Medical Retirement under FERS & CSRS: The avoidance factor

When does avoidance become a problem?  Say you found out something about a close friend or neighbor — an embarrassing fact, a hidden truth or perhaps a juicy tidbit of revelations that could topple a friendship or marriage — and your self-guiding principle of being honest and forthright scares you into believing that, were you to encounter the person, you fear that either your demeanor will reveal that hidden secret, or you may be a person who cannot control your emotions and you believe that you may blurt out the secret and damage, ruin or perhaps even end the relationship altogether.

Or, maybe you avoid something simply because you dislike doing it, or fear the consequences of finding out the truth, or even disregard knowing that if you seek it and find it, the discovery itself would merely confirm the fears of life’s travails that you believe are better left alone.

What we don’t know, we can deal with; that which, once uncovered, revealed and brought out into the open, we suddenly realize is a certainty that cannot be avoided.  Is work becoming that way?  Are coworkers likewise avoiding you, and you them, with eyes averted, speaking about the weather, the last sports extravaganza, how the Orioles never seem to make the final push or whether money ruins the equality of teams, etc.?

For Federal employees and U.S. Postal workers who suffer from a medical condition, such that the medical condition prevents the Federal or Postal worker from performing one or more of the essential elements of the Federal or Postal job, the issue of the avoidance factor looms large.

Everyone begins to avoid the obvious — that you have a medical condition; that your medical condition impacts, impedes and prevents you from performing all of the essential elements of your job; that, perhaps, even your own doctor has already hinted at the truth of your medical condition — that you should likely seek a change of career; that the ceiling of sympathy has been reached, already, and your agency has begun to grumble about termination proceedings; and many other indicators, besides, that showing what everyone is avoiding is actually just a confirmation of the elements needed to prove a Federal Disability Retirement case; it’s just that everyone has been avoiding the obvious.

For, in the end, the proof of a Federal Disability Retirement case is likely already in existence in the very avoidance factor that you and everyone else has been tiptoeing around, and it is precisely the avoidance factor that makes of certainty the issue itself: Now is the time, and not tomorrow; today is the first step that needs to be taken, and not some obscure time down the road, and the avoidance factor that leaves everyone in the dark is like the hidden secret that everyone knows about but believes that he or she is the only one with the truth that, actually, everyone already knew.

Whether everyone without exception experiences it, one can never tell.  For some, it comes in a subtle, slow manner, approaching at the beginning of, somewhere in the middle, or near the end when the long days of cold and darkness seem to have pervaded for too long that it has extinguished any memories of summer days and the sound of lapping waves in the heat of August.

For others, it comes like the roaring rush of the Siberian winds, paralyzing one as the shivers and overwhelming sense of doom and gloom – those twin cousins of an anticipated darkness and a subjective response to such environmental causation – becomes unavoidable in their power and sensation.  Of course, those who live in Florida never experience it, or rarely so.

The winter doldrums come upon most, in varying states of power, with impact in spectrums that only the affected individual can concede to.  It is, of course, too early to complain about so nascent in the season.  Instead, we are to be “joyful”, as the holiday season is upon us; and yet…

The analogy and metaphor have been applied in literature great and mediocre; of seasons likened to life’s cycles, and of their parallels to the experiences engaged.  From the “winter of discontent” to the “summer of childhood memories”, the cycle of seasons play upon the imagination, as spring represents the innocent beginnings of youthful dreams and fall betrays the end of childhood.

But of winter?  Where does the metaphor begin, and more importantly, what is anticipated beyond the frozen pillars of shivering nights?  And of winter doldrums – do we all experience them, and to what metaphor will we attribute the sensation of blanketed despondency, never to be shed except in the light of hope for a future yet to be anticipated?

For Federal employees and U.S. Postal workers who suffer from a medical condition, such that the medical condition has brought about the winter doldrums too early in one’s career, preparing a Federal Disability Retirement application, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, may well be the only way to shed the blanket of winter doldrums.  For, if spring is the season of hope and summer the embracing of tomorrow, then fall must by necessity be the phase of the downtrodden, and the winter doldrums the time to begin preparing.

Such analogies, of course, are meant to be just that – images by which to begin a process that remains a stark reality – for, the bureaucracy of the U.S. Office of Personnel Management is likened to a dark dungeon that must be faced, and the perilous journey of filing a Federal Disability Retirement is sometimes the only way out of the despair of the Winter doldrums, by preparing, formulating and filing an effective OPM Disability Retirement application.

OPM Disability Retirement Attorney: Uncharacteristic Behavior

It is the clash between an expectation and the actualization of an encounter, which determines one’s perspective of self-fulfillment of a belief, or a resulting dismay from failure of verifying the basis of a paradigm.  Characteristic behavior is thus that type of human encounter which meets with, or exceeds, one’s predetermined paradigm of what one has already believed to be so; to act out of that previously considered belief system, by definition makes it fall outside of the realm of such expectation.

For the Federal employee and the U.S. Postal worker, the bureaucratic complexity of the entire administrative process of preparing, formulating and filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, is normally not a surprise, and meets with or even exceeds, the expectation of an already-formed paradigm of what constitutes the “characteristic behavior” of the system as a whole.

It is the anomaly of the century when efficiency, helpfulness and pleasantries prevail throughout the process of filing for Federal Disability Retirement benefits, where one hears with surprise and shock that it was “uncharacteristic”.  Sadly, that tells us something.  While somewhat unfortunate, we must always remember that the road of every bureaucratic process is paved with personalities of every type.  We tend to lump the entirety of an administrative process into a single cup and cauldron of judgment, but the reality is that there are multiple categories, just as there are different types of people throughout the universe, distinctly compartmentalized into:  helpful; friendly; efficient; nasty; backstabber; fair; unfair; loyal; unpredictable; just to name a few.

The process of filing a Federal Disability Retirement application through OPM can be a stressful one, if only because it is based upon an obvious stressor to begin with:  a medical condition which impacts one’s ability to perform one’s Federal or Postal job.  But it is not the bureaucratic process itself which adds or detracts from the inherent complexities of the process, but the behavior — characteristic or not — of those who must help along the way or hinder the necessary transition of the Federal or Postal employee, from one of active Federal or Postal employee to that of disability annuitant.

OPM Medical Retirement: Of Vultures Riding the Currents of Time

Watch the vultures float the currents of time, gliding high above, awaiting a trail of destruction behind.  Universally, across the globe, they have similar outward appearances; with wide wingspans for the ability to soar and patiently await high above, watchful for death and decay to progressively come to fruition.  Is it the scent of decay, or the fading gaze of death which attracts?  Or, perhaps, weakness and state of debilitation has a natural aura which draws?

The weak among us becomes a magnet for prey; the scavengers of time become the savagery of timelessness.  Despite our declaration for civility and sophistication, the brute essence of man comes to the fore when elements of weakness manifest. Sympathy and empathy constitute window dressings for civilization’s social contract; a concession to effeminate yearnings voice that of the spectacled class.

Look at the brutality of Federal agencies when once a Federal employee or a U.S. Postal worker announces an intent to file for Federal Disability Retirement benefits.  Suddenly, the skies are filled with gliding wingspans of watchfulness.  No one seemed to care before; now, the sunlight is blocked by widespread fans of feathery flurries.

Federal Disability Retirement is a rightful benefit which can be asserted by any and all Federal and Postal employees who have the minimum of Federal Service (18 months for those under FERS; 5 years for those under CSRS).  But as with every contingency in life, there are residual consequences in filing for a benefit, and such resulting ends will often involve the hostility of the Federal agency, the sudden shying away by one’s coworkers, and a subtle (or not so hidden) loss of camaraderie among peers and supervisors.

But what are the choices? For the Federal and Postal employee who suffers from a medical condition, such that the medical condition begins to prevent one from performing one or more of the essential elements of one’s positional duties, filing for Federal Disability Retirement benefits is the path to escaping the slow and progressive deterioration of one’s health condition.

That the vultures may circle during the wait, may be an inevitable consequence; what one wants to prevent, however, is for such creatures to land and begin the pecking process of maggot-laden flesh.

OPM Medical Retirement: Obligation through Declaration

It is through the vehicle of the declarative statement that obligations are created.  Thus, when one states:  “I promise…”; “I will…”; “You can count on me…”; and other similar declarations of intent, then the connection between the speaker and the one to whom it is stated, is immediately created, such that a binding sense of mandatory indebtedness is established.

In many ways, then, it is through the spoken word, arranged in a pre-established sequence of grammatical form, which constitutes something beyond a mere folly of ideas, but binds an obligation of intentionality.

That is why talking “about” something is often the first step towards doing it.  Of course, words alone can result in a continuum of inaction, and the more words which are spoken by an individual, without any follow-up as a consequence, can undermine the very force of those initial linguistic hints, until the day comes when those around simply mutter, “He’s been saying that for years…”

For Federal employees and U.S. Postal workers who suffer from a medical condition, such that the medical condition prevents him or her from performing one or more of the essential elements of one’s positional duties of the Federal or Postal job, the consideration for filing for Federal Disability Retirement benefits will normally take those initial, communicative steps of inquiry:  first, with one’s family; next, with some research and thought; and further, some outreach to someone who has knowledge about the process of preparing, formulating and filing for Federal Disability Retirement benefits, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset.

Mere talking and gathering of information does not create an obligation of an irreversible nature; but when one moves from declarative statements devoid of future contingency (“I plan on filing…”) to one of present involvement of intent (“I am in the process of…”), then the step from mere words to activity of production has been established, and the Federal or Postal worker is then well on his/her way towards securing one’s future.
