FERS OPM Disability Retirement: Subtlety’s Disappearance

Was there ever a stabbing seen?  Or, was it the raising of the knife, the shadow of the woman behind the shower curtain, the chalkboard-fingernail-scratching music; and blood; and of the psychotic stare of Anthony Perkins.

Or from that classic Western — not the gore of modernity, but the sudden scream and the terrified, bulging eyes of the older daughter as dusk was setting and the mother didn’t want the lamps to be lit — or later when John Wayne began shooting repeatedly at the buffalo in anger; we saw not the slaughtering of those beautiful creatures, but the facial expression of a rage-filled searcher.

Where is subtlety?  How is it that we came to know fear and terror without seeing the actual gore and blood, but by the facial expressions seeing and experiencing it for us?

In modernity, of course, everything must be made explicit, because when the current audience has already seen the extremes of violence and murders, including “real-time” violence from mass school shootings and other group mayhem, there can be no subtlety left, and subtlety’s disappearance is merely the reality for those who grow up in a surreal reality of virtual un-reality.

Federal & Postal Worker Disability Retirement: The Chore of Life

We all have our chores to do — some more pleasant than others; of emptying the dishwasher; taking out the garbage; cleaning up the yard after a hard winter’s debasement; attending to the pets; even taking a shower — although, it is puzzling as to why we do not consider the latter to be a “chore” and instead deem it as a daily activity of living.

Watching a toddler, we realize that they, too, engage in chores; the only difference is that everything that they do is involved in the most important chore — the chore of life.  For, the initial engagement with the world — of objects, furniture, toys, pets, other people — involves the primary learning process of how to maneuver through the obstacles of this experience called “life”.

We, as adults, forget that important lesson, because we have encountered it repetitively so many times that everything becomes boring, unimaginative, a burden — in short, a “chore”.  Life in general, after a time, becomes a burden and thus a chore, and then cynicism begins to seep in.  But the chore of life to a child is the fresh encounter of everything in the world precisely because of its freshness and newness.

OPM Disability Retirement: The Lost Illusions

In childhood, we retained many illusions; as adulthood came to fruition, such illusions were slowly stripped away, one by one, until reality hardened the sunlight of hope and replaced them with the gloom of daily existence.  Then, sometime later in life, when maturity formed the mold of contentment and latter-day fancies allowed for happiness to reside, we came to compromise with life’s misgivings, allowing that not everyone is bad, not everything is a failure, and not every regret has to be turned into a nightmare attributable to the fault of our parents.

In short, we finally grew up.  But what about those lost illusions?

We define an illusion as that which is wrongly perceived — in other words, it is our “perception” of X that is in error, and not the substance of what X actually is.  Encountering “Being” in the world is a scary matter [sic] in and of itself; for many, the elixir of living in a world of illusions is preferable to the ugly reality of pure Being; just visit any mental institution and one can get a sense of a universe where illusion dominates.

Throughout life, we must always adjust the world as we perceive it, the manner in which we desire to perceive, and the reality of matching perception with pure Being.  It is the game of expectations and the bumping into reality that is the hardest lesson to learn; and for most, the lost illusions of childhood yearning constantly battles to regain our need for a time past, a regret turned, and a desire snuffed.

For Federal employees and U.S. Postal workers who suffer form a medical condition such that the medical condition prevents the Federal or Postal employee from performing one or more of the essential elements of one’s Federal or Postal job, the illusion that one’s Federal or Postal position was secure for a lifetime’s future engagement may be the first thing that needs to be shed.

Further, the illusion that your Agency or Postal unit will be cooperative during the long and complex administrative process — because you “earned it” or that your prior years of dedicated service should count for something — may also be an illusion that needs to be set aside.

Filing for Federal Disability Retirement benefits will likely require the shedding of many illusions, and like those lost illusions once held by the innocent child that was once you, the illusions inherent in preparing, formulating and filing for Federal OPM Disability Retirement benefits under FERS is no different precisely because the encounter with Being is still the tumultuous affair that it always has been.

OPM Medical Retirement Legal Representation: “It would happen, anyway…”

This can be a catch-all excuse, of course.  Fatalism is a self-contradictory philosophical perspective; one cannot by definition remain in such a belief-system without experiencing the self-immolation of one’s own convictions.  What if we prefaced each and every one of our actions with such a statement. “It would happen, anyway.”

The operative principle falls behind the “It”, of course, and the remainder of the fatalism makes sense when once we identify the opening dummy subject that is otherwise left unstated, as a pronoun that remains unattended, often purposefully.  The “It”, of course, can mean many things, including: death; failure; a disastrous outcome; complete destruction, etc.

To conclude that X would happen regardless of the causal interventions of human resolve perpetuated by the will of a conscious mind, is to attribute to the universe a determinism that is without design or goodness.  Is there such an omnipotent being that cares not, perhaps similar to Aristotle’s Unmoved Mover?  Of such a being, Aristotle of course did not conceptualize a meddling kind of god, good or bad, but rather where perfection caused others to desire reaching towards its apex of unperturbed immovability.

But why must fatalism always posit the negative?  Why must it always end in disaster, death or progressive decay, and not towards some optimism of a future yet to be determined?  Why don’t we hear anyone say, instead, “Oh, it would happen, anyway…”, but implying that the dummy subject of “It” is meant to connote greater fortunes for tomorrow, a happier life to be had, or better days ahead of health and joy?

For Federal employees and U.S. Postal workers who are stuck in the rut of a negative outlook because of a medical condition that pervades and will not go away, it is time to replace the dummy subject of “It” with a pronoun or other grammatical subject that conveys a positive outlook upon life’s travails.

Filing an effective Federal Disability Retirement application with the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, is an important first step in filling in the “unknowns” of life’s tomorrows.  And, ultimately, that is the key point, isn’t it?

To avert, subvert and otherwise replace the negative with a positive — and for a Federal employee who can no longer perform all of the essential elements of one’s position, it is the negative “It” that must be replaced with a positive and effective Federal Disability Retirement Application, lest fatalism lead to a determinism that undermines the positive tomorrows that are yet to be.

Legal Representation on Federal Disability Retirement Claims: The simple life

We all crave it; most of us dream of it; some try to implement it.  The “simple” life is the one that runs throughout the cultural history of Americana; from those days of Walden’s Pond and the life proposed by Thoreau and the transcendentalists, to the hippie communes in the Sixties and the movement back to agrarian life of more recent vintage, the desire to “downsize”, simplify and go back to the harkening calls of less complexity, less technology and less everything has always remained throughout.

Yet, “simple” does not mean “easy”, and one has to only visit an Amish farm to recognize that where technology does indeed save time (an hour’s commute by a car can be twice that in a horse and buggy), shedding one’s self of the daily convenience of modernity is no simple matter.

Do we even know what it means to go back to a “simple life”?  Or, by that concept and idea, do we merely mean the peeling away of complexities that have formed in our subjective states of mind, like barnacles that accumulate on the underside of boats over years and timeless travel through life’s trials and tumults, only to have a period of need where chipping them off becomes a necessity?

Television shows and various movies provide for nostalgic images that stir an emotional sense within all of us – of those days of lazy summer when childhoods were enveloped within a haze of timeless carefree thoughts, like so many waves rolling upon the warmth of sand dunes and castles created that only crumble once the day is over.  But that is the point, is it not – of a fictional state of things, of a world that is looked upon with fondness but probably never was, except in the imaginary memories of writers who realize the need to have a hope for a simpler life, but recognize that the reality is much more complex that they would have us believe.

Notice the subtle differentiation – between the “simple life” and the “simpler life”?  That is all we can ultimately hope for – not the former, but perhaps the latter.

For Federal employees and U.S. Postal workers who suffer from a medical condition, such that the medical condition prevents the Federal or Postal worker from performing one or more of the essential elements of the Federal or Postal job, preparing an effective Federal Disability Retirement application will often constitute the requirement of striving towards the objective of a simpler life.

The medical condition itself may be complex; the interaction with one’s agency or the postal facility within the context of that medical condition and “dealing” with them about needing to attend to one’s medical condition – all of that is complex and complicated.  And, while a Federal Disability Retirement application does not guarantee a “simple” life, what it does do is to provide an avenue to simplify the greater complexities of life’s trials by preparing for an uncertain future that only seems to be getting more and more complicated.

Federal Disability Attorney: Beliefs beyond boundaries

There are beliefs that are presumed to be true, if not merely conventional.  Superstitious beliefs, so long as they do not interfere with daily activities and being productive, are acceptable; believing in the existence of aliens on other planets, for instance, or even that some have visited this planet, will not make a difference in the conduct of one’s life; on the other hand, if the same person believes that the alien is invisible and shadowing him wherever he goes, it might begin to impede ordinary and acceptable behavior.

There are “flat earth” associations, and one may cling religiously to the belief that the earth is flat and not round or oval, and argue vociferously that when you walk and see the horizon, there is no indication other than that the earth is flat; and such a belief would likely remain harmless and largely irrelevant.

Then, of course, there are beliefs beyond boundaries of acceptable and normative accountability, like embracing a belief in a date certain that the world will end, where such a belief results in preparation for the coming doom, spending all available resources in building and reinforcing a bunker constructed in one’s backyard, quitting one’s job in order to prepare for the inevitability of the end.  Or, of a belief that all women on Thursdays who wear blue are germ-carriers, because when Jason was five years old there was a woman who wore blue on a particular Thursday who stopped, patted him on the head and said, “Nice boy”, and on that very day, by that woman who wore blue, he became deathly ill and ended up in the hospital for two months teetering on death’s doorstep.

Is that an “unreasonable” belief to have?  Can one not make the argument that there is a “rational” basis for such a belief, and it is within the reasonable boundaries of acceptability?  Would you call such a person “crazy”?  And, so long as he goes to work each day, is productive, doesn’t harm anyone – and no woman on Thursday enters his cubicle wearing blue, he never runs out screaming, “Don’t let her touch me!” – no one would be the wiser for holding such a belief.

And of the Federal or Postal employee who refuses to take the necessary steps to file for Federal Disability Retirement benefits because he or she believes that taking “advantage” of such a benefit means that he or she is no longer “worthy” – is that a belief beyond boundaries of rationality?

Yet, that is often what pauses the Federal or Postal employee from preparing, formulating and filing an effective Federal Disability Retirement application with the U.S. Office of Personnel Management – the mistaken belief that is beyond the proper boundaries that there is something inherently “wrong” with the Federal or Postal employee when you file for OPM Disability Retirement benefits, when in fact all you are doing is to finally recognize that health, life and one’s well-being are more important than killing yourself over a job that has always accorded the benefit of a Federal Disability Retirement.

Legal Representation on Federal Disability Retirement Claims: Joy and trials

It is the defining of life itself; of the spectrum across a wide range of peaks, valleys, proverbial mountaintops and chasms of tumults like a groan beneath the terrain of the earth.  We attempt to avoid the latter and quantitatively expand the former, thinking that if we fill our experiences with joy, the trials will be lessened or the impact less eventful.

There are gauges of summer, the plateau of fall; we sense the discontent of winter and the exhilaration of spring; and like the subtle pull of the orbs afar that impact the tides and moons of horses galloping in the night, the shudder of sensations unfelt and the future yet untold make anxious of us all.

Joy is the experience of human beings; trials, the objective world impinging upon the subjectivity of our daily refrain.  Can we even have one without the other?

We posit fictional hypotheticals that probably never were; of Rousseau’s “State of Nature” where savages roamed in scant loincloths without a care in the world; and of paradise lost like Milton’s foreboding of a utopia now crumbling into the dystopian paragon of untruths and Orwell’s misinformation where totalitarianism becomes the choice of self-immolation.

As Being cannot mean anything without its opposite, Nothingness, so is it not the trials of life that magnify and make relevant the joy felt on any given day?  Can one truly exist without the other?

And yet we attempt to minimize and diminish the latter in thinking that we deserve the former.  But as the inane philosopher now long forgotten once stated with annoyance and greater impertinence, “It is what it is”.  Whatever that means.

For Federal employees and U.S. Postal workers who are experiencing the “trials” period of one’s life because of a medical condition that prevents the Federal or Postal worker from performing one or more of the essential elements of one’s Federal or Postal job, the attempt to jump over and across the great divide so that one can get back to the “joy” part of life’s offerings by trying to “work with” the Federal agency or Postal service, or to “seek an accommodation” with one’s Federal department or Postal facility, there is another proverbial adage that comes to mind: “Banging one’s head up against the wall.”

It is often the case, unfortunately, that in order to get from the “trials” to the “joy” part of life, the Federal or Postal employee will have to prepare, formulate and file an effective Federal Disability Retirement application, to be filed with the U.S. Office of Personnel Management, whether the Federal or Postal employee wants to or not.

For, in the end, the truth of the matter is, the “trials” part of life is something you have little or no control over – such as a medical condition; it is only the “joy” part of the deal that you can assert some dominance over: by taking the affirmative steps to file an OPM Disability Retirement application.

Federal Disability Retirement: Life’s perverse fullness

As children, many are taught that life’s promise is unlimited in potentiality, full in its discourse of uncharted waters, and expansive in its promise for tomorrow.  Somewhere, in middle-to-late years, we begin to have a somewhat more “balanced” view: not of fullness merely painted with hope and promise, but with graffiti unasked for, undesired and unwanted: the perverse side of fullness.

Life can indeed contain and present a “full plate” (as metaphors go), but the question then becomes: What is on that plate?  When a potluck dinner is coordinated, there is an interesting phenomenon that occurs, where judgments are fairly quickly made by the systematic depletion of certain foods, and the untouched portions carefully avoided.  Anonymity is crucial to the success of the endeavor itself, but defensiveness is easily assuaged by the general rules of etiquette when asked and confronted: “Oh, I plan on getting seconds” or, “My plate is too small to get everything the first round!”

Excepting social pressures and avoiding hurt feelings, we all tend to gravitate towards that which we desire; yet, we also put on our plates the food items that “balance” the diet – with knowledge and admonitions that certain foods are “healthy” for us, while avoiding those that we have specific allergic reactions to, or otherwise leave us with uncomfortable residual gastronomic pains.

Every now and again, of course, we take on too much – or, as the saying goes and the wisdom that we impart to our children, “My eyes are too big for my stomach”.  It is then that we surreptitiously look for the hidden garbage bin, and infelicitously dump the “leftovers” beneath the mountain of other paper plates, and quickly scurry away from the scene of the crime committed.  Yet, why we fret over an infraction of taking on too much, is often a mystery; is it because waste balanced by greedy overreach combines to reveal a character flaw?  Or is it much simpler than that – that we are often too hard on ourselves?  Taking on “too much” is not a crime; it is simply an anomaly in the general dictum of life’s perverse fullness.

For Federal employees and U.S. Postal Service workers who are at a critical juncture where filing for Federal Disability Retirement benefits – whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset – becomes a necessity, it is often the case that one’s “life-plate” has become overburdened: work, career, personal obligations, medical conditions, effects of surgery, etc. – the balance can no loner be maintained.  Something has to “give”, and whatever that “something” is, it usually ends up further impacting one’s health.

Filing for OPM Disability Retirement benefits should not be forever stuck on the “pause” button; the longer it stays in a rut, the greater opportunity for deterioration and detriment to one’s health.  We often wait until it is almost “too late”; but just remember that, where life’s perverse fullness includes one’s deteriorating health, it is never a good thing to leave that which is most important, untouched – one’s health.  And, as Federal Disability Retirement is a means to allowing for one’s health to improve so that, perhaps, one day, a second career, vocation, or further productivity can be achieved, so preparing an effective Federal Disability Retirement application, to be submitted to the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, is often the portion of the potluck meal that requires first attention.

FERS Disability Retirement Attorney: The Social Security factor

For Federal and Postal employees under FERS, who now comprise the majority of the workforce in the Federal government, the issue of when to file for Social Security Disability benefits (SSDI) while concurrently filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, is often a recurring question.

On SF 3112A, at the very bottom of the standard form, there are two boxes to check with respect to whether (A) Social Security disability benefits have been applied for, and (B) whether the receipt has been attached and included with one’s Federal Disability Retirement application.

Since most FERS Disability Retirement applicants are still on the agency’s rolls as either active employees, on Sick Leave, Annual Leave or Leave without Pay, the filing for Social Security disability benefits becomes an anomaly, a puzzle and a conundrum, precisely because of the following: Ultimately, the reason why Social Security disability benefits must be applied for, is to see whether or not a coordinating “offset” between FERS Disability Retirement benefits and Social Security disability benefits will be appropriately imposed (a 100% offset in the first year of concurrent receipt of benefits where the annuity rate for the FERS Disability Retirement annuitant is set at 60% of the average of one’s highest-3 consecutive years of service; then, every year thereafter, a 60% offset during each year of concurrent receipt of Federal Disability Retirement benefits at the Federal Disability Retirement annuity rate of 40% of the average of one’s highest-3 consecutive years of service); but presumably such an analysis leading to an offset would occur if an approval by the Social Security Administration is based upon information concerning the severity and extent of the medical condition and disability, and not because a denial of Social Security disability benefits is based upon one’s status of employment.

But here is the “rub”:  Human Resource Offices often will demand and insist that Social Security disability benefits must be filed for, before the Federal Disability Retirement application can be forwarded to OPM.  Nothing could be further from the truth; but then, as gods, dictators and other power-wielding fiefdoms comprise the vast expanse of authoritative sources in the universe, it is often a good idea to go with the flow, file (with minimal effort expended), obtain a receipt which shows that one has filed, and be asked at a later date to duplicate the effort, if needed.
