly portrayed, that the tables are turned around by the one who allegedly is begging for the nickel, in that he recognizes the empathetic component that there are others who are poorer in the world who also want to give, but needs the nickel more than the beggar to whom it is given.  Thus, the hole on the bottom where the nickel given drops back for the giver, yet the act of giving has been consummated.

Of course, in modernity, perhaps such innocence of satiric portrayal is no longer thought to contain humor; that, as the ethics of inequality and financial disparity have given rise to resentment, and the inane concept of “fairness” today pervades the political spectrum throughout, the focus would be upon the fact of maliciously describing a person with a disability in terms which might betray mocking jest.  But that is clearly not what Sandburg meant by it; and, indeed, it was because he believed that his generation lacked children’s stories which taught lessons of virtue and behavioral uprightness, that he engaged the literary device of satire.

Life itself is difficult enough without undermining the joy of a joke recognized.  A funny line, a witty scene, a belly-laugh from a picture of incongruence; such moments allow for innocence and the lightness of being to prevail as an interlude to an otherwise dreary continuum of surviving in a world which shows but cold shoulders twisted and followed by phony smiles to cut the throats of back-turned bystanders.

Such experiences, of course, are not new to the Federal employee or U.S. Postal worker who suffers through the meanness of workplace hostility and harassment at the hands of supervisors and coworkers, merely because a medical condition prevents the Federal or Postal worker from performing one or more of the essential elements of his or her positional duties.  Whether under FERS, CSRS or CSRS Offset, there comes a time when the Federal or Postal worker must decide to prepare an effective Federal Disability Retirement application, to be filed with the U.S. Office of Personnel Management, in order to escape the diatribes of the Federal agency or the U.S. Postal Service.

Carl Sandburg’s joke was of a time when true empathy was understood by all; unfortunately, in modernity, the nickel which was meant to be returned to the giving passerby, would today be snatched up by wolves in waiting, where the lambs who once roamed the hillside of life’s joke no longer gather upon the pastures of a forgotten innocence forever lost.

Federal Disability Retirement: The furrowed face

Does the palm reader tell from lines deepened and extended by time, or in the creases of birth and predetermined fate?  Do the ruts and chasms criss-crossing like doodling designs created by a madman mixing a cauldron of witch’s brew depend upon fate already set, or can the future be altered by choices one foresees?  And what of the face — the creases around one’s mouth, the ruts above the furrowed brow, or the fine filaments of timeless cuts around the eyes; do they tell a story of joy and promise, or of sadness and sorrow?

The furrowed face is but a moment’s expression; it is rather the corrugated painting, forever captured in the stitch of life’s experiences, which lasts in timeless bottles of floating memories, like butterflies caught in a web of deception where promises of boundless expectations and revelations of hope as sung from the loving tongues of mothers dreaming of tomorrow’s future for children yet unborn.

Time, experience, and confrontations of life tend to deepen the furrowed face of age.  As do medical conditions.  It is when the tripartite combination coalesces, that decisions need to be made, lest extinguishment of life become the goal of sorrow.  For, when a medical condition comes to the fore, it impacts one’s capacity and ability; when capacity and ability become impacted, then one’s work suffers; and when one’s work begins to suffer, the notice of employers, coworkers, and the Federal agency or the U.S. Postal Service begins to turn on its engine of harassment and adversarial modalities of meddlesome trickery.

Federal agencies and the U.S. Postal Service care not whether the ruts and grooves of the furrowed face deepen by the actions of an uncaring bureaucracy.

As Americans spend billions each year on health care and cosmetic products to enhance beauty and delay the inevitable lines of age, so it is often the best medicine to alter the predetermined fate of time by considering filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, when the furrowed face of life requires such a step.  Adulthood rarely spares any of us from the deep ruts of facial scars; and when there is a “baby face” in middle age, it often reflects deeper chasms and valleys within the psyche, where hidden traumas are screaming to be let out.

In that sense, the furrowed face need not be the last and frozen picture of a person’s future, and the palm reader may yet be tentative in predicting the final chapter of one’s life.

Federal Disability Retirement: How Long Can Negation Define Living?

The tipping point where negation of living constitutes greater time spent than affirmative enjoyment of the activity engaged, is determined by individual choices and preferences.  Some individuals retain a higher threshold for pain, discomfort, and capacity to endure; and the fact that an MRI reveals a degenerative or decaying physical attribute does not necessarily correlate with the capability to ignore or otherwise minimize the magnitude of pain.

To what extent one avoids “doing something” in order to contain the pain; deny the self from pursuance of an activity in order to endure; to maintain quietude and an immobilized sedentary state of being in an effort to make the worn body and troubled mind last for a day, a week, or a decade longer; such are the efforts expended in a life of negation, in order to continue to “live”.  But is life defined by a quantum?  Or, is quantity in any way related to quality?  In “elder law”, there is often a discussion about “quality of life” issues, but the fact is, such a question and concern pervades with significance throughout one’s life, and not just towards the twilight of living.

For Federal employees and U.S. Postal workers who suffer from a medical condition,such that the medical condition begins to prevent one from performing one or more of the essential elements of one’s positional duties in the Federal Sector or the U.S. Postal Service, the question of when “enough” is already “too much” is one which haunts, tails, latches on as an appendage of inflamed emotions, and refuses mere hand-waving as an irritant to swat away.

Yes, filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management is a major step in one’s life, but at some point, the alternative left unstated and ignored must be directly confronted and faced with courage, pragmatism and prudent behavior.

Habit of negation can become so intertwined with one’s daily life, that it remains as a compromise allowed because one believed that no alternative was offered.  But as a life defined by negation becomes, at some point, a qualitative issue where all joy has been sucked out of the vibrancy of rightful ownership, so the choice to change in order to attain a semblance of a past life, memorialized in times of youth where pain and psychiatric disorders were merely hypothetical constructs hinted at by “others” in the community, so taking an affirmative step in order to be released from the confines of daily toil and turmoil is often the best and most hopeful avenue towards a life of positive images.

For Federal employees and U.S. Postal workers, filing for Federal Disability Retirement benefits through OPM is often the best choice left in order to “move on” towards a greater definition of “life as living” once forgotten because of the constant harassment and fear imposed by the Federal agency and the U.S. Postal Service.  At some point, negation cannot define living, as life is more than avoidance, and there is joy to be found beyond Federal employment and the U.S. Postal Service.
