FERS Disability Retirement Law: “It’s Behind Us”

The phrase can, without context, mean a number of things.  In story-writing exercises, a phrase such as the one referenced may be thrown at a student, and the student must then formulate the context surrounding the phrase, in order to give it “meaning” and relevance.

For example:  Perhaps it is a story about a haunted house, and two children are looking about, cautiously walking from room to room, when suddenly they hear a creaking noise, and one whispers to the other “It’s behind us!”  Or, it could have a completely different context — of a family crisis and how the various individuals deal with the problem, and when it is finally resolved, the wife turns to the husband and declares, “It’s behind us.”

Context is important, and relevance comes about only when the context is sufficiently fleshed out.

For Federal employees and U.S. Postal workers who suffer from a medical condition such that the medical condition prevents the Federal or Postal employee from performing one or more of the essential elements of one’s Federal or Postal job, it begins with a medical condition.  From there, however, the “context” must be fleshed out — the relationship to one’s job; whether or not there is a possibility for an accommodation; what “fleshing out” needs to be done within the context of the law, etc.

In a vacuum, a medical condition cannot “win” against the U.S. Office of Personnel Management in attempting to secure a post-employment Federal Disability Retirement annuity.  It is the experienced lawyer who can help in fleshing out the context in order to ground your case in relevance and “the law”.

OPM Disability Retirement Application: Worth in Our Day

Worth has become a meaningless concept; inflation, the valueless dollar, the expansion from millionaire to billionaire, and now to the next level — the first “trillionaire” — who will it be?

There was a time not long ago when aspiring to make or save a million dollars was within sight; that, once achieved, it was a level of monetary achievement which would allow for a fairly comfortable living.  These days, purchasing a home in a relatively middle class neighborhood ranges in the $600,000 – $700,000 range and beyond, rendering a million dollars to be viewed as somewhat of a pittance.

And what of human worth?  As money becomes meaningless because the decimal point continues to move to the right, leaving unfathomable zeros multiplying to the left, do we treat workers with any greater dignity, with any greater value in parallel conjunction with the exponential multiplication of those zeros?  Doubtful.

At least, however, the Federal Government does recognize that a person who is disabled from performing his or job elements should be eligible and entitled to disability retirement benefits.  To that extent, worth in our day has improved from the middle ages where the disabled were merely discarded as beggars on the streets of London and Paris, as well as in middle America.

OPM Disability Retirement: Stress and the Harassment Factor

Stress is a reality which has become a normal aspect of everyday living.  The more stress we feel, the greater interpretation of outside actions as harassment; and thus does the vicious cycle begin.  Life is stressful enough.  When another ingredient is added — like a medical condition that weakens one’s body and mind — the tolerance for stress becomes reduced and the capacity to keep things in its proper perspective becomes impossible to manage.  Stress always seems to come in bunches, doesn’t it?

When you are dealing with a medical condition, everything and everyone you interact with becomes a stressful encounter.  For Federal employees and U.S. Postal Service workers who suffer from a medical condition such that the medical condition prevents you from performing one or more of the essential elements of your job, the stress of dealing with the medical condition itself is more than enough.

Add to it, your agency or the postal facility will inevitably begin to pressure you to return to work, to file this or that request, to follow their “procedures”, etc.  Whether such actions are objectively considered “harassment” or not is beside the point; you, as the Federal or Postal employee, are dealing with enough factors without having to deal with the harassment factor.

FERS Disability Retirement: The Meaning of Incompatibility

We hear the word often — used in conjunction with “irreconcilable differences” (in a divorce proceeding), or perhaps in an electrical engineering context where voltages and circuitry are “incompatible” with this or that mainframe, or some similar language game involving technical issues which don’t work well together.

It is a peculiar word; stated in a certain way or tone of voice, it is a declaration of finality, as in, “Nope!  These two [blanks] are incompatible!”  And ascribed to human beings?  How about: “Jane and Joe were married for 20 years.  They have separated and are going to get a divorce because they are no longer compatible”.  Does the phrase, “no longer compatible” mean the same thing as being “incompatible”?  Can two people, like two components of some mechanical processes, become “incompatible” when previously they were not?  Are people like widgets where parts can be irreplaceable in one instance, but are no longer so in the next?

It is, as well, a legal term.  In the field of Federal Disability Retirement Law, incompatibility is the “fourth” criteria that can be met if the first three (deficiency in performance, conduct or attendance) cannot be satisfied in a Federal Disability Retirement case.  Some medical conditions cannot so easily be described in terms of a 1-to-1 ratio between a medical condition and an essential element of one’s Federal or Postal job that cannot be met.

In their aggregate and totality, the compendium of medical conditions may have come to a critical juncture where they are no longer compatible (i.e., incompatible) with continuation or retention in the Federal Service, and that is when filing for Federal Disability Retirement benefits through OPM becomes a necessary function of one’s future goals and plans.

OPM Disability Retirement under FERS: Stress of the Moment

From a distance, we can all handle stress.  It is that time and removal from the moment that makes all of the difference, is it not?  Afterwards — after the explosive anger, the sudden quietude or the paralyzing fear — we reflect and wonder as to what created such a stressful reaction.  Or, years later, one may recall that it was a moment of “something”, but rarely remember the exact details as to what prompted or triggered it.  It is often the combination of multitudes of factors: Too little sleep; overworked; a sense of isolation; a feeling that no one around you really cares, etc.

Then, when a medical condition enters upon the scene, all other factors tend to become exaggerated, magnified and exacerbated.  One’s health and deteriorating medical condition always adds to the stress.  It is like the old adage about a fish not realizing that it is swimming in water; when we have our health, we barely recognize it; when we lose it, it becomes the focal animus of our daily lives.  Without our health, there is no “stress of the moment”; rather, every moment is a stressful experience.

For Federal employees and U.S. Postal workers who suffer from a medical condition such that the medical condition prevents the Federal or Postal worker from performing one or more of the essential elements of one’s Federal or Postal job, it is time to consider filing an effective Federal Disability Retirement application under FERS, through the U.S. Office of Personnel Management, in order to reverse the course taken — that of going back to experiencing the stress of the moment, as opposed to living a life of unending, unendurable and eternal stresses throughout each and every waking moment.

OPM Disability Retirement under FERS: The Carefree Life

Is there such a thing, or is it a fiction, a mirage, a fantasy of those who create mythologies old and new — like the Utopia of some ancient history or of immortality in a netherworld of paradise’s dream?

To live is to care; to have a carefree life is therefore to die.  The incompatibility of the two concepts coexisting is intuitively clear; but the oxymorons we create are often as a result of dreams and goals expressed out of frustration from the overwhelming nature of those cares which confront us.

Life is a series of “cares”; to be free of them is to be free of life itself; and as living means that the human drama of interacting, helping, engaging in conflict and facing daily trials and all that constitutes the “stuff” that life is made up of, so it is the one who engages it successfully, who is able to maneuver through the complexities of such messes we make of it — that is the closest we can come to in becoming “care-free”.

There are those few who, perhaps, are able to escape a good part of the daily cares of life; but then the unexpected happens, such as a medical condition which one has no control over.

For Federal employees and U.S. Postal workers who suffer from a medical condition such that the medical condition begins to prevent the Federal or Postal worker from performing one or more of the essential elements of one’s Federal or Postal job, it may be time to modify the types and numbers of the “cares” that you are confronted with.

No, there never was or is a carefree life; but obtaining a Federal Disability Retirement may at least allow for the Federal or Postal worker to at least focus your attention upon the cares which matter most — that of health.
