OPM Disability Retirement: The Frustrating Process

Every administrative and bureaucratic process is a frustrating one, and waiting for an OPM Disability Retirement application to be approved is likely the epitome of frustration.

Thus, it is essential to understand at the outset that filing a Federal Disability Retirement application with the U.S. Office of Personnel Management is a long and arduous process that will likely take many years to accomplish, and nothing short of a miracle will expedite the time required.

Can anything be done about it?  The short answer is, Not Really.  Calls to OPM will often only exasperate the level of frustration, and while “doing something…anything” may temporarily appease the frustration in the short term by making it appear that some progress is being made, almost all such efforts come to naught, and all that remains is to await OPM’s response.

Once received, of course, the entire process can be a further stage of frustration.  For, if an approval is received, there are further battles in getting the annuity payments started, and that doesn’t even touch upon whether the annuity is correctly calculated.  On the other hand, if a denial is issued, the bureaucratic frustration is further extended, especially because of the short timeframe provided in preparing and submitting a response.

Any Federal or Postal employee contemplating preparing, formulating, and filing a Federal Disability Retirement application under the FERS system to be submitted to the U.S. Office of Personnel Management, must be prepared for a long and frustrating administrative process.

FERS Disability Retirement Benefits: The Commonplace

Without it, there would not be the extraordinary; or, at least we would not notice it.  For, if all of X is Y, then there is no distinction between X and Y and the identity of X would be subsumed by Y, and conversely, the identity of Y would lose its distinctive identification.  Similarly, if everything is nothing, then nothing is everything, and as negation is the dominant gene, nothingness would prevail (or some such logical nonsense as that).

It is precisely because of the commonplace that the extraordinary can be identified; and yet, we never applaud the former but exuberantly place accolades and laud the latter.  Of course, when the commonplace becomes extraordinary, that is when we yearn for it — as when our lives are disrupted and torn apart, as in the war in Ukraine.  We identify with it because we can relate to it — of a nation enjoying the commonplace, and suddenly it is gone and replaced by the extraordinary, where the term “extraordinary” is used to describe the indescribable.

For Federal employees and U.S. Postal Service workers who suffer from a medical condition such that the medical condition prevents the Federal or Postal employee from performing one or more of the essential elements of one’s Federal or Postal job, the commonplace of being healthy has now been replaced by the extraordinary of suffering from a medical condition, and it is because of this change that one’s “regular career” must now be replaced by a Federal Disability Retirement annuity under the Federal Employees Retirement System (FERS), through the U.S. Office of Personnel Management.

For, the commonplace (ability to continue as usual) is now the extraordinary (the effects from the medical condition itself), and the yearning for the commonplace is precisely because X has been subsumed by Y.

Office of Personnel Management (OPM) Disability Retirement: The Agony of Purgatory

Of course, it is only strictly applicable in Roman Catholic doctrine, as the Protestant set rejects the existence of such a concept.  Whether one accepts such a precept or not, one must be forced to acknowledge the creativity of it.

It is like a fairytale story of a son who loves his parents who are atheists and, upon their death, comes up with the following idea based upon logic: God is good; my parents, despite being non-believers, were essentially good people.  God would not punish good people.  Therefore, there must by logical necessity be a place where good people can have a chance to expiate their “sins”, and that place is deemed “Purgatory”.  It makes sense.

The Agony of Purgatory, of course, is that you are stuck in a middle kingdom. — like quicksand or the fear we all had as children when we went into a department store or a hotel where there was a revolving door — you know, the ones with small, V-shaped sections that you had to quickly squeeze into, and where you feared your older brother or sister would jam it at the precise moment, and you would be stuck while everyone watched you, laughing uproariously at being caught in purgatory.

Federal Employee Disability Retirement: Anticipation

It is an exceptional inkling; a necessary premonition so helpful in multiple ways; an instinct based upon — what?  How do we anticipate?  What is it based upon?  Is it merely a characteristic which some have and others are at a disadvantage because of the lack thereof?

How is a tennis champion able to anticipate the moves of his or her opponent?  Or a football team, the plays next to be called (excepting those who have been found to cheat); a baseball team able to anticipate the pitcher’s next type of pitch (again, excepting those who have stolen the catcher’s signals given)?

Or, in a Federal Disability Retirement case, how does one anticipate the arguments which will be made by the U.S. Office of Personnel Management, and preemptively answer them with greater efficacy?

Federal & Postal Medical Retirement: Stupid Mistakes

Of course, one can argue that all mistakes, by their very definition, are “stupid”; but, of course, that would then make the entire concept differentiating between “mistakes” and “stupid mistakes” disappear, as the distinction between the bifurcated differences becomes one and the same.

It is a difficult concept to define; yet, we know when we or others have made them.  When we make them, we slap our forehead and say, “Duh!”  When another person makes one, we try to put a gentle cover over it — if we care at all for the person; if it was made by a child; when we know that the other person is “sensitive” to criticism, etc. — and try and say things like, “Oh, it’s okay, anyone could have made that mistake”.  On the other hand, when it is made by someone whom we dislike, is arrogant or condescending (or all three), we get the joy of “rubbing it in” and say offhand things like, “Boy, not even stupid ol’ me would have made a mistake like that!”

“Stupid” mistakes are distinct from “common” errors; the former is made without thought, while the latter is often made with thought, but without knowing the inherent consequences contained.

For Federal employees and U.S Postal workers who suffer from a medical condition, and where the medical condition may require the Federal or Postal employee to consider filing for Federal Disability Retirement benefits through OPM, one wants to — if at all possible — avoid not only the “common” mistakes, but the “stupid” ones, as well.  Mistakes happen; we all make them; but the one mistake that cannot be corrected once a Federal Disability Retirement application is filed with the U.S. Office of Personnel Management, is the one where “blinders” are placed upon OPM once OPM sees something.

OPM Disability Retirement Benefits: The mind’s bookshelf

Entertainment is a peculiar thing in human psychology: happiness accompanies its anticipation, but during the process of “being entertained”, do we recognize our own joy, or are we lost in the suspension of our own inner world while being completely oblivious to the suffering around us?

We toil day in and day out with a singular goal, held by many, to enjoy a period of respite and entertainment — of becoming lost in a movie; of going to a play; of putting headphones on and listening to a favorite song, piece or series of favorites; of pulling from the mind’s bookshelf an episode of imaginative adventures or a wonderland of a dream’s figment.

Entertainment, joy, happiness and contentment are the ingredients of life’s admixture of troubles, trials and turpentine creations in a universe of chocolate-ice-cream-not-quite-right, ups and downs and joining and break-ups; it is a mixed up world where everyone is trying to extract an ounce of pleasure when the last cupful has already been taken.  Then, there is the capacity of the human mind that has just had enough — where too much bombardment of stimuli leads one to withdraw, become reclusive, and seek the solitude of one’s own soliloquy of minds.  It is a rather peculiar concept, is it not?

To withdraw within the mind’s bookshelf — that corner of studied solitude where others cannot share, and only the loneliness of one’s self-induced privacy allows for an entrance and exit to the backrooms of an unlit alcove that is marked “private”, and where no admittance is allowed except by exclusive invitation only.  It is when even the mind’s bookshelf is toppled by the troubled waters of the world that too much stress, too much stimuli and way, way too much intrusiveness begins to overflow.

That is what a medical condition tends to do — for, when it becomes chronic and begins to gnaw at even the privacy of the mind’s bookshelf, then the unbearable nature of one’s condition requires a change.  For Federal and Postal employees who suffer from a medical condition such that the medical condition begins to invade even the privacy of the mind’s bookshelf, it is time to consider preparing, formulating and filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset.

FERS & CSRS Disability Retirement: The title itself

Sometimes, it is good to go “back to the basics”.  Throughout these blogs for these past and many years, the attempt has been to relate common everyday experiences and life’s challenges to the Federal employee and U.S. Postal worker struggling daily to maintain one’s career and to extend a career in the face of a medical condition.  Yet, the primary focus has always been to try and remain informative; to give some sense of the process of filing a Federal Disability Retirement application through the U.S. Office of Personnel Management, whether the Federal or Postal employee is under FERS, CSRS or CSRS Offset.

Sometimes, however, the title itself is sufficient, and one does not need the additional analogy, metaphor or “connectedness” to try and understand the process, and instead, all that is required is the title itself.

OPM Disability Retirement is a “medical” retirement.  It is based upon a medical condition that prevents the Federal or Postal employee from performing one or more of the essential elements of one’s Federal or Postal job.  Yes, it can be a very, very complicating process, especially because there are potential pitfalls throughout the multiple administrative steps.  At each step of the procedural paths, there may be legal consequences that may not be correctible once the Federal Disability Retirement application has been submitted and a case number has been assigned at Boyers, Pennsylvania – i.e., a “CSA number” that begins with the number “8” and ends with a seemingly irrelevant “0” appended as the last of series of numbers.

Aside from the inherently complex questions posed on SF 3112A, Applicant’s Statement of Disability, the initial question that one must face and answer is (A) Whether, as a practical matter, Federal Disability Retirement is worth it, and (B) Whether there is a good chance to become eligible for it.

As to the first question, the factors that must be considered are: One’s age (for, at age 62, all disability annuities are recalculated based upon the total number of years of Federal Service, including the time that one is on Federal Disability Retirement, and as it now takes at least a year to get approved by the U.S. Office of Personnel Management, the question needs to be asked as to how old one is, how close one is to reaching regular retirement, and whether one can last until such age of retirement and the accrual of enough service computation years of Federal employment, etc.), how many years of Federal Service, and whether the Federal agency or the Postal Service is threatening to proceed with termination or separation.  And as to the second question, issues concerning the type of medical condition, the severity, the impact upon the Federal or Postal positional duties, the extent of support, how much reliance of such support is based upon a VA disability rating, and multiple other factors.

The “title itself” is often quite simple; it is the subtexts, the parenthetical unknowns and the hidden potholes along the road to filing a Federal Disability Retirement application (here we go again with the analogies and the metaphors) that makes for a complex and complicated journey.  But, then again, hasn’t that always been the case throughout life – facing the title itself that seems simple enough, but finding out that it is a bit more difficult than first thought?

Federal Disability Retirement: Social Contract Theory

In modernity, what is the “Social Contract”, and does it still hold any meaning?  Or, is the bundle of bureaucracy, the conflict between the competitive predatoriness of capitalism left to its own devices resulting in a cronyism of wealthy interconnections, as opposed to the growing girth of Federalism with a pittance and breadcrumbs left to State governments to fill in some minor gaps — does the aggregate of such entities, comprised of regulations, statutes, laws and a compendium of languages isolated in fine print, all together reflect the vestiges of the Social Contract we once revered as the awe-inspiring product of the Age of Enlightenment?

Would Rousseau, and to a lesser extent Hobbes, and further explained in Locke’s Treatise, represent anything of value, anymore?  Or are we left to our own devices, as Darwin proposed those many decades ago on the lapping shores of the Galapagos, where survivability is determined by genetic origin, environmental refinement, and ultimately the devices used in subterfuge when societal niceties require at least a surface semblance of genteel behavior?  In the end, the concept of a “Social Contract” means little if the basic legal constructs are not adhered to.

For Federal employees and U.S. Postal Workers, such legal constructs are represented by the cumulative promises made by the bureaucracy which employs them, comprised of statutes, regulations, executive orders and corollary mandates.  For Federal employees and U.S. Postal workers who suffer from a medical condition, such that the medical condition prevents the Federal or Postal employee from performing one or more of the essential elements of one’s positional duties, the idea of honoring the Social Contract becomes important, because part of that agreement is to fairly treat the Federal or Postal employee when the Federal or Postal employee is no longer able, because of a medical condition, to continue working in the same job.

Preparing, formulating and filing for Federal Disability Retirement benefits through the U.S. Office of Personnel Management, whether the Federal employee is under FERS, CSRS or CSRS Offset, is each day a test as to the continuing resolution of the viability of the Social Contract.  While not every Federal or Postal employee may be automatically eligible for the benefits to be received through Federal Disability Retirement, it is the fairness of the process which is important, and whether a proper course of administrative protocols are followed and met throughout the entirety of the bureaucratic process.

In the end, those vestiges of that grand idea originating in the minds of philosophers — the highfalutin concept of a Social Contract — are only as good as the promises made and declarations kept in the things that impact the everyday lives of ordinary people, like those dedicated public servants who toil daily in the Federal Sector and the U.S. Postal Service.
