No one can replace Jim Croce’s classic, Time in a Bottle.  The lyrics are so beautifully written:

If I could save time in a bottle

It describes the conceptual complexity of so much — of time; of eternity; of love; of the imagery of a bottle adrift at sea; of a devotion to a special someone.  And of time and a flower — of the age-old adage that a flower represents a moment in time where a pause to reflect, a hesitation of a reminder, of beauty in nature which reminds us that this fast-paced world cannot abide in eternity without the momentary realization of transcendent aesthetics, of form and beauty which betrays our mortality, and of the need within every human being to be awed by an inviolable encounter with Being.

It is the simplicity of contrasts — of the complexity of time and the beauty of a flower.  When do we ever have time, anymore, to enjoy simplicity?

This is a complex world, full of strife and stresses.  The sad reality is that we have time only to smell the roses when we are forced to — as when a medical condition forces the Federal or Postal employee to slow down, to not take things for granted.

FERS Disability Retirement from OPM: Piling On

There is an unspoken ethos in sports and other disciplines — of being charged with “unsportsmanlike conduct” if you engage in the activity of “piling on”.

If a game has already been decided but you push forth anyway to go for the touchdown followed by a 2-point conversion, you are likely guilty of the offense.  If you have already made your point and the intended target has clearly been shown to be wrong, and yet you persist in hammering out every conceivable other criticism to lay upon the individual, you are likely “piling on”.

If, in defeating a proposal or pointing to the inadequacy of some submission, you go beyond the first 3 points of a critical rebuttal — all valid and determined to be correct — but then go on with a red marker and circle every comma missed or adjective overused, it is likely that you are committing the sin of it.

For Federal employees and U.S. Postal workers who file for Federal Disability Retirement benefits from the U.S. Office of Personnel Management under FERS, a Denial from OPM will likely find the feature of “piling on”.

OPM is notorious for engaging in this activity; it is another way of saying, “Why did you even file?  You idiot!  You never stood a chance!”  Now, of course, OPM doesn’t put it in such an inartful manner; instead, it will be couched in lengthy “discussions” by large chunks of extrapolated statements from your medical file, and then concluding that you do not meet the “legal criteria” under Federal Disability Retirement Law.

OPM Disability Retirement: The Winning Argument

Most arguments are not won by sheer force of logical persuasion; for, that would require the assumption that not only does everyone think “logically”, but that everyone also has been versed in the technicalities of propositional and syllogistic logic, has studied them and accepted them as overriding and dominant methodologies of discourse.

We like to harken back to the classical period of civilization’s cradle and cloak our biases with Aristotle’s dictum that we are all “rational animals” — implying thereby that our thought processes are powered by a predetermined set of algorithms characterized by the model of a supercomputer.  Yet, we — as fallible human beings ourselves — instinctively know better.  People do not think, leaving aside argue, by mere logical rules and discourses of such modalities; there are almost always other factors involved, whether of emotional ties, internal egoistical motivations or just the pure and unadulterated need to win at every engagement.

Aside from such human factors, however, is there an “objective” standard that characterizes a “winning argument”?

Federal Disability Retirement Claims: Hypocrisy

What is it about carrying about one’s state of existence with the knowledge that there is a dichotomy between that which we declare and what we secretly harbor, or between the words we convey and the actions we engage?  Is it likened to the adage of, Do as I say, not as I do?  Why do we so relish with a sneer when failure of moral dimensions become exposed — of a priest who is “caught in the act”, the preacher who is seen to embrace episodes of moral turpitude; a moralist who denies the obvious inclinations of human desire, or the purist who pounces when the mere tinge of impurity spreads its imperfect wings?

Hypocrisy abounds, and has always throughout history, and the louder the volume of protestations, the harder the fall as the chasm between reality and the theoretical purity of ivory towers only reveals the baseness of human frailty.

For Federal employees and U.S. Postal workers who feel like hypocrites because of a medical condition that continues to be denied, hidden and overcome by sheer will of concealment, there often comes a time where fatigue simply catches up to the fear of being “found out”.  No, it is not quite the same as your run-of-the-mill hypocrisy, like the preacher who falls from grace; but the tension is still there, nevertheless, and it is just as real as if your moral failings suddenly become unconcealed.

Federal employees and U.S. Postal workers who have to “hide” their medical conditions and act “as if” everything is fine and dandy, ultimate pay the same or similar price as the hypocritical moralist who walks about with a puffery undeserved: the anxiety that continues to grow and fester remains so and grows beyond a bearable state of concealment.

Preparing, formulating and filing an effective Federal Disability Retirement application, to be filed with the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, is often the first step in an admission of “failure” — but more importantly, of turning that failure into a success, by shedding the cloak of hypocrisy and facing the reality of a medical condition that needs priority of attending, in order to regain that balance that should be first, foremost and in the front of the proverbial line: One’s health.

Federal Employee Disability Information: Mortality averted

Does it occur when the body is entombed?  Or, perhaps, like children who play “king of the hill”, the exhilarating feeling that overwhelms when once you are alone on top of the hill, unchallenged, identified as the winner of a game otherwise known to be silly but at least for the moment, a sense of immortality, where mortality is averted for a day, a second, a moment or in likened eternity.

Is the “winner” of life he/she who has the most toys at the end?  Is that why old men divorce their best friends after 30 years of marriage, only to remarry immediately to a person some generation or more younger, so that mortality can be averted?  Is there unequivocal, scientific proof that fad diets, working out at gyms, avoiding dangerous leisure activities like bungee jumping without making sure that the cord is shorter than the distance between Point A and the chasm’s end below — do any or all of these ensure mortality to be averted (surely, not the last of the series implicated, although the exhilaration felt just before the cord strains to restrain must bring about a rush of sensation before the concept of causality is tested for the last time)?

Do we surround ourselves with things that last beyond the days of antiquity only to remind ourselves that some things in life do, indeed, remain beyond the time of our own demise? Why do people write out wills and instructions detailing post-death affairs, knowing that we will not be present to oversee the execution of our wishes?

It is, indeed, a puzzle — of transporting ourselves in consciousness to a time beyond and planning for a moment when we are no longer here; yet, to race furiously during our lifetimes to make sure that others have some semblance of a memory of our existence.  How many tombstones lay fallow in graveyards just around the corner, unvisited, untended and forgotten, except in echoing whispers of yesteryear’s cousins who once stole the golden chalice of mortality’s laughter?  And what about the middle ground — that time of illness and deteriorating health, when we are reminded that mortality is, indeed, just around the corner, and the not-so gentle nudge that pulls us in that direction?

For Federal employees and U.S. Postal workers who suffer from a medical condition, such that the medical condition prevents the Federal or Postal worker from performing one or more of the essential elements of the Federal or Postal job, the mortality to be averted is the constant pain, suffering or debilitating episodes that make for life’s misery to continue, and it may be time to avert mortality’s nudging reminder by preparing an effective Federal Disability Retirement application, to be filed through the U.S. Office of Personnel Management, if only to temporarily escape from the daily grind that reminds you that your deteriorating health is no longer compatible with the positional requirements of your Federal or Postal job.

In the end, mortality cannot be completely averted, but in the meantime, enjoyment of the remaining days is the best that one can hope for and preparing, formulating and filing an effective Federal Disability Retirement application is a small step towards achieving that goal.

OPM Medical Retirement Legal Representation: Paradoxes

Quine, probably the greatest logician since Bertrand Russell, notes that paradoxes often occur as a result of presumed beliefs otherwise left unstated, and once they are “fleshed out” through query and made explicit via closer scrutiny and analysis, the portion which befuddles often disappears.  Confusion within a language game, of course, is often a large part of it, and certain unstated preconditions and assumed facts otherwise implicit and hidden will leave the stated portion incomplete such that others must come along and unravel the mystery.

In a similar vein, statements made as “necessarily” so also retain unstated presumptions.  Thus, if we claim that “the sun will rise tomorrow”, we are asserting that it is “necessarily so”.  If a child asks, “Why is that so”, we will often revert to nothing more than Hume’s response that because it has always risen in the past, and the revolution of planets and rotation of the earth around the sun has been a reliable compass upon which we can depend, it is the regularity of events in the past that determine the necessary expectation of repetition for the future.

It is, then, those unstated or “hidden” presumptions that made certain statements and claims unclear, and the job of an attorney is to clarify that which is left in a muddle.

For Federal employees and U.S. Postal workers who suffer from a medical condition, where it becomes necessary to file an effective Federal Disability Retirement application through the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, the questions surrounding paradoxes and necessity can be important.

Medical conditions can certainly be paradoxes.  Without explanation, they can debilitate, progressively deteriorate and impact a person’s ability and capacity to continue on as before.  Even with a medical diagnosis, prescribed course of treatment and sometimes surgical intervention, they may remain a befuddlement because of a lack of knowledge or explanation.

Having such a medical condition may nevertheless require that the Federal or Postal employee file for Federal Disability Retirement benefits because the Federal or Postal employee is no longer able to perform one or more of the essential elements of the Federal or Postal job.  The filing itself becomes a “necessity”.

The gap between the paradox of the medical condition and the necessity of filing a Federal Disability Retirement application through the U.S. Office of Personnel Management becomes quite clear: Necessity does not equal entitlement, and the paradox must be proven.  In doing so, implicit facts must be explained and explicated, and more than an argument of “because it has always been so” will have to be put forward to persuade OPM of the viability of one’s case.

To that extent, do not allow for concealed and presumed “facts” to defeat your Federal Disability Retirement application, and never allow your statement of facts to remain a paradox, lest it become “necessary” to engage further steps of appealing the Federal Disability Retirement process in pursuance of an approval from OPM.

OPM Disability: The Chasm between Expectation and Reality

Expectation constitutes the anticipatory goal to be attained sometime in the near or far future; reality is the actualization of the potentiality of one’s imagination.  That anticipatory potentiality, however, can be formulated based upon numerous factors, including:  baseless imagination (more of a child-like quality); desire and hope (with perhaps some admixture of factual context and content, and somewhat of a more mature basis); or sequences of planned actions culminating in a realistic fulfillment based upon actual circumstances analyzed, deliberated upon and ascertained (a mature consequence of purposeful strategies formulated and initiated).

The chasm which exists between one’s expectation, and the reality of fruition, retrospectively reveals the state of maturity (or immaturity) of one’s soul.  That is why gamblers and lottery tickets abound; for, the play upon adolescent wants and desires portends of dreams unfulfilled, desires still unrestrained, and creative imaginations unbounded allowed to wander aimlessly.

For Federal employees and U.S. Postal workers who expected one’s own agency to embrace loyalty and constancy of support just because the Federal or Postal employee showed such honorable characteristics for many years previously, and perhaps for more decades than the half of one’s lifetime, the chasm of reality often hits hard.

Medical conditions can often be “accommodated“, if only in a loose, non-legal sense of the word.  But it is amazing how people and organizations suddenly become quite “legal” in matters where honor should prevail; and in that sense, to be “accommodated” takes on a new and restrictive meaning.  Medical conditions often bring out the worst in people and organizations, and concepts involving the humanity of one’s soul no longer become relevant, but mere irritants to be legally sequestered in order to protect and deny.

For Federal and Postal employees who suffer from a medical condition, such that the medical condition prevents one from performing one or more of the essential elements of one’s Federal or Postal positional duties, filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, is often the last bastion of hope — hope which bridges the chasm between expectation and reality, and one which sets the path for future security upon the solid foundation of a reality which one may want to shy from, but which one cannot escape in this world of love, hate, humanity and cruelty — the compendium of that complex animal called Man.

OPM Disability Retirement: House of Cards

We have all built them as children; those shantytown assemblages like the poverty-stricken and make-shift huts constructed by corrugated debris gathered from refuse and discarded materials, flimsy and ready to collapse, if not by architectural fault lines, then certainly from the sudden and malicious puff of air emitted by one’s younger brother or sister tiptoeing  up from behind in a sneak attack.  The House of Cards — they test the dexterity and patience of one’s character, and simultaneously represent anything built on a precarious foundation, including business ventures, family relationships, and of life itself.

For the Federal employee or the U.S. Postal worker who suffers from a medical condition, such that the medical condition begins to impact one’s ability and capacity to perform the essential elements of one’s Federal or Postal positional duties, the concept of a House of Cards can become quite personal, and in the modern proverbial metaphor, “hit close to home”.

Daily, the precarious and tenuous state of one’s employment status is tested by sudden and unexpected winds of fate, by sneak attacks and underhanded methods of operational malice.  A sudden stir of the atmosphere, a deliberate act of adversity, or the unsuspected whisper of undermining; they all amount to the same:  an attempt to further weaken the foundations which were already being tested.

The option the Federal or Postal employee needs to consider, is to file for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, whether under FERS, CSRS or CSRS Offset, because if the foundation of one’s life has already become shaky, the fall itself is an inevitability when confronted by the vast behemoth of the Federal agency or the U.S. Postal Service.

Just as 2 out of the 3 little pigs came to understand and appreciate the necessity of a firm foundation, so the Federal or Postal employee should see the wisdom in fleeing from under the House of Cards, and consider filing for Federal OPM Disability Retirement benefits; for, they ran to the third when they could, and lucky for them, the Big Bad Wolf could not get to them — at least not in some versions of the tale.
