Federal Disability Retirement Law: Knowledge of the Elements

It is important to understand what a thing is made up of; otherwise, without that knowledge, you will fail to appreciate the interaction and possible reaction to other elements.

It is the Aristotelian approach which is important — of understanding “first principles” and the underlying substratum of a thing.  Plato’s approach, as well, was similar — of abstracting the greater principle from the particular, but the manner in which he explained things was more in a poetic sense than the practical, and thus do we consider the Aristotelian approach the more “scientific” of the two.

In Law, an understanding of the elements is just as important.  For, if you are not familiar with the elements, you can be easily sidetracked into irrelevant issues, inconsequential arguments and insignificant declarations.  In a very different sense, as well — as in the “elements” comprised of the weather — it is important; for, knowing the elements will mean that you can prepare for any eventuality.

For Federal employees and U.S. Postal workers who suffer from a medical condition such that the medical condition prevents the Federal or Postal worker from performing one or more of the essential elements of one’s Federal or Postal job — it is important not only to know what “essential elements” might mean, but also, what the elements of the law governing Federal Disability Retirement are comprised of.

Federal Disability Retirement: The Growth Stopper

In life, inertness is considered “bad”; it is progress, the ascent of man and the constant striving towards attaining and achieving which are considered “good”.  “Growth” and the incessant need to extend, expand and extoll the virtues of acquisition and accomplishment remain the medals of success; and whether we agree with such values, it is as if we never had a choice.  Isn’t how we define the parameters of what is important to us the basis of happiness?

For Aristotle, the world was seen in terms of constant potentiality striving to reach the actualization of an entity’s intended fruition.  Thus, a stone does what it is meant to do when it constantly falls to the lowest point in the chaos of the world; a lion achieves its value of Being by being what it does best — of being the aggressor and catching its prey; in other words, by being a lion qua lion-being.

And what of man?  To reach his or her potentiality by achieving the essence of what each individual human being was meant to strive for and accomplish, but in a moderated way without the excesses of either extremes upon the spectrum of choices (read his Nicomachean Ethics).

Growth, for every organic being, is crucial to the very essence of its reason and value for existence.  It is thus its opposite — the “growth stopper” — that is considered as “bad”, “evil”, and contrary to human nature.  But sometimes, in life, we have no choice in the matter, and having a medical condition is that “growth stopper” that must make one pause and redirect one’s focus and value.  Ultimately, 2 things have to always be done: Define what values constitute “growth”; then, determine the best course of action to progress in that endeavor.

For Federal employees and U.S. Postal workers who suffer from a medical condition such that the medical condition prevents the Federal or Postal worker from performing one or more of the essential elements of one’s Federal job, “growth” will need to be redefined.  Is “growth” worth it at the expense of one’s health?

FERS Disability Retirement is not a “growth stopper”, but a growth enhancer — for, it is a retirement and a basic annuity to allow the Federal or Postal worker to pause, refocus one’s priorities upon one’s health and well-being, and then take the steps to progress toward other endeavors and vocations in life.  In other words, to re-prioritize.  Yes, the medical condition can be seen as a “growth-stopper”, but it is how we define our values which makes all of the difference.

Federal Employee Disability Retirement: Artemis for Our Age

Perhaps the most venerated of the Greek deities; but why?  As protector of young girls, the Greek mythological figure is always associated with the hunt, carrying with her a bow and arrow, accompanied by a loyal deer; is it chastity and fidelity that make her so attractive?  Do we have an Artemis for our Age — someone whom we can look up to, to feel the warmth of love and pure presence, if only to provide comfort in times of turmoil?

We give lip-service to terms like “community” and how it “takes a village” to bring up a child; of the importance of “family” and “family-values”; and yet….  When words are merely utterances without an action to follow, do they ring as hollow as the sound of an echo in a dark cave where no one can hear?  Is it because we have become so cynical in modernity that we cannot fathom an Artemis for our Age?  Does believability depend upon ignorance, and does ignorance result in the greater bliss where faith and happiness can coexists despite the dreary conditions of daily existence?  Did Greek Mythology develop because of a need for human beings to explain the anomalies of the universe, and was it science that destroyed the structure of such paradigms?

Without an Artemis for our Age, the promise of creativity in the innocence of childhoods yearning for something more than the reality of daily existence becomes a mere hope without even the scent of faith.

For Federal employees and U.S. Postal workers who are seeking to file for Federal Disability Retirement benefits under FERS, the ugliness which develops in the very process of such seeking is often what destroys any faith in an institution.  Medical conditions, once revealed, tend to bring out the worst in agencies: Suddenly, “loyalty” is no longer a concept discoverable; “empathy” is a far cry from reality; and “accommodation” becomes a foreign concept even when there are laws to try and protect it.

It is the latter that gives rise to the former; and the former that remains forlorn and tattered until the latter begins to take shape.  Hope without its latter partner, a Plan, is like the proverbial boat without a rudder; drifting amiss amidst the torrential currents of directionless pathways, being guided throughout by the vicissitudes of uncertainty.

One can hope for many things in life, but hope without a plan is tantamount to allowing a child to wander through a candy store without instructions or restrictions; unfettered liberty leaves one to one’s own devices that more often than not leads to self-destruction.

Whether “the plan” is a good one, a well-thought-out one, or a flawed shadow based upon a rational discourse of options considered is less besides the point than to formulate one in the first place.  Plans can always be modified along the way; adapted to, altered and changed in order to “fit the circumstances”, as every blueprint is merely the rough draft of a finalized product.

For Federal employees who are under FERS, CSRS or CSRS Offset who have begun to suffer from a medical condition such that the medical condition prevents the Federal or Postal employee from performing one or more of the essential elements of the person’s Federal or Postal job, the “hope” is that the medical condition will soon go away, health will be restored and the Federal or Postal employee will become fully recovered.

Sometimes, however, hope’s desire fails to become fulfilled.  In such an event, hope needs a plan, and the plan is to prepare, formulate and file an effective Federal Disability Retirement application, to be filed with the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset.

For, the solitary hope without a developing plan is likened to a piece of driftwood racing down the river of time; what you do not want to have happen is to travel so far down hope’s uncertainty where the waterfall meets the lack of a plan that dashes any hope left.

Federal Employee Disability Retirement: Distractions

They are the projects of life of which Heidegger recognizes, allowing for avoiding the inevitabilities of life’s challenges; of fate, mortality, future insecurity, and death.  What quantifiable slice of one’s life is governed by distractions?  Must it always be less than 50% in order to remain so, and if it exceeds that halfway point, does it then become something substantive and not merely the peripheral meaning of what it means to “be distracted”?  If a distraction is considered to be an aside – that which waylays a person’s attention by focusing upon a central project of life’s endeavor – what then defines an inversion of that perspective?

Take, for example, the following:  A mechanical engineer is working on a technical project that consumes one’s focus, concentration and attention to detail, but has a unique and eccentric ophthalmological condition, whereby the eyes are compelled to follow any and all red objects that pass by.

Now, the company has attempted to accommodate the medical condition by requesting that no employee shall enter into the mechanical workshop wearing red, but on this particular day, some investors are visiting, and a man in the troop of intruders is wearing a red tie, and a woman in the entourage is sporting a red sweater.  They go from bench station to the next cubicle, within the purview and arc of dimensional periphery of the eccentric man’s attention, and with each movement, every sidelong blur, his eyes are “distracted” by the red moving objects.

Out of every minute of work, fully 45 seconds are spent on focusing upon the red objects that detract from the necessary mental acuity attending to the project at hand, and indeed, while they are far enough away such that from an objective viewpoint, the objects are mere inches in proportion and are of a distance as to almost be unnoticeable to others in the group of engineers, for the eccentric mechanical engineer, it is the focal point of his attentions.

The distraction is such that it disrupts the sequence of testing conditions and interrupts the validity of the technical precision required, and a coworker finally declares, “You’ve been too distracted and the project has to be scrapped.”  Would we agree that, because of the numerical disproportionality of concentration attributable, “red-object observation” takes precedence as the primary project, and it is the engineering project that is the distraction?  Or, because it is a medical condition of which he “cannot help it”, do we excuse the distraction in its entirety?

For Federal employees and U.S. Postal workers who suffer from a medical condition, such that the medical condition prevents the Federal or Postal employee from performing one or more of the essential elements of one’s Federal or Postal positional duties, the central point made here is precisely how the Federal agency and the Postal facility views the issues significant in a Federal Disability Retirement application.

Federal Agencies and the U.S. Postal Service possess a myopic view of “work”, and even if the Federal or Postal employee is able to continue making valuable contributions to the workplace, they often see the differentiation between “work” and “distractions” as one quantifiable by time alone.  This is too bad, but a reality that must be faced.  For, medical conditions are not mere distractions; they are life’s interludes that can often be faced and overcome, if only outmoded ideas about what constitutes workplace contributions are set aside, and realize that even distractions delaying the central mission of a Federal agency or Postal facility are not the most important, or even of much significance, when it comes to the worth and value of a human life.

OPM Disability Retirement: The Long Goodbye

The relegation to the basement office; the loss of niceties with coworkers; the negation of superlatives from higher ups; the clues become overt, blatant and uninviting.  Long goodbyes are often fertile ground for the souring of relationships forged over decades, and human interactions which reveal a perversity once thought uncommon.  Does the past count for anything, anymore?

Medical conditions and their impact are meant to evoke empathetic responses; instead, they often bring out the worst in humanity.  For Federal agencies and the U.S. Postal Service, they portend of headaches and interruption of efficiency; they are a bother.  For the Federal employee and the U.S. Postal worker who suffers from a medical condition, such that the medical condition begins to prevent one from performing one or more of the essential elements of one’s positional duties, the growing absences, the need to attend to one’s medical conditions — all become the priority of life and living.

From the agency’s viewpoint, it is a malignancy of logistical magnitude; another problem to be solved; and the longer the goodbye, the greater the extenuating interruption.  It is this clash of interests which calls for resolution.

Filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, whether one is under FERS, CSRS or CSRS Offset, is an indicator to the agency that there is an end in sight, and once filed, it is merely a waiting game before finality of decisions is reached.  Often, the mere filing relieves the increasing pressure felt, like the encasement of boiling water which needs an outlet.

Federal Employee Medical Retirement System: Smiley, Ace of Hides

Similarity of consonant alliteration can evoke and prompt collateral thoughts and memories; likewise, phrases which sound somewhat familiar, yet distinctively remain apart.

Historically, spies were the masters of subterfuge, of appearing as that which they are not.  Then, of course, there is the complexity of the “double agent”, where the appearance is twofold in concealment:  acting with apparent fealty to one source, pretending to be diabolically loyal to a second, when in fact reverting back to the first; and the potential play upon an infinite multiplication of conundrums involving questionable ties of patriotism.  Smiley was the ace of them all, as the fictional character of unperturbed and unflappable creation by John le Carre.

In real life, as in the world of imagination, it is indeed the facial characteristic of the smile which hides; and it is that much more pronounced with the addition of the electronic smiley face that is thoughtlessly pasted whenever deemed appropriate.  Because the smile covers all defects, hides much reality, and conceals deportments of denigrated despair, it remains the choice of frozen acceptance.

People with medical conditions often attempt to smile more than usual, if only to hide the reality of the pain and despair of life.  For Federal employees and U.S. Postal workers who suffer from a medical condition, such that the medical condition prevents them from performing one or more of the essential elements of one’s Federal or Postal job, the veil of a smile is often what the agency expects, and nothing more.

Agencies rarely show a fealty towards an employee who no longer can perform as days of yore; and help, guidance or assistance by a Human Resource Office should be viewed with suspicion and pause, leaving aside the question of whether actions are taken for the best interests of the Federal or Postal employee, or for the benefit of the agency.

Smiles hide realities; they can mask pain, and also present a picture of friendliness when in fact the knife has already been readied for the backside of an unsuspecting victim.

Federal Disability Retirement benefits, filed through the U.S. Office of Personnel Management, whether the Federal or Postal worker is under FER, CSRS or CSRS Offset, is something which should be considered by any Federal or Postal employee who is experiencing the two-faced subterfuge of an agency which purports to support, but in fact has shown signs of a hostile working environment.

Smiles are nice, and can sometimes be genuine signs of a person’s demeanor; but, more often, they hide the true deportment of intent; and while George Smiley could alter the character of the geopolitical sphere of power shifts and the passing of state secrets, it is the state of the ordinary Federal and Postal employee that is most impacted by actions of agencies which show no loyalties.

Federal Disability Retirement under FERS Reduction and Emergence

The fear in most instances is that the latter will not follow upon the former; that the state of diminution will become permanent, and the potentiality promised by a subsequent stage of linear progression will instead reflect a downward spiral or, worse, remain in a state of stagnant immobility.   And, indeed, neither in physics nor in human living, is there a stated and inevitable law of nature which mandates that following a period of reductionism, emergence of a greater state of affairs will occur.

Perhaps personal experience even dictates thoughts and reflections otherwise perceived; for, why is it that inventions and innovations seem to occur in youth?  Or that the older populace wants to merely hoard and fend off losses, like the football team that tries desperately to hold on to a lead, and loses in the process because they have failed to play with aggression and abandonment of fear?

Federal Disability Retirement should always be looked upon as an opportunity for the future.  It is likely the most thoughtful paradigm formulated by the Federal government, precisely because it encourages the system of disability payments to be “self-paying”, by allowing for disability annuitants to enter into a different vocation even while receiving a Federal Disability annuity, thereby continuing to pay back into the “system”.

Federal OWCP/Worker’s Comp does not allow a person to work at another job at all, while concurrently receiving permanent partial disability benefits; and Social Security Disability has such a low threshold of allowable earned income that it discourages further alternatives in employment.

But for Federal employees and U.S. Postal workers who receive FERS Disability Retirement benefits, the Federal and Postal worker can make up to 80% of what one’s former position currently pays, and all the while continue to receive the Federal disability retirement annuity, and meanwhile, accrue further years of Federal Service while on Federal Disability Retirement, such that at age 62, when one’s Federal Disability Retirement benefit is recalculated as “regular retirement“, the time that one was on Federal disability retirement counts towards the total number of years of service.

Thus, when a Federal or Postal employee first considers filing for Federal Disability Retirement benefits, there is always the fear involving the immediate reduction of one’s income; but such a limited perspective should always include the further possibility of the corollary potentiality — that of emergence in the near, intermediate or long-term future.

Regrouping sometimes takes some time; but whatever the specific circumstances which necessitate consideration in preparing, formulating and filing for Federal Disability Retirement benefits from the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset, one should always be careful that a skewed perspective of future opportunity is not altered or quashed because of the medical condition from which one suffers.

As emergence is the natural consequence resulting from a period of diminution, and is the pink dawn of hope for the promise of a bright future, so reductionism is merely a temporary interlude in this brief visit upon the historical expansion of man’s infinite and limitless plenitude of potentialities.
