Federal Employee Disability Retirement: Selfishness

Many are taught concerning the virtues of selflessness; that in a society of greater complexities, that is often a good thing.  But there are times when the opposite must be considered:  of selfishness, when weighing the relative import of contending values.

Now, one might begin such a discussion with the wink of irony:  “Doesn’t it depend upon how we define the terms, to begin with”?  Yes, it does; for, relativity in ethics, while denied by many with a religious “bent” because it is assumed that everything relative cannot be universalized, and as we are all under the misguided Kantian notion that if anything is less than a universal, it must by necessity be invalid.  Yet, if you read Aristotle correctly, it is always from the particulars by which universals develop, and in that respect, it is the very foundation of Truth.

Selfishness”, at some point, in specific circumstances, can be a “good” thing.  The selfless individual who has disregarded his or her own well-being in pursuance of the good for others, at some point must return to the care and maintenance of the self, if only to conserve and persevere in order to fight for another day.

Federal Gov. employees and U.S. Postal Service workers are a prime example of the selfless devotion to duty, to responsibility, and a sense of carrying out “the mission” for the agency — often at the expense of one’s own health.   When the time comes, however, when the Federal or Postal employee has sacrificed his or her own health in the process of working to death one’s self, for the furtherance of the agency’s mission, then it is time to consider becoming somewhat “Selfish”, and in that context, selfishness is a “good” thing.

OPM Medical Retirement under FERS: The Seriousness of Life

It is because of the seriousness that too many fall quickly into frivolous living; for, it is the distraction which allows for the capacity to tolerate; otherwise, the burdens of daily living would overwhelm us all.

The entertainment industry manipulates us because of it; the harsh realities of daily living compel us to avoid the burdens and responsibilities; the ease of rational justification for which human beings are especially noted for, provides us with the necessary allowances.

The seriousness of life — look at the animal kingdom, of even the suburban enclave of pigeons, squirrels, cardinals, sparrows, rabbits, etc. — in the dead of winter, there is little joy or entertaining distractions; merely, the seriousness of life, of trying to forage just to survive.

The poignancy of such seriousness is magnified, quantified and exponentially enlarged in scope, when a medical condition impacts our lives.  Then, there is very little room for error.  We become limited.  We become paralyzed.

For Federal employees and U.S. Postal workers who suffer from a medical condition such that the medical condition no longer allows the Federal or Postal employee to continue in his or her chosen Federal or Postal career, the seriousness of life is but a lone lightbulb dangling from the ceiling — illuminating the limited choices available.

OPM Disability Retirement: The Tightening Standard

Some would say that, since 2018 or so, the U.S. Office of Personnel Management has been “tightening” the standards in Federal Disability Retirement Law.  Perhaps that is a valid point.

However, whether by way of an unofficial quota system or because there has been a policy change at the highest levels, the fact remains that there are laws in place which must be followed, a criteria of regulations which must be complied with, and standards dictated by case-law and legal opinions set both by the U.S. Merit Systems Protection Board, as well as by the Federal Circuit Court of Appeals, which govern all decision rendered by the U.S. Office of Personnel Management.

All benefits must be fought for, and fought hard.  Nothing should ever be taken for granted.

Whether one believes that there is a tightening standard or not, the applicable rules, regulations and case-laws must be asserted, cited and demanded to be applied, and that is why, when a Federal or Postal employee begins the process of preparing, formulating and filing a Federal Disability Retirement application under FERS, through the U.S. Office of Personnel Management, it is a given that you should consult with an experienced attorney who specializes in Federal Disability Retirement Law, to prepare for the fight ahead.

OPM Medical Retirement: Beyond the shutdown

What does it mean for the government to “shut down” because the Congress and the President were unable to come to a budgetary agreement?  It is often the question that is focused upon, but may be the wrong one.  The more relevant issue concerns the events that will occur after the cessation of the shut down.  What happens afterwards?  For, everyone assumes that the government will come to some sort of budgetary reconciliation, and that there will ultimately be an end to the deadlock.

The House and Senate will finally pass a spending bill, whether of a temporary, continuing resolution, or of a long-term bill that addresses the various issues each side is fighting for.  With that assumption in mind, the question becomes, What happens beyond the shutdown?

Essentially, nothing dramatic, other than that the bureaucracy of the Federal government will experience greater delays, and the shutdown merely becomes interpreted as a slowdown for goods and services, much like the picture painted of a local grocery store closing for a week, a month or many months, and where shoppers would have to find another venue to obtain their wares.  The difference between the private-sector shutdown and a Federal government shutdown, however, is that the former often allows for its competitors to take advantage of the situation, whereas the latter has no such “competitors”, as it is the only “game” in town.

For Federal employees and U.S. Postal workers who are considering filing a Federal Disability Retirement application, to be submitted to the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, the question of “what to do” with the shutdown should be approached with the following questions: Do we assume that the Federal Government will “reopen for business” at some point?  The general answer is: Yes.

With that assumption, should we just proceed with preparing, formulating and filing an effective Federal Disability Retirement application?  Again, the general answer is: Yes.

The “private” sector continues to operate, and so the doctors who need to submit medical reports and records can still be accessed; the standard forms still need to be prepared, and the faster one is placed into the “waiting line” for determination by the U.S. Office of Personnel Management, the quicker the “product” of an approved Federal Disability Retirement benefit will accrue, once the doors of the Federal Government and the U.S. Office of Personnel Management are again opened for “business as usual”, beyond the shutdown that occurs from time to time.

It is that part of the universe that is often seen as the “far side of the moon”, where shadows befall and eyes never perceive, witnesses never survive and documents don’t exist.  Mount Everest was once that world; galaxies outside of our own, despite our best efforts to invent and create greater and stronger telescopes, or ones that float in the nothingness of outer space and send back digital images that are obscure and indistinguishable from inkblots accidently spilled upon a sheet of white paper, but somehow scientists can discern great discoveries by pointing to colors, hue, magnified analogs and complex algorithms that leave the rest of us scratching our heads and declaring, “You got all of that from this picture?”

There was life once on Mars and Jupiter since contained icicles that entrapped microbes billions of years ago, and just through a photograph of a fuzzy specter that the rest of us would have interpreted as Bugs Bunny leaning against a fencepost eating a carrot stick.  But of unknown worlds and the far side of the moon where shadows rest upon and hide the human toil of secrets and conspiracies, the truly mysterious one is the subjective mind of the person sitting next to you.  Yes, yes, it may not appear that way – perhaps each time you ask a question of that individual, he or she merely grunts and states in the same monotone of boredom and unexcitable drone, “Yep. What of it?”

And so when PBS or the National Geographic Society has some show about the complexity of the human brain, the neurons and the micro-conceptual foundations that make up the universe of human circuitry, dreams, images, thought-processes, Freudian and other “-ians” that delve into the human mind of the conscious, subconscious and unconscious and all spectrums in between, you turn, look at that same person and say, “Not.”  Or, that person one day does something completely out of the ordinary and during his lunch break takes out a book – say, Kant’s classic on the foundations of metaphysics, or some such esoteric material, and proceeds to mumble to himself, and you say, “Gee, didn’t know he was into that.”  But then you again try and engage him with, “So, what are you reading?”  And the familiar refrain comes back: “Yep. What of it?”  Beyond disappointments and non-engagements with universes parallel, mysterious and already predicted, there is still that “subjective” universe where pain remains, medical conditions are hidden and plans for the future are yet to be expressed.

That is the netherworld of the Federal or Postal employee who must contemplate preparing, formulating and filing an effective Federal Disability Retirement application through the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset.  It is also the world of “cat-and-mouse” – of when to tell the Federal agency or Postal service of your intentions; how much to tell; when to submit the Disability Retirement packet so that it obtains the greatest advantage against the Federal agency or Postal Service; and all of the complexities in between.

Federal & Postal Disability Retirement: Meaning of life

Most of us are too busy to pause for air, reflect upon theoretical, hypothetical or philosophical issues that have little to do with day-to-day living or earning wages in order to maintain a certain standard of living.  Every now and then, however, when the tumults of life’s encounters reaches a pinnacle of unsolvable problems such that the stressors exceed the barometric pressure allowable for the human psyche to withstand, there is a compelled stoppage, a mandated cessation and a forced condemnation to rest.

It is, in short, called a “medical condition”.

It is when we become debilitated, destroyed, distraught and disillusioned that we begin to ask such universal, exhaustive and unnatural (by this term is meant with a rhetorical question:  What other animal in nature asks such questions, and thus do we posit them as “unnatural”) to the core queries that, as Bertrand Russell once wittily quipped, is likely the result of indigestion.

What do we mean when we ask such questions; of looking up at the ceiling with furrowed eyebrows and inquiring, “What is the meaning of all of this?”  It is, of course, the focal point of “this” that one must then turn to, for such a word is obscure, undefined and like a blank space to be filled, can be interpreted in an eternity of ways depending upon the context of the query.

Is the “this” referring to the pain, suffering and debilitating medical condition being experienced?  Is it about the “unfairness” of it all and the fact that others seem to be roaming this earth carefree, careless and thoughtless as to one’s pain, whether physical, emotional or cognitive?  Or does the “this” reference the connection of all of that striving, the hours and commitment to work – of a loyalty to a Federal Agency or the Postal Service who cares not about your medical condition, may not have even noticed your absence (at least for the time being until someone finally notices the pile of work backing up on the desk of that…what was her name?) and likely thinks of individuals as mere cogs in a wheel, replaceable and fungible.

In the end, Russell was probably right; such questions about the “meaning of life” are beyond the comprehension of any level of rationality, belief or coherency that has any real impact upon our lives to make a true difference.  What really matters, in the end, is not that “philosophical” query about the meaning of life, but about human contact, relationships, and securing a future for ourselves and our families.

OPM Disability Retirement: Arrive with bluff, depart with bluster

That has become the motto of universal exceptionalism; it is the bravado of the incompetent, the arrogance of the ignorant and the methodology of the unwary:  besides, it is a funny line plagiarized from a work by Evelyn Waugh (no, that is a male writer, not a female).

It is to come into a circumstance, a job, an assignment or a social conduit acting like one knows what one is doing, messing everything up, then leaving the desecration of incompetence and a heap of human detritus for others to deal with, while all the while turning up one’s nose, shaking the proverbial head in disgust, and departing with an unjustified defense of one’s own incompetence with:  “You guys are hopeless.”

That is the guiding declarative foundation of all self-help books, advice columns and Oprah-wanna-bees in columns of suspicious pearls of so-called wisdom:  “The key is to act like you know what you are doing, with confidence and assertiveness; the rest will follow and everyone will believe in you.”  Or, in other words, believe in yourself despite not knowing anything; act with declarative arrogance; be self-confident (of what, we are never told) and take charge of your life.  Then, if things don’t work out, don’t be too hard on yourself (or, better yet, not at all) and don’t ever allow others to get you down.

Such a foundational folly of methodological madness fits in very well, and is completely commensurate with the cult of youth; for, even if we all know that the younger generation knows not anything but having been coddled throughout their educational years (hint:  a euphemism for indoctrination for heightening self-esteem), the world generally operates on its own in spite of massive and daily incompetence, but that is precisely why there is a need to hire a dozen people for every job:  quantified incompetence somehow makes up for qualitative lack.

Once upon a time, bluster was known, recognized and dispensed with; and bluster was laughed at, mocked and ridiculed.  Now, it is an everyday and common occurrence, because the substantive basis has been ripped out and the soul is now an empty cavern of echoing banter steeped in words of meaninglessness topped by nonsensical linguistic cacophonies of boundless chatter.

Yet, there are times when substance matters, as when a Federal employee or U.S. Postal worker experiences a medical condition, such that the medical condition begins to threaten one’s ability and capacity to continue in the position one is designated in.  That is the time when neither bluff nor bluster is desired, needed nor welcome.

Honest answers and forthright advice is what needs to be obtained, both from Supervisors, coworkers and Human Resource personnel; in the legal advice rendered and received from one’s Federal Disability Retirement lawyer; and from friends, family and loved ones in pursuing this very difficult bureaucratic process couched within a cauldron of administrative nightmares.

Federal Disability Retirement: Carpet Bombing

It is an approach meant to saturate an identified area of enemy territory especially recognized as any and all potentialities related to the central target.  The antonym of such an approach is one of targeted precision, such as drone strikes represented by guided missiles upon a specific individual or area of identified combatants.

In either case, collateral damage can be expected; the difference is that in the former methodology, the invading forces remain unconcerned and unperturbed, as it is fully expected; in the latter, the term “precision” has its narrow focus, but with the real-world recognition that general public consumption likes to think that when a targeted focus is declared dead, the rubble of destruction didn’t extend to the entire block surrounding the individual’s living area, when in fact it did and almost always does.  The concepts thus have differing distinctions; in linguistic and semantical disputes, the issue often has to do with the methodological approach of effectiveness.

For Federal employees and U.S. Postal workers who are considering filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, the former approach of “carpet bombing” is often the preferred choice, as opposed to the latter perspective of “precision bombing”.  That is exactly why Federal employees and U.S. Postal workers who prepare an OPM Disability Retirement application often attach a massive volume and compendium of medical reports and records, hoping to “hit the target” just by sheer coverage of length and width of evidence.

We have all built them as children; those shantytown assemblages like the poverty-stricken and make-shift huts constructed by corrugated debris gathered from refuse and discarded materials, flimsy and ready to collapse, if not by architectural fault lines, then certainly from the sudden and malicious puff of air emitted by one’s younger brother or sister tiptoeing  up from behind in a sneak attack.  The House of Cards — they test the dexterity and patience of one’s character, and simultaneously represent anything built on a precarious foundation, including business ventures, family relationships, and of life itself.

For the Federal employee or the U.S. Postal worker who suffers from a medical condition, such that the medical condition begins to impact one’s ability and capacity to perform the essential elements of one’s Federal or Postal positional duties, the concept of a House of Cards can become quite personal, and in the modern proverbial metaphor, “hit close to home”.

Daily, the precarious and tenuous state of one’s employment status is tested by sudden and unexpected winds of fate, by sneak attacks and underhanded methods of operational malice.  A sudden stir of the atmosphere, a deliberate act of adversity, or the unsuspected whisper of undermining; they all amount to the same:  an attempt to further weaken the foundations which were already being tested.

The option the Federal or Postal employee needs to consider, is to file for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, whether under FERS, CSRS or CSRS Offset, because if the foundation of one’s life has already become shaky, the fall itself is an inevitability when confronted by the vast behemoth of the Federal agency or the U.S. Postal Service.

Just as 2 out of the 3 little pigs came to understand and appreciate the necessity of a firm foundation, so the Federal or Postal employee should see the wisdom in fleeing from under the House of Cards, and consider filing for Federal OPM Disability Retirement benefits; for, they ran to the third when they could, and lucky for them, the Big Bad Wolf could not get to them — at least not in some versions of the tale.

Federal Disability Retirement Lawyer: Insular Delusions

The advantages of holding one’s own counsel are multiple:  little internal strife; dictatorial rule; decision by fiat; complete control and dominance; no blame can accrue to others.  The downside, of course, are just as numerous:  no input from others; the limitation of new ideas, constrained by the perspective of one’s own thoughts and concerns; the fool’s impropriety of listening and following one’s own judgment; little to no brainstorming.

Judgement and decision-making by singular counsel has worked well in countries, corners and civilizations which respond subserviently to dominance and domineering.  But when the populace begins to realize that the emperor is not as wise as once thought (or declared by fiat to be by the dictates of the royal palace, issued in blaring tones and trumpeted daily in printed leaflets used by the peasantry for bookmarks and beddings), then the rumblings of a hunger beyond mere need and wants begins to pervade.

Insular delusions occur because the holding of one’s own counsel ultimately results in a circularity of logic and judgment, and unless new and fresh perspectives are allowed in, self-immolation is the resulting loss of vigor and vitality.  Further, when a deteriorating force begins to gnaw away, such as an unexpected medical condition, then sound judgment and rational perspectives give way to exaggerated and exponential quantification of fear and paranoia.
