FERS Disability Retirement Law: The Patchwork of Life

It is an appropriate metaphor — of a hodgepodge (even the word itself reflects well the definition) — where the composition is made up of miscellaneous or incongruous parts, yet with the result possessing the potentiality of a fulfilled and even “beautiful” end-product.

FERS Medical Disability Retirement Benefits: Not Just

There are at least two meanings to the phrase; one can be considered as a declarative sentence, complete in itself; the other, a prefatory remark, unfinished and incomplete.

Yet, perhaps both are correlative in their meanings, and essentially state the same thing.  For, one can witness a violation of human dignity and declare, “Not Just!”  That would be one sense.  Or, a person can lament the incompleteness of describing one’s personhood, as in: “I am not just X, but also A, B and C” — or, more particularly, for someone to be seen only as a plumber, a teacher, a student, a child, etc., without regard to the greater complexity and inner psychological intricacies that make up the whole person.

But, perhaps, the two meanings merely complement each other: It is not just to just consider a person in a one-dimensional manner.

Federal Disability Retirement: When Winning becomes a Problem

Winning is always better than losing.  But if a person, entity, organization or body is empowered with the responsibility of merely applying a regulation, a set of rules, a legal analysis, etc. — and is supposed to have no “interest” in the outcome of a case or issue — then “winning” can become a problem.

Whenever people are involved, egos and self-interest are by nature intertwined.  To declare that “X has no interest” in an issue is to try and ascribe an automaton — a mere computer chip with no personal, emotional or other “interest” involved.

One argues, often, that because “X doesn’t get anything out of it, therefore X has no interest involved”.  But having an “interest” can involve more than just the question of whether there is some personally identifiable and quantifiable interest — it can also involve the mere act of “winning”.

Federal & Postal Disability Retirement: The Variety Show of Life

It is never very predictable, and certainly not a monologue with a single voice conveying a logical sequence of events.  Life itself is more akin to a Variety Show — of singers in one moment, dancers in another; of solitary soliloquies by sometimes uninhabited corners, or a storyteller, then a story to be told; and discussions and accidents, or arguments and agonies.

The popularity of a Variety Show in its extravaganza of star-studded collections and unexpected appearances is an appropriate metaphor for the lives we live.  Whether by internal sufferings or external calamities, most people live lives that reflect the tumultuous bubbles of an unfolding drama.

Federal Employee Disability Retirement Benefits: Stop & Go

The rhythm of our daily lives is a reminder of who we are, how we live; and so the necessity of transportation — of driving a car, riding a bus, and even of a subway or the more traditional train; of how we ride for a time, then stop; then, ride again for a further time, then stop.

The work day is set up in the same manner, with a parallel rhythmical indifference: We work furiously for a specified number of hours, then pause, stop for a while — perhaps eat our lunch, go and use the “facilities”, and then rush back to “ride” for a while by working again, only to stop again for a brief moment, eat dinner, sleep for a bit, etc.  Throughout that rhythmic process called “living life”, we try and avoid all of the calamities of known origins and unknown expectations — and like the accident on the road we try and avoid, the living calamities (e.g., injuries; divorce; death, etc.) are there at unknown places and in foretold quantities.

What do you tell a young child who tries to plant seeds in the fall, and when asked about the activity, responds, “I want flowers for the winter and am planting them now so that they will bloom by the time the cold comes”?

Do you: (A). Laugh and tell the child that he or she is being foolish, (B) Explain to the child that flowers don’t bloom in the wintertime, (C) Direct them to the proper plants that will produce the intended effect or (D) Let the child discover for him or herself as to whether such an effort will have any positive results?

Clearly, options A and B would not assist the child in learning and advancing one’s knowledge of the world (Answer B, while generally the case, ignores the greater effort required in explaining that some flowers do, indeed, thrive in the dead of winter or, alternatively, that this particular region is not conducive to certain plants); and choice D, while perhaps allowing for a greater lesson to be learned — may instead attain the wisdom of the harsh reality of the world through explanation and discussion.

Explanation and a proper understanding of the circumstances, context and limitations of one’s activities in light of the surrounding universe is the key to gaining wisdom and knowledge.

Given that, Choice C would obviously be the “best” option towards greater understanding.  Thus, it is not merely the vacuum within which what one is doing that matters; rather, it is the effective interaction between one’s activities with the greater world beyond that produces a balanced comprehension of one’s place in the universe, how one can be effective and even influential.

Camellias are wintertime flowers that continue to thrive despite the harshness of the environment; whatever the genetic make-up that allows it to remain in bloom while others wither or die, their hardiness in environments others hibernate from and shun is a testament to the reality that, indeed, there are such things as wintertime flowers.

That is sometimes a difficult reality and lesson to learn — for we too often categorize times of our lives in similar ways: In extremes where it is an “all or nothing” proposition.

For Federal employees and U.S. Postal workers who suffer from a medical condition such that the medical condition no longer allows for the Federal or Postal employee to perform one or more of the essential elements of one’s Federal job, it is important to understand that the end of a Federal or Postal career does not necessarily mean that it is an “all or nothing” proposition.

There can be life even in the wintertime of one’s career; for, Federal Disability Retirement allows for the individual to work in the private sector, the state, county or municipal job, and continue to receive the OPM Disability Retirement annuity, so long as you remain under 80% of what a person’s former Federal Salary pays, and to the extent that it is medically justifiable that there is a distinction between the former Federal job and the non-Federal job.

Like wintertime flowers, you just have to find the right circumstances in order to thrive in the season of your life.

Federal Disability Retirement: The language divide

Why is it that language is often so far removed from the living of life?  Was Wittgenstein correct – that it is a distinct world, separate and apart, that really has nothing to do with the “reality” of an “objective” universe?  Was Russell’s cutting quips about the bald King of France a way to point out that the primitive outlook of the traditional correspondence theory of language – that words, concepts, etc. are meant to parallel the objective world “out there” – doesn’t quite fit the proverbial bill, and that we are left with a linguistic universe insularly created and forever divided from the noumenal world that Kant had identified?

Take the following short puzzle that was recently heard: “There are eleven birds sitting on the telephone wire.  A young boy takes a gun and shoots one, and kills it. How many are left on the telephone wire?” Now, the answer to that minor conundrum should be quite elementary, but depends upon how we approach it.

From a mathematical viewpoint, one simply takes the numbers – a purely “theoretical” approach, divorced from the reality of the objective world in which we live, and subtract the 1 dead bird shot by the young lad, from the original number of birds identified on the telephone wire, and come up with the correct answer: 10 are left, because 1 was shot and killed, and therefore the mathematical equation: 11 – 1 = 10.  But it turns out that the correct answer is: “None”.  Why?  Because once the boy fired the gun and killed the 1, all of the others flew away.  Now, one can scratch one’s head and say with self-effacement, “Of course!  That only makes sense!”  Or, one can pause and say, “Now, why wasn’t that as obvious as the answer now seems, after it is pointed out to me?”

Now, contrast that with “real life”:  A hunter goes with his loyal dog and flushes out 3 pheasants from the forest; he takes aim and kills 2; 1 gets away.  He is later asked, “How many did you get?”  He answers, “Two.”  He is asked:  “Any left behind?”  The hunter looks at the questioner quizzically, with some puzzlement.  Why?  Because the question doesn’t quite make any sense – why would you ask such a question?

The fact is that there is a language divide – in real life, asking “how many are left” is not a relevant question, because the reality of living one’s life has already revealed the reality of the living.  It is only when we turn reality into an insularity ensconced within a theoretical construct does it become a thinking universe divorced from the objective world around us.

For Federal employees and U.S. Postal workers who suffer from a medical condition, such that the medical condition prevents the Federal or Postal worker from performing one or more of the essential elements of one’s Federal or Postal job, the issue of the language divide is a reality that the Federal or Postal worker must live with each and every day of your life.  That is because you live with a medical condition – the deteriorating effects, the daily symptoms, the chronic pain, numbness, gait imbalance, dizziness, vertigo, cognitive dysfunctions, etc.  The “world of language” doesn’t quite “understand” the reality of the medical condition, and is often inadequate to describe or decipher the sensations experienced.

That being said, in order to formulate an effective Federal Disability Retirement application, the language divide must nevertheless be bridged; for, an effective Federal Disability Retirement application must by necessity enter the world of language – of the Applicant’s Statement of Disability (SF 3112A), the medical reports, and legal argumentation with persuasive force; and it is the language divide itself which must become the vehicle for an approval from the U.S. Office of Personnel Management, so that when the single bird is shot, there aren’t any left to speak about on the telephone wire that connects language to the reality of one’s life.

Medical Retirement under FERS & CSRS: Inversion thinking

The dictionary definition often refers to a “reversal” of an opinion, position, order of sequence or relationships between entities, but may also connote the grammatical alteration of the normal sequence in a sentence, such as placement of a verb before its subject.

In modernity, we often hear about the admonishment to “think outside of the box” – and advertisements often try to play upon this concept by declaring some grand secret that is only available to a limited number of people who are smart enough to call in to the station within the next 5 seconds, lest the opportunity of a lifetime be lost (ignoring the fact, of course, as you are sitting singularly in the confined space of your car listening to the radio, that there are tens of thousands of other listeners who similarly have the mistaken belief that being alone in a vehicle listening does not mean the same thing as being the only person hearing the announcement).

The fact of the matter is, that once a person begins to be told to “think outside of the box”, it is already too late; for, inversion thinking must occur prior to everyone else engaging in the herd-mentality of being different.  Being different means doing so before everyone else has similarly become different, which is to say that everyone becomes the same.  At that point, one must try and become different from the collective differences already alluded to, and in so doing, it is already likely that many other people have already considered the next course of mutation and followed a similar suit; and so it goes.

Inversion thinking is just a different way of thinking outside the box; or, one might say, it is the same as thinking outside of the box, only stated in a different way.  We all like to think of ourselves as unique and singular, when in fact most of us are mere figments of an aggregated collectivism.

We all go to the same type of schools; we listen to the radio programs within the restricted airwaves of our communities or at least until the satellite programs expire and the constant flood of offers to extend become so annoying that we go ahead and give that credit card number to pay for programs we never listen to; and the spectrum of information we are bombarded with – from television to movies, internet and Facebook, et al – makes herds of us rather than mavericks upon the great plains of the creative mind.

We are told as we are growing up, how unique and “special” we are, but in the end, inversion thinking is a phenomena that rarely occurs.

For Federal employees and U.S. Postal workers who are considering filing an effective Federal Disability Retirement application with the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, it is often the thought of being “different” that prevents the Federal or Postal employee from taking that “next step”.  Be not fooled, however; for, from the perspective of the Federal Agency and the U.S. Postal Service, you have already been targeted as “different” because of your medical condition.

Inversion thinking requires taking that next step, and to think “outside of the box”, and preparing, formulating and filing an effective Federal Disability Retirement application is that distinguishing feature of human activity that will require a different kind of approach in order to step into the uncertainty of one’s future.

OPM Disability: Those Winds of Change That Portend to Pretend Promises

Change is an inevitable circumstance of life; it is what we seek when we are discontented; what we demand when threatened; and of which we fear, when least we expected it.  For Plato and Aristotle, the puzzle of life and the winds of change had precursors who, in the tradition of ancestral doomsayers, declared the natural corollaries reflecting discontent, despair and fear, as represented by Heraclitus and Parmenides.

Such change was first observed in the natural order of the universe, and worked slowly, deliberately, and sought a teleological understanding because of the mysteries inherent in the seasons, the heavens and the geocentric perspective defied by the reality of a heliocentric algorithm of calculations.  At some point in history, man was no longer satisfied with measuring with thumb and forefinger; and thus were pyramids built and Stonehenge created, to satisfy the yearnings of universal comprehension.

Changes did not just occur from the ashes of natural disasters; we invited them, manufactured them, and manipulated the vast conspiracy of quietude, lest we became comfortable in our own discordant behavior.

For Federal employees and U.S. Postal workers who suddenly find that a long and productive career may come to an end because of an intervening medical condition, the winds of of change may seem uninviting, but the inevitability of life’s resistance to permanence requires taking affirmative steps in order to establish future security, such that change which portends alterations of present circumstances does not pretend to make promises falsely expected.

Filing for Federal Disability Retirement through the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, is an option to be taken when once a medical condition is recognized to last a minimum of 12 months (which can be accomplished through a medical “prognosis” as opposed to actually waiting for that period of time) and where the chronicity of the medical conditions prevent one from performing one or more of the essential elements of one’s Federal or Postal positional requirements of the job.

Medical conditions portend change; but the promises resulting from inevitable change need not be subverted by subterfuge and lack of knowledge; and like the harkening of soothsayers of yore, we should listen to wisdom in light of a hastened call to change, and distinguish between those winds of change that portend to pretend promises, from those which have an established record of success.

OPM Disability Retirement Lawyer: The Happiness Principle

A society’s trending obsession is often reflected by the backdrop of books written, published and popularized in culture corridors of mass media; and so the Oprah of timeless celebration never loses its luster for belated works attempting to keep pace with the commercialization of principles which once may have been considered seriously.

Plato and Aristotle addressed the issue; Existentialism arose from the ashes of war, and sidestepped it by considering the bleakness of the human condition; but in the age of technology and the optimism blanketed through mass dissemination of information, the focus has shifted from essence to residual results, where the natural consequences of X becomes the focal obsession of Y.  Happiness was once, in a time of yesteryear, an afterthought to survival, secondary to ethical conduct, and tertiary to a productive life.

Today, it seems that the principle is the primary goal of living, as organisms and amoebas naturally tend towards food sources.  Beyond the happiness principle, however, is the undeniable fact that it cannot be attained when certain interrupting forces blockade and obstruct; and pain, psychiatric conditions and medical disabilities certainly fall into that category.

There is, then, the condition itself (the medical condition) which impedes the happiness principle; and administrative processes (such as Federal Disability Retirement, filed through the U.S. Office of Personnel Management) which constitute a bureaucratic obstacle to corollary life principles.

Obtaining Federal Disability Retirement benefits through OPM does not and should not pretend to resolve medical issues; but it does allow for the Federal or Postal employee to attend to the primary concern underlying one’s life — the medical condition itself. Often, we confuse the essence of a thing with the appearance of that which presents itself to us.

For the Federal employee and the U.S. Postal Service worker, it is important to understand that preparing, formulating and filing for Federal Disability Retirement benefits, whether one is under FERS, CSRS or CSRS Offset, is not the “end all and be all” of attaining the ultimate goal, but rather part and parcel of multiple components which, like pieces of a puzzle, need to be gathered, sorted and organized in order to create that collage of life called contentment.

Thus the “happiness principle”:  perhaps not the destination to be confused, but the quality of the ride to get there.
