Postal and Federal Disability Retirement: Persuasion

Persuasion is a funny animal; when it is effective, success is determined by the reversal of an opponent’s viewpoint, but if it is ineffective, mere silence ensues, and unless prompted by subsequent queries, one never knows how close one came to persuading another and what further evidence or argumentation may have pushed the other side over the edge.

Then, of course, there is always the question of whether the opposing party is open to persuasion or not, and what are the conditions within which it may occur.  The danger lies especially when an organization or bureaucracy has become so powerful or autocratic that it need not ever be persuaded because there are no consequences to being left unpersuaded.

The presence of outside safeguards is often necessary for persuasion to have its salutary effect, as a more obscure sense of “fair play” is often not enough to make a difference.  All of this, of course, doesn’t even touch upon the substantive content of what constitutes a persuasive argument, as context is often just as important as content (anyone who has been married will immediately understand the truth of this statement).

For Federal employees and U.S. Postal workers who have submitted a FERS Medical Retirement claim with the U.S. Office of Personnel Management (also known for its acronym “OPM”) and have received an initial denial and must now respond to the denial at the Reconsideration Stage of the Process, “persuasiveness” becomes the battle cry in preparing the proper response.

OPM has all the time in the world in preparing its denial and needs little basis in its persuasive content.  They merely need to have some minimal basis of reasons to issue a denial.  On the other hand, the denied Federal or Postal applicant has (A) a very short timeframe in responding and (B) must advance a heavy burden of proof in order to overcome the denial, despite the often scatter-brained content of an OPM Denial.

Furthermore, in preparing a reconsideration Response, one should always keep in mind that the targeted audience is not just OPM, but the next stage in the event that OPM remains unpersuaded — that of the Admin Judge at the U.S. Merit Systems Protection Board (MSPB).  That is why any response to an OPM Initial Denial should include a recitation of the relevant case laws discussing why your particular case meets the legal criteria for an approval.

OPM Disability Retirement Law: Confusion and What to Do

Confusion naturally follows upon a new and challenging circumstance.  That is not an anomaly; it is not a negative reflection upon a person’s ability or capacity; and it should not be taken as a sign of some inherent weakness.

We like to think that we are prepared for every eventuality, but even the wisest amongst us can use some guidance.  This has become a “specialized” world, where no one can any longer be that “jack-of-all-trades” person.

Modern life has become complicated beyond the capacity of any single individual, and the loss of extended “support systems” — because of fractured family relationships, the incursion and influence of Social media beyond their healthy originations; and the sense of isolation despite the greater freedoms we enjoy — makes for increased confusion in the midst of so much information available through the internet.

The self-contradiction is inexplicable: The greater the availability of massive amounts of information “out there” in the electronic morass of the internet, the lesser knowledge attained and wisdom displayed.  Perhaps it has to do with the loss of need for memorization; perhaps because of over-specialization; but whatever the reasons, we have become less knowledgeable.

Federal Disability Retirement: The vacation that wasn’t

When is a vacation no longer one?  Is it when we take work with us, sit upon the sands of timeless recreation — but with a laptop or a pile of papers that are kept weighted down by a crumpled towel and children asking or demanding for immediacy of attention becoming distant noises of irritation and not the gaiety of sharing?

Or, is the intrusion upon our insular universe — you know, the mind’s eye behind the blank stare; the constant rumination of what we expect and anticipate upon our return; the angst over the backup of emails that will await us upon our return; the fear and knowledge that some devious action has been planned for by our boss or coworkers, or perhaps both in conjunction within a conspiratorial scheme no longer veiled with declared foreknowledge and barely hidden beneath the seething tides of backstabbing dominions?

Even that 3-day weekend, or the weekly routine of the 2-day weekend; they are no longer refreshments from the toil and rumination of worry and anxiety, panic-stricken with sleepless nights and dreams that once gave a fading smile but now urging you to wake up in the middle of the night drenched in pools of sweat for nightmares that won’t leave you alone.

The vacation that wasn’t — isn’t — is the one that no longer refreshes and cannot be looked forward to because the anticipation of what will be left behind becomes too overwhelming to bear.

Life is lived by analogies.  It is how we understand, comprehend and make sense of a world in turmoil.  By identifying a resemblance between two or more particulars while perhaps remaining somewhat different in other aspects, we are able to relate things, understand them, comprehend the isolation of differentiation between X and Y and yet embrace those differences despite the lack of commonality in all other respects.

Without the tool and transporting impact of an analogy, most of the objective world would remain isolated, irrelevant and separated from the subjective coherence that we bring to the world.  Explanations and argumentation would often lack any comprehensible understanding; scientists would simply speak in technical languages that non-scientists (i.e., laymen like most of us) would fail to appreciate; and life would continually remain a series of isolated islands of conceptual conundrums that would be separated from civilization as a whole.

That is essentially why the administrative laws governing Federal Disability Retirement must by necessity be spoken of in analogic terms – precisely because, in order to make sense in the greater context of life, everything in particular can only be “explained” and “made sense of” through analogies that we can relate to.  Without relational contexts and reference points, life’s various complexities would remain in isolation from one another.

Federal Employee Disability Retirement: Resignation

It is both an act, as well as a demeanor.  In the former sense, the fulfillment is accomplished by the actual tendering of an offer to terminate a business or contractual relationship, with a declarative statement of unequivocal certainty.  In the latter form, a feeling, a sense of foreboding, and a concession to life’s hardships.  In either case, it is an act of withdrawal, whether by action via terminal certitude or in the wasting away of the soul’s inner flame of light.

Resignation, submitted as an act of defiance to one’s employer or as a private tender of retreat, is a statement of definitive intent, and one that negates the living embrace of Being.  In political circles and parliamentary procedures, there is often involved a game of dare and a play of obfuscation, like card players in a high-stakes poker game where the tendering of a resignation letter is not expected to be accepted; yet, such attempts at bluffing possess moments of backfiring, with the resulting end to promising political careers because of the inability to foresee substance from play-acting, or want of proper timing.  Resigning, and for what purpose?

For Federal employees and U.S. Postal workers who are considering preparing, formulating and filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, the question of resigning from one’s Federal job or Postal employment should always take on multiple questions and conditions of “why”, “when” and “what for”?

What is the reason; why resign; when should the resignation be tendered; and what is the reason for resigning?  Is it because the doctor has recommended such a course of action?  Will the agency refuse to extend the LWOP status during the process of awaiting a decision from the U.S. Office of Personnel Management?  Will it allow for access to TSP funds during the process, in order to survive financially?  Or are there other justifying, pragmatic considerations to factor into the decision-making process?

These, and many other considerations, should be discussed, evaluated and objectively defined, before a resignation is submitted to one’s agency or the U.S. Postal Service.  For, once the resignation is received, and an SF 50 is generated separating the Federal or Postal employee from Federal Service, then the 1-year Statute of Limitations begins to toll, where the (now former) Federal or Postal employee has one year from the date of separation from Federal Service to file for Federal Disability Retirement benefits, directly to the U.S. Office of Personnel Management.

Thus, there are direct and irreversible consequences in the tendering of a resignation in the first sense of the term; as for the alternate consideration – of a demeanor more suited for a change of circumstances – that is up to each individual to embrace, and determine in an existential sense that any resignation from life’s beauty and worth of being, must remain a choice left only to the unidentified tombstones of unvisited grounds where neither hallowed voices are heard, nor hushed silence interrupts.

FERS & CSRS Disability Retirement: The Little Engine that Couldn’t

It is an educational tool utilized to impart upon children the value of hard work and unfettered optimism, but one wonders, At what point should the harsh realities of the world be included?  How, sometimes there are situations where the obstacles are so great and the conspiratorial caverns so deep that the graph of upward mobility is but a mere mirage in life’s cycle of certitude. The balance between the benefit of maintaining optimism in the face of adversity, and tempering unrealistic expectations, is a scale of justice which is delicately configured throughout life.

While the tale of the Little Engine that Could represents the cultural and societal impetus for encouraging work, fair play, persistence and a positive attitude, some of life’s obstacles serve to cut short the capacity and ability to achieve stated first goals.  Medical conditions tend to do that.  Whether primarily physical or secondarily psychiatric, or inversely impacted, a progressively debilitating medical condition saps the self-confidence of the individual, and eats away at the abilities of the patient.

For Federal employees and U.S. Postal Service workers, when a medical condition begins to prevent the Federal or Postal worker from performing all of the essential elements of the positional duties of the Federal or Postal employee, consideration must be given to one’s future, and that future planning should include filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management.

Eligibility for OPM Disability Retirement benefits encompasses all Federal and Postal employees, whether one is under FERS or CSRS, so long as the Federal or Postal employee has met the minimum eligibility requirements: 18 months of Federal Service for those under FERS, and 5 years for those under CSRS (which is essentially assumed that anyone under CSRS already has at least 5 years of Federal Service).

Further, if the Federal or Postal employee is still on the rolls of the agency or the U.S. Postal Service, or has not been separated for more than 31 days, then the Federal Disability Retirement application must be routed first through one’s Human Resource Office of one’s Federal agency or the U.S. Postal Service (for the latter, the central processing point for all Federal Disability Retirement applications for Postal Workers is located in Greensboro, N.C.), then to the U.S. Office of Personnel Management in Boyers, PA.

Implicit in this requirement, of course, is that there is a “Statute of Limitations” as to filing a Federal Disability Retirement application.  All Federal Disability Retirement applications must be filed within 1 year from the date of separation from Federal Service.  Thus, if a Federal or Postal employee is terminated, or has resigned, and a Federal Disability Retirement application is filed, the (now former) Federal or Postal employee must file within 1 year of the date of separation — but if separated for less than 31 days, then through one’s former agency or U.S. Postal Service, and if over 31 days, then directly to Boyers, PA, which is the “intake” processing office for OPM for all Federal Disability Retirement applications.

Whether the Federal or Postal employee ever read or heard tell of the tale of the Little Engine that Could, the time for filing for FERS Disability Retirement benefits is when that proverbial engine gives out, and when life’s harsh realities turns the story of optimism and hope into a pragmatic approach in order to secure one’s future; for, sometimes, life accords engines which need fine-tuning, and medical conditions represent just that sort of mechanical need, for the Little Engine that once Could which turned into the Little Engine that Couldn’t.

FERS & CSRS Disability Retirement: The key to happiness

There are countless titles of books which predicate upon the presumptuous endeavor; palm readers who, for a prepaid fee, make their living from it; and wanderers who trek the Himalayas in search of it.  Others merely change the definition or meaning of what constitutes the achieved goal, or drink themselves silly when self-deception fails to fulfill.

The problem with happiness is that it was once a byproduct of our lives; when it became the end-goal, the very nature and essence of it became unachievable.  It is when a singular focus upon an effect becomes the sighted destination to reach, that the frustration of unrealistic expectations come to the fore, and dismay and doubt of self becomes the mainstay.  Happiness was never meant to be a constancy of one’s trophied achievement; rather, it is a secondary effect as the residual of an accomplished life.  Frustration thus dawns upon us because the fleeting aspect of its very nature is never within one’s control.

For the Federal or Postal employee who suffers from an ongoing medical condition, such frustration of purpose is self-evident on a daily basis, especially when one plays the never-ending game of, “If only X…”  For, the contingent precedent is never within the grasp or control of the injured Federal or Postal Worker, or one who is beset with progressively debilitating medical conditions.  Federal Agencies and the U.S. Postal Service make it their job to obfuscate, place obstacles, and ensure the daily denial of accommodations, and flout their open disregard of the laws and protections allegedly designed for Federal and Postal workers who suffer from a medical condition.

Often, in life, there are limited choices; but the options we choose are the known pathways to happiness.  Loss of it, or the denial of the effect, comes about when we rely upon those things which are beyond our control, and expect others to “do the right thing“.

For the Federal employee or the U.S. Postal worker who suffers from a medical condition, such that the medical condition prevents the Federal or Postal employee from performing one or more of the essential elements of one’s positional duties, the key to happiness is to take affirmative steps in taking charge of one’s own life.  Beginning the process of preparing, formulating and filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, is a pragmatic step which one can actually quantify with respect to the progress made towards a goal defined.

Federal Disability Retirement: Of Tomorrow’s Dreams Delayed

We like to think that our lives progress unencumbered in a linear line of advancement, with nary a bump or an obstacle unconquerable, and but for the occasional exuberance of planned erraticisms, the journey should be a smooth ride without surprises.  But just as planes sometimes fall from the sky, and nature betrays its perfection by mistaken errors of comedic turmoil, so the linear aspect of constancy often must confront the bumpiness of expectations.

Life rarely turns out as planned, and the more we plan, the less we expect fulfillment.  Perhaps that is the great tragedy of loss of youthful innocence.  In the end, it is how we face up to that realization that plans are meant to be altered, that unexpected curtailment of expectations unrealized merely represent the reality of the universe, and that in the end, the process of “how we face” it is more important than the desultory buoyancy of cynicism.

On a rollercoaster or other thrill-seeking device, there is often that final moment of exhilaration, that last pause before the turn; perhaps that is precisely why we seek such madness, for life itself rarely presents us with a similar and parallel event.  Instead, like the medical condition which slowly, steadily, and with monotonous rage progresses to debilitate, the constancy of repetitive boredom in life mirrors the tragedy of human proportionality and graveyards filled with unnamed tombstones.

For Federal employees and U.S. Postal workers who suffer from a medical condition, such that the medical condition results in an inability to perform the essential elements of one’s positional duties, the bumping up against the tides of obstruction means that one must prepare, formulate, and file for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS or CSRS, or even CSRS Offset.
