OPM Disability Retirement: The Process of Decision-Making

As has been previously stated in repetitive fashion, in preparing, formulating and filing for Federal Disability Retirement benefits from the U.S. Office of Personnel Management, whether under FERS or CSRS, it is important to understand and acknowledge the duality of the process — for it is a process, as opposed to a singular event, both as an administrative legal issue, as well as for the individual Federal or Postal employee in a personal sense.

To clarify:  As an administrative issue, it is a process which involves multiples stages of argumentation (potentially).  Yes, it would be nice if every case was decided with an approval at the First/Initial Stage of the administrative process; however, there is a purpose and a reason why there are multiple stages.  It is precisely because it was anticipated that there would be denials and appeals to such denials, that an administrative procedure for multiple stages of review and further submissions of evidence and arguments was constructed and implemented.  It is not an entitlement pursuant to a fixed date, a fixed age, or a triggering event.  Rather, it is an administrative process which must be proven, applied for, and affirmatively shown that one is eligible.

From the personal perspective of the Federal or Postal employee, the decision of “when” to apply for Federal Disability Retirement benefits from the U.S. Office of Personnel Management, is also a process, as opposed to a singular event.  There are, of course, cases where a traumatic injury or life-changing accident occurred, and such an event is the triggering moment for filing.  But for most Federal or Postal employees, the medical condition suffered is a progressively deteriorating process, and it is often difficult to determine a “date certain” where one can point to on a calendar and state, this is the day and hour when I cannot perform one or more of the essential elements of my job.

This is why there is an inherent complexity to a process, as opposed to a singular event of certitude — for, it is always the unknown and the uncertain which gives rise to the anxieties of life, and a process is indeed a period of the unknown, and a chasm of uncertainty.

Federal and Postal Disability Retirement: Simplification of Complexities

The art of simplifying the complex requires an effort beyond mere reduction to basic concepts; it is a process of unravelling compound components in order to separate and undo intersecting concepts which tend to confound through connections otherwise incomprehensible, then to analyze each individual element in their own right, before reassembling and reorganizing.

Anyone who has taken apart a piece of equipment without quite knowing what to expect, understands such an intellectual process.  But simplification of explanation does not mean that the issue conveyed is an uncomplicated one; rather, it is an art form of making comprehensible without regurgitating the inherent esotericism itself; it is a reflection of pure understanding when one is able to explain without puffery.

Federal Disability Retirement is a complex process.  There is no getting around it.  One can separate the multiple components into their individual issues, and certainly simplify the morass by attending to each element independently; but in the end, one must reassemble the disparate parts and reorganize it back to its wholeness of integrated integrity.

As an admixture of three complex groupings — the medical, the legal, and the bureaucratic — one cannot entirely escape the linguistic confusion of technical complexities by merely referring to it as “showing this or that”.  The language of the medical issues must be embraced, followed by a clear understanding of the legal elements established, and further promulgated by maneuvering through the administrative process and the agency’s attempt, often deliberate and with conscious effort, to put up unnecessary roadblocks and obstacles.

Federal Disability Retirement benefits, filed through the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS or CSRS, is not rocket science; however, nor is it an Andy Warhol piece of artwork.  But then, I never understood the latter to be so uncomplicated to begin with.

Immediate Medical Retirement for Disabled Federal Workers: Complex Simplicity

Often enough in life, the most complex of conceptual constructs is constituted by its very simple nature; and, conversely, the seemingly simplest of tasks is characterized by its concealed complexity, only to be revealed upon an attempted unraveling of its internal mechanisms.

Consider the games of basketball or golf; the concept begins with placing a round object into a similarly-shaped chasm.  From a spectator’s perspective, nothing could be simpler; for the one who has practiced the identical motion to succeed, nothing could be more frustrating.  Conversely, witness the passage of a simple law, or of the original amendments to the U.S. Constitution; words of limited complexity; yet, it is the very simplicity of the underlying principles which conceal their complex conceptual underpinnings.

For Federal and Postal employees who first encounter the administrative process of filing for Federal Disability Retirement benefits from the U.S. Office of Personnel Management, whether under FERS or CSRS, one might be tempted to “go it alone” because of the seemingly simple construct of the necessary nexus: of the connective bridge which must be established between one’s medical condition and the essential elements of one’s job.

But it should become abundantly (and quickly) clear that it is not the foundational precept of the entire process which makes for complexity, but the ancillary issues, including the required medical documentation, the agency’s attempt to accommodate, or the elements which constitute the essential duties of a position and how they are impacted by a medical condition, etc.  No, it is the coordination of all of the arms and legs which go into preparing and formulating an effective Federal Disability Retirement packet, which makes for its very complexity.

Like the boy who is “all arms and legs” when first he attempts to play the game of basketball, so the nascent encounter with a complex administrative process which has been around for many years, will require some trial and error for the Federal or Postal employee who attempts the feat without assistance.

Trials are fine; it is the errors which become of concern.

OPM FERS/CSRS Disability Retirement: Foreign Territory

Entering a foreign country often has the residual impact of a changed perspective, and an appreciation for what constitutes one’s life “in comparison” thereof.

Such a perspective had greater prevalence decades ago, perhaps, because of the disparity and disproportionate inequality of comparative international standards of living, whereas in recent times there has been the meteoric rise of the middle class in many other parts of the world.  The “East” has attempted to mimic the “West”; the “West” has embraced the “East”; everywhere, in fashion, movies, clothing and personalities, the differences between foreign lands and one’s own has become monolithic in its loss of individualization.

The proverbial “culture shock” has somewhat dissipated, because through telecommunication, the internet, Skype, constant following on Facebook and Twitter, the “new world order” of a singular character has emerged without the need for totalitarian imposition.  But such shock of a foreign culture can occur in an intra-cultural sense.

Thus, for Federal and Postal employees who suffer from a medical condition, such that the medical condition impacts one’s ability to perform the essential elements of one’s job, the crisis felt and the impact experienced is akin to culture shock, in that the foreign territory of physical incapacity or psychological turmoil becomes just as real and unfamiliar as entering a foreign country.

Further, for the uninitiated, the bureaucratic morass which one must encounter in preparing, formulating and filing for Federal Disability Retirement benefits, is often a complete and unalterable conundrum and puzzle for the Federal and Postal employee.  Such an experience, of course, is further magnified and exacerbated because of the crisis one experiences as a consequence of the medical condition itself.

For those Federal and Postal employees who are contemplating filing for Federal Disability Retirement, then, the experience itself is often like entering a foreign country; and, in such instances, it is often a good idea to consider obtaining the services of a tour guide.

OPM Disability Retirement: The Recognition of Time

Time is a factor in all of our lives; we are conditioned to it; we respond to the constraints, and procrastinate because of its allowance.  Both time and timing may be factors in preparing, formulating and filing for Federal Disability Retirement benefits, whether under FERS or CSRS, through the U.S. Office of Personnel Management.

For the Federal or Postal worker who is contemplating filing for Federal Disability Retirement benefits, the fact that it is the “end of the year” should not be the motivating factor, nor that in a week or so it will be the “beginning of a New Year”.  Rather, the issue of time and timing should be governed by the extent and severity of one’s medical condition, and its impact upon one’s inability to perform the essential elements of one’s job.

As recognition and utilization of time is always an indicator of proper planning, so it is with the Federal and Postal Worker who must prepare, formulate and file for Federal Disability Retirement benefits.

OPM Disability Retirement: The Divide between Words and Reality

The problem with the linguistic universe is that they create a parallel universe which can be completely devoid of any connection or correspondence to the reality of the world which we occupy; thus the span of genres of imaginary creations, including fiction, science fiction, fantasy; as well as the virtual world of video games (which encompasses language because of the imaginary conversations which act “as if” the events occurring in the game itself are real).

The danger of language is that it may well communicate far more than what the objective world represents; and, conversely, it can also convey far less than what one may intend.

In preparing, formulating and filing for Federal Disability Retirement benefits from the U.S. Office of Personnel Management, whether under FERS or CSRS, the point of language is to describe and delineate the reality of one’s situation; the severity of one’s medical condition; the logical nexus between one’s medical condition and the positional duties one must engage; and the reasoning, based upon medical evidence, of why the Federal or Postal employee cannot perform one or more of the essential elements of one’s job.

The wide chasm between the world of language and the world of objectivity is the test of success; for, it is the one who can close that gap, and represent the reality of one’s universe by the correspondence of language, who will achieve a successful outcome.

The great divide between language and reality is a challenge which must be approached with care and trepidation; for, in the end, if language fails to correspond to reality, what would be the point of civilization in its endeavor to maintain the historicity of its existence?

Federal Disability Retirement: In Life, the Pragmatic Trumps the Theoretical

In administrative and other processes, as in life generally, there are issues which on a theoretical level would seem to work; but when tested in the “real world”, somehow the perfect paradigm suddenly disintegrates.  Thus, one may ascribe a series of seemingly logical propositions, each in their independent and isolated delineations apparently stand strong and without a flaw; but somehow, in their linear progression of dependence, one upon the previous one, the linkage itself may be the determining factor.

Thus the old adage:  An X is only as strong as the weakest link.

In preparing, formulating and filing for Federal Disability Retirement benefits from the U.S. Office of Personnel Management, whether under FERS or CSRS, the Federal or Postal employee may lay out a plan of attack which, on its face, may appear sound and credible; but as experience in anything constitutes the crux of everything, so the first-time experience of thinking that one’s own case is a “slam-dunk” case because the “pain I feel” is so excruciating that there is no way that OPM could do otherwise than to approve my case, may be that weakest link.

Think again.  OPM deals with thousands of such cases; your particular case, as the unique case singularly known by you, is essentially a mere theoretical example of countless other such cases.  The pragmatic reality of the Federal bureaucracy is what one must ultimately face; again, as in life in general, the practical aspects of an engagement rules the day.

CSRS & FERS Medical Disability Retirement: Refinements

One often hears of a “refined” or “cultured” person; such a description often provokes an image of one who has had the leisure time in order to engage in the arts and of higher society; and the word itself leaves connotations of perfecting the rough edges of a person, thing or work.  But if the focus of one’s efforts is upon refinement at the outset, then there is the danger that the core of the focus will not have been adequately worked upon.

Refinements should come only after the essence of a work has been produced, just as leisure time should be enjoyed only after one has completed the necessary work.  Refinements should not be the focus of one’s attention if the centrality and essence of the issue is not first attended to; and so it is with all things in life.

In preparing, formulating and filing for Federal Disability Retirement benefits from the U.S. Office of Personnel Management, whether under FERS or CSRS, it is important to focus upon creating, formulating and producing an excellent Statement of Disability; expending the effort to obtain an effective medical report; promulgating the applicable legal arguments which support the substantive underpinning one’s Federal Disability Retirement application.

Refinements can be made; but such a focus should only be engaged once the core essence of a case has been formulated.  Leisure time is just that — only after the essence of a case has been attended to.

Medical Retirement Benefits for US Government Employees: Termination

Termination for the Federal or Postal employee should generate an administrative personnel action reflected in an SF 50 or PS Form 50, showing the date of the action, the nature of the issuance and the reason for the administrative process which is initiated and culminated.  Without it, technically no such action occurred.  However, there are cases where such a form has not been produced.

Further, such a personnel initiation is rarely issued in a vacuum; for a Federal employee to be terminated, there are certain procedural hurdles which are normally provided — an issuance first of a proposed termination, and the basis for such a personnel action, and one to which the addressee has a right to respond to within a specified period of days or weeks.  Thereafter, consideration must be given by the Agency in the response, whether verbal, written or both, given by the Federal or Postal employee.

Subsequently, when a termination is effectuated, an SF 50 or a PS Form 50 will be generated.  From that date of termination, the Federal or Postal employee has up to one year to file for disability benefits.

If such filing occurs after 31 days of the official termination date, then the application for Federal Disability Retirement benefits must be submitted directly to the U.S. Office of Personnel Management in Boyers, PA.

If prior to 31 days, it can be processed through one’s former agency — although, such a filing should be carefully monitored, as one’s former agency may not process it with any urgency, and in the event that it is not forwarded to OPM within the other 11 months and some-odd days left, there will be a question as to whether it was timely filed at all.

Federal and Postal Disability Retirement: The Owl, the Chicken, and the Anomaly of Life

In the early morning hours as the peripheral light of the sun reaches the crest of the horizon, the insidious owl glides seamlessly and noiselessly above the tips of tree lines, and upon a slight movement, flutters a wing and swoops down.

In a second, the head of the injured chicken is severed; yet, without the connecting neurotransmitters guiding the body, the headless fowl persists in running, attempting to escape from the prey which has already been encountered.

Thus, civilization develops the adage:  running around like a chicken with its head cut off.  And that often describes the Federal or Postal employee who attempts to desperately put together a Federal Disability Retirement application and submit it to the U.S. Office of Personnel Management.

Dealing with one’s medical conditions is stressful enough; attempting to wind through a Federal bureaucracy and the administrative obstacles of proving and establishing the nexus between one’s medical condition and the essential elements of one’s job, only compounds and complicates the process.

To further the analogy, the question is:  Who represents the owl — the Office of Personnel Management, or the entire Federal bureaucracy?  Or, moreover, while the owl flies away with the head, it is often the scavengers who come and feed upon the rest of the torso.
