It is one of those stories / folklores which transcends time, and a quick look at “sources” (yes, ashamedly, an internet search on “Wikipedia” reveals much) shows that the story possesses derivations and deviations from other countries and cultures, establishing that every profound theme has been recognized by a multiplicity of times and civilizations, to wit: vanity; con-artists; a child’s innocence; the sin of self-importance, etc.

That such themes cross over many cultures attests to their universality; and the lesson to be learned is not mere hyperbole, for we have found ourselves (if we are to be open and honest) in metaphorical circumstances similar to the story’s moral lessons.

In modernity, the folklore can be of greater instructive relevance than in any other time; for, to engage in the insularity of social media without a concomitant “reality check” against the objective world, can feed into one’s vanity and establish a type of insulated verification without regard to reality.

In simple terms, we can fool ourselves by engaging in a protected cycle of like-minded people.  That is why there are so many “romance scams” on the internet — of lonely people being scammed out of their life savings, all by stroking one’s vanity that love can be discovered through mere words on a blank screen.

What is the lesson here for Federal employees and Postal Service workers who suffer from a medical condition?  That there are no “new clothes”, but merely old ones — no new or magical solutions, but the age-old one of mortality.  People’s health can deteriorate, and we cannot think that you can just go on like you were in your twenties, or even thirties.  Sometimes, one’s health deteriorates, and you do, in fact, have to go out and try on “new clothes” — like filing for Federal Disability Retirement under FERS and thinking about preserving your health by going into another line of work.

FERS Disability Law: Falling Through the Cracks

Where did that phrase originate from?  It often refers to small things slipping through without getting noticed because of their insignificance, whether because of size or lack of notoriety.  Children who lack popularity are often thought to be in danger of falling through the cracks — of not being given their due attention; of being ignored; of failing to be noticed.

What thoughts are connoted from such a phrase?  For most, it is perhaps the penultimate game of the Western world — Chess.  Or, if you have been exposed to Eastern or Oriental influences, the game of Go.  Perhaps neither — and the phrase, “the next move”, may evoke thoughts of a basketball player or some other sport which requires a “next move”.

There is drama everywhere — whether in theaters, local plays, movies or daytime soap operas, the drama of life is being played out.  “Drama”, “dramatic”, “melodrama” — whichever word or concept you apply, we all know what it means.  Most of us try to minimize it, avoid it, marginalize it — and the quick response to cut it down to size is often, “I’m not into that kind of drama” or, “Aren’t you being a bit over-dramatic?”

Once upon a time the fable of lessons learned included “The Boy Who Cried Wolf” — of that story with a moral lesson of the importance of truth-telling, and if you over-dramatized a lie too often, your reputation would suffer.  And so the moral of the story taught 2 things: “Truth” is important; creating drama for your own amusement would have consequences.

Postal & Federal Disability Retirement: Competing Interests

It is a concept which is familiar to all; for, within a society where various individuals interact, where each person represents a self-interest and groups of individuals combine to form aggregate (or “corporate”) interests, the competition that develops and erupts is a natural phenomena.

For the most part, society operates well and rather smoothly; courts allow for competing interests that have reached a point where resolution must be arbitrated by a third-party authority; physical violence where competing interests resulted in an altercation are resolved by a criminal judicial system; and a well-trained police force deals with competing interests where laws have been violated.

Between nations, competing interests are often resolved by diplomatic negotiations — or end up in wars, resulting in devastation and famine for the general population.

For Federal employees and U.S. Postal workers who suffer from a medical condition such that the medical condition prevents the Federal or Postal employee from performing one or more of the essential elements of one’s Federal or Postal job, the competing interest which should be identified are: The applicant, whose interest is to obtain a Federal Disability Retirement benefit; the Federal Agency or Postal Unit, who may or may not be supportive of the employee/applicant, and thus may represent a “first order” competing interest; and the U.S. Office of Personnel Management, whose competing interest is to deny, where possible, the employee’s application for Federal Disability Retirement benefits.

There is also a fourth “competing interest” — that of a Federal Disability Lawyer who will effectively represent the Federal or Postal employee.

Medical Retirement under FERS & CSRS: Procrastination and delay

The former denotes an active passiveness, while the latter connotes the former but may also include objective circumstances beyond the subjective input or control over the consequences resulting, whether from external forces, internal influences or a combination of both.

What compels one to procrastinate?

There can be a number of factors — of secretly not wanting to proceed; of the proverbial kicking the can down the road; of wanting to extend the known quality of the present and resisting the unknown quality of an uncertain future; or perhaps, just simple laziness.  Of the latter — of delays in a process, or of results expected — this can be because of actions taken or not by others, and a whole host of reasons not known by the expectant party.  Thus, for a delay to occur, much of the circumstances often cannot be controlled; of the former, most, if not all of it, is within the purview of one’s influence.

Further, it is often the monsters within that loom much larger than the reality without, and that is often true of things we anticipate we will not like, and of obligatory mandates that may be inevitable objectively but resisted subjectively.

Federal Medical Retirement: Plato and Play-Doh

If a person says to another, “Have you used Play-Doh” and he answers, “Well, yes, but only as it applies to certain situations in my life.  Otherwise, I tend to rely upon Aristotle in a more pragmatic, scientific approach.”

Somewhat taken aback, the inquiring mind restates his position, saying, “No, no, I meant, have you played with Play-Doh?” Still not distinguishing between the inserted alternative of a consonant (the “D” in Play-Doh as opposed to the “t” in Plato), the responding individual states again, “Well, conceptually Plato is difficult to ‘play with’, as you state it, in that you have to first understand the conceptual paradigms he posits, then…” and the same person goes on to provide a full-fledged, half hour dissertation on the esoteric aspects of a Dead White Irrelevant Philosopher (otherwise known by the acronym, a “DWIP”).

At this point, frustrated, the inquisitive interrogator walks away, throwing his hands up in complete confusion and befuddlement.  What does one do?  How is the incommensurate encounter resolved?  Question: Does the fact that we “hold” in the base of our minds a certain spelling of a word make a difference as to intent and deliberative motive, when what we “speak” out into the objective world makes the receptor of the word, phrase or sentence interpret it as something different from that image that we behold in our minds?

How does one close the chasm between subjective thoughts and objective reality?  Do we approach it in a different way – and does the problem really remain in the subjective domain of the questioning individual insofar as he or she is unable to, incapable of, or otherwise unwilling to alter the originating course of his posited query?

In other words, shouldn’t the person have restated his conceptual query in the following manner: “Oh, I see.  You must have misunderstood.  I am talking about ‘Play-Doh’ – the clay-like substance that we all used to play with as children, and I thought I saw some when I visited your house the other day.”  To which the responder should appropriately state, “Ah, I see now.  You must excuse me. I am concurrently reading Plato’s Dialogues and I mistook your question to be referring to that.”

It is, then, the capacity to listen carefully, to recognize the response given, then to respond back appropriately and relevantly that often dissipates any compelling reason to become frustrated.

Similarly, for Federal and Postal employees who are attempting to respond to the U.S. Office of Personnel Management’s subsequent queries, or even in response to the Statement of Disability’s questions (SF 3112A) that need to be answered, the Federal or Postal employee who is attempting to formulate an effective Federal Disability Retirement application must take care in bridging that gap between subjective reality and objective communication.

There are many “tricks” to the “trade”, and OPM has probably dealt with them all; but the one trick that OPM cannot ultimately ignore, is the tricky web of legal precedents and prior MSPB and Federal Circuit Court decisions that compel them to act in ways that they cannot forego.  Legal argumentation is an art form that should not be ignored, and whether you are asking about Plato or Play-Doh, remember always to include in any Federal Disability Retirement application an effective legal argument that persuasively argues the legal precedents applicable in your case.

Federal Disability Retirement: The Holiday Season

We are entering into that period of respite; of the contradictory clashes of duality in purpose, paradigms and expectations:  to “be happy” during a season where one is forced to conform to a standard no one quite remembers was ever met in the history of mankind; of rushing to “get everything done”, while supposedly being reflective, meditative and contemplative upon the season of new birth and magical fantasies; of responding to cheerful salutations contrary to one’s nature, reflex and possible genetic disposition so ingrained that the forced smiles hurt the resistant flesh around one’s mouth; and, all the while, to act “as if.”

“As if” the religiosity of the event still matters while we stand in line to follow the incessant promptings of the commercialization of that which we are admonished to recognize as a “sacred” time of sacraments and benedictions; “as if” kids can still believe in something when throughout the rest of the year the cynicism of hopeless trope pervades and dominates; and “as if” the heart is really where the mind should be, when rationality is overwhelmed by the emotional turmoil of one’s life experiences, the present hope gone and replaced by tomorrow’s sorrowful cries for yonder residue of ashen dust as the angels of lost years flew by in a whirlwind of timeless escape.

Yet, as we were once young and the trials of childhood memories forbade but a glint of hope, we remember trying to stay awake and listening, with but hopeful ears and fleeting dreams, of the footsteps of Santa upon the roof above, knowing that the tears suffered in years long gone could be embraced by a singular touch of a hopeful tomorrow.

The Holiday Season is upon us – with all of its inherent stresses, the clash of psychology between hope and expectations, and the further problems now upon those who actually believe that someone else’s Instagram truly represents the reality of life’s perfection, where there is none.  Yes, yes – everyone will be given that trope of wisdom:  Slow down and enjoy the season; it is not as important to receive, but to give; if everything doesn’t seem perfect, relax and enjoy the company surrounding; if you are getting too “stressed out”, then – what?

Often, it is actions beyond words which result in the first steps toward a “feeling” of accomplishing something, and for Federal employees and U.S. Postal workers who need to take the next step towards getting beyond the medical condition that has become chronic, and away from the constant harassment and condescending remarks about not “carrying your weight” at the workplace, preparing an effective Federal Disability Retirement application, to be filed with the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, is often the necessary first and next step in reaching a goal known but not yet materialized.

Federal Disability Retirement: The Trail of Tears

History is replete with the metaphor of maltreatment; it is the silent graves that cannot speak, anymore, which haunts a nation’s soul.  It is a reminder, of sorts; a way of understanding and revisiting the history and essence of a nation – of the westward expansion and the decimation and systematic thievery against a civilization that was doomed from the start.  But trails soon get overrun by either settlements or city construction; and tears quickly dry up so that the agony of a peoples once felt become a mere memory told in narratives and tales by old men and forgotten women who no longer matter.

Reservations were demarcated and a defeated populace was shuttled into forgotten corners of the world, left to sputter amongst themselves in wallowing memories of defeated battles and violated treaties; and, as modernity replaced the fading residue of an inglorious past, only the diaries and annotations of eyewitnesses maintained a memory of coherent violations otherwise set aside to make room for future time.  Does each one of us, in addition, have a trail of tears?  Do we shed them in the privacy of our scorned thoughts, left to the isolation of our own destroyed lives?

The Medicine Man of yore could not stop the onslaught of that which we deem “progress” and “modernity”; and in the end, it was modern warfare that doomed any resistance to change.  The medical doctor of today, like the appeals of yesteryear to the Great Spirit, can only stem the tide of a progressive and chronic disease; the methodology may have changed, from fasting and foreboding fortunetelling to pharmacological modalities and surgical intervention, but when a diseased body or mind continues to deteriorate despite such intercession, the personal trail of tears follows a parallel course of those we once trampled upon.

For Federal employees and U.S. Postal workers who suffer from a medical condition, such that the medical condition prevents the Federal or Postal employee from performing one or more of the essential elements of one’s Federal or Postal position, it may be time to consider preparing, formulating and filing an effective Federal Disability Retirement application, to be submitted to the U.S. Office of Personnel Management.

There are always historical travesties, as well as personal ones.  In this world where history barely catches the fancy of those who must contend with the tides of an uncaring world, it is the personal trail of tears which is most important to each individual, and not the “grand scheme” of events which we can neither control nor foresee.

History is what it is – acts committed by ancestors, certainly, but ones which most of us could neither control nor protest against.  But that which we can determine – like the destiny of a future for a Federal or Postal worker who must contend with a medical condition that continues to debilitate and constrain – should be accomplished within the confines of the laws which predominate, lest one’s personal trail of tears begins to parallel that of a past now long forgotten.

Medical Retirement from Civil Service: Recognizing the best of times

Often, we mistake short-term travails with the chronic despair experienced by some.  In the midst of an experiential trauma, compounded by a lack of capacity to consider the limited perspective we find ourselves in, the enmeshment of the “now” without any insight for a better tomorrow, a future to behold nor a distance aglow with the proverbial light at the end of the tunnel, inflames the inner Darwinian categories of instinctive responsiveness to merely survive.

In retrospect, one’s judgment on any particular day or time, or even of an event remembered, may be altered.  We may even point to that slice of life and state with aplomb, “It was actually the best of times.”  How often do we hear that when one harkens back to the starving days, when struggling was a daily commotion and worrying was but a common routine?

By contrast, such reverential references are rarely attributed to those periods where longevity of suffering cannot be measured, where the chronic nature of the pain cannot be determined, and where no promises can be made that tomorrow will be any better off, no matter what extent of effort is exerted, than the next day, or the day before, or the day after, or the time prior.  In such circumstances, change itself may be a necessary component in the search for a light of hope.

For Federal employees and U.S. Postal workers who daily struggle with fulfilling the positional requirements of one’s job, filing for Federal Disability Retirement benefits, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, is often the best option available.

The concept itself – the “best of times” – is a relative one; we compare it to other memories where distance of time has not faded too radically a moment of the negative:  no (or lesser) pain; controlled depression; inability to remain sedentary for long; unable to bend, lift or reach repetitively; unable to engage in the physical requirements of the job; inability to have the requisite focus, concentration or work for any sustained period of time without the high distractibility of pain; these, and many more, constitute the foundational loss which may qualify the Federal or Postal employee to become eligible for Federal Disability Retirement benefits.

Perhaps, getting an approval from the U.S. Office of Personnel Management will not necessarily mean that the best of times still lay before one; but surely, whatever the future beholds, the chronic nature of one’s medical condition, the unbearable burden of the daily toil just to make it to work, cannot by any manner of the definition, even imply that the “best of times” resides in the present circumstances of choice.

Preparing, formulating and filing for Federal Disability Retirement benefits is a choice of sorts; it is to recognize that there is, indeed, life after Federal Service or the U.S. Postal Service, and further, that recognizing the best of times involves movement forward and beyond, where the present circumstances of negative returns will likely never allow for a regeneration of that which keeps us stuck in the quicksand of daily toil.
